A regular meeting of the Municipal District of Kneehill #48
was held in the Municipal Office, Three Hills, on Monday,
August 9th,1976, commencing at 9 00 A M
Councillors present for this meeting were- PRESENT

Division 2 Clifford W Poole
Division 3 Ralph W Brown (Reeve)
Division 4 Art W Bauer
Division 5 T A Ferguson
Division 6 Leonard Litz
Division 7 Reginald Campbell
Mr G G King, Secretary- Treasurer was present and recorded the
minutes
Mr John Jeffery, Assistant Secretary - Treasurer also was "
present for the greater portion of the meeting
Mr Walter Anderson of the Three Hills School Division was
present for the greater part of the afternoon portion of the
meeting
Mr Bauer moved approval of the minutes of the combined APPROVAL
meeting with the Agricultural Service Board and of Council MINUTES
held on July 26th,1976 as per cgnes circulated v

The financial statement for the month ending July 31st, FINANCIAL
1976 was presented and discussed This showed a net STATEMENT
balance at the end of the mont'z of $12,102 75, but with JULY, 1976
$282,000 00 owing on loans
Mr Poole moved acceptance of the financial statement
Carried
'?eport from the Drumheller Health Unit was read in regard
to the water at the Tolman Park The tests showed a very WELL
PARK

definite improvement, and Council was advised that one WELL
further test has been made and a report should be received TESTS ETC
soon The matter is not considered very serious now that
a new base has been put in Mr Litz maed acceptance of the
report

Letter of July 26th,1976 from Premier Lougheed thanked CABINET
Council members who had met with the cabinet when they TOUR
were on tour through the area this summer Mr Poole moved
that this be accepted and filed

Mr R W Brown reported that he had attended the official COUNTY
opening of the new office for the County of Lethbridge in LETHBRIDGE
Lethbridge on July 30th, 1976 It is a two storey building OFFICIAL
the upper part rented to the OLDMAN River Planning Commission OPEl ?-ING
The building, cost about $982,000 00 and the land $92,000 00
The old site and building had been sold for $135,000 00 V
The Honourable Dick Johnston Alberta Municipal Affairs, and
Mr William Isbister, Deputy Minister, had both been in
attendance Mr Berdahl moved acceptance of the report

Circulars from AAMD & C were read and dealt with as follows. CIRCULARS
7_ Mr Poole moved that this Council recommend a change in AAMD 6 C
the Municipal Government Act, to permit a municipality to
pass a by -law prohibiting cables lines or poles closer
than 101 feet from the center of any road within the municipality,
with the clear understanding that this be kept optional for
each municipality Carried 2

Mr Ferguson moved that Council recommend a $1000 00
minimum tax for the drilling of any well, with the
additional rates to be as per the schedule sent, and
with reasons to be given, including the fact that
any rig moving in or out does considerable road damage
at most seasons of the year

3 Information re salary schedule is to be supplied
from the office
4 Mr Campbell moved that the information regarding
life insurance coverage for volunteer firemen be sent
to each of the rural fire departments with inquiry to
ask if they are interested

It was noted that if they wish to participate, all must
take part, and the volunteers must be registered
3 This was actually discussed later in the meeting, but
recorded here for convenience The requirements for
voting in a municipal election and in a school election
are different Mr Poole moved that the government
be requested to amend the School Election Act to make
the requirement for voting the same as in the Municipal
Election Act Carried
Mr Walter Anderson stated that he would refer this
matter to a later school division meeting for discussion

