A regular meeting of the Council of the Municipal District of Kneehill
No 48 was held in the Municipal Office, Three Hills, on Monday,
July 12th,1976, commencing at 9.00 A M.

the minutes. APPROVAL
Mr Poole moved approval of the minutes of June 28th, 1976 MINUTES
as circulated, with one correction, namely, that the
reference to Development Control Officer, should read

FINANCIAL
The financial statement for the month of June, 1976 STATEMENT
was presented, as per copy with these minutes
This showed a net balance at the end of the month of
$8914 67, but with $150,000 00 owing on loans Mr
G King added the major items of receipts were
1 Balance of Municipal Assistance Grant - $158,473.59
2 Chemical Sales to the Valleyview Colony - $10,968.00
3 Taxes •- $61;883 79
Mr Campbell moved acceptance of the report.

Mr. Ferguson moved approval of the building permit as BUILDING
.issued to Mr C. Hodgkinson for a private garage in PERMIT
SW 34- 34 --23 -4 HODGKINSON

Mr G King reported that he had talked to Mr B Court TRAILER
of Swalwell regarding a small trailer located on lots B. COURT
east of the community center Mr. Court stated that the LOTS SWALWELL
trailer is owned by a Mr Dunbar, and Mr. Dunbar was
to check about the legality of having it there
Mr King stated that the trailer is small and old, and
not of good standard Mr Court was to advise the
trailer owner to make application for a development
permit soon
Mr Berdahl moved that this report be accepted

Council was advised that Block 7 in Swalwell is owned BLOCK 7
by the Municipal District, and is unsightly because of SWALWELL
the accumulation of stuff on it, including an old CLEAN UP
trailer box, machinery, and various other items
Mr Campbell moved that a letter be written to Mr Stan
Young at Swalwell, advising him that he is granted
60 days to remove any items which he may own from Block
7
Carried
It gas agreed without motion that the Municipal District
would clean up Block 7, after Mr Young has the opportunity
of removing any of his property

ALTA. POWER
Mr G King advised that the new Alberta Power line south LINE
of Part of Section 15- 31 -24 -4 is constructed on the road S Sec 15-
allowance, and it is therefore the responsibility of that 31 -24 -4
company to move same if and when required for road improvements.
The costs would be borne by Alberta Power Ltd
Mr Ferguson moved that this report be accepted and
the Alberta Power Company advised that in future it
must get approval for lines in advance of construction

Mr G King advised that Underwood, McLellan & Associates
on behalf of this Municipal District has made application
to Central Mortgage and Housing Corporation to find what
are available for the water and sewer system for
Ruarkville After that information is obtained, costs
and methods of repayment will be decided and a meeting of
area held.

briefly This Municipal District's share is $438 00
Mr. Poole moved that this be accepted and payment authorized

Mr Berdahl and Mr Brown reported that they had met
at our office last Friday with Dr Scace who is
making an evaluation of the benefits of the Regional
Resource Project. They had given their personal opinions
to Dr Scace, and had discussed various ideas with him
Bids for purchase of the building at the Swalwell Cemetery
were then opened, and the following noted

Howard and Gordon Paget - bid $110.00
Mr Poole moved that the bid of Howard and Gordon Paget of
$110 00 be accepted, subject to the conditions as advertised

Council was advised that a Ministerial Order from Alberta
Municipal Affairs has been issued, granting authority
to adopt the assessment roll of the year 1976 for taxation
purposes in 1977
Mr Poole moved first reading to by - -law number 802
this being a by -law to adopt the 1976 assessments for
use in 1977, subject to up- dating changes and corrections
as may be made by the assessor

Letter of June 25th,1976, from the City of Drumheller, REC GRANT
thanked Council for the 1976 recreation grant promised CITY
to that City, and stated that they will file the necessary. DRUMHELLER
financial report early in 1977 Mr Berdahl moved that
this be accepted and filed as information

COUNCIL MEETING JULY 12th,1976
Mr John Jeffery, advised Council that the cost for
installation for a pay phone at Keiver Lake Park
would be about $1300 00, and the rental rate would
be $30 00 per month The Municipal District would
recover 100 of the pay phone collections Mr Ferguson
moved that no action be taken regarding installation of
the phone as the costs are considered too high

Report of the Sanitary Land Fill Committee Meeting
held June 29th,1976, was read and discussed briefly
Council was further advised that the Town of Trochu has
not made any decision about particiption and therefore
the matter is tabled pending their reply A further
meeting will then be held.

