( SEE OVER FOK JKt t-UN I KUL D COUNCIL -MEETING - -- JANUARY -10th ,1977 A regular meeting of Council was held in the Municipal Office, Three Hills, on Monday, January loth,1977, commencing at 9.00 A.M Those present for the meeting were: PRESENT Gilbert Berdahl C W Poole Art W Bauer T. A Ferguson Leonard Litz Reg Campbell Div 1 Div. 2 (Deputy Reeve) Div 4 Div 5 Div 6 Div. 7 Mr. G G. King, Secretary - Treasurer, was present for and Mr J. C Jeffery, Assistant Secretary - Treasurer, for portions of the meeting Jean Wilkinson was present and recorded the minutes. the meeting was present In the absence of Reeve Ralph W Brown, who is away on holidays, Deputy Reeve C W Poole chaired the meeting APPROVAL OF The minutes of the meeting of December 28th, 1976 were reviewed, MINUTES and it was noted that a correction should be made with inregard tor to the address of Mr Alf Louranee, recently appointed under the new Stray Animals Act His proper address is �arbon not Acme See page 5 h minutes of the meeting, subject Mr Bauer moved approval of t e to the above noted correction Carried The preliminary financial statement for the month ending December 31st,1976 was reviewed It showed a net balance at the end of December of $456,523 preliminary financial Mr Ferguson moved approval statement as presented Carried The wages for the caretaker was reviewed The rate is presently $4.80 an hour Mr Ferguson moved that the wage rate for the caretakers for 1977 be $5 00 an hour Carried A memo from Jubilee Insurance regarding Councillor's accident policy was reviewed This policy gives the Councillors 24 hour protection and file ,F+ar discussion, Mr Berdahl moved to accept formation FINANCIAL STATEMENT DEC 31/76 WAGE RATE CARETAKER for 1977 JUBILEE INS ACCIDENT POLICY COUNCILLORS this as n Carried MINUTES TORRINGTON & The minutes of the Torrington Recreation Board meeting held CARBON recently, and minutes from the Carbon Recreation Board meeting REC BOARDS were reviewed, and discussed. Mr Litz moved to accept and file these minutes for a natural BUILDING Building perrits issued to Dale Henkel - NE 14- 33-24 -4 for PERMITS a residence, and to Alberta Gas Trunk Line Co. gas measuring facility at SW 4-28 -29-4 wereconsidereissued Mr. Campbell moved to accept and file the SPECIAL There was discussion about the need for setting date for a MEETING special meeting to discuss planning / by -laws, etc, and having Mr Nemeth and other persons there Mr Ferguson moved that this matter be tabled until the 24th .' 2 � u, P .'J COUNCIL MEETING JANUARY.. .1- oth,1"3,77 P 2 of January meeting, after discussion of the matter at the January 19th meeting of local governing officials Carried Mr Brown had forwarded certain memos he had comp..._.ed, to the meeting for discussion One item was -did the OTHER councillors wish the matter of each individual councillor PLANNING holding a meeting in his division, if requested by his MATTERS ratepayers, advertised? He had also compiled certain ideas regarding subdivision matters, mainly regarding the direction that subdivisions should take in this area, from discussions which he had with B Wray of C R P C The matter of Development Permit No. 15 -76 - Dean Esau for a second residence mobile home, which permit was refused, and no appeal received was also noted Mr Bauer moved to table these matters until the special meeting that is planned with C R P C Carried Mr King then gave a report on certain matters regarding the hamlet of Swalwell A registered letter had been sent to Mr R V. Melwood of Swalwell,with copy to Barry Brodie of Swalwell It appears Mr Melwood has rented the Brodie property and is moving numerous cars onto the property He was advised that this is not a permitted use for this area, and given until April to remove the vehicles Mr Melwood called at the office and verbally appealed this decision, and advised that his written appeal would be forthcoming Mr Campbell moved acceptance of this report, and no further action be taken until Mr Helwood's appeal is received, or the time granted to remove the vehicles lapses Carried DEV. PERMIT NO 15 -76 REPORT ON SWAT MAT-_ R V MELWU37 Lots 11 to 26 in Stan Young has removed his Pprier ee from /Block 7 in Swalwell and this property should now be cleaned up by the M D BLOCK 7 Mr Ferguson moved that the property be