Ferguson Div 5 Leonard Litz Div 6 Reginald Campbell Div 7 Mr G G King; Secretary- Treasurer, was present and the minutes were recorded in part by Mr King, and in part by Jean Wilkinson, Stenographer. APPROVAL MINUTES It was noted that in the minutes of the September 14th meeting, page 9 the reference to the price increase of regular gas should read $.047 rather than 0474 as written, etc. Mr. Berdahl moved approval of the minutes of the meeting of September 27th,1976 as circulated Carried FINANCIAL The financial statement for the month ending September 30th STATEMENT 1976, was read. This showed a net balance at the end of the month of $20,687 11 with loans owing of $255,000 00 The Secretary reported that the balance of the road grant for the year 1976 had been received early in October, and all loans were paid off at that time Mr Poole moved acceptance of the financial statement as presented Carried ADVERT PENALTY Brief discussion was held regarding the penalty deadline, DEADLINES and it was agreed that the penalty dates of December lst and February 1st should be advertised in the Capital during the month of November ORGAN MEETING It was moved by Mr Bauer that the date for the organizational DATE meeting of Council be Friday, October 22nd, 1976 at 11:00 A.M Carried The minutes of the recent ambulance meeting were reviewed, MIN AMB and Mr. Campbell moved to accept the minutes as presented. MEETING Carried The minutes of the Carbon Recreation Board meeting held CARBON - eptember 14th,1976 were read and discussed It was also REC. MINUTES noted that the semi annual regional supper meeting of recreation boards will be held on Thursday, November 4th 1976 at the Carbon Community Center Mr Berdahl moved acceptance of the minutes Carried A request from C J D V , Drumheller had been received in ADVERTISEMENT RJ%UE S T regard to an advertisement for the Three Hills Rodeo Mr Poo RODEO moved that no advertisement be authorized on behalf of the Municipal District. Carried The Secretary reported to Council regarding increased load LOAD LIMITS lin. j on M D roads, and noted that there would be exceptions BY -LAW required on certain roads. Discussion followed and again ETC Council stated that the load limits should be 5,000 pounds on all light coat surfaced roads, and 72,000 pounds on gravel and heavy paving. It was noted that one exception would be the road 2 �6 v COUNCIL MEETING OCTOBER 12th,, 1976 ------------------------------- - - - - -- P 2 leading to the Merle Anderson Bridge on Three Hills Creek as the bridge would not carry 72,000 pounds It was moved by Mr Ferguson that the Secretary draft a new by -law regarding load limits as noted above, and outlining any portion of roads to be excluded from such increased load limits, and bring such by --law back to Council for its consideration at the next regular meeting. It was also agreed that prior to final passage of such a by -law; it should be advertised to allow comments from interested ratepayers Carried A letter from Ralph A Siebring & Company was read which CHANGE OF stated that effective October 1st, 1976 the firm name NAME will be changed to Henri Van Den Hoven, Chartered Accountant.AUDITORS Mr Bauer moved to accept the letter and confirm the appointment of Henry Van Den Hoven as our auditors for the reminader of this year Carried CORRESPONDENCE Correspondence from the AAMD & C was read.; including information AAMD &C about sales tax exemption blanket certificates for purchase of culverts not now satisfactory, information about Section 8 of the Stray Animals Act, which was discussed by Council, and information about a meeting to be held in Edmonton on October 28th,1976, regarding changes to be made in the County Act It was moved by Mr Bauer that Mr Brown be appointed as a delegate from our Council to attend the meeting in Edmonton Carried It was moved by Mr Litz to accept and file the other correspondence Carried REG LAND Mr Brown reported to Council on the meeting held October 7th FILL SITE 1976 in Drumheller concerning a proposed Regional Land MEETING Fill Site for the entire area served by the Drumheller Health Unit Copies of the report and quotes received for this type of service from Central Dispose All were given to each councillor. Mr Brown and Mr. Berdahl attended the meeting on behalf of the Council Mr Berdahl added his comments It was noted that perhaps there would have to be three land fill sites, rather than just one in order to serve such a large area It was further noted that there are no regulations at present which prevent buring in a rural area, or an urban area, unless a specific by -law is passed prohibiting such burning The matter of roll off containers was discussed, and increased costs of such a service were also discussed Mr Ferguson moved to accept and file the report as information Carried A discussion was held regarding garbage pick up from the Linden Nursing Home Mr Brown noted that Central Dispose All would pick up garbage from the home on a weekly basis for the sum of $25 00 a month Following discussion of the matter, and other areas which do not receive garbage pick up, it was moved by Mr Ferguson that the M.D pay a c-r=nt of $200 00 to the Linden Nuring Home for the year 1976 Carried The accounts were then considered by Council It was noted that a check is to be made about the garnishee summons and w'_i(_ther or not it applies month by month until paid in full. Discussion was also held regarding the high cost of tool replacement each month, and it was agreed that this matter GARBAGE PICK UP LINDEN NURSING / HOME ACCOUNTS 3 i y a • • • COUNCIL MEETING OCTOBER 12th 1976 P 3 should be discussed at the next Foremen's meeting T SLATER Prior to completion of the accounts, Mr Tom Slater s WATER RESOURC S of Alberta Water Resources entered the meeting, at approximately 11.