A Ferguson Div. 5 Leonard Litz Div 6 Reginald Campbell Div 7 Mr. G G King, Secretary - Treasurer was present and Mr. John C Jeffery was present for the major portion of the meeting. ,. Jean Wilkinson was present and recorded the minutes Councillor Berdahl was absent due to a foot operation ✓` Mrs Ada Major from the Three Hills Capital was present for the major portion of the meeting The minutes of of the meeting Mr C W Poole as circulated APPROVAL the meeting of February 28th, and the minutes MINUTES of March 7th, 1977 were discussed briefly, and moved adoption of the minutes of the meetings Carried The Financial statement for the month ending February was presented to the meeting The statement showed a on hand of $341,130 91 Mr Ferguson moved approval financial statement as presented Carried FINANCIAL 28th, 1977 STATEMENT net balance of the A report of the meeting held March 9th; 1977 in connection with the proposed Reginal Sanitary Land Fill was read to the meeting. There was discussion of this matter of sanitary land fill sites in the province and also discussion regarding the costs of roll off containers Mr Bauer moved approval of the report as presented Carried The minutes of the Kneehill Sanitary Land Fill Committee meeting held on March 9th, 1977 weir read to the meeting There was discussion about this matter, and in particular regarding the underground storage tanks and the use of old car bodies in the Three Hills sewage lagoon Mr Campbell moved approval of the report as presented Carried The minutes of the Regional Resources Project meeting of February 15th 1977 were briefly discussed and Mr. Poole moved that the minutes be accepted and filed as information Carried REG SAN LAND FILL MEETING 1^ KNEEHILL SAN. LAND FILL MEETING REG RES PROJECT MINUTES The minutes of the Carbon and District Recreation Board meeting REC of February 14th 1977 were read to the meeting Mr Litz BOARD moved to accept and file the minutes as information MINUTES Carried The minutes of the Torrington and District Recreation Board of January 26th, 1977 were read to the meeting Mr Poole moved to accept and file the minutes as information. Carried 2 f COUNCIL MEETING MARCH 14th 1977 P . 2 Mr Brown mentioned the matter of various community organizations not carrying insurance on their buildings or contents It was generally agreed that there should be a minimum of $2000 00 insurance carried on the building and contents and the organization should also carry at least $100,000 00 liability insurance. Mr Brown moved that a letter be sent to all rural community organizations within the Municipal District advising that in future proof of insurance coverage in a minimum amount of $2000 00 on building and contents and liability insurance of at least $100,000 00 must be given to the Municipal District prior to payment by the Municipal District of any annual grants to the organization Carried A letter from the Toy the Labour Relations read to the meeting response received to Mr Ferguson moved to an of Trochu regarding attendance at Seminar on March 16th., 1977 was It was noted that this is the only date accept and file this letter as .information Carried A letter from Alberta Municipal Affairs regarding a 1977 Census was read to the meeting There was brief discussion about the need for a census Mr Ferguson moved that no census be taken in 1977 and the Municipal District of Kneehill use the 1976 Census figures as supplied by the Dominion Census Carried A letter from Calgary Power Ltd., regarding line extension to SW 3- 30 -25 -4 was referred to the meeting Mr Brown moved approval of the line extension as per plans submitted Carried A letter from Simons McBean Ltd pipeline crossings of Municipal v referred to the meeting, and & Associates Co Ltd , regarding and access road to 11- 30- 31 -24 -4 Mr Poole moved approval of the submitted by Simons McBean Ltd , , regarding proposed Roads in the Carbon area a letter from S E Sim V a proposed well site was also read to the meeting road crossings as per plans Carried The proposed access road to well site in 11- 30- 31 -24 -4 had been checked by Mr Cunningham and the company requested to move the access road 100 feet to the south of the location shown on the plans as submitted This gave much better site vision kAr Bauer moved approval of the access road on condition that the road be located 100 foot to the south of the location originally propos-1 by S E Sim and Associates Ltd Carried A letter from Alberta Environment regarding Derelict Vehicle Removal Program was read to the meeting After discussion of the proposed programs Mr Poole moved that Mr R W Brown and Mr J C Jeffery be appointed as loyal co- ordinators of the Derelict Vehicle