A regular meeting of the Municipal District of Kneehill #48 Council
was held in the Municipal Office, Three Hills; Alberta, on Monday
August 23rd, 1976 commencing at 9 00 A M

Mr G G King, Secretary - Treasurer was present and recorded the
minutes for the major part of the meeting and Mr John Jeffery
Assistant Secretary - Treasurer was also present and recorded
a portion of the minutes.
APPROVAL
Mr Bauernoved approval of the minutes of the meeting of MINUTES
August 9th.1976, as circulated

Four applications had been received for the position APPLICATIONS
of assessor.. namely -- Peter Spilchen, Albert W Buckland, FOR ASSESSOR
Ed. Woof and Anthony Cheung The firstthree named had been
interviewed by a committee of R W Brown, C W Poole.; L Litz
and G G King last Thursday afternoon, and this committee
recommended hiring Peter Spilchen The fourth applicant had
not been interviewed as he had just come into the country from
Hong Kong, and his letter showed that he did not have qualifications
Mr Spilchen was recommended as he had the most experience, in
the combined work, for farm land, residential or hamlet work
and oil field work
Salary to be $16,000 00

Mr Campbell reported that a pump with battery operated motor
had been used -- two successive days to pump water at the TOLMAN
Tolman Park and considerable silt had been pumped out WELL
Water appears fairly clear now A further test is to be made
by the Drumheller Health Unit Mr. Campbell further advised
there is approximately 60 feet of pipe in that well Mr Poole
moved that this report be accepted

Mr J. Jeffery and Mr G King reported on two breaks in GRANTVILLE
connection with the water line from the south side of the roadWATER LINE
at Grantville to the north side One break was on either side BREAKS
of the paved road. These were fixed at the end of last week
Oris Rodger spent about 12 days there with his machine, and the
Town of Three Hills had given help Mr Campbell moved
that this report be accepted

Circular regarding Local Initative Program was referred
to briefly Mr Brown moved that this be filed L I P

No- ice was read in regard to a meeting of Rural RURAL
Municipal Administrators to be held at Sedgewick on AD
October 8th,1976 Mr Ferguson moved that Mr
John Jeffery and Mr G King be authorized to attend MEETING
if they can so arrange

Minutes of the meeting of the Three Hills School
Division of August llth'1976 were referred to briefly
and Mr R. W. Brown gave a further report of special notes
he had made while in attendance at that meeting He made
two suggestions for our future meetings here
1 That he sign the minutes of previous meeting as soon
as they are approved
2 That hot water and instant coffee etc be available
in the Council Room in the forenoon of the meeting days
Mr Bauer moved acceptance of the minutes of the meeting
and the report of Mr Brown

It was suggested that any programs received at our office
in respect to possible improvements at hamlets should be
sent to some representative in each of the hamlets for
consideration Mr G King ited he would endeavour to
follow this idea.
Brief reference was made to courses which are being organized
by the Department of Extension for councillors, office staff
and others Mr Brown and Mr. G King have been authorized
to attend a course on Sources of Finances for Municipalities
to be held at Jasper Park Lodge on October 19th to 21st, 1976
Council will be kept advised of details regarding other
programs Mr Berdahl moved that this be accepted and
filed as information

Mr John Jeffery, Assistant Secretary - Treasurer, reported that J FREDERICK
the garnishee for an amount slightly in excess of $2800.00
has been received by the Municipal District in respect to employee
Joe Fredericks. Mr Poole moved that this be accepted and
payments made each month, less the appropriate allowance
for living expenses etc

Mr Campbell moved that no c nsus be taken of the Municipality NO CENSUS
as we agree to abide by the federal census figures as of June 1st

Circulars from AAMD & C were read and dealt with as follows AAMD & C
CIRCULARS
1 Resolutions to Fall Convention - Previous resolution regarding
recreation grants is to be submitted again, and we are to ask
the Town of Three Hills to submit a similar one to the Urban
Association Other previous resolutions of this M D are to be
reviewed
2 Delegates to the Fall Convention -- Mr Poole moved that
all Councillors be named as delegates with Mr G King as
alternate and that John Jeffery and Ted Paquette and G King
also be auth,, --zed to attend the convention

Mr Brown moved that the Secretary Treasurer arrange
reservations for all those who will be attending the
Fall Convention, with reservations to be at the Macdonald
Hotel in Edmonton,

Mr Poole moved the approval of Alberta Power Ltd , POWER
extension to serve a residence in NW 27- 29 -24 -4 as EXTENSION
per plan submitted (R Koehn)

Mr. Brown moved approval for A G T to put
telephone cable at locations near Linden in 30 -25 -4 ti A G T
as per plan submitted CABLE