•00 A M F WATER Mr Slater discussed with Council various requests he had RESOURCES received and it was noted that Mr Slater wishes to meet with PROJECTS various councillors to go over these proposed projects 1 Gibbs Project - Acme Area - meeting with Mr. Brown and owner's representative within the next two weeks 2 Orkney Hill - River Erosion Problem - meeting with Mr Berdahl to look at the problem Mr. Slater noted that the Department will consider what can V be done to the river to save the road, or if the cheaper method would be to move the road, their funds could be diverted to this method Mr Campbell noted that the road committee had looked at this site, and he felt that the river was not the entire cause of the erosion problem It was agreed that Mr Slater contact the office when he wishes to meet with the councillors involved, and a meeting will be set up Mr Slater requested more information about the Swalwell Dam and the request of Mr Ralston for a 13�1' diameter pipe It was noted that Mr Ralston feels he should have a continuous 12" flow of water from the dam, and a 11�" diameter pipe or syphon would be acceptable Mr Slater pointed out that certain repairs should be made to the east side of the dam to prevent washouts occuring from overflow of water, Mr Poole noted that there is no further need for the syphon at the dam and also noted that the valve had been removed from the syphon Ducks Unlimited from Hanna will come and pick up their syphon, and Mr Slater will advise them to have the valve repaired and submit the account to the Municipal District Mr Slater noted that their department may not supply any funds for work on the Dam as this is classed as maintenance, but he will attempt to obtain funds for it Mr Berdahl requested information about slough drainage assistance and Mr Slater outlined what is available from his Department SUNNYSLOPE Mr Bob Thiessen and Mr Victor Thiessen of Sunnyslope area EAST PROJECT entered the meeting at approximately 11.15 A M The matter of the Sunnyslope East Project was discussed and various methods of drainage of the area and costs involved were discussed Mr Slater pointed out that the costs involved must be related to the amount of benefit which would be obtained from the drainage It was agreed that the parties involved should hold their own meeting and decide what amount of money, if any; they would be willing to invest into such a project, and come bacic to Council with their committments Then Council could decide if the costs .involved and land to be reclaimed warranted any payment from the M D Mr Edgar Penner entered the meeting at this time It was noted that the project would involved 6 or 7 quarters of land to some degree It was also noted that there is now provision for increase of land assessment if the land is .4 n 4 • • • COUNCIL MEETING OCTOBER 12th,1976 P 4 improved through a drainage project It was agreed that Mr Brown attend a meeting with the parties interested in the drainage project, and it was noted that every person involved must be in attendance at the meeting in order to obtain unanimous approval for the project Mr Slater inquired about an acconnt owing to the M D for work done on the Kneehill Creek early this spring, and he was advised that this was now paid in full. X Carried 2 Leonard Mullock - Second Dwelling - Parcel A, NE 5- 30 -25 -4 ✓ Moved by Mr Brown that a temporary permit for one year be approved Carried 3 Bethal Fellowship Church - Addition - Pt SE 28- 31 -23 -4 Moved by Mr Campbell that this permit be approved Carried LAMMLE & BARG Mr King brought up the matter of the Lammle and Barg SUBDIVISIONS subdivisions in Grantville He noted that in 1974 a design for GRANTVIL subdivisions in this area was worked out with Mr Fenerty of C R P C , and it was agreed at that time that no alley was needed, as it would split the playground area owned by the M D Also the design was made to accomodate existing buildings Following discussion of this matter, Mr Bauer moved that ✓ Council request Mr Lammle to appeal his subdivision conditions, that Council request C R P C to reconsider their decision regarding the subdivision outline, and that C R P C consider this design in regard to the Barg subdivision Carried Mr Paquette and Mr Dobler entered the meeting at this time, approximately 1 30 P M GAS LINE A letter from Professional Gas Engineering was read regarding KNEEHILL installation of a gas line for the Kneehill Gas Co -Op , 15 GAS CO -OP feet east of the highway property line - SE 19- 30 -25 -4 It