A regular meeting of the Council of the Municipal District of Kneehill #48
was held on Monday., September 27th,1976, commencing at 9 00 A M

meeting, and the minutes were recorded by Jean Wilkinson., Stenographer
Mr M Brereton, School Division Trustee was present for the major portion
of the meeting APPROVAL
Mr. Berdahl moved approval of the minutes of September 13th and 1 n
, 1976, subject to a correction to be made as follows
Page 6 - Mr Dobler s report should read - Pope Lease Road, to Taylor
Siding and then to the Orkney Road

The Secretary was requested to check the hold harmless agreements from
Carbon and Trochu regarding length of time the agreements are in effect
The Secretary read a letter from the Town of Trochu regarding closOureU oNrUIS
the Trochu Nuisance Grounds to use by the rural people, effective
October 1st, 1976 Brief discussion was held and it was moved
byMr Poole that the correspondence be accepted and filed

A letter from Robert Cranston of Trochu was read in which he
requested consideration of his purchase of C4 a D7 Cat and
S -4 Garwood Scraper for the sum of $15,000 00
He stated he intends to use the machinery for cleaning
up the Kneehill Sanitary Land Fill Site and nuisance grounds
if his bid for this work is accepted by the Committee
Discussion was held and it was agreed that further information
would be needed - such as hours of work required to
maintain the land fill site, and the possibility of a
Regional Land Fill Site in Drumheller area - before any
decision could be made Mr Ferguson moved this matter be
tabled until further information is available

Discussion was held about a two acre pEvcel on the edge of
Acme, being Pt SW 19- 29 -25 -4 which is owned by Reed Hatch
of 4507 - 20th Avenue S W , Calgary. It appears that the
area is being used by people as a garbage dump Mr
Brown moved that a letter be sent to the registered owner
advising that the land is unsightly and must be cleaned up
immediately

The minutes of the September 20th, 1976 Sanitary Land Fill MINUTES
Meeting were reviewed The hours of operations, fencing and SAN LAND
rates for use of the site were discussed It was noted that FILL MEETING
the agreement with Central Dispose All had been signed by the
Chairman and Secretary of the Committee, and Central Dispose
All had agreed to carry on under the terms of that agreement
for the time being despite the fact that Torrington had withdrawn
from the agreement. The rates may have to be increased later
It was also noted that Eric Bowhay of Three Hills will look after
the land fill site for the time being until someone can be found
to replace him

The Secretary advised that application forms have been sent
ftm for a Grant from the provincial government to pay for
installation of an underground storage tank or tanks for storage
of used oil at the nuisance grounds It was further noted
that Gulf Oil has 8 3000 gallon tanks which may be purchased,
and Hub Oil of Calgary or Turbo Oil of Edmonton will come
out to collect the used oil, amd if properly screened Hub
will pay for the same

Mr Berdahl moved to accept and file the report and further to REPORT
advise the Fire Commissioner's Office that the following fires

A letter from the County of Wheatland NO 16 dated September PEACETIME
17th was read to the meeting It appears that the County AID
will not participate in any Peacetime Disaster Mutual Aid AGREEMENT
agreement at this time The matter was briefly discussed and
agreed that the peacetime aid agreement with the surrounding
counties and towns and villages should be followed up at
the next Central Association meeting It was noted that one
or two parties had replied, and were willing to participate
Mr Litz moved to accept and file the letter from the County
of Wheatland and to follow up this matter with the other
parties

A letter from the Alberta Disaster Services School was referred DIS
to briefly, and it was noted that there is a training course SCHOOL
October 26th to 28th, 1976 Mr Poole moved that Mr Campbell
and Mr Cunningham be authorized to attend the school, if
possible, and make necessary reservations

A letter from the University of Alberta, Extension Department, regarding
a Forum on Issues of Local Government - New Sources of Finance"
was read It was noted that Mr Brown and Mr King were previously ✓
authorized to attend the course Mr Brown moved to accept and
file the correspondence

