Fuel Storage on country acreage 13 C R C P - Turner Valley and Airdrie 14 Building Standards, Building Inspector 15 Minutes from C R P C 16 Beagrie Subdivision - Still concern over 10' strip? a r E* F II s SPECIAL COUNCIL MEETING FRIDAY, DECEMBER 3rd, 1976 ---------------------------------------------- - - - - -- A special meeting of the Council of the M D of Kneehill #48 was held in the Municipal Office, Three Hills, on Friday, December 3rd, 1976, commencing at 9.00 A M Councillors present for this meeting were PRESENT Gilbert A Berdahl Div 1 Clifford W Poole Div 2 Ralph W Brown Div 3 (Reeve) Art W Bauer Div 4 V T A Ferguson Div 5 Leonard Litz Div 6 Reginald Campbell Div 7 Mr G G King, Secretary - Treasurer, was present and recorded the minutes Mr Poole moved that Council waive notice of the meeting and proceed WAIVE to deal with any business which may be brought before this meeting. V NOTICE OF Carried Unanimously MEETING Brief discum.on was held concerning general planning procedure, and then the following representatives of C R P C met with Council PLANNING Mr Earl Nemeth, Mr W Fairbrother and Mr Gary Youde In these PROCEDURE minu as reference to C R P C will mean reference to the three present. By -law number 789 which provides for development control was reviewed in detail Provincial controls over such things as hog operations, poultry BY -LAW 789 feeding operations, etc , were also referred to After- considerable discussion C R P C advised that it would be possible, subject to proper procedure, to amend by -law 789 to reclassify some areas and not require development permits, if the buildings are up to standards, which may be set by Council C R P C again strongly recommended that development control be exercised under by -law 789 Mr G King, as Secretary - Treasurer, again advised that it is not really necessary, at this time, with view of a new planning act coming next spring, but that amendments would help el4minate many of the problems Mr Don Anderson met with Councilt:) ask if there would be any possibility of getting a subdivision for approximately 7 acres of land cut off by the C N R , at the south west corner of the South West of 30- 31 -23 -4 C R P C advised that this was contrary to the Preliminary Regional Plan which requires a minimum size of 40 acres, and also contrary to the restrictions which state that no country residential subdivision within two miles of an urban center However in special cases both of these could be relaxed Much might depend on the opinion of the Town of Three Hills He was further advised that he should make the application if he wishes to proceed, and the fee for that is $10 00 It is likely that the 10% reserve would apply by cash Mr Don Anderson thanked the meeting, and then left Municipal by -laws requiring building permits and putting certain restrictions in regard to building locations, etc , were reviewed, with particular reference to number 420 C R P C questioned the validity of some of these items, because of the building standards act, but there can be no definite ruling without reference to the courts Mr D W Davidson met with Council and stated that he wished to obtain a permit for a retail licence for building specialties and supplies to be handled at his place of residence in Grantville, namely Lots 1 and 2, Block 5, Plan 7816 F U He stated he planned to use his existing garage as a temporary headquarters as he is looking for a larger area, but has not been able to get a suitable site at a reasonable price C R P C outlined the procedure under Development Control, which means that Mr Davidson makes an application, it is first referred to the Town of Three Hills, and the Town has 30 days in which to reply The development control officer then makes his decision / P_ V SUBDj.Y.Lo SW 30 -31- 23-4 I- D W REQUEST FOR PERMIT RETAIL BUSINESS GRANTVILLE 2 e • • • SPECIAL COUNCIL MEETING DECEMBER 3rd, 1976 and this must be advertised, if it is approved by him There is then the right of any person to object and the Council sits as the Court of Appeal If the Development Control Officer refuses the application, then Mr Davidson has the right of appeal, and the Council must advertise the date of hearing and proceed to deal with the same If the matter were not dealt with under Development Control, he would apply to the government for his licence, and the Department would refer it to this Council for opinion, which would then recommend for or against the same, and the matter would then be proceeded with Mr Davidson stated he felt this would be a temporary business but likely for a minimum of 1 year He was advised that he would be given information about the procedure later He thanked Council and left the meeting Council's procedure in passing by -law number 812 on November 24th,1976 was questioned by C R P C That by -law repealed Development Control by -law 789 Mr G King agreed that the procedure may not have been correct, but the by -law was duly approved and passed and stays in effect in his opinion unless challenged in the courts or repealed by Council. Considerable discussion followed