Removal program for the Municipal District of Kneehill #48 Carried COMM. ORGANIZATIONS INSURANCE COVERAGE LABOUR REL SEM MARCH 16/ 77 1977 CENSUS CALGARY POWER LINE EXT SW 3 -30- 25-4 PIPELINE CROSSINGS WELL ACCESS ROAD ETC D r ! -,ICT VEHICLE REMOVAL PROGRAM ,v.1 ...3 t u COUNCIL MEETING MARCH 14th 1977 P 3 Mr Campbell gave a brief report on the firemen' meeting FIREMEN MEETING held at Trochu recently with firemen from the Three Hills and Lirxb n departments The matter of compensation COMP in lieu of lost wages while attending fire schools was IN LIEU OF d' is s -A d The feeling was that $200 00 LOST WAGES cus t per person would be a satisfactory figure The existing policy of the M D is payment on a 50 -50 basis with the towns and villages for a limit of two per area per year Mr Ferguson moved the Municipal District set a policy as follows The Municipal District will pay $100 00 per7yearrin lieu of lost wages for those attending Fire Training School in Vermillon,w.ith this limited to 2 men per area per year with provision for transfer from one area to another It is suggested that the towns and villages involved match this contribution Costs paid by the M D will be charged to the Rural Fire Protection Area from which the representatives came. Mr Soder entered the meeting at this time, approximately 10 30 A M Mr Soder and Mr Bauer reported to the meeting regarding REPORT RE- KEIVER LAKE discussions held recently with Mr Frank Hansen in connection PROBLEMS with the Keiver's Lake Park Mr. Hansen is concerned that the terms of sale of the land to the M D will not be lived up to should the park be leased to a private individual, and eventually the land might be sold and subdivided and lost to public use Mr Hansen does understand the problems which the M D is encountering in looking after the park, such as loss of fuel, lack of telephone and sanitary facilities; vandalism, and spillage of oil in the lake He feels that motor boats should not be allowed on the lake Mr Hansen feels the land should be taken over by the province as a provincial park The general feeling of the meeting was that it would be looked after in a more satisfactory manner by a private individual, and this would eliminate most of the problems and expenses ✓ the M D is now incurring It was noted that it would take at least 2 men to look after the park properly There was a lengthy discussion about installation of facilities, and a concession booth, and it was noted that there had been considerable vandalism during the winter months No definite conclusions had been reached in the discussions with Mr Hanson Mr Poole moved that Mr Hanson be invited to attend a council meeting on March 28th 1977 to discuss Keiver's Lake Park and the Parks Committee draft a proposal for presentation to Mr Hansen at that meeting Carried Mr Soder then left the meeting ACCOUNTS Mr Jeffery presented the accounts to the meeting VA Mr Poole moved approval of the accounts as presented. Carried CARBON HOLD Mr King reported to the meeting about discussions held HARMLESS with the Village of Carbon in connection with the hold harmless A/G agreement. The Village has agreed to sign the agreement subject to a change in pEmgraph 3 regarding interest charges, and date for commencement of interest charges, as outlined in the report Mr Campbell moved that the agreement be returned to Mr Ross ✓ for his consideration and amendment as requested by the Village of Carbon in connection with the interest charges Carried 4 7 COUNCIL MEETING MARCH 14th,1977 DEV PERMIT P 4 FEES The matter of the agreement with the Town of Trochu TROCHU HOLD regarding the hold harmless covenant was also discussed HARMLESS and a letter received from the Town of Trochu read to A/G the meeting They request a minor amendment to the HEARING TIME agreement DEA14 ADAM - Mr Bauer moved that this agreement be referred to Mr Ross for the amendment as outlined by the Town of Trochu Carried circulated to the landowners within a half mile radius WARBLE A letter from the Town of Trochu regarding warble control CONTROL and pest control officer was read to the meeting AUCTION MART The Town of Trochu has appointed Mr Soder and Mr Smyth TROCHU as pest control officer with limited authority at the C N R local auction market only HUXLEY Mr Ferguson moved acceptance of this letter as information CROSSING Carried A copy of the summary and policy paper from Calgary Regional EA....:y.. REG REPORT Planning Commission regarding the Eastern Region Committee meetings was given to each councillor Mr Ferguson moved J,C R P C that this report be tabled until the Council Meeting of �m the C N R without notice. April 11th, 1977 Carried Carried SUBD. A proposed subdivision for Block