Circular from the Energy Res+;uiL,c Conservation Board
asked if there are any objections to the construction
of a gas processing plant in LSD 15 of 35- 29 -24 -4
Mr Brown advised that he thought the proper location
should be LSD 14 of the same section Mr Poole moved
that a reply be sent stating Council has no objection
to the plant subject to a 125 feet set back from the
center of the road, but that ERCB be asked to check
regarding the proper LSD

Another circular from the Energy Resources Conservation Board
asked if there were any objections to a gas processing
plant in LSD 3 and 6 of Section 3-- 29 -23 -4
Mi Poole moved that a reply be sent stating there is no V
objection, subject to a 125 foot set back from the center
of the road

Council was advised that Mrs Kay Elliott of Swalwell SWALWELL
sent thanks for oiling of the streets She also asked OILING STREETS
if Council would pay for paint for playground swings PAINT FOR
etc , if the local people donated the labor. Mr. Ferguson PLAYGROUND
moved that Mrs K. Elliott be advised that Council expects ITEMS ETC.

Development Officer, then met with Council for a discussion BUSINESS
of matters pertaining to development control and planning
matters Mr Poole moved that Council recommend approval f
of the subdivision of Lot 2, Block 2, Plan 4617 F N in Ruarkville --
Fred May as per details received from C R P C

2 Representing the proposed private school near Linden
Mr Claude Wiebe, Mr Ralph Klassen, Mr Elmer Klassen
Mr Ron Loewen, and Mr Marvin Penner
The Linden Nursing Home plans one additional room for
storage and crafts on the west end of its building, and �
some other minor changes in the nursing home structure
After brief discussion Mr Brown advised them there should
be no problem in getting approval, but they should
apply for the required development permit
Representatives regarding the private school stated they
wished to construct same on the northerly part of the
nursing home property in Part of NE 29- 30 -25 -4
Mr Nemeth stated this could be a permitted use under
our development control by -law and resolutions
It was agreed that Mr Harold Henderson would meet them
at the Linden Nursing Home at 10 00 A M tomorrow morning
to complete the required application forms
The Linden Nursing Home is also interested in having a
mobile home on the nursing home property as a staff
residence There is now one nurses residence on that
property Mr Nemeth pointed out that more than one
dwelling per title is not allowed under Section 27 of
the Planning Act, but the M D can request relaxation
of this provision by the Provincial Planning Board
Mr. Poole moved that Council ask the Provincial Planning
Board to grant relaxation to allow the extra residence
at the Linden Nursing Home as requested

The two delegations from the Linden area then thanked
Council and left the meeting
Development Control Resolutions Number land 2 had been
redrafted by Mr C. Nemeth of C R P C , and a copy was
now given to each Councillor The copies are dated
June 30th,1976, and show the changes proposed by Mr
Nemeth for consideration by Council
Council agreed without motion that the word "may"
be changed to "shall" in resolution number 1 Sections
201 and 202
Council meeting adjourned for dinner from 12 00 Noon
until 1.00 P M
Clause 201 of Resolution 1 was then discussed at length
The original proposal was a density factor of 2 and a minimum
parcel size of 2 acres Mr Nemeth suggestion
was for density factor of 1 and a minimum parcel size
of 160 acres Under the first proposal, regulations might
have to be tightened if too many subdivisions were applied
for under the second proposal, Council would be called
upon to relax the regulations for any subdivision on good
farming land, except as otherwise provided in the regulations
Mr Brown expressed his opinion that this Municipal District
could allow the density factor of two and the minimum parcel
size of 2 acres on condition that strict regulations be made
that the developer must provide a good graded and gravelled
road to the subdivision .5

Mr Campbell moved that minutes as received from C R P C
be filed.