about ju,t,poi procedure Mr Brown moved first reading to by -law 815, this being a by -law to repeal by -law 812, retroactive to November 24th,1976 at the time of its passing Carried Unanimously Mr Bauer moved second reading to this by -law Carried Unanimously Mr Poole moved third reading to this by -law Carried Unanimously Propoeed amendments to by -law number 789 were then discussed in detail Mr Ferguson moved that C R P C be asked to draft amendments to by -law 789 and submit same back to Council at a later meeting for consideration to provide for the following changes 1 Page 2 - clause 2 Point 1.1 (g) Delete two - thirds P 2 DEV CONTRDL 789 & BY -LAW 812 6 BY -LAW 815 V 2 To remove the necessity of getting development permits for residential uses in hamlet areas or any other parcel, on condition that the floor area is 600 square feet or more, and on condition that other regulations regarding location, etc , be followed J 3 Page 2 - clause 2 Point 1.2 (e) Delete 4 Page 3 - Clause 4 0 5 - (b) subsection (ii) Add and resolutions thereto Carried Development Control Resolutions number 1 and number 2 were then referred to C R P C suggested certain changes that should be made to bring them into conformity with by -law 789 Mr Berdahl moved that these resolutions be redrafted to provide for the following changes 1 Resolution Number 1 - Clause 2 1 1 - Agricultural Holding Area to have a density factor of 4 and a minimum parcel size of 40 acres 2 Resolution Number 2 - Page 4 - Clause 3 4 1 - Area of site to read 40 acres 3 And such other matters as may be required to bring it in to conformity with the Preliminary Regional Plan Carried 3 a C X • SPECIAL COUNCIL MEETING DECEMBER 3rd,1976 P 3 C R P C advised that they are willing to prepare a new building V BUILDING ��F`- BY -LAW by -law for consideration by this Council Mr Bauer moved that this offer be accepted Carried Mr G King advised the meeting that he had talked to Mr F G PRYOR Pryor and his son regarding the proposed subdivision in NW SUBDIVISION 30- 31 -24 -4, for approximately 7 and 2 acres, being a parcel NW 30 -31 -24 25o feet east west by 1320 north south Mr Pryor had been advised that it appeared the parcel was too narrow and there might be problem in road improvements at a later date Also in regard to location of buildings Mr Pryor had stated that he wished the application to proceed as submitted, as it took only the poor part of the land from that quarter section Mr Pryor was willing to locate buildings, so as not to interfere with road development 1/ This was discussed by Council and C R P C advised that it was against the Preliminary Regional Plan as there was no existing dwelling on the site, and it was under 40 acres The size would also create some objection Mr Lrown moved that Council recommend against this subdivisinn Carried Mr Bauer asked to be recorded as opposed The size of lots required for a building site within a hamlet was discussed The minimum parcel size for a new subdivision in a size of location without water and sewer is 20,000 square feet, but this LOTS FOR may be relaxed in special cases This does not affect the size ✓ BUILDING of property for an existing title, in regard to a building permit IN HAMLETS This was given to Council as information, with the agreement ofCRPC Mr Poole moved that the building; permits as issued to Herb BUILDING Gogal for a machine shed in NE 26- 33 -24 -4 and to Alfred Esau PERMITS for a poultry barn in Part SE 25- 30 -25 -4 be approved, but that V, APPROVED Dr R G Foulon be advised he must make application under by -law 789 for a development permit for the proposed new dwelling in Pt NE 22- 28 -20 -4 Carried Mr G King advised Council that he had been asked if it would be legal for town residents to locate fuel storage tanks on the FUEL STORAGE property of Mr Belt lying east of the railway in the NE 1- 32 -24 -4 TANKS This would be so that they could buy fuel on a bulk basis. C R P C V BELT PROPER advised that this would not be a permitted use unless regulations were relaxed but could apply for a development permit Mr Hauer moved that this be recorded as information Carried Mr Poole moved that Council. voice no objections to the proposed high density area in Turner Valley and Airdrie as per information CHANGES received from C R P C TO PREL Carried REG PLAN Mr Litz moved the matter of building standards and a building V BUILDING inspector be tabled pending receipt from C R P C, of a new building by -law INSPECTOR Carried TABLED Mr Ferguson moved that the minutes as received from C R P C be tabled ✓ C R P C MINUTES Carried Mr Brown advised that the Calgary meeting of C R P C members had turned BEAGRIE down Council's proposal in regard to the Beagrie subdivision in NW 9- 32 -24 -4 SUBDIVISION as per Council minutes of November 8th,1976, page 3 Mr Bauer moved that CREEK RESERVE the developer be asked to appeal the decision of C R P C , so that no separate NW 9-32-24-4 title is required for the creek area Carried 4 0 • v 0 SPECIAL COUNCIL MEETING DECEMBER 3rd,1976 C R P C members present were thanked for attending the