cleaned up by the Municipal District in the spring Carried A report was given to the meet -ng regarding tie Proposed closure of Wacker Avenue in Swalwell It was noted that WACKER the closure as previously outlined would leave certain lots AVPNUE isolated and therefor would not be satisfactory An alternate suggestion for closure of the avenue and a replot of the area was given to Council by Mr King This suggestion would however cost money, and would of course require the consent of the owners of the lots involved It was noted that Mrs K Elliott, who had requested the closure, wishes a large area for residential building and storage of construction machinery Mr Berdahl moved that this matter be tabled until the area can be looked at in the spring, and further information obtained from the owners of the lots involved Carried It was noted that an appeal against subdivision conditions BEAGRIE has been filed by Mr and Mrs K Beagrie in regard to SUBDIVISION Pt NW 9- 32 -24 -4 Mr Bauer moved to accept and file as information'`' Carried 3 COUNCIL MEETING JANUARY 10th,1977 P 3 It was noted that the pound by -law Number 12 is no longer required, as the Stray Animals Act has now been proclaimed Mr Ferguson moved first reading to by -law number 819, th-_ being a by -law to repeal by -law number 12 in its entirety Carried Unanimously Mr Litz moved second reading to by -law number 819 Carried Unanimously. Mr Berdahl moved third reading to by -law number 819 Carried Unanimously Mr King gave a report regarding the Eastern Region Planning mtiu,dheld in Carbon Thursday, January 6th,1977, which he an Ar.eR.`5mith, Director, opened the meeting and spoke for a few minutes and then left for another meeting Mr B Wray of C R P , and other representatives then carried on with the meeting and discussed various items such as the direction of subdivisions in this area, isolation of homesteads, commercial and industrial businesses in the rural area, in particular machinery dealerships, etc , size of subdivided parcels, and density per quarter section It was hoped that the Eastern Region Plan could be kept very broad The definiition of home occupations was discussed It was also noted that C R P C. drafting a new plan for the entire region with exceptions to be included in this plan to cover the proposals for the Eastern Region It was however anticipated that there would be a separate Ulan for this area The next meeting is to be February 3rd,1977 at Carbon commencing at 1.30 P M There is also a meeting to be held in Calgary on January 26th,1977 in connection with this matter Mr Campbell moved to accept this report and file as information Carried Mr Poole reported to the meeting regarding the road closure south of 28 and 29 in 29 -24 -4 He had contacted Mr Kostrosky, felt he should only pay 10 times the assessed value for the land, as this is all Council had paid him for road taken previously He is willing to pay for the land on this basis It was noted that perhaps no minimum was involved when land was purchased m him Mr Kostrosky also requested that the road allowance land be left in separate title, to allow him to add land to it from the adjoining quarter, by means of a subdivision, to provide for a separate building site It was noted that there is about 2 and one quarter acres in the road and he wishes to add enough land to make a suitable site for a residence Mr Poole advised he had also seen Mr Gieck, and he wished to acquire the road as well as the land to the north of the railway However he feels the matter should be left until spring so that the road committee could have a look a- the area, as there is some question about boundaries, etc Mr Ferguson moved that Mr Kostrosky be charged for the road allowance he is purchasing, at the same rate that he was paid for land taken previously for road from his land, and the balance of this matter be tabled until spring to allow the road committee to have a look at the area Carried M BY -LAW 819 REPEAL POUND BY LAW #12 EASTERN REG PLANNING 1 Mr Bauer MEETING ROAD CLOSURE SOUTH 28 & 29 in 29 24 -4 V Z,)(, COUNCIL MEETING JANUARY 10th,1977 Mr Ferguson advised the meeting that Mr E Cullum had contacted him with regard to the road allowance to the south of the NW of 36- 30 -24 -4 He is definitely interested in obtaining the land if the road is