Correspondence from Carbon was read in regard to a lift
station for the sewer system The correspondence and
plan were somewhat contradictory in that one had the lift
station located within property in the Village of Carbon
but the correspondence referred to it as being on the
road allowance Mr Ferguson moved that a committee
of Mr. Berdahl, Mr Poole and the Road Committee try
to arrange to meet with the Village of Carbon representative
to clarify this matter

Mr C Nemeth of C R P C was thanked and he then left
the meeting
Mr Henderson asked Council to set a policy in regard
to advertising development permits which have been approved
by him Mr Brown moved that the advertising be done as
follows
By advertisement in the Three Hills Capital and /or
by letters to those owning property within one half mile
in the rural areas, or immediately ad3acent properties
in the subdivided areas

Mr H Henderson, Development Officer was thanked and
then left the meeting
Request of Mr Kostrosky for road closure and transfer
to him of a portion of road south South West 29 -29-
24-4 was considered Mr G King suggested that Council
consider closure of the road allowances to the east which
are also cut off and not used anymore, because of the
diversion to the south Mr Ferguson moved that this
be referred to the road committee for study and report.

was read in regard to reclamation of garbage dumps
and the estimated costs for so doing In brief the
estimate for cleaning up the dump, covering and revegetating
were as follows

4 Torrington Gravel Pit including the trimming up of
the pit - $4000 00
5 Linden $1100 00
Mr Ferguson moved that a reply be sent, asking that the
estimates for items 1 and 3 be doubled, that the Council
otherwise approve

Mr Campbell moved that the circular from Twister Pipe
Ltd , of Calgary regarding culverts, etc , be accepted V
and filed

Letter of June 28th,1976 from the County of Red Deer
advised they agreed to our suggestion that stop signs
be used for roads entering the paved road north of
Wimborne That County wishes to keep its speed limit
at 50 miles per hour, and asked that our M D consider
reducing our limit to agree with that
Mr Litz moved that the letter be accepted as information
but that no change be made in our Municipal speed limit

It was noted that Alberta Transportation is to get some
gravel from beds and bars from the right side of the
Red Deer River in Portions of Sections 4, 9, and 15
in 30 -21 -4. Mr Ferguson moved that a letter be sent
to Alberta Transportation to see if this Municipal t
District can arrange to get some gravel from the same
areas through them, or in some other manner

Mr Campbell moved that the Municipal District
arrange to have some testing for gravel done from
Samson's cabin to a location south of where Elvins took
gravel from the Red Deer River

South East of 17- 30 -26 -4 and asked that this be checked

and Mr John Empey for the road along the correction line
in Division 5 Mr Litz moved that these be approved

Mr G King advised that Pan Canadian has contacted the
office regarding granting permission for that company
to re -oil the road west of Section 21 and south of 28
in 28 -21 -4, being from their plant north and east
to the Horseshoe Canyon Corner This had been referred
to Mr Berdahl The company wish us to supply a motor
grader to spread the gravel, which is already on the
road Mr Berdahl stated that he had not yet been
able to contact Mr Larry Sept of Pan Canadian, but
hoped to do so Mr Brown moved that Council approve
of the proposal in principle

Mr Reg Campbell reported that the government is
now hauling gravel on the road from Number 21 east
to the Huxley Park Some parts of the road are
pounding out badly and rutting, and no repairs seem
to be made Danger areas were not well marked Mr
Paquette advised that they do now have private motor `r
graders working on that road Mr Campbell also advised
that a few loaded trucks had been using other municipal
reds but this was not deemed a serious matter

Fhe Councillors then reported several small matters PUBLIC
regarding-, public works as follows WORKS
Mr Litz reported the Allingham corner signs are in ITEMS
the ditch and should be replaced, and also there is
an infestation of thistles in the ditch north of the
Allingham Corner
Mr. Brown reported that two miles west of Linden
going south needs gravelling badly
Mr Berdahl and Mr Ferguson reported that there
is a place settling on tha Orkney Road, which needs
fixing badly
Mr Campbell mentioned that he had several complaints
concerning gravelling
The Secretary reported that he had been contacted by
Mrs Meehan and Mrs Lemay They were very dissatisfied
with gravelling in Division 7, and also felt that
Division 7 had not been getting its fair share of the
road work
Mr Dobler reported that the gravel crew would be moving
into Division 7 early this week
Mr Paquette and Mr hler reported that they propose ROAD
to start surfacing of roads this week also, so there SURFACING
will only be three or four travel trucks doing gravelling
of roads The other trucks will be with the surfacing crew
The gravel crew are finishing work In the Greenleaf area
in Division 5 today
Mr Paquette advised that the Small Crew had started SMALL
work et the Huxley Lagoon Mr Campbell stated that he CREW
had arranged for the small crew to be worki.nF at Gagyi