meeting, and they then left Mr John Jeffery, ssistant Secretary - Treasurer, and Mr Ted Paquette, and Mr John Dorn, foremen, then met with Council It was noted that there are now about 1Q3 miles of oiled or surfaced roads which are the responsibility of the M D for snowplowing in winter Council members expressed concern about the fact that these had not been snowplowed on the previous weekend during the time of the snowstorm as the snow has now packed and the roads are very icy; in part Mr Pmle moved that Council accept as policy and that the foremen directed to get snowplowing done on the oiled or surfaced roads as quickly as possible, even if it means working on a Saturday, Sunday or Statutory Holiday, and that they make use of motor graders as well as the trucks. Carried Mr Berdahl asked that each Councillor be advised when any alternate motor grader operator is working in his division due to holidays, or other cause This was agreed The foremen were asked to give some more attention to training men for snowplowing Mr Jeffery read the report of the shop and foremen committee meeting of November 25th,1976, and the following recommendations were especially noted ✓1. Buy a new 9 to 12 passenger Rally Wagon - no trade in 2 Transfer the crew cab to the Small Crew .3 Buy a new four wheel drive truck with a trade in of T -8, which has about 70,000 miles (John Dorn) P 4 C R P C out REPORT ON SNOWPLOWING ETC V SHOP & f COMMITTEE MEETING RECOMMENDATI 4 Buy a used school bus to replace T -29, which would then be sold or traded. Trade in P -8 12 F motor grader for a new motor grader 6 Trade in P -9 motor grade f. 1 new motor grader which would then go in to Division 7 No change in respect to crawler tractors 8 Buy a new 6 foot steel drum vibratory packer either self propelled or pull type and trade in C -18 9 Arrange for a tractor to pull the sheepsfoot and or the mixer This could be on a rental basis Discussion followed on the above items Mr Litz moved that Council call for CALL FOR BIDS bids for items 1,§ 3, 5; 6; and 8, as referred to above, with the call to be X sent out in early January, and the bids to be considered by Council on February 2nd, 1976 Carried REG FEE Mr Campbell moved that Council agree to pay the $12 00 registration fee for employees who take the safe driving course Carried SAFE ddift Mr Poole moved that Council approve sending Joe Dobler and one other truck driver, to take a truck driver training course under Alberta Transportation Carried Council agreed without motion to contact the Three Hills School Division regarding a school bus They also appeared above to pull the Council was advised over $2000 00 No agreed that it would be better to rent a tractor for item 9 sheepsfoot or mixer that a high pressure washer for the decision was made. shop would cost somewhat 5 I 0 • n • SPECIAL COUNCIL MEETING DECEMBER 3rd,1976 CouncilFas advised that the foremen had inspected the boxes for the two new trucks which were recently ordered, and had agreed to take same One new truck with box is now here and in use, and the other is expected next Tuesday Two of the trades have been delivered to Calgary, and the other two will be sent next week Mr Poole moved that this be approved, and that the costs be included in the 1976 business Carried Mr Berdahl moved that the other recommendations from the Foremen Committee meeting be approved, and the minutes adopted Carried Mr Paquette advised that Joe Fredericks has been temporarily on a motor grader, but that Brian Plant will be the chief operator of the machine P -9 P 5 TRUCK BOXES ETC COMMITTEE MINUTES j MOTOR GRADER OPERATORS Mr Brown advised that the men recommended a slight change in regard to the days off for Christmas Day, Boxing Day and New Year's Day HOLIDAYS Mr Ferguson moved that this be approved, with the Statutory Days off to be December 24th and December 27th,1976, and December 31st 1976 FOR XMAS ETC with the last to be included in 1977 business In response to a question from Mr Campbell, Mr Dorn agreed that V Albert Kimmel should be responsible for snow removal on the Trochu East Road unless otherwise notified Mr Alex Cunningham met with Council briefly, and brought in 4 RADIO bases for the mobiles to be located in homes These were given to �, BASES John Dorn and to Councillors from Division 2, 5 and 6 Others are to follow Mr Cunningham, Mr Paquette, Mr Dorn then left the meeting Report of the Employee Committee Meeting held December 1st, 1976 EMPLOYEE was given Mr Brown gave a comparision of wage rates in this COMMITTEE Municipal District as compared with the report from the AAMD & C / MEETING It was agreed that further information be obtained about proposed WAGE salary increases, and the report brought to a later meeting, REPORT with the suggestion that the minimum wage be left as it is Mr Ferguson moved that this meeting do now adjourn Carried ADJOURNMENT Time of Add.,..... ...t 5 30 P M - - - - -- - - - -- -- -------- - - = - -- -- - - --�- -- - - - -- - - - -- Reeve Secretary - Treasurer Next Regular Meeting of Council - December 13th,1976 commencing at 9 00 A M
