PRESENT Gilbert A Berdahl, Div 1 C W Poole Div 2 • Ralph V. Brown Div 3 (Reeve) Art W Bauer Div. 4 T A Ferguson Div 5 ° L G Litz Div 6 R. G. Campbell Div 7 Mr G G King Secretary - Treasurer, was present and recorded the minutes Mr. John Jeffery Assistant Secretary- Treasurer was present throughout most of the meeting*., and submitted reports as noted � later MINUTES APPROVAL The minutes of the meeting of June 17th,1976, as circulated j were discussed Mr G King advised that the monthly financial statement for May should be corrected The transfer of $204 00 from one account to another, was shown as a receipt, but this was not correct The net balance should be reduced from that statement by $204.00. Mr Berdahl moved approval of the minutes of June 17th,1976 subject to the correction in the financial statement as noted --- DRAINAGE Mr. Brown moved that land owners in Sections 7 and 8, 31- 26- &ROJECT in and adjacent areas, be reminded that Council is not taking 31 -26 -4 any action in regard to the drainage project, until such time as we have a definite reply from the owners concerned. Carried BUILDING PERMITS Mr Litz moved that Council approve of the building permits as issued, according to item number 2 of the agenda Carried Council was advised that a registered letter had been TED CHALK SUNNYSLOPE sent on May 12th,1976, to Ted Chalk directing that he PROPERTY clean up and put into a safe condition his property in Sunnyslope, described as Lots 9, 10 and 11 in Block 8 Plan 4761 E H. He was given an opportunity of appearing before Council on June 17th,1976 The letter was returned with the notation - moved, address unknown. The site has not been cleaned up, and it is a hazard Mr. Brown moved ✓ that under the Provisi -ns of the Municipal Government Act., Sections 158 and 159 and others, that an order be now issued directing that the property must be cleaned up and made safe, and if the owner fails to do so, that the Municipal District will take action to have the work done and the costs charged against the property Carried Mr Brown and Mr King satisfactorily cleaned Sunnyslope, and is now he made as a guarantee that this report be ac W SHORT reported that Mr Short had PROPERTY up the old hardware store site in SUNNYSLOPE entitled to the refund of the deposit concerning this Mr Bauer moved cepted and the refund made Carried k" r� 10 COUNCIL MEETING JUNE 28th,1976 Report from the Fire CommissionercE losses from January lst, 1976 to March 31st,1976, was read Included in M Cooper - Nacmine $600 00, B Hadden Cambria $400 00 and M Williams, Trochu $41,250 00 Mr. Campbell moved that this information be accepted but that the Fire Commissioner be advised that the first two named above are not in the M D of Kneehill Carried 1975 Recreation Reports were read as received from Carbon, Torrington; Trochu, Linden and Allingham Mr King advised that this completed the 1975 list. Mr Litz moved that these be accepted and filed. Carried Minutes of Recreation Board Meetings as received were ordered filed Circular from Alberta Housina and Public Works was read regarding the Federal Govermment program of $1000 00 municipal incentive grants It appeared that this would not apply within the M D of Kneehill unless perhaps in hamlets Mr. Ferguson moved that the information be accepted and filed Carried P 2 FIRE REPORT RECREATION REPORTS & MINUTES CIRCULAR FED INCENTIVE GRANTS Letter from Mr Gordon Taylor,. M L A ; was read G TAYLOR in which he gave some information regarding funding for M L A hospitals Mr Berdahl moved that this be accepted as RE HOSPITAL information and filed FUNDING Carried Mr G King advised that the STEP program had been approved STEP PROGRAM for the hiring of one student only for July and August HIRING Mr Soder, Ag Fieldman had suggested that a second person be hired for similar work. T'-. Committee had considered the applications and approved the hiring of Dale Brown and Jim Perks Mr Bauer moved that this report be accepted Carried Mr Jeffery outlined to Council the information he has DIRECT PHONE obtained regarding a direct phone service to Calgary, LINE which would provide one line with an extension to the shop without toll The cost per month would be $181 35 and there would be a one time installation charge of $29 00 Our telephone tolls to Calgary in April amounted to $168.23. Discussion followed regarding the advantages of the system and