Mr Carl Nemeth of Calgary Regional Planning Commission PLANNING
met with Council He brought with him a letter dated July ITEMS
29th,1976, from Director, A R Smith of C R P C, which
outlines the Director's opinions regarding the proposed
resolutions numbered one and two of this municipal district
following by -law number 789 This letter was read and
considerable discussion followed It was especially noted
that the Director advised that Council's proposal for a
density factor of two and a minimum parcel size of 2 acres
is contrary to the present preliminary regional plan and
he therefore suggested a change to a density factor of 4
and a minimum parcel size of 40 acres Mr Nemeth advised
that a East Central Preliminary Regional Plan had been ✓
started last October, but the committee to deal with it has
not even been named to date and no meetings have been held
It therefore appears that it will be a long time before this
gets off the ground, and in the meantime Council is tied to
the existing preliminary regional plan which has been in
effect since about 1971
Council also discussed tabling everything to do with further
planning resolutions, etc , for the time being, pending the
decision about ]oini.ng with the Palliser Regional Planning
Commission with headquarters to be at Hanna Mr Nemeth forecast
it would take that new commission at least two years to get a
preliminary regional plan, but he did not elaborate on what
controls there would be in the meantime _ 3

be now passed as had been discussed by Council on
July 12th,1976, with amendments then made, and with
the hamlet maps attached

and a copy was given to each of Councillors Brown, Bauer
and Poole, and others were advised that they may obtain

DEVIFLOPMENT CONTROL RESOLUTION NO ONE
Being a Resolution to establish a Land Use
Classification Guide for the Municipal Dis-
trict of Kneehill
■
This document is for delegation purposes only and is not binding on
the Council It may be withdrawn replaced or repealed at any time under the
procedure prescribed in Section 8 O 1 of Development Control Bylaw No 789
WHERFAS T'e Council of the Municipal District of Kneehill (hereinafter
called the Council) has duly passed Development Control Bylaw
No 789 and
WHEREAS The Planning Act 1P70 as amended, provides that pursuant to a
Development Control Bylaw a Council may by Resolution adopt a
Land Use Classification Cuide,
NOVI THEREFORF The Council hereby resolves as follows
SECTION 1 TITLE
1 O This Resolution shall be known as Development Control Resolu-
tion Ho One and may be referred to as the "Land Use Classifi-
cation Guide'
SECTION 2 DENSITY AP!D LAND USE TABLES_
2 0 1 The Municipality shall be divided into the following
Density Districts
(i) Low Density District
(ii) High Density District
2 0 2 Each Density District shall be further divided into one
or more Land Use Areas as set out below
2.1.0 Low Density District Table

2.2 1 When an area of land is designated Low Density, the lands
therein may be classified'into one or more Lanes Ilse

2 2 2 When land is reclassified from one Low Density Land Use
Area to another, the unit area for reclassification shall
be a quarter section of land, provided that in particular
cases the location of highway, railway or major watercourse or
the occurrence of a fractional quarter section or a High
Density Area may be deemed as cause for relaxing this
requirement to the effect that the unit area may be
adjusted appropriately
2 2 3 When a quarter section is re- classified from one Low
Density Land I.se Area to another Low Density Land Use
Area it shall be listed and described in the Table in
Section 2 1 1, and the Land Use Classification Guide
shall be amended accordingly

2 4 1 When an area of land is designated High Density, the
lands therein may be classified into one or more Land

2 4 2 When a subdivision containing existing urban sized lots
is designated as a Nigh Density District, the area so
designated shall coincide with the boundaries of the
registered subdivision until such time as a need for
expansion of the District has been established
2 4 3 When an area of land is designated High Density District
for the purpose of accommodating an existing or proposed
Highway Commercial use, the siting, location and design
of the parcel shall comply with the provisions of Reso-
lution No 2 and with the Subdivision and Transfer Regu-
lations
2 4 4 When an existing subdivision is designated High Density
District for Resort Cottage Residential purposes, the
area so designated shall be limited to the existing
subdivision until such time as a need for further expan-
sion of the district has been established, and parcel
sizes shall correspond with those set out in the Sub -
division and Transfer Regulations