V was moved by Mr Brown that approval be granted for this intallation as per plans submitted, subject to compliance with government regulations ROAD CROSSINGS A letter from Troy Oils regarding road crossings in the Carbon TROY OILS area :aas read A pipe line is to be installed to accormodate three wells which will flow into the Carbon gas plant n 4 C COUNCIL MEETING OCTOBER 12th,1976 P 5 It was moved by Mr Poole that the road crossings be approved as per plans submitted subject to compliance with our road crossing regulations Carried There was a brief discussion of road crossings by Leduc Construction in the area It was noted that some complaints had been received about the workmanship involved Mr Berdahl moved that the road crossings constructed by Leduc Construction which are not satisfactory, be referred to the Surface Reclamation Board Carried LEDUC CONST ROAD CROSSING WELL SITE 6 A letter from Sim and Associates Ltd regarding a well site ACCESS and access in SE 17-29-23-4 was read Mr Poole had inspected SE 17-29 - the site previously Mr Poole moved that the site and ✓ 23 -4 access be approved as per plans submitted subject to compliance with our regulations Carried It was noted that a check should be made regarding access to ROAD ACCESS the well located in SW 27- 30 -24 -4 The road now comes out SW 27-30 - to the south, but Council had required that it be out to the 24 -4 west Carried ALTA POWER Plans submitted by Alberta Power Ltd , for a line extension in LINE NE 29- 31-25 -4 was considered It was moved by Mr Bauer that EXTENSION this extension be approved as per plans submitted, subject / NE 29-31 - to delay in their line construction until the Municipal District 25 -4 can complete its road construction in that area Carried KUBENIC & Mr Ferguson reported to Council regarding agreements reached HUGO with Mr Kubenic and Mr Hugo for crop damage relating to the CROP DAMAGE road along the West of 36- 31 -22 -4 They had agreed on $150 00 AGREEMENTS per acre and the damage covered 2''� acres of crop Mr Ferguson moved that payment of $187 50 be made to T & T Kubenic; and payment of $187 50 to Hugo Farms -d i Carried Mr Ferguson also reported that Mr Nakaska was relucant to sell any land for road requirements in NW 19- 31 -21 -4, but would sell if necessary at $500 00 an acre It appears that we require two rods on each side of the road in this area It was moved by Mr Ferguson that we purchase the required land from Mr Nakaska at the sum of $400 00 an acre and payment of $200.00 total be made to him for past use of the land as a road Carried It was noted that we should obtain a signed agreement to this effect from Mr Nakaska Mr Bernard Milan had requested a hearing with Council Council discussed the problem with Mr Paquette, and Mr Ferguson outlined what discussions he had with Mr Milan Mrs Milan had been to the office and had complained about Mr Paquette discussing this matter with her instead of with Bernie Mr Paquette, Mr Dobler and Jean Wilkinson then left the Mr Milan entered the meeting After discusson with Mr Milan, he left the meeting and Mr Paquette reentered NAKASKA ROAD AGREEMENT NW 19- 31 -21 -4 V BERNARD MILAN HEARING meeting. Further discussion was held., and Mr Paquette then left the meeting again After further discussion by Council, Mr Paquette, 6 �i��i i 0 C` r� U COUNCIL MEETING OCTOBER 12th 1976 P 6 Mr Dober and Mr Milan re- entered the meeting Mr Brown advised Mr Milan that. 1 He was not fired 2 That he was and is warned about attendance at work and that good work is expected 3 That he remains a senior operator only if his work warrants the position 4 That his seniority only started this spring so there is no work for him this winter and layoff would likely be November 12th 5 That any second fob he holds is his own business, but we require good work from our employees Mr Milan then left +he meeting V HEER & Mr Campbell advised he had not yet seen Mr Heer and Mr JOHNSON Johnson about their account The matter is tabled pending ACCOUNT receipt of further information The matter of the beaver problem in the M D was discussed BEAVER PROBLEM A permit has been obtained from Alberta Wildlife to trap beaver on any road allowance in the M D , but it was noted that a trapper must have permission of each individual landowner before he can trap on their land A report must be submitted to Alberta Wildlife as to the number of beaver and muskrats trapped Mr Litz advised that the trapper he had contacted would remove the beaver at this time, but he would charge for his work as the pelts are not prime at this time He would trap in the winter at no charge, providing he could retain the pelts Mr Campbell advised that the beavers are plugging one culvert in his division and something should be done about this problem as soon as possible Mr Bauer moved that each councillor make a list of the areas involved with the beaver problem.. and names of landowners be obtained, and this be referred to the trapper Carried TOWN OF The Town of Three Hills had requested use of an M D THREE HILLS scraper for two or three days for work on the road and the RFQUEST FOR site for the new curling rink Mr Paquette advised