M Plan 7521 A N , NE 8- 33 -23 -4 NE 8-33 - was referred to the meeting A 23 -4 Mr. Campbell moved approval of the subdivision as per plan submitted Carried Building permits as issued to single family residence on Pt Allen Sorensen for a hog barn were referred to the meeting Mr Bauer moved approval of t Ronald Leis for a BUILDING SW 12- 33 -27 -4 and to PERMITS on SW 32- 29 -25 -4 he permits as issued Carried The matter of a fee for development permits was discussed DEV PERMIT The Secretary was requested to obtain some verbal information FEES from C R P C regarding a possible schedule of fees and the matter will be discussed again later in the meeting APPEAL The meeting was advised that an appeal has been filed HEARING TIME by Dean Adam against the refusal of the Development Officer DEA14 ADAM to issue a development permit number 34 -77 Mr Litz moved that the appeal hearing be held at 10 °30 A M on March 28th.,1977, and the notice of appeal hearing be circulated to the landowners within a half mile radius ,f the proposed development Carried The meeting adjourned for dinner from 12 00 Noon to 1 00 P M DINNER A letter from Canadian National Railway regarding the C N R crossing at Huxley was read to the meeting It was noted HUXLEY that the C N R will not re- install the crossing at this CROSSING location After discussion of this matter, Mr Campbell moved that the problem be referred to the Board of Transport Commissioners for a full review of the situation, and a request for re-- installation of the private crossing removed by �m the C N R without notice. Carried 5 1 ,f ,-W 4t-a COUNCIL MEETING MARCH 14th.,1977 P 5 Mr Ferguson moved that Mr Alex Cunningham be authorized ALEX to attend Part I Fire Investigation Course at the Alberta ,i CUNNINGHAM Fire Training School at vermilion, from April 4th to FIRE SCH AT »i1 8th, 1977 Carried Mr Jeffery reviewed the accounts receivable and mentioned the accounts which had previously been turned over to the solicitors There are five large accounts owing, totalling $1052 55; four for fire ca.ils and one for gravel There are 17 small accounts owing which total only $108 38 It was suggested that these 17 small accounts be cancelled and the parties involved put on a permanent black list and no work be done for them except on a cash basis prior to the work being done There was discussion about possible collection of some of the fire calls by levying the charges against the land involved, and that the R C M P should be contacted to determine their authority in calling out the fire trucks Mr Campbell moved that the solicitor continue with attempts to collect the outstanding accounts Carried The AAMD & C's report on assessment and taxation was reviewed and there was lengthy discussion regarding assessment and taxation of residences, and possible assessment and taxation of all buildings Mr Paquette and Mr Dobler entered the meeting at this time Approximately 1 30 P M It was agreed that the report from the Association be tabled until after the matter is discussed at the Spring Convention The matter of resolutions to be presented to the Spring Convention by the M D was then discussed A resolution regarding the A S B program was read to the meeting as drafted by Mr Soder and Mr King ►ne resolution in effect asks for a global budget for the Agricultural Service Boards Mr Ferguson moved approval of the resolution as presented and directed that the resolution be presented to the R Spring Convention of the AAMD & C Carried The resolution drafted to request an increase in the drilling rig tax was read to the meeting It was noted that a revision of the tax had been looked at by the Provincial Government previously, but nothing had been done Mr Bauer moved approval of the resolution as presented and directed that the resolution be presented to the Spring Convention of the AAMD & C Carried A circular from the AAMD & C regarding conversion to the metric road signs was read to the meeting Orders for new road signs for delivery in September should be placed with the Association shortly This would enable the Association to obtain a better price on large quantities Mr uitz move that the M D place an order with the Association for the�rumUer of metric signs determined by a committee of Mr Paquette Mr Duncan and Mr Smith Carried 6 ACCOUNTS RECEIVABLE AAMD & C REPORT ASSESSMENT & TAXATION RESOLUTIONO TO SPRING CONVENTION METRIC ROAD SIGNS 1P .; COUNCIL MEETING MARCH 14th, 1977 A letter from Alberta. Energy 6 Natural Resources was GRAVEL read to the meeting The sand and gravel lease at LEASE E� 14 and SW 13 33 - -22 4 - Tolman Bridge is up for TOLMAN renewal BRIDGE Mr Campbell moved that this lease not be renewed Carried A letter from