closed, he feels the land should go back into this quarter It was noted that the office had written to S Schmidt and Park Brothers also to determine if they have any use for the road, and no replies have been received from them as yet The matter will be considered when such replies are received P 4 CLOSING ROAD ALLOW South and NW 36 -30 -24 An agenda for the combined meeting of local governing officials to be held on January 19th was discussed, as well as the brief prepared by Mr Brown regarding local government, which he wishes presented to the meeting It was agreed that no special agenda be set for the meeting Mr Don Rees of Alberta Energy and Natural Resources and Mr Alex Cunningham then met with Council Mr Rees advised the meeting that he had checked the two flowing wells north and west of Huxley at NE 24- 34 -24 -4 He feels that the wells could be plugged off, but wishes to ascertain if doing this would cause a hardship on any adjoining farmer, who may be using the run off from the wells for a water supply in their pasture It appears that the water is getting away from the area 0 as there is no great accumulation of ice, but it is definitely causing a problem on the road The M D had installed a perforated culvert in the intersection which seemed to help alleviate some of the road problems but the holes would have to be plugged in order to completely solve the problem This work should be done in the winter The holes are filled with cement, and this will be done by the government, if the M D wishes it done Mr Campbell moved that the parties involved be written to see if they have any objections to the holes being sealed off Carried Mr Rees stated that if there are any other problems of this nature, he would be glad to look at them Mr Rees and Mr Cunningham then left the meeting The meeting then adjourned for dinner AGENDA LOCAL GOVERNING OFFICIALS MEETING ALTA ENERGY SEALING OFF TWO FLOW_ "G WELLS N Sc fA HUXLF r NE 24 -94 -2q DINNER V-\ Mr Jeffery entered the meeting and reviewed the accounts ACCOUNTS Mr Litz moved approval of the accounts Carried Mr Paquette and Mr Dobler entered the meeting at this time CANCELLING There was a brief discussion held regarding closing a road diversion in E12 of 1- 30 -26 -4 - Wittstock ROAD DIV The road in this area had been straightened out some years ago.E3� 1 -30 4 There is approximately 74 of an acre in the North East Quarter and 1 acre in the South East Quarter taken for the road diversion After discussion of the matter, Mr Poole vl moved first reading to by -law number 820, this being a by -law to cancelthe above noted road diversion in the East half of Section 1- 30 -26 -4, and the land be returned to the quarters from which it came Carried Mr Bauer moved second reading to this by -law CANCELLING Carried OTHER RD There was a brief discussion about two other road diversions which DIV should be cancelled, these being in the NW 3 and NE 4 in 30 -25 -4 Mr Berdahl moved this matter be tabled until Mr Brown is back from holidays, and also pending receipt of further information 1 Carried 4 I n COUNCIL MEETING JANUARY 10th,1977 P.5 Mr C A Winther made a complaint regarding the road approach on the East side of 3- 34 -24 -4 Also regarding road work not done on the SW 14- 34 -24 -4 This work is required to stop water from running into his field Mr Litz moved that Mr Winther be advised the approach will be replaced in the springy and the other matters � will be looked at again when Council is on road tour Carried ROAD APPROACH 3- 34 -24 -4 It was noted that the borrow pit agreement with B O'Rourke g O'Rourke had not been signed yet 0 BORROW Mr Berdahl moved that the borrow pit agreement be forwarded PIT AGREEMENT to sir O'Rourke for signature Carried A verbal complaint has been received from Mr Ralph Kientz R KIEN'TZ about ridging snow in his field, where he had fall crop RIDGING planted Mr Bauer stated Mr Kientz had contacted him SNOW about this matter as well. This matter will be looked at ,/l DAMAGE FALL in the spring CROP Two other people have advised the office not to ridge in certain of their fields due to fall crops. DATE FOR There was a brief discussion about the date set for MACHINERY the machinery meeting - February 2nd, 1977, which was MEETING conflicting with Mr Ferguson's meeting with his ratepayers. /) FEB 2/77 