The Recreation Board minutes from Three Hills and Carbon were REC
reviewed briefly Mr Ferguson and Mr Jeffery added comments /MINUTES
about the Three Hills Recreation minutes in rega:d to the
curling rink, etc , and Mr. Brereton also made comments regrding

The Three Hills School Division minutes of their meeting HILLS
of September 8th:,1976 were briefly reviewed, and Mr Brereton ✓ SCHOOL DIV
added comments regarding rental of School Division houses, MINUTES
and subsidized rentals, etc
Mr Ferguson moved to accept and file the minutes

Mr Brown brought up a matter of a road which requires ROAD
some work brushing grading and gravelling, in order REPAIRS
to accommodate the school bus route The road is west FOR SCHOOL
of Section 17 and 20 in 30 - -26 -4 Mr Poole move that the BUS ROUTE
necessary work be done, in order to make the road passable
for the school bus.

A copy of a letter from Underwood, McLellan & Associates Ltd RUARKVILLE
addressed to Alberta Environment was read to Council The SYSTEM
letter requested permission from Alberta Environment to constructQUOTE
a water and sewer system in the hamlet of Ruarkville, which
would tie into the existing Town of Three Hills system The
costs for such a project were quoted - Sanitary Sewer $116,115 00
Water Mains $68,945.00 - Engineering $27,759 00
for a total project cost of $212 819 00
The matter was briefly discussed and Mr Bauer moved to accept
and file the correspondence

It was noted that second reading of by -law 80% to close a
road allowance in the hamlet of 3vallwell was required before
the necessary advertisements could take place Mr Berdahl
moved second reading to by 80% being a by -law to close
Wacker Avenue from Main Street to Queen Street in the hamlet
of Swalwell

The Secretary gave a brief report on Defensive Driving Month
The government is undertaking a campaign to encourage everyone
to take a defensive driving course The School Division and
the M D are attempting to arrange a course for all employees
who may require it The qu=stion of some reimbL1i,.°.: c n1. nt to
employees was discussed Mr Brereton added comments about
the course as far as the School Division was concerned
Mr Capbell moved that the correspondence be accepted and filed

It was noted that the Secretary should check with the employees
and advise Council at the next meeting how many employees are
interested in taking the course
Amoco Canada Petroleum Company Ltd , has received approval for
a road crossing east of Section 6- 32 -23 -4 - Highway 21 -

The Secretary advised the meeting that the Highway Patrol ?
Division of the Province of Alberta will enforce our municipal
by -laws on roads We should outline to them the roads which we
wish patrolled and enforcement of our by -laws will be undertaken
Discussion of load limits on the roads followed The meeting
felt that the load limits should be changed, possibly to 59,000
on light coat surfacing and 72,000 on gravel and heavy paved
roads The meeting felt more information was required about
bridges, etc , which might not carry 72 000 pounds

Mr Poole moved that the Secretary obtain the necessary information
about bridge restrictions, and load limits on roads from
Alberta Transportation, and bring a report to the next meeting

The meeting appeared generally agreed that the Highway Patrol
should be requested to patrol the light coat surfaced roads
but this would be finally decided following receipt of more
information
ROAD WORK
The Secretary advised the meeting that Amoco Canadian Oil Company MOCO CO
had requested road work done by the M D on the following
roads
West of Section 10 (north west of Three HIlls) in 32 -24 -4
West of Sectiola,�Rl '
t 2 -24-4 into Section 15
and along the R r side of Section 22 in 32 -24 -4
Following discussion it was moved by Mr Bauer that these roads
cannot be built at this time and if the company wish to
build the roads itself to Municipal standards the
M D will supply culverts as required

It was noted that the company be supplied with a copy of our
road standards
The Secretary advised the meeting that Mr Loosmore
called in about the road access which he previously required
through the F Lammle Estate land in NE 36- 31 -23- -4
It appears that he does not use this road anymore, and
therefore felt it could be cancelled
It was moved by Mr Berdahl that we discontinue the practice
of paying $10 00 compensation to the Fred Lammle Estate for
road access granted to the M D to gain access to
the SE 36 -31 -23 4