Alberta Municipal Affairs regarding a WORt("HOP one day workshop on metric conversion for the METRIC construction industry was read to the meeting CONV This is being held in Calgary March 15th and 16th, 1977 Mr Ferguson moved that no delegate be sent to this workshop Carried A letter from Mr and Mrs Cardwell of S.,.. -..y ,:.lope was read to the meeting It appears they suffered WINDSHIELD damage to their windshield from gravel spraying XP DAMAGE off a gravel truck This matter has been referred CARDWELL tc Jubilee Insurance Agencies Mr Bauer moved to accept this letter as information as the matter has been referred to our insurance company Carried A note regarding, a Cat Care School to be held for councillors and employees of the M D of Starland and CAT CARE the M D of Kneehill was referred to the meeting SCHOOL The school will be held at the Diana Restaurant in March 24/77 Drumheller on March 24th 1977 and the company would like at least 25 -30 people there The company will supply lunch for those attending It was agreed that v the school would be of benefit to councillors, mechanics, partsmen and operators as well es the service men Mr Campbell moved that the M D send up to 15 employees to the seminar, depending on the weather conditions, and Mr Paquette be authorized to determine which employees should attend Carried It was noted that any of the councillors may attend the seminar if they wish Mr Paquette was requested to advise the Councillors at the next meeting the number of men attending the school v and the Councillors can then determine whether they will attend the school A fuel price increase notification from Imperial Oil was IMPERIAL read to the meeting OIL FUEL Mr Bauer moved to accept and file same as PRICE information INCREASE Carried A letter. from Alberta Transportatinn regarding Bridge File 6514 - WNW 23-- 31 -24 -4 was read to the meeting BRIDGE This letter outlined the work still required to be done FILE 6514 by the Municipal District on this bridge. jA WNW 23 -31 Mr Ferguson moved that this letter be referred to 24 -4 Mr Paquette for his consideration and completion of the required work Carried W C B A letter from the Workers` Compensation Board regarding Mr �.� Les Kinch Leslie Kinch was read to the meeting, and Mr Brown moved ✓1 that this letter be accepted and filed as information Carried 7 ff J s COUNCIL MEETING MARCH 14th 1977 P 7 TOWN OF The letter from the Town of Three Hills regarding THREE HILLS their proposed 1977 road program was again referred to ROAD PROGRAM the meeting This was to clarify the roads in question, , -gamely The road running north and south on the �.� west side of the C N R and the road from the Three Hills School south to the town limits, and it was noted -that the work will be done by the M D using its equipment and the costs for same charged to the Town of Three Hills It was agreed that the Town be asked if they might wish to try the stablilization product Terrazyme on these roads Various work applications noted on the agenda item that the applications for be referred to Mr Paquet in the office be retained were referred to the meeting as 24, and Mr Poole moved work on the public works crew to and the applications for work on file Carried It was noted that a meeting of the Finance Committee and the m Foremen and Shop Committee should be held soon to discuss the problems of costs of operating the M D machinery The costs are in excess of government rates Mr Litz moved that a meeting of the Finance Shop and Foremen Committee be set for Thursday March 16th„ 1977, commencing at 9.00 A M Carried APPLICATIONS FOR WORK FINANCE 6 SHOP COMM MEETING v/1 ROAD BANS There was brief discussion regarding road bans, and the 45,,000 pound limit Mr Poole moved that there be no change in the existing road bans on light coat surfacing and that a road ban be imposed on the heavy paved roads effective 12 00 Noon / March 11th, 1977, to allow 750 of G V W , or 60 000 pounds whichever is the lesser amount Carried Mr Dobler reported briefly on the gravel crew work and he GRAVEL was requested to put some gravel on the hill going to the CREW Sarcee Cemetery REPORT The annual meeting of the M D of Starland will be held in Delia STARLAND at the Legion Hall Tuesday, March 15th_. 