related matters Mr Berdahl moved that this be tabled but that regular cost records be kept for referral to Council Carried Mr Carl Nemeth of C R P C and Mr Harold Henderson Assessor then met with Council Mr Nemeth stated that he wished C R P C to discuss with Council the proposed resolution number RE 1 and 2 under Development Control. He explained in RESOLUTIONS some detail the problems that might arise if the proposed ETC resolutions were passed by Council, in that they would allow one subdivision of a minimum size of 2 acres from each quarter section There could be problems in regard tv the extra population, and the demand for roads, school buses, etc , and future planning would be involved He suggested a freeze on a parcel size of 160 acres except for separation of farm stead with two acres to 40 acres and for severed parcels or for intensive agricultural use Mr Nemeth stated that Council could 3 o 1�q 0 COUNCIL MEETING JUNE 28th,1976 P 3 relax the provisions of the resolutions, but could not go contrary to any by -laws or strict governing rules A lengthy discussion followed Mr. King suggested that Council could also tighten its regulations if the demand for subdivision become a problem Council members were divided, some being of the opinion that farm land should be preserved, and others being of the opinion that the provisions should be very broad The Council meeting adjourned for dinner from 12 00 Noon to 1 00 P M Mr Nemeth and Mr following the noon followed in regard that C R P C revi send their written at a later meeting Henderson again met with Council adjournment, and further discussion to the resolutions. It was agreed ew the resolutions further and then comments for consideration by Council The maps to show boundaries of the various hamlets were reviewed Mr Bauer moved that the hamlet boundaries as drafted be approved, and that Council exercise direct control over development within the hamlets Carried Mr Poole mentioned that a rather poor trailer has b ?en located in Swalwell on some lots owned by Mr B Court It appears that the trailer owner may be a Mr Duncan Mr King is to check regarding this as no permit was issued DINNER TRAILER IN SWALWELL ,( NO PERMIT Discussion followed regarding the duties and responsibilities DEV of a development eontr.olel officer Mr Henderson stated -04#Z-40t OFF ICEi he is not very familiar with the requirements, but perhaps could accept the appointment Mr Poole moved that Mr Harold Henderson be named as Development °41 Officer for the Municipal District of Kneehill #48 Carried Mr Nemeth and Mr Henderson were thanked for meeting with Council, and they then left the meeting Mr Ted Paquette, Public Works Superintendent, Joe Dobler Gravel Foreman, and Norman Soder, Ag Fieldman, then met with Council Mr Jeffery read to Council the report of the Foremen and Shop Committee Meeting held June 24th 1976 The following decisions were made following that report 1 Mr Ferguson moved that Council approve of Public Work Employees working on some Saturday, in lieu of a holiday on Friday, July 2nd, but that no special overtime be paid in this regard Carried 2 Mr Ferguson moved that we follow up in regard tc a warranty for a reconditioned motor received from R. Angus which had given trouble after a few hours of operation Carried 3 Mrr' Litz moved that the driver of the sprayer truck FOREMEN COMM MEETING MINUTES 4 s L C? 0 COUNCIL MEETING JUNE 28th,1976 P 4 be put in the same category as the driver of gravel trucks as from July lst, 1976 Carried 4 Mr Berdahl moved that the Hyster Packer be put in the same category as the large motor ✓ scrapers etc Carried 5 Mr Poole moved that other reports and recommendations from the committee meeting be accepted Carried Mr Jeffery reviewed with Council the minutes of AG SERVICE the Ag Service Board meeting of June 21st, 1976, and BOARD MINUTES the following were noted 1 Mr Robert Tullikopf be classed as a senior laborer but Mr Kurta is not to be named as such, until he receives his number 3 licence 2. Mr. Bauer moved that Council approve of the Ag Service Board leasing three acres of land adjacent to Highway 21 as recommended in its minutes Carried 3 The sale of Tordon and other chemicals was discussed at some length Mr Berdahl moved that sales of Tordon and other chemicals for use on municipal projects be approved on a basis of cash on delivery Carried 4 Mr Bauer moved that