3 1.0 Low Density District
3 1 1 Excepting as may otherwise be set out in this resolution,
all of the lands in the Municipality are designated as
Low Density District
3 2 0 Land Use Areas in the Low Density District
3.2.1 All of the lands contained in the Low Density District
are classified as Agricultural Holding Area excepting
as listed in the followipg table.

inafter called the Council) has passed Development Control Bylaw
No 785, and
1,.HFREAS The Planning Act, 1070 as amended provides that pursuant to a
Development Control Rylaw, a Council may by resolution make
rules respecting the use land,

SECTION i TITLE
1 1 This resolution shall be known as Resolution No Two and may be

2 1 1 A person shall not use a building or land for a purpose
not permitted or otherwise allowed by any Development
Control Resolution

2 " 1 No permit stall be. issued for any development on a site,
the area or width of which is less than the minimum area
or k -idth prescribed for the proposed development in the
district on which the site is located, except that a lot
of separate record in the Land Titles Office containing
less than the required minimum area or width may be used
subject to the discretion of the Development Officer if
all other requirements of the Development Control Bylaw
and resolutions thereto are observed
2 3 COVERAGE OF SITE
2 3 1 The area of a site whichrmay be covered with either a
principal building or accessory buildings, or both, shall
not exceed the limits prescribed fcr the Land Use Area in
which the site is located
FRONT, SIDE A14D REAR YARD SFTRACKS
2 4 1 On each site there shall be established and maintained
front side and rear yards of such dimensions as are pre-
scribed for the Land Use Area in which the site is located

2 4 4 The minimum distances required for yards do not apply to
construction wholly beneath the surface of the ground
2 5 HEIfHT OF BUILDINGS
2 5 1 No building shall be erected to a greater height than
the maximum height prescribed for buildings in the Land
Use Area in which it is proposed to be located
2 E UTILITIES
2 6 1 The erection of a building on any site where it would
otherwise be permitted under this Bylaw is prohibited
when, in the opinion of the Development Officer, satis-
factory arrangements have not been made by the developer
for the supply to the building of water, electric power,
sewerage and street access or any of them, including
payment of the costs of installing or constructing any
such utility or facility by the developer
2 6 2 When any services or facilities are required pursuant to
Section 2 6 1, a person shall not begin the excavation
for the foundation nor commence the development until he
has made provision for such services or facilities to the
satisfaction of the Development Officer
? C 3 No development permit shall be issued for a development to
be served by private sewer and water systems until the
site plans have been approved by the Department of the
Environment and the Drumheller Health Unit,
2 7 ACCESSORY BUILD114GS
2 7 1 Any accessory buildinq shall be located at least 5 feet
from any principal building
2 7 2 For the purpose of calculating yard and site
requirements, when an accessory building is to be attached
to the principal building, it shall be deemed to be part
of the principal building
2 R LAND NEAR WATER OR SUBJECT TO FLOODING OR SUBSIDENCE
2 8 1 Development on land that is subject to flooding or subsi-
dence or that is marshy or unstable shall be discouraged,
but when such development'is allowed, the developer shall
by agreement idemnify the Municipality from any damage or
or loss of the development caused by flooding, subsidence,
or other natural cause
2.P.2 Where a building or a structure is approved adjacent to a
watercourse no part of such building or such structure
shall be sited less than 125 feet from the said watercourse

2 9 SHELTER BELTS
2 9 1 All trees, hedges or shrubs forming a farm shelter belt
shall be located not closer than
(a) from the centreline of a municipal road right -of -way