Mr G King reported that he had finally been able
to locate Ted Chalk, in Edmonton, and had telephoned TED CHALK
him in regard to the clean up of the old Sunnyslope Store SUNNYSLOPE
property Mr Chalk had stated he had no interest at LOTS
all in the buildings and the costs should not be charged
to the property He has no objection to the M D making
other arrangements for the clean up Mr Glen Keiver
was officially rcTonsible for the clean up and he has
been contacted by telephone and also sent a letter
asking him to attend to this as soon as possible He v
may wish to hire a bulldozer to push some of the junk
into a pile to be burned under supervision of the Linden
Fire Department
Mr Bauer moved that this report be accepted and filed

Council was advised that Mr Dunbar of Swalwell had been A DUNBAR
at the office last Thursday afternoon in regard to the DEV
old trailer and old house which he has pulled onto PERMITS
certain lots in Swalwell; which are owned by Vernon Court
He had discussed this matter with R W Brown, C W Poole
and L Litz and G King Mr G King as Development
Officer had refused the development permits as Mr Dunbar
did not own the property and the buildings were below
standard He has the right of appeal within two weeks
Some discussion took place regarding enforcing provisions
but no decision was reached
Mr John Jordan of C R P C met with Council at 11 15 A M
and the following planning matters were dealt with
1 Proposed subdivision in Lot 1, Block 4., Grantville C R P C
- Don Lammle - Mr Jordan said it appeared to meet all SUBDIV
regulations Mr Bauer moved that this subdivision be
recommended for approval, subject to taxes being paid.

2 Proposed subdivision by Jerry Berreth in SW 18- 28 -24 -4
This would create a subdivision of slightly over 30 acres
of land, lying west of a coulee which runs through that
land and would include the old building site Mr Poole {/
moved that Council recommend approval subject to reserve
being by cash in full at a recommended rate of $500 00
per acre, with taxes to be paid

This will include the building site Mr Campbell moved
that this be recommended in principle with no objection
to a slight variation from the size of 1 5 acres, that

crossings at the owner's expense, with full cash in lieu
at $500 00 per acre, and with taxes to be paid

4 By -law Number 789 and Resolutions 1 and 2 of
this Municipal District as previously passed were
referred to briefly Mr G King also read to
Council a letter he proposed to send to the Provincial
Planning Board in support of these items
Mr Berdahl moved that these be approved

5 Mr G King advised that Mr Tilzey appeared to
have ejected a barn in the North East portion of Grantville
without any authority
It appears that he proposes to kept at least one cow
there but details are lacking as Mr and Mrs Tilzey
have been on holidays Mr Ferguson moved that
this report be and that Mr. G. King check
further in regard to this matter

Mr Poole moved that Council approve the extension of
Alberta Power Ltd., services to serve Mr. R Elliott in ✓ ALTA
SW 32- 30 -24 -4, as per plan submitted POWER

Mr G. King advised that Mr and Mrs H Siemens had SIEMENS
requested permission to locate three or four metal GRAIN
grain bins to the west of their quonset in Nort'i West BINS
23- 29 -22 -4 The bins will be 100 feet or slightly over NEAR
that from the center of the north south road They ROAD
had also agreed to move or tear down the old wooden bins
which are closer to the road Mr Berdahl reported
that he had met with Mr and Mrs Siemens at the site
and had discussed this with them. The road is light traffic.
Mr Berdahl moved that this be approved, subject to
Mr and Mrs Siemens agreeing to move the bins if required
by road improvement or if they cause a snow problem on
the road. Carried
Mr Litz moved that Council approve of the building permits BUILDING
as issued for the following PERMITS
1 Don Williams - Small Addition to his dwelling in Wimborne
2 Eldon Toews - Hog Barn in NE 14- 30 -25 -4

Mr G King advised that a building permit will be issued DEV
to Bumper Development for a gas processing plant in PERMIT
LSD 6 of 3- 29 -23 -4 unless some objection is received ,/ GAS
by August 26th.,1976 This was given as information PLANT
Council was advised that Alberta Gas Trunk Line had METER
inquired about the required set backs for a meter STATION
station likely to be located in NW 34- 28 -23 -4 This SET BACKS
;_c not an opened road at present, but Council members V NW 34-28 -
stated it may be developed later Mr Poole moved 23 -4
that the requirements stay with the regular policy
requiring 125 foot set back from the center of the road

Mr Campbell moved first reading to by -law number 805 BY -LAW
this being a by -law under the Tax Recovery Act NO 805
to buy Lot 18, Block 3, Plan Huxley in the name
of the Municipal District for a price of $50 00 V/ Lot 18
as the site of the hamlet well BLK 3