that TS SCRAPER 18 is presently in the shop and perhaps they could use this machine when it is repaired Mr Campbell moved that the machine might be made available tc the Town of Three Hills for use on a Saturday, Sunday and possibly a Monday following completion of repairs but that no other time be taken away from our fobs The rate charged would be government rates, and consideration may be given at a later date to a grant by the M.D towards this project Carried It was noted that at the present time the only interest DEF DRIVING expressed from employees for a defensive driving course was COURSE by Ted Paquette and Karl Gundlach The feeling expressed by some of the crew was that it should be during working hours, (/ and not in the evening This matter will be reviewed again at a later date Mr. Ferguson moved that the motor under dispute with R Angus R ANGUS should be brought back from their shop in Calgary and installegOTOR in a vehicle as soon as required Carried The Bridge Inspection report was reviewed with Council The BRIDGE work on the S. Burns Bridge is organized and will be undertaken INSPECTION shortly by the government crews It was noted that there was REPORTS no way one bridge could be done away with in that location Mr Ferguson reported on a complaint he had received about the location of signs set out for this project, and this has now been corrected 7 i 0 U is COUNCIL MEETING OCTOBER 12th 1976 P 7 It was noted that the motor grader operators should be advised to remove gravel from any bridge decking as leaving it on causes deterioration of the deck Mr Poole moved to accept and file this report Carried The road committee reports were reviewed by Council ROAD COMMITTEE 1 Vickery Slough problem --- Mr Poole moved that the ditch REPORTS channel be cleaned out one more time, by the M D and that following this, the M D will have no further responsibility for the ditch Carried It was agreed that a signed agreement to this effect be obtained from Mr Vickery 2 E Henkel - East of 23 -33 -24 4 Caraganas Moved by Mr Campbell that this matter be referred to Mr Paquette and the caraganas be removed in the best possible way to improve the safety and vision in that location Carried 3 H Leischner - East 36- 33 -24 -4 Culvert - and two other culverts on same road - George Lemay Property SE and SW corner of 35-33-24--4 ✓ These culverts require cleaning and possible replacement of one culvert which is not large enough Moved by Mr Berdahl that these recommendations be accepted and the work done when possible Carried 4 A Winther -- South of 14- 34- -24 -4 Ditch requires cleaning It was moved by Mr. Campbell that Mr Paquette take levels in this area to see if the ditch could be lowered with a motor grader, and if feasible to do the job Carried 5 A Winther Water in basement - West of 14- 34 -24 -4 It was moved by Mr Litz that this matter be referred to the Oil and Gas Conservation Board for their consideration Carried 6 J Barnes Road - Trees and rocks in ditch It appears that Mr Barnes intends to widen the road in this area There is no visible damage to the road at present and no culverts are plugged No recommendations were made by Council in this regard 7 C A Winther - Victor Gustafsen has asked for grade improvements for the north 3/4 of a mile West of 23- 32 -24 -4 Mr Paquette suggested that this could be done with one or two motor ✓ graders Council appeared agreed Some small culverts will also likely be required 2 Main Crew is working; in Division 6 progress has been slower then expected as one TS 18 has been down awaiting repairs ,,/ 3 The Small Crew is now cleaning up the Swalwell Nuisance Grounds and other machinery is improving the road to the new Acme well. Mr Brown suggested that only a narrow strip of gravel be put on this road aft�_r some crushing has been done at the Megli Pit 4 Mr Berdahl asked about speed limits and signs for this on the Pope Lease Road Mr G King was asked to check existing by -laws and current procedure for specifying speed limits and to report to the next meeting 5 Mr Campbell and Mr Berdahl reported that the sewer line work at Trochu is still a mess along our roadway A similar condition may occur at Carbon Some ditches are filled higher than the road and manholes are too high General condition is untidy Mr Brown moved that Mr Campbell endeavour to get responsible parties to meet with our road committee this coming Friday Carried 6 Mr G King was asked to check the hold harmless agreements with Carbon and Trochu and to establish whether these agreements continue forever 7 No grading or other work near Fred Art's - West 26- 32 -27 -4 - Y to be done pending a report from the Bridge Branch 8 Mr Campbell and Mr Paquette advised that some government official is to be out this week in regard to our application V to test for and remove gravel from the Red Deer River 9 Mr Litz moved that, if approval is received for taking gravel from the river, we call for bids for doing this work ✓ Carried 10 Mr Ferguson mentioned that there is some possibility of ✓ gravel in NW 16 31 -22 4 Tests to be made later 11 Mr Dohb r reported that testing h?d been done at suggested y locations in Division I;