Road and some fences had been taken out ready for this
It was agreed that Mr Campbell, Mr Paquette and Mr
Cunningham review the schedule for the Small Crew and
arrange the work in the best manner possible
Mr Paquette reported that the siphon is now working
at the Swalwell Dam and approximately a five inch down SIPHON
stream flow of water is being released It appears

Mr Brown reported that he had talked to Ted Paquette
last Friday, and later in the morning to Harvey Jesske HOURS WORK
and John Dorn Harvey had objected to a change in his H JESSKE
work schedule which meant that he was starting work at
11.00 A M , and working until 8 00 P M each day This
deprived him of any free evenings Mr Jesske stated
that he would be willing to service during coffee breaks
and thought more suitable hours should be arranged
Mr Paquette advised that there has been some problem with t

representatives to attend the opening cermony for the LETHBRIDGE
new administration building on July 30th,1976, at NEW

Mr Poole moved that no official delegates be sent
but that any who wish to attend be certainly free

Mr Poole and Mr King reported on the meeting of the
Executive of the CAAMD & C which was held at our office
on July 8th 1976
Orders for the books of minutes in bound form were not
sufficiently high to 3ustify same, so they are going �
to explore the idea of having; the minutes typed and
copies made in a cheaper fashion
The next meeting of the executive will also be at our
office in Three Hills and will be on Thursday, September
2nd, 1976
No summer meeting of the Association will be held, but the
fall meeting will be at Three Hills on Thursday, October 7th,
at 10 00 A M
Various other items including Councillors' remuneration had
been discussed by the Executive

Letter of June 30th from St John's Ambulance advised
that certificates will be sent to those who successfully
completed the first aid course at Trochu No payments are
necessary from the M.D to Mr Olsen the instructor and
for supplies, as these are being looked after by that V/1
organization Mr Berdahl moved that this information be
accepted and filed, and a donation of $100 00 made to
St John's Ambulance Society

Report from the Drumheller Health Unit regarding the water from KEIVER
the Municipal well at Keiver Lake showed that the sample taken LAKE WATER
was perfect Mr Campbell moved that this information be accepted SAMPLE

office site in Wimborne, but hoped to do so soon This item was 'r
tabled
Mr G King advised Council there is legal access to an acreage
in Part SW 14- 29 -23 -4 - Venn - by way of an easement to the north
Mr Poole advised there is no crossing over the Kneehill Creek
in that location, so the genEral traffic has been out to the west
There is no real problem reported to the M D at this time

Mr G King briefly reported to Council regarding a black SALE
white faced heifer .impounded at the Loosmore Pound which
will be offered for sale this coming Saturday at 1 00 P M

help at the pound sale if Mr Loosmore is not able to
fully look after the duties due to his recent accident

STRAY ANIMAL
Mr G King advised that the stray animals act has been ACT
passed by the Provincial Legislature, but not proclaimed
After proclamation, the Municipal District will not
have pound keepers, nor anything to do with animals

It was agreed that the road committee meet at the Municipal
Office Monday, July 19th 1976, at 9 00 A M , and then ROAD TOUR
go- trough the District to inspect matters referred to it v JULY 19/76
Mr. Pocle advised that the Bei.seker Seed Plant has purchased LBEISEKER
approximately 3 acres of additional land. Survey costs alone SEED PLANT
are about $3000 00 REPORT

Mr Berdahl advised that the next meeting of the
Regional Resource Project will be at our office on Tuesday, REG RESOURSL
July 20th,1976 commencing at 7 30 P M He asked that all W; MEETING
Councillors attend if possible
Mr Berdahl reported that the renter of the Eest half of f FENCE
22- 29 -21 -4 ( owned by Otto Braaz) had started building a EI-2 22-29 -
fence near the shoulder of the road Mr Berdahl had asked 21 -4
him to properly locate the fence and will check further
regarding it