the minutes and recommendations of the Ag Service Board be accepted, subject to the motions as listed in these minutes Carried Mr Brown stated he wished to go to the Agricultural Service Board Tour and meetings at Sangudo as a private individual without expense to the Municipality This was agreed without motion The Park Committee report of June read and discussed It was noted that the Acme School caused some damage to park proper and Tolman by painting on various moved that the School Division be to arrange for a clean up 23rd, 1976 was then PARK COMM REPORT Grads had apparently ty at Keiver Lake buildings Mr Campbell notified of this and asked Carried Mr Litz moved that the report of the Park Committee be accepted Carried Mr. Norman Soder was thanked for the information brought to Council, and he then left the meeting Mr Paquette asked if any charge should be made to the Bridge Branch for our assistance given in building approaches to the new bridge south of W McLean at W 21- 31 -22 -4 Mr. Poole moved that no charge be made to the Bridge Branch for this work as they are quite co- operative with the M D , and that the Bridge Branch be so advised Carried i W McLEAN BRIDGE CHARGE FOR APPROACHES . 5 A r C3 COUNCIL MEETING JUNE 28th 1976 Mr Paquette reported that the Bob Milne basement at Sunnyslope has been filled in by the Municipal District The account is to be sent to him for payment Mr Campbell advised that his motor grader man, Albert Kimmel had asked about doing some extra work prior to going on holidays. This was left to the discretion of Mr Campbell as Councillor Council was advised that Earl McRae had passed his first year course as a welder. Mr Campbell moved that this information be accepted and congratulations sent to Mr McRae Carried P 5 B MILNE BASEMENT SUNNYSLOPE EXTRA WORK MOTOR GRADER DIV 7 EARL McRAE FIRST YEAR WELDER COURSE Mr Dobbr suggested there may be some gravel in either GRAVEL the SW 15 or SE 16 in 29 -21 -4, on the north side of the , SW 16 29 -21 -4 railway This will be investigated ETC Mr Brown moved that Council approve of payment to H THIESSEN Mr H Thiessen at $2 00 per cubic yard for gravel ✓ GRAVEL which he crushes from SE 30 -and stock piles on M D CRUSHING property in NW 19 in 30 -25 -4, with this to .include royalty and all other costs Carried It was noted that it may be necessary to call for bids for further gravel crushing Most of the equipment owned by Linden Contractors has been advertised for sale by that company Mr King advised that Alberta Highways on behalf GRAVEL & of the Parks Branch of the Government will be putting GRADING approximately 900 cubic BUFFALO Pp y yards of gravel per mile on the Buffalo Jump Park Road, and that this will then be oiled JUMP PARK ROAD and leveled It was agreed that the road committee meet with a representative from Alberta Transportation to go over that road tomorrow, and to discuss details concerning same Request from Swalwell for oil to settle the dust was SWALWELL considered Mr Poole moved that Council approve STREETS of oiling the streetsJn Swalwell REQUEST OIL Carried The road committee reported that they had met with M ANDERSON representatives of Alberta Transportation at the BRIDGE road south of Merle Anderson, West 17- 30 -22 -4 W 17- 30 -22 -4 The alternate routes and locations for a new bridge had been discussed The committee recommended the easterly route as it appeared equally good, and quite ✓ a lot cheaper This is route C - 1 as referred to in correspondence with Alberta Transportation under file 7473 Mr Berdahl moved that Alberta Transportation be advised that Council agrees to the easterly route Carried Mr John Regehr had inquired regarding a road diversion J REGEHR at north west corner of NW 12- 30 -25 -4 It was agreed ROAD DIV X that this be referred to the road committee for .inspection NW 12-30 -25 -4 1.1 C3 �q �q COUNCIL MEETING JUNE 28th,1976 Mr G King advised that two men from Alberta Energy Resources Conservation Board had been in t`^ area and had authorizied the municipal district to fill in a hole at the former Hugo mine in SW 2- 32 -22 -4, and also some holes on the Smyth land in SE 34- 32 -23 -4 Costs are to be paid by that Board Mr Bauer moved that this report be accepted Carried Mr King also advised that he and Mr Campbell had met with representatives of Alberta Environment at our office recently, and had discussed the reclamation of