(b) from the nearest limit of a primary highway or second-

2 10 RESIDENTIAL BUILDINGS ON THE SAME SITE
2 10 1 No persons may erect a residential building on a site on
which another residential building is already located
unless the site is used exclusively for agriculture and
the additional dwelling is required to accommodate the
additional agricultural help to be employed directly in
connection with the site
2 11 MOBILE HOMES
2 11 1 Double -wide and single -wide mobile homes which have been
approved by the Canadian Standards Association may be
permitted in a Land Use Area where a dwelling is a per-
missible use, subject to the home being placed on a
foundation and compliance with the minimum
floor area requirements for a dwelling in that Land Use
Area
2 11 2 Single wide mobile homes may be permitted for temporary
periods riot exceeding
(i) a twelve month period where it is to be used solely
for farm help purposes and
(it) a six month period where it is to be used as a
temporary dwelling wI^ile a principal building on
the property is actually under construction,
and where a person proposes to extend the temporary
period beyond the time set out in the permit, he shall
not later than sixty days prior to the day on which the
permit will cease to be in effect make written application
to the Development Officer for renewal of the permit setting
forth the reasons therefore
2 12 HOME OCCUPATIONS
2 12 1 A home occupation shall comply with the following special
provisions r
(a) There shall be no exterior display or advertisements,
(b) There shall be no outside storage of materials, com-
modities or finished products,
(c) No commodity other than the product or service of the
home occupation shall be sold on the premises,
(d) A home occupation shall not include any use or oper-
ation which will cause or permit to be created a
nuisance by way of dust, noise, smell, smoke or
traffic generation
(e) The Development Officer may allow the employment
of one person in addition to the residents of the
dwelling
2 12 2 Home occupations are limited to those which are approved
by the Development Officer for the dwelling where they
are carried on
2.12.3 The Development Officer may issue a temporary permit for
home occupation

2 13 SIGN CONTROL
2 13 1 In considering development applications for signs, the
Development Officer shall consider the design and size
of the proposed sign having regard to the purpose and
intent of the lard use area in which the proposed sign
is to he located
2 13 2 All signs shall comply with the front yard setback
requirement for principal buildings in the land use area
in which the proposed sign is to be located

SECTION i' INTERPRETATION
In the Development Control Resolutions adopted pursuant to Development Control
By -law No 789 unless the context otherwise requires, the interpretation
set out in the following subsections shall be used
(1) "accessory building" means
(a) A building which is separate from the principal building on the
site on which both are located and which the Development Officer
decides is normally subordinate and incidental in use to that of
the principal buildinq, or
(b) A building, the use of which the Development Officer decides is
normally ircidental and subordinate to the principal use of the site
on which it is located,
(�) "accessory use" means a use of a building or a site which the Develop-
ment Pfficer decides is normally ircidental and subordinate to the
principal use of the building or the site,
(3) "buffer" means a row of trees, shrubs or berm planted or constructed
to provide visual screening and separation between sites or districts,
(1+) "building area" means the greatest horizontal area of a building above
grade within the outside surface of exterior walls, or within the out-
side surface of exterior walls and the centreline of fire walls
(5) ''country recreational centre" means a recreational development conducted
on a unified basis on a single site where the prime reason for location
in rural areas is to take advantage of natural physical features, including
the availability of large areas of land to provide day to day sporting
and athletic facilities and the structures incidental and includes ;I.t
.lines, qo'f course., nrcha_ry, trip and rifle ranges, race tracks, 6o,-tir,c

and containing two side by side dwelling units
(8) 'dwelling, single - family" means a building which contains only one
dwelling unit and, except as otherwise allo,,,,J by these Fesolutions is
used for no other purpose -
(9) "dwelling unit" means a set or a suite of rooms used as a residence for
one family or the housekeeping equivalent thereof, whether or not
cooking or bathroom or toilet facilities are contained therein,
(10) 'extensive agricultural pursuits" means systems of tillage and animal
husbandry through which one may qain livelihood from large areas of
land by the raising of crops or the rearing of livestock either separa-
tely or in conjunction with one another in unified operations and includes
buildings and other structures incidental to the operation,
(11) 'fence" means a vertical physical barrier constructed out of typical
building materials to prevent visual or unauthorized access or both