1977 at 1 00 P M v1 ANNUAL Mr Brown will be attending the meeting and it was agreed that MEETING any other councillor wishing to attend this meeting should meet at the M D office at 11 00 A M TOWN OF The Town of Three Hills have requested permission to THREE HILLS explore for water in various areas of the Municipal District WATER After discussion, Mr Bauer moved approval of the proposed J1 EXPLORATION groundwater exploration subject to the Town or its agents obtaining permission from the individual landowners involved Carried A letter from Andex Oil Co Ltd regarding road access ROAD ACCESS to LSD 6 of 27- 30 -24 -4 off the light coat surfaced road LSD 6 was read to the meeting The company was not given permission 27- 30 -24 -4 by the M D for road off the light coat surface road BARKMAN to this well site, but was instructed to obtain access off the gravel road to the west However the landowner requested the road not be put across his land to the west, but rather to the south Andex guarantee that they will be responsible for any damage to the light coat surface road beyond normal wear and tear from light vehicle traffic Mr Poole moved that Council Tree to accept the road access where it is now located, providing Andex Oil Co. Ltd. is responsible for any undue road damage caused to our light coat surfaced road CARRIED 8 COUNCIL MEETING MARCH 14th., 1977 WW Mr Brown mentioned that the Spring Meeting of the Central AAMD & C will be held in Didsbury on April 21st, 1977 commencing at 10 00 A M MEETIN, CAAMD & April 21 1977 C *� There was e brief discussion regarding a possible fire protection �> area around the Village of Carbon and the possible purchase CARBON of a new fire truck by the Village of Carbon Nothing f FIRE PROT definite is known about this matter The matter of development permit fees was then discussed FEE FOR C R P C gave some verbal information by telephone about DEV fees in different areas., but was not able to come up with /' PERMITS much definite information The fees may range from a flat $50 00 fee to a sliding rate for different types of developments n � f J After discussion, Mr Ferguson moved that the fee for development permits be set at a flat rate of $20 00 each Carried DAVIDSON Mr King advised the meeting that Mr D W Davidson of TEMP Three Hills had requested an extension of his temporary PERMIT permit for a garage located on his property - Lot 2, GARAGE Block 5 Grantville for a one year period GRANTVILLE �-` The garage is merely a shell, not on a foundation and is being used as temporary storage, for his business operations Mr Poole moved that Mr Davidson be granted a temporary permit extension for this garage to September 30th, 1977, and the entire operation be reviewed at that time Carried GRANT The Ghost Pine Athletic Association has submitted an APPLICATION application for a Pro]ect Co- Operation Grant GHOST for approval by the M D They wish to obtain the grant PINE ATHLETIC for installation of a new well new pump, pipe hose ASSOC electrical hookup and lights for a rink This grant would be paid on a 50� per capita matching basis by the Provincial Government and the Community Organization The matter was briefly discussed, and it was noted that the V, agreement should be referred to the Three Hills and District Recreation Board Mr Bauer moved that the M D of Kneehill approve of the application for the grant on condition that approval for the grant be obtained from the Three Hills District Recreation Board as well Carried There was brief discussion regarding sand and gravel pit reclamation projects, and it was again noted that the Province requires title to the area before they will do any reclamation .P work CALL FOR Mr Paquette advised the meeti.na that a load of bridge planking TENDERS will be required this year as well as fence posts BRIDGE PLANKING Mr Poole moved that the M D call for bids for supply & FENCE of a truck load of mountain fir lumber or its equivalent POSTS for bridge planking Carried Mr Campbell moved that tha M D call for bids for supply of a truck load of fence posts - 31' to 4" posts 6 feet long and for the supply of 300 7 foot 5" to 6" posts for use as corner posts Carried n � f J a COUNCIL MEETING MARCH 14th, 1977 P 9 Mr Dobler advised the meeting that the radiators on the RADIATOR new G M C trucks have both been replaced, at our cost PROBLEM They are no longer under warranty G M C TRUCKS Mr Ferguson moved that a letter be sent to General Motors and with a copy to Shaw G M C , outlining our problems with X the radiators and requesting their consideration of a possible price adjustment CARRIED The matter of the shocks on the trucks has been taken up with Shaw G M C , but no reply has been received from the company as yet There was brief discussion about Mr Kimmel checking the MIS PUBLIC '1\ WORK ITEMS gravel as well as blading during the next week while the gravel crew is on the long hauls Mr Ferguson moved that negotiations be undertaken with the landowners involved to obtain tho necessary right of way for the bridge to be installed at the Merle Anderson location Carried The Pope Lease Road and the Three Hills West Road were discussed briefly,;