auisance ground sites The government is prepared to pay the costs for full reclamation of sites which are being abandoned This information was ordered accepted and filed The application for work of Dan Vetter and Barry Vickery were referred to Mr. Paquette V WW Notice was read of a Directors Meeting of Central Alberta AAMD & C, to be held at our office on July 8th, 1976, commencing at 1 30 P M The notice asked for certain information from each v municipality for that meeting, and these were decided as follows 1 Mr Berdahl moved that no summer meeting of the association be recommended unless for some special reason which may arise Carried 2 Mr Campbell moved that this municipal district agree to purchase 1 ropy of th3 minutes of the association dating back for some 40 years at a price of approximately $25 00 Carried Mr Berdahl moved that Council approve of the borrow rat agreement with Mr Robert Larson in the NE corner of SE 15- 28 -22 -4, at a price of $50 00 Carried I/ V filling OLD MINE HOLES RECLAMATION OF NUISANCE GROUND SITE APPLICATIONS FOR WORK DIRECTORS MEETING CENTRAL AAMD & C. R LARSEN BORROW PIT Council was advised that the Bridge Branch had W EVANS telephoned to state they would not paint the bridge BRIDGE over the Three Hills Creek near the farm of Wilfred REQUEST FOR Evans, as this would be a responsibility of the M D , PAINTING under maintenance V Mr Ferguson moved that Mr Evans be advised of this, and told that the Municipal District has no plans to paint the bridge, but he may do so at his own expense if he so wishes Carried The Road Committee reported that Doug Hazelton had GRAVEL advised them there is still a good supply of gravel SUPPLY to. crushing at the Megli Pit Mr Poole moved this MEGLI PIT information be accepted Carried I r? Ln �a COUNCIL MEETING JUNE 28th,1976 It was noted that Alberta Transportation has been given approval for removal of gravel from Part of NE 4- 30 -21 -4 in the Red Deer River south of the Orkney Hill Mr Ferguson moved that this be accepted as information Carried Mr Brown read a letter Mr George Whitehead, P outlined problems which Association has because promptly answered Mr information be ETC people to walk through, but which will keep out the cattle Mr Poole moved that Council authorize signing of the release form in regard to the clean up of RELEASE FORM the ditch near the A1lingham Corner as a result of d ACCIDENT SEPT truck accident in September of 1975 75 Carried Mr Poole again asked about payments that might be BORROW PIT authorized for Art Becker and Alf Kostrosky for BECKER & borrow pits on the north side of the road built in KOSTROSKY N35 of 20- 29 -24 -4 V Mr Ferguson moved that each be paid $150 00 subject to Mr Poole getting signed agreements, for same Carried Mr Berdahl reported that Mr Jim Doyle had donated 4 acres of land in SE 32- 28 -20 -4, for a road, but asked DOYLE that the Municipal District gravel approximately 3c mile DONATING LAND further up to his place in compensation FOR ROAD Mr Berdahl moved that this gravellin, for Mr Doyle be approved on a one time basis only Carried Mr Ferguson reported regarding negotiations under way with Mr Ben Jasman for the road south of Section 3 and JASMAN 4 in 31 -23 -4 Mr Jasman has been requesting a cattle ROAD SOUTH OF pass in the NE 4- 31 -23 -4 as a condition for the other 3 & 4 in 31-23 - improvements It was agreed that Mr Ferguson and Mr V King meet with Mr Jasman for further discussions It was also noted that Mr John Empey will need to be paid crop damage as renter of the Jasman land Mr Ferguson further advised that Mr Ray Dau had stated that in lieu of crop damage the Municipal District should take out some old trees at the Brunken Farm in SE 5- 31 -23 -4 This appeared reasonable Mr Ferguson asked if the Municipal District would dig a pit free for use by 8 farmers if they wished to establish one private nuisance grounds Mr Poole moved that the Municipal District not take any part in such a project, at this time, as the nuisance *rounds would not meet with Provincial regulations Carried BRUNKEN FARM CROP DAMAGE PRIVATE NUIS GROUNDS V Y+ I N 0 COUNCIL MEETING JUNE 28th 1976 3 Mr Bauer asked that the road committee note the following for inspection- ROAD COMMITTEE Blind spot approximately 2 miles north of Keiver Lake 2 Need for a road to serve the new dwelling in the INSPECTIONS Walesky subdivision in NE 20- 31 -25 -4 3 