It was noted that the above by -law was required to
get title for the lot with the well and to enable
Council to proceed with transfer of Lot 19 Block 3
to the owners of Lots 20 to 22, Block 3 as per
previous arrangements
Mr G King asked Council if they wished to sell
or otherwise dispose of the 4.25 acres which is under
Tax Recovery in the north east corner of the North West ACREAGE
of 14- 33 -23 -4 - near the Trochu Mine Site NW 14-
Mr Berdahl moved that this be tabled and the location 33 23 -4
inspected by Council when convenient, with this
perhaps being on road tour

Mr Ted Paquette, Public Works Superintendent, and Mr v'
Joe Dobler, Gravel Foreman , met with Council
Mr Doug Hazelton of Linden Contractors then also met ✓'
with Council.
Mr Hazelton stated he would like to crush gravel for

us in approximately two to three weeks, if possible

Brief discussion followed on the locations of some

crushing required Lowen - possibly very little gravel

Fraser - no gravel at all Lowen Estate - no agreement as
yet Megli - stripping is required
Mr Hazelton stated that there is some gravel available
under water in the Megli Pit Floor He further stated
that it runs in pockets He felt that probably 20
to 25 000 cubic yards could be crushed before any stripping
is required at Megli's He further stated that he would
be at McNair's pit in the very near future, and he offered
to crush our gravel at $1 15 per cubic yard if he
got the job, and if he did not sell out before Mr
Hazelton then left the meeting Mr Campbell moved
that Linden Contractors be hired to crush approximately
60,000 yards of gravel at $1 15 per cubic yard
20;000 plus at Megli's , 30;000 plus at Torrington and
10,000 at the Beiseker Pit CARRIED
The plus signs on the above mainly at Torrington are
the amounts of pit run available to be crushed until
stripping is required
Mr G King was asked to check regarding progress being
made in plans for the improvement of the underpass under CNR
the C.N.R Line at South of 18- 31 -23 -4 UNDERPASS
The locations where new bridges or government culverts are

needed for 1977 and later years was then discussed 1977

Mr Bauer moved that the committee of Mr Berdahl, and Mr G King
be authorized to complete an agreement with Mr Vm rheilig
in regard to the right of way for the road along the South
of Section 33- 28 -20 -4

Mr R Campbell and Mr G King reported on their
discussions recently with George Stankievech and
Louis Sich in regard to the old road diversion in
Section 35 -32 -22 4 and also regarding the survey
for the road across the south side of the said
section 35 Mr George Stankievech agreed to
provide the land for the road along the south side
of the said Section on the following conditions
in brief
1 That the old diversion on the north side of the
SE 35- 32 -22 -4 be cancelled and returned to his quarter
Or
that he be paid for the four acres on the south side
at current rates
2 That he be paid $300 00 as full compensation for
fencing
Mr Louis Sich had stated he had no objections to the
cancellation of the old road plan on condition that
the portion lying in the NE of 35- 32 -22 -4 be transferred
back to that quarter
Council voiced no objections to these general arrangements.
Mr Poole moved first reading to by -law number 804, this
being a by -law to cancel road diversion plan number 6359 BM
in NE and SE 35- 32 -22 -4

Circular from AAMD & C advised that there has been
a slight reduction in the prices of spiral culverts CULVERT
bought through Armco, Twister Pipe or Westeel PRICE
Mr Campbell moved that this information be accepted REDUCTION

Letter from Myrtle A Biggs was read requesting
cancellation of the unused road diversion in Section M BIGGS
29- 27 -20 -4 Mr Berdahl moved first reading REQUEST

Mr Litz moved that Mr A. W Bauer investigate this

Copy of a letter from Alberta Transportation to Wilfred
Evans stated that the costs of painting bridge railing
etc.,, is the responsibility of the local municipal district
However the Bridge Branch agreed to supply the paint
for the Evans Bridge if he wishes to donate the labour

Letter from Mrs A Schlichenmayer was read again
requesting payment for a fence moved about 1972
This had twice been refused by Council once in January
of 1974, and again recently Her reasons were reviewed
with Council and received further consideration
Mr S C Schmelke, former Councillor, had been asked
about this by some of the Councillors privately, and
had stated in his opinion no payment was due
Mr Ferguson moved that a reply be sent; stating that
Council regrets the position,; but does not authorize
payment

reported briefly regarding the following
1 Drumheller R C M P still investigating regarding
the caterpillar tractor owned by the M D of Kneehill, which
was started, and run a short distance at the 1st of August,
1976, when parked near the Orkney Hill