Mr Litz advised the meeting he had not obtained too
much information about the beaver problem:, and possible
trapping of beaver It was agreed that this matter
be tabled until the Secretary can obtain information from
Alberta Wildlife about permits; etc , and until Mr
Litz can discuss this matter with a party who is involved in
trapping animals
Mr Poole moved that the Council meeting do now adjourn to sit
as the Development Appeal Board

Calgary Regional Planning Commission had entered the meeting
during the appeal hearing

The Secretary advised that Tuggle & McMullan Gravel Crushing McMULLAN
Company had contacted him requesting permission to crush GRAVEL
gravel at the McNair Pit first rather than at Tolman as they -.' CRUSHING
felt they would be done at McNair by October 15th in any event
The Secretary had advised them there would be no objection to
this, and it was agreed by Council that this was satisfactory
The Secretary advised the meeting that Arnold Dunbar of Swalwell A DUNBAR
had not filed an appeal regarding the refusal of his development PERMITS
permits for a mobile home and house on certain lots in Swalwell SWALWELL
Following discussion, it was moved by Mr Brown that a registeredLOTS
letter be sent to the registered owner of the lots in question,

advising him that the developments located thereon do LOTS

Brief discussion was held regarding E Albretch and E ALBRETCI
compensation for road diversion in SW 7- 33 -24 -4 ROAD
It was agreed that this matter be followed up and DIVERSION

A copy of the extract of minutes of C R P C dated August 27th CORRESPOND
in regard to subdivision application for 1 acre parcel in SW ENCE
1- 32 -24 -4 (D Pryor) and Board Order 741 S 76 C R P C
was received from C R P C
Mr Brown moved this correspondence be accepted and filed
A copy of letter from C R P C dated September 9th.1976
addressed to the Prov Planning Board in regard to our
Development Control By Law 789 was read to Council, as well
as a copy of a letter from Alberta Municipal Affairs dated
September 15th,1976 which stated that By -law 788 had
been passed in accordancc with the provisions of the Planning
Act Mr Jordon of C R P C advised Council that no further
word had been received from the Board in regard to our resolution
1 and 2
Mr Brown moved that the correspondence be accepted and filed

A copy of the extract of minutes of meeting of C R P C dated
August 27th,1976 in regard to subdivision application in
SW 27- 29 -21 -4 (Rowbottom) and Board Order 743 S 76 was received
from C R P C , and Mr Berdahl moved this be accepted and filed

It was noted that cash in lieu of public reserve for this
subdivision had been established at $500 00 an acre for the ✓
sum of $256 50 payable as cash in lieu
It was noted that a motion passed by Council on September 13th,
1976 regarding minutes from C R P C was not correct
It was moved by Mr. Poole that this motion be rescinded

dated September 7th 1976 in regard to the Linden Nursing Home HOME BOARD
request for another mobile home residence on the property was ORDER

being only occupied by staff members of the nursing home, and
the mobile residence not being occupied leased or sold to
any other persons unless it is first removed from the said

A letter from Alberta Wheat Pool, through their Huxley Elevator FERT STORAGE
Manager, was read to Council The cool wish to store ammonium HUXLEY
nitrate fertilizer in a shed on their property in Huxley POOL ELEV.
Moved by Mr Poole that the M D have no objection to the
storage of ammonium nitrate fertilizer in a shed on the
Pool property in Huxley, subject to their compliance with all l
provincial and federal regulations

A subdivision application filed by Myrtle Sweet for a SUBDIVISIONS
2 acre parcel in SW 3.29 -25 -4 was referred to the M SWEET
meeting by Mr Jordan of C R P C The parcel is below SW 3- 29 -25 -4
minimum parcel size Buildings are back at least 125
feet from the two roads Mrs Sweet has a house sitting
on the parcel ready to be set down on a foundation if
the subdivision is approved
Mr Brown moved that C R P C be requested to apply for
relaxation of the minimum parcel size to allow
this 2 acre subdivision, and that Council recommend approval V
subject to the figure of $500 00 per acre being used as
the figure for cash in lieu of public reserve