However Mr Ferguson was able to change his meeting, so nothing further is required Truck bids will be opened in the morning, and grader bids in the afternoon The councillors requested a report for the January 24th meeting f outlining a proposed machinery budget and capital funds available A letter from Alberta Environment regarding land reclamation LETTER was read to the meeting There are funds available for ./A RE LAND reclamation of land under certain conditions After discussiolECLAMATION Mr Ferguson moved to accept and file as information Carried It was noted that no sites in our area would appear to meet the conditions, at this time There was a brief discussion regarding the possible sale of SWALWELL the old Swalwell nuisance grounds to the owner of the balance ANUIS GROUNDS of the quarter section No decision was made POSSIBLE SALE A letter from Jubilee Insurance regarding heavy equipment insurance coverage was read It was noted the deductible vA HEAVY EQUIP is increased to $250 00 The total value of our heavy INSURANCE equipment, which is in excess of two million dollars, is insured for 100% of its value Mr Bauer moved to accept and file as information Carried An offer has been received from Mr Frank Sherring of Carbon for certain items stored in the old tin shed at Carbon There is an old cast iron stove and an old diesel space heater Mr Sherring offered $30 00 for the two items n Mr Ferguson moved that the stove be sold to Mr Sherring for $10 00, as is, where is, and the space heater be kept and advertised for sale at some later date Carried The meeting was advised that Mr Ross L Fraser had signed the five year gravel lease, after discussions by Mr Berdahl with his son, and by Mr King with Mr Fraser Mr Berdahl moved to accept this report, and to authorize the Reeve and Secretary - Treasurer to sign the said gravel lease OFFER FOR ITEMS F SHERRING ROSS FRASER LEASE AGREEMENT GRAVEL 6 'r c�c COUNCIL MEETING JANUARY 10th,1977 P 6 on behalf of the Municipal District Carried A statement of claim has been received from Messrs STATEMENT Woods, Homme, Baker & Company on behalf of Robert L CLAIM Blount in regard to an accident which happened on ✓\ ROBERT a road in the Linden area This has been referred BLOUNT to Jubilee Insurance, who are arranging for a statement ACCIDENT of defence to be filed by their solicitors Following brief discussion of the matter Mr Campbell moved to accept and file as information Carried A letter dated January Ith,1977 from the Carbon Home and School CARBON Association was read to Council They are concerned about HOME & the hill east of the Jack Harris property and west of the SCHOOL Jack Barber place - in the South half of 18- 29 --22 -4 DANGEROUS and feel it is dangerous for the school bus to travel this J� HILL area in the winter They request a guard rail be installed at this location If nothing further can be done to improve the safety of this hill, they will request the School Division to change the school bus route Mr Poole moved that the Carbon Home and School Association be advised that Council does not feel a guard rail would be of any value at this location, and no further work is planned for this portion of road Carried An application for work has been received from Doug Kline WORK and Carl Gundlach Mr Ferguson moved these be referred to � APPLICATIONS Mr Paquette Carried CANCELLATION It was noted that no objections had been received to the advertised ROAD proposed closure of unused road diversion in Part of the DIV SE 30-30 - SE of 30- 30 -23 -4 23 -4 Mr Berdahl moved third reading to By -law Number 813 to cancel the unused road diversion in SE 30- 30 -23 -4 BY -LAW 813 and return the land to the quarter from which it came Carried It was moved by Mr Campbell that the Foremen and Shop FOREMEN & Committee meeting scheduled for January 20th,1977 be changed SHOP COMM to the forenoon of January 19th,1977, at 9 °30 A M , and 1 MEETING Jan no Council meeting be held on that date \1/ 19 Carried It was noted that Mr Brown gave a report to the meeting of the local governing officials last year regarding roads constructed etc , and it was agreed that this information be compiled for the meeting on January 19th Mr Ferguson also requir.:s this information for his meeting on February 3rd, 1977 ROAD Mr King advised the meeting that the