(12) "home occupation" means a use of a building or site which is normally
incidental and subordinate to the principal use of the building or the
site and meets the special requirements of these Resolutions, where
allowed,
(13) "hotel" means a building used primarily for a sleeping accommodation ,nd
ancillary services provided in rooms or suites or rooms which ay contain
bar /kitchen facilities The building may also contain ccFFcrciil or
other uses and may or may not offer such additional services is p-irking
facilities restaurant or dining room., room service or public convt_ntion
facilities,
(14) "intensive agricultural pursuits" mean systems of tillage and animal
husbandry through which one may gain livelihood from proportionately
small areas of land by the concentrated raising of crops or the
concentrated rearing or keeping of livestock and poultry or their

(15) 'mobile home" means a compact and transportable detached single - family
dielling which is designed for domestic use and which can be transported

(27) "site” means a parcel or parcels of land used for or proposed to
be used for any development,
(28) "site depth of" means the mean horizontal distance between the
front and rear boundaries of the site,
(29) "site plan" means a plan drawn to scale showing the boundaries of
the site, the location of all existing and proposed buildings
upon that site, and the use or the intended use of the portions
of the site on which no buildings are situated, and showing fencing,
screening, grassed areas and the location and species of all
existing and proposed shrubs and trees within the development,
(30) "site, width of" means the mean horizontal distance between the
side boundaries of a site
(31) 'yard" means an open space (other than a court) on a site unoccupied
and unobstructed from the ground upward except as otherwise provided
by this Bylaw,
(32) "yard, front" means the yard which extends in width between the side
boundaries of a site and in depth from the front boundary of the site
to the principal building thereon;
(33) "yard, rear" means the yard which extends between the rear boundary
of a site and a building on the site,
(34) "yard, side" means a yard which extends between the side boundary
of a site and the side of a building on the site

Letter of July 28th, 1976, from Alberta Environment, together
with agreement for reclamation of garbage dumps was
referred to briefly Mr Poole moved that this be tabled
until the next council meeting, so that there will be
a report from the further Sanitary Land Fill Committee
Meeting to be held this coming Wednesday

Mr. Poole stated that he hoped that the Swalwell
nuisance grounds could be one of the first to be
reclaimed, and he asked about the present fencing
It appeared that Council agreed that the Municipal
District owns the fence on three sides of the existing
Swalwell nuisance grounds
Council was advised that Mr John Watt had reported
there are scraps of metal and dunk, etc , at the
stock pile area in north east 36 -30 -22 4 Because
of this stuff, he is not able to do the mowing in
that area. Mr. Poole moved that Mr Paquette and /or
Mr Dobler arrange for a clean up of that location

Mr Campbell reported that some old stock pile sites
at the Elvin location have not been tidied up It was
noted that the old frame works and scrap materials.,
mostly were Elvin °s and not the responsibility of
the M.D.
Mr Poole moved that the borrow pit agreement and crop
damage agreements, etc , be approved as presented at
this meeting, and that payment be made when the projects
are completed

Request of Albert Schlidenmayer and account dated
August, 19763 was read to Council, being for $7.50 00
for moving a fence, west SW 7- 33 -25 -4 in 1972
Mr G. King read to Council a copy of a letter
of January 14th,1974, which had been sent to Mr
Schlichenmayer, refusing the account previously
submitted, as the fence had been removed considerably
prior to the start of the grading? work Mr. Ferguson
moved that no payment be authorized and that he be
sent a copy of the said letter

Account of Howard F Helton was read in the amount
of $200 00 for control of weeds on a roadway to Block
B in the NE 1- 32 -24 -4 Mr Ferguson moved that no
payment be authorized and that Mr Helton be sent a
copy of the municipal by -law which states that the
land owners are responsible for weeds to the center of
any road

Mr G King advised Council that he had been in touch
with Mr Trev Weir of Alberta Power regarding the
regulator station which they propose to locate at the
south east corner of the SW of 18-- 33 -25 -4 A Weisenburger
If possible our grading work will be done at that area
before construction starts Further details are to be