The subdivision application submittedly J Barg for subdivision J BARG
of Lot 3, Block 4, Grantville 4617 F N was considered GRANTVILLE
Mr Jordan pointed out the conditions for approval of the Lammle
subdivision in the same block and noted that the lot being
subdivided by the Lammleso will be 104 feet by 66 feet wide
He stated that other subdivisions in that block should follow
the same pattern in order to provide for proper alignment of
the alley required between the proposed new lots and existing
developments Mr Poole moved Council recommend approval
subject to adjustment of the length of the lots to 104 feet,
dedication of a 20 foot lane between the propcsad lots and
the existing developments, dedication of a 10 foot strip for lane
widening on the east side of the entire lot; and dedication
of street widening as required on the north end of the lot

Mr Jordan also presented a subdivision application from A I DUNBAI
McCulloch Agencies of Acme on behalf of Arnold I Dunbar and SWALWELL
Sharon Dunbar of Swalwell to obtain title to Lots 11 and 12
in Block 6, Plan Swalwell 5050 A K Lots 11 and 12 are contained
in title with Lots 13 and 14, Block 6
It was noted that the four lots would not be sufficient square
footage for a residential dwelling as there is no water or
sewer system in Swalwell, and each parcel requires 20µ000 square
feet in order to accomodate a septic system and a well
Mr Poole moved Council recommend refusal of the subdivision
for the reasons noted above

Swalwell dump to clean up, work on the Acme Water Well Road,
and the Linden nuisance ground to clean up
There was a discussion of the amount of down time on various
machines

There was a discussion about priority for the Walesky road
in Division 4 and the Linden East road in Division 2
It was agreed that perhaps the Walesky road should be
done first

Council discussed the work required on the Fred Art
Bridge location in Division 7 and Mr Paquette noted
the government crew will be coming to work
on the Linden underpass next week
Mr Bauer noted there is 1 mile of road west of Gustafason's
which is only a prairie trail and requires some work Mr s/
Paquette is to check this road

Mr Poole adased Mr Paquette he had received a complaint
about the road between Sections 5 and 6 and sections 7 and 8
(East of George Melenchuk) It requires some work and
possibly a culvert
Mr Paquette stated the road had been fixed by the
motor grader operator about a month ago, and it does not
require a culvert at this time
Mr Ferguson mentioned the creek crossing at the Carney location
and that the Nakaska road requires some ditch work yet
This should be done and the area seeded to grass
He also mentioned the paving on the Orkney Road
Mr Litz reported that Division 6 requires gravel
Also he has a problem with R W Vickery Apparently a slough
on the Vickery land was ditched some years ago to assist
with drainage of the area; and the ditch now requires cleaning
out Mr Vickery feels the M D should do this. Discussion
followed Mr Litz felt perhaps the M D should clean the
ditch once more on the understanding that they would then
have no more responsibility for the ditch Mr Paquette
stated this clean out would require a lot of work and the
drainage is not now required for the road as the road has been
built up It was agreed that the road committee look at
this and report to the next Council meeting
The road committee arranged a road tour Thursday., September 30th
at 9.00 A M
The meeting discussed briefly the need for paving the 2 miles of
road to the Wimborne Gas Plant
Mr Campbell reported the power poles on the Trochu West Road
have been moved and the mounds of dirt are still there Mr
Roy Enzie asked if he could remove the dirt Council agreed
this would be satisfactory providing Mr Art Knieval had no
objections
Mr Campbell reported he had a complaint from a Mrs McGuire of
Edmonton Apparently while the South Huxley Road was being /
oiled she travelled over it and her car was covered with oil J/
Mr Campbell advised h(.r to put in a claim with the office
for referral to the insurance company