Land Titles Office have Sec 29 -27 -20 issued title in the name of the Municipal District for the road diversions cancelled in Section 29- 27 -20 -4 rather than 4 - consolidating them back into title with the quarters from which they came It is now the responsibility of the M D to transfer title to the owners of the land Mr Berdahl moved that the said cancelled road diversions in Section 29- 27 -20 -4 be transferred to Miss M Biggs et al, on the condition that she pay the registration fees involved, which are estimated at $15 00 Carried 7 &P, COUNCIL MEETING JANUARY 10th,1977 with R P 7 Discussions were then held with Mr Dobler and Mr Paquette PUBLIC WORK regarding public works ITEMS The gravel crew is working out of the Megli him, and stated he was agreeable, - pit stock piling gravel was not too happy DITCH Mr nobler advised tnere is approximately 14,000 yards agreed of gravel at Garson, but this does not agree with the book would be keeping records checked with Mr Vickery when he He also noted there is no gravel stock piled at Greenleaf at the at this time He advised the meeting he requires another stock pile site on ✓ Highway 21 near the Arthurville turn off After discussion of possible sites, Mr Bauer moved that Mr Litz also inquired about the Mr Dobler and Mr Campbell check into this matter and for 20,000 arrange for a suitable stock pile site Carried he was Mr Campbell asked about the required permit for testing the required in the Red Deer River . Section 2- 34 -22 -4 information This will be looked into Mr Paquette advised the meeting he had looked into the price for either a hi boy or low boy trailer The existing trailer is not entirely suitable as the beaver tail is too short New trailers are very expensive and there is nothing available at the present in the second hand l line He was requested to see if the existing beaver tail could be modified and lengthened to make it more useful, and to check further regarding second hand trailers An estimated price of $1250 00 a piece for replacement of the Carbon Shop doors was obtained A written bid will v be submitted soon, and this matter will be checked further at that time There was discusmon about tearing down or removal of the old shop in Carbon and this matter will be followed up The tin has been partly removed at this time Mr Berdahl has a party who may be interested in moving the building and he will check with him again Mr Berdahl also inquired about the culvert for SW 25- 28 -22 -4 which was not received last summer This will be checked with Alberta Bridge Branch DEATH Mr Berdahl advised the meeting that Mr Stan Torrance STAN Secretary- Treasurer of the former Carbon Municipal District TORRANCE passed away recently and it was agreed that a card of condolences be sent to the family Mr Ferguson inquired about how the wage schedule for the office staff was arrived at This matter was briefly ✓� discussed, and information given to him, as he had been away when these were settled Mr Litz inquired about the agreement with R W Vickery VICKERY regarding the drainage ditch Mr Vickery had contacted DRAINAGE him, and stated he was agreeable, but was not too happy DITCH with some of the wording It was agreed this would be A/G checked with Mr Vickery when he calls at the office and ,V, the agreement modified if necessary Mr Litz also inquired about the need for 20,000 square feet in hamlets for buildings and he was given the required information C COUNCIL MEETING JANUARY 10th,1977 Mr Campbell inquired about the date for a meeting with the Rural Fire Department volunteers After discussion of possible dates, Mr Campbell t% moved that the meeting be held in the evening of January 27th,1977, at 7 30 P M Carried It was agreed that if there was anyone with 15 years service or more, they be especially invited to attend the meeting to receive their long service certificate It was also agreed that possibly a representative from the Fire Commissioner's Office should be requested to attend Mr Campbell will look after this matter Mr King gave a report about the possible annexation of additional land to the Town of Three Hills to accomodate a new site for a machinery dealership There is a subdivision application pending for 20 acres from the SW 1-- 32 -24 -4 (Pryor land) and annexation of this area will be requested.