Request of Mr Maerz regarding a slough in SE 26- 32 -25 -4 Mr Ted Paquette stated they have been checked in regard to moving the TS 18 and other equipment that size without MOVING loading same They require a permit and must load TS 18 ETC the machinery to move them on any provincial highway or ✓ ON PROV secondary road He stated that the total weight of the ROADS TS 18 is about 37 tons Mr Paquette stated they are doing, some rapping of the old surface on the Linden Road, and have experimented with some terrazene as a sealent Mr Paquette asked Council's emulsion coat on the roadway from the CNR track north to west of 7- 32 -23 -4 Mr Bauer moved that Council for 1976 work opinion about putting an north of Three Halls Fred Penner's corner, plan for Ruarkville water and sewer was read to Council Estimated total cost would be about $200,000 00 There would be approximately 4513 feet of frontage and the cost for debt repayment could be as high as $4 15 per foot per year There would likely be some grant from C M H C for the sewer, but perhaps no grant in connection with the water system More details are to follow The P B I is interested in getting at least part of this project this year for use by their pasturizing plant Mr Poole moved that negotiations for this water and sewer system continue and that the report be adopted and the committee keep going on the details Carried WORK ON ROADS RUARKVILLE SEWER & WATER SYSTEM 4✓ Mr Cunningham advised that work may start as early as July 5th on the modified sewer system in Huxley HUXLEY SEWER All required details and preliminaries have been looked SYSTEM after Mr Poole moved that Council approve of road crossings ROAD for C W N Gas as per plans submitted with letter from CROSSING Alberta Transportation of June 10th,1976 C W N G Carried Mr Poole moved that Council approve in principle of COMPRESSOR a compressor station in SE 24- 28 -24 -4, as per information V STATION from CDC Oil and Gas Ltd SE24- 28 -24 -4 Carried Mr Bauer moved that Council approve of the extension CAN UTILITIES of Canadian Utilities Services to LSD 15 of 10- 31 -24 -4 EXTENSION but to check to dated ROLL Carried Mr Berdahl moved that Council approve of building permits as per item 13 on the agenda, but that the request of Linden BUILDING Nursing Home to put a mobile home at its nursing home be b PERMITS referred to C R P C for advice Carried Carried Mr King was asked to contact Arlie Harder regarding compensation ✓ for his work on the design for the crest SWALWELL Council was advised that the building at the Swalwell CEMETERY Cemetery has been advertised for sale and bids will be referred BUILDING to the next Council meeting Mr. Litz moved that this information FOR be accepted AT CORNER Alberta Municipal Affairs had sent its final payment SALE 1976 municipal assistance grant in June in the amount Carried SUN ASSIST Mr King and Mr L Litz gave a report regarding the iiviviClPAL municipal crests and some price information received from CRESTS Spielman Signs of Red Deer Information from AAMD 6 C is to follow Mr Ferguson moved that this information be accepted, and tabled Carried Mr King was asked to contact Arlie Harder regarding compensation ✓ for his work on the design for the crest WIMBORNE LOT Mr Litz stated he had not yet seen the owner of the corner,�LIMITED lot in Wimborne where vision is somewhat limited VISION AT CORNER Alberta Municipal Affairs had sent its final payment of 1976 municipal assistance grant in June in the amount of d' SUN ASSIST $1589473 59 Mr Campbell moved that this information be GRANT accepted Carried Letter from Mr J Fromhold of the University of Calgary was HISTORICAL read regarding a historical Resource Policy Mr Berdahl v moved that the minutes and the report be accepted Carried Mr Brown and Mr King reported they had attended the crash course, 1976 on Administrative Law at the Red Deer College this CRASH past week A received from Mr Vic McCune, P Eng , regarding services which he is offering to municipalities Mr Berdahl moved that this letter be filed, but a reply sent to Mr McCune acknowledging same Carried Mr Ferguson was excused from the meeting at this time.; approximately 6 00 P M Mr G King outlined a tentative schedule for holidays for office staff Mr Campbell moved approval Carried Mr Brown moved approval of a building permit for Mr D K Harvey for a mobile home in Sunnyslope Carried P 10 V" V.