Per G King and Mr T. Paquette reported on their
discussions at our office on July 30th with Mr
Braaz regarding his fence along the west of the
Ea- half of 22- 29 -21 -4 Mr Braaz had agreed to
put his fence back on the property line, and
Ted had agreed to arrange to have some backsloping
and other minor work done with our motor grader

Wabco Number 555 MOTOR GRADERS will soon be manufactured
in Edmonton Mr Bauer moved that this information

to prepare a list and submit them to the next council

The condition of the road from Highway 21 east
to the Buffalo Jump Park was discussed This has recently
been given a heavy coat of gravel and an oil surface
treatment through the government. Reports vary., but
there are rough places and it does show signs of breaking
up at a few spots Mr Campbell moved that the government
be thanked for the work; but that they be asked to check
some four or five places which are showing signs of breaking
up or getting a washboard effect

Mr Ferguson moved that Alberta Transportation be advised HIGHWAY
that Highway Plumber 27 east gets very slippery when wet 27
and parts of it have a decided washboard surface There y, SLIPPERY
has been a number of serious vehicle accidents on that
road recently due to its condition

Mr Paquette advised that the main grading crew has
finished the project along the correction line in
Division 5 and is now at the Nakaska Hugo two miles of
road. Approximately cic miles of that is finished,
but the work has been slowed because of the rains.
Mr Dobler gave a report of gravel put on roads in
various divisions this year as follows

Every councillor present stressed the need for more gravel
following the rains Considerable discussion took place
about why roads were so short of gravel with the following
noted
1 The Manco blades `. "r in the center and therefore are
as good for blading.
2 Too much grass and dirt are brought in from the sides
this mixes with the gravel and in effect creates
a need for more.
3 A lot of the gravel flies into the ditch and is bladed
into the ditch
Mr Poole moved that a record be made of the councillors'
concern over the shortage of gravel on the roads and
that the matter of grass control by spraying be given
consideration

Council was advised that our D7 Cat tractor had been parked
near the top of the Orkney Hill the weekend of August 1st

Mr Ken Ferguson had come by there on the Saturday evening

and had found that a group of people had the tractor running

and were moving it around, dozing with it., etc He had
taken the licence number of the vehicle at the location and
had reported it to the Drumheller RCMP Mr Paquette stated
that Alex Williams had gone out for the machine on the Tuesday
morning and had seen tracks where it had been moved around,
?-•` he reported that no damage had been done to the machine

T Paquette also advised that a cable cutter was missing
Mr Bauer moved that Mr G King contact the Drumheller
RCMP for their report regarding this incident with authority
to take action if it seems advisable

the estimated amount due to him in regard to the Huxley

Mr Berdahl reported regarding the following.
1 Some trees should be trimmed at a corner of the
road near Beynon
Mr. Paquette stated that this would be looked after
later in the year
2 The Orkney Flat near the raver will need a
retaining wall
Council agreed that the District Engineer be asked
to study this matter and give a report concerning this
3 The C F R Crossing at Hesketh needs new planks
Mr. G. King to advise the C P R
4 Culvert in the approach near Dewar on the
Beveridge Lake south road had the ends crushed when
they were being installed. He suggested that the
machine operator should repair this on his own time
Mr Paquette agreed to check this
Mr. Bauerzeported regarding the following.
1 Valleyview Hutteri.an Brethren wish the road maintained
to clear the gravel, etc , from sides of the road when they
are preparing silage Mr Paquette said this could be
looked after
2 David Smithers has complained that some of the slopes from
the road grading near his farm are too steep
3 Mr Bauer and Mr Soder have looked at the location south
of B Parry Farm which had been referred to at the previous meeting
Mr. Paquette stated the dug out had been started, but not completed,
but it would hold water part time.
Mr Campbell referred to some culvert north of Gary Adam,
and Ted stated he would look after the requirements