2 Mrs. Francis Reed through Bob Delgaty had inquired
regarding improvements to her driveway in SE 16- 31 -22 -4
This would be private work that might be done by a motor grader

3 Leduc Construction have been doing considerable
pipeline work in the general Three Hills area, and have LEDUC
not always adhered to our regulations Simons-- McBean CONST.
co Ltd 4 and Leduc Construction have agreed that the PIPELINE
roads and crossings will be jointly inspected when the WORK
pipeline project nears completion
4 Councillor Tom Ferguson had authorized John Dorn
to use part of the main crew to cut down a knoll to IMPROVE
improve vision south of Section 1- 31 -22 - -4 Then Lewis VISION
Malaka had asked for improvements on the road going ✓ Sec 1
south towards his place Mr Dorn investigated and 31 -22 -4
said the ditch was too wet to do any work now but some
work might be done with the motor grader later
Mr Litz moved that the local Councillor take notes of
the items affecting things in his division and that the
reports be accepted

Council was advised that certain warranties are still WARRANTY
under dispute with R Angus Ltd They have allowed 50% DISPUTE
only on a truck motor and there are other items including
one trip out here for $140 10, which perhaps should not
be charged Mr Ted Dunlop had agreed that he and another
representative of the company will meet Council for
discussion Mr Bauer moved that this information be
accepted

Letter from Alberta Transportation was read in regard
to the road from Number 21 Highway cast to the Buffalo ROAD
Jump Park In brief it stated the road was under municipal TO BUFFALO
jurisdication and we should endeavour to keep it in JUMP

would endeavour to maintain this as an oiled road, but could V
not do heavy surfacing for at least five years

The report of the Foremen's Committee Meeting held August
19th,1976 was read and reviewed Motions were made in regard FOREMEN

1 Mr Bauer moved that Frank Gerli.tz be advised that he MINUTES
cannot be granted leave of absence; but he may re -apply for
work next spring, if he wishes
His resignation is accepted

2 Mr Ferguson moved that the offer from the County of SALE
Camrose of $2200 00 for the contourmatic boom and Berg truck OF BOOM
deck be accepted, and the units authorized sold 6 TRUCK

Trentham in a special catagory as operator of the oil JOHN
distributor from the time the paving work starts until TRENTHAM

1 Mr Poole reported that road improvement is needed on ETC
the east of 6 and 7 in 31 -24 -4
2 Mr Litz reported that the signs at Richard Maerz
break up should be moved back farther, to gi\e traffic
a chance to slow down
3. Mr Brown reported that the sanitary land fill
should be off the ground after the Wednesday night meeting,
and will probably need a cat for one day per week from then
on to cover the pit site Mr Brown asked if the cat could
be placed full time on nuisance grounds to finish off the
old nuisance grounds and to fill in the new sanitary land
fill site once a week
Mr Poole moved that the old crawler work on the nuisance
grounds when the operation starts full time

4 Mr Ferguson reported that there is atnle in the
pavement by Art Maerz' house
Mr G King read the Save Harmless Agreement from the
Town of Trochu Brief discussion followed and council
felt that Trochu should be responsible for the project
for a limitless time period, regarding cave in of the
site; etc Mr Poole moved to accept the save harmelms
agreement asb3ect to a continuing agreement for
various liabilities

Mr Campbell reported that there are no signs on the
road at present where the sewer line crossed the road
Mr Berdahl moved that we notify the Town of Trochu by
letter that no signs have been placed to date

Mr King read a letter from Mr Powell of Grantville
regarding the lilacs on the road going east and west
which Mr Powell stated are obstructing vision and
should be cut back Brief discussion followed
It was explained that the lilacs were on private property
and several in the room had driven past there and felt
that no obstruction was evident Mr Poole moved to
file this letter

Mr Paquette reported that the main crew is now working
at Sich's on the Greenleaf Road He stated that a half
mile further west of where they are now working the road
is impassable in the spring. Mr Paquette asked if he
could fix up approximately % mile while the main crew is

Mr Paquette reported that the truck number 18
is in very poor shape, and that the rolled truck
may be ready by noon August 24th
After discussion Council agreed to fix up the T18
unit to at least a safety factor and to run the unit
until it quits
Mr Dobler reported that a motor went out of one
of the gravel trucks last Friday, and the mileage
is approximately 14.000
Brief discussion followed Mr Ferguson moved that
R Angus Ltd be contacted to meet with Council at the
next meeting at 1 30 P M

that Mr .,suer tell Mr Schmautz to put either pit run
of gravel on the road to tix it, with no consideration

to Mr Taylor and ask if we could make our submissions
to the cabinet ministers in Drumheller in the evening

road committee to look at at their earliest convenience
