Vestern Nast Gas, Carbon - fire demo By-Laws for allocation of 1976 grants Development Control Resolutions 'slater Supply Line - ,cme e N COUNCIL MEETING, TUESDAY,MAY 25th,1976 -------------------------------- - - - - -- P.1 A regular meeting of the Municipal Council of the Municipal District of Kneehill ##48 was held in the office at Three Hills; on Tuesday May 25th, 1976, commencing at 900 AM Councillors present for the meeting were PRESENT G. A Berdahl Div 1 C W Poole Div 2 R W Brown Div 3 (Reeve) A W Bauer Div 4 T. A Ferguson Div 5 (until 5 40 P.M ) L Litz Div 6 R G Campbell Div 7 Mr. G G King,Secretary- Treasurer, was present and recorded the minutes Mr Poole moved approval of the minutes of the meeting of May 10th,1976 APPROVAL and May 18th, 1976 as circulated. I MINUTES Carried Mr Doug Hazelton of Linden Contractors then met with Council, along with LINDEN Mr Ted Paquette, Public Works Superintendent, and Mr Joe Dobler, Gravel CONTRACTORS Foreman GRAVEL Mr. Hazelton stated that his crushing work has been delayed 7 weeks while CRUSH1gG waiting for parts He has recently been crushing adjacent to our Torrington Pit for his own use Mr Brown stated that the question had come up about getting some of the gravel corners cleaned up at the Torrington Pit, and he had authorized Linden Contractors to do 5000 cubic yards after talking by radio with a couple of the other Councillors. It was then suggested that a greater quantity should be done to get odds and ends cleaned up Mr Hazelton stated that he had stripped for 412 hours on Friday, so there is a reasonable quantity now available Mr Poole moved that Linden Contractors be authorized to crush approximately 10,000 cubic yards additional at the Torrington Pit Carried (This includes the 5000 referred to above ) Linden Contractors will next be moving to the Megli Pit, where they have 15,000 cubic yards more crushing to do under their contract for the Municipal District Mr Hazelton stated they want approximately 3000 cubic yards for their own use, and he estimates there would be some 15,000 cubic yards left stripped, after that is done Mr Brown moved that the road committee check at the Megli Pit when the other crushing is about done, to inspect the quantity remaining, and decide whether any further amount should be done this year Carried Mr Hazelton estimated another 5 hours stripping at the Torrington Pit should be done Mr Ferguson moved that Mr Bauer check regarding this with authority to decide Carried Mr Hazelton stated they have a center dump trailer with three hoppers and are licenced for 80;000 pounds gross He asked permission to haul loads of that weight from the Torrington Pit north to Highway Number 27 only He was advised this would be considered by Council later He thanked Council and then left the meeting Mr Berdahl moved that Council grant overload permits to any applicant for up to 80,000 pounds gross weight subject to legal axle loading, on the road from the Torrington Pit north to Highway 27 only, with the trucker to be responsible for any major damage Carried P OVERLOAD PERMITS FOR LINDEN CONTRACTORS & OTHERS 2 i 91 COUNCIL MEETING MAY 25th..1976 P 2 Mr Ted Paquette, amd Mr Joe Dobler suggested that Ron Toews of R TOEWS Three Hills area has been hauling overloads on M D roads without OVERLOADS permits Mr Poole moved that a letter be written to Ron Toews warning him about this practice of hauling overloads Carried It was mentioned that a trailer is parked in the SW 6- 32 --24 -4 TRAILER dust west of the buildings of Ron Toews Inquiry is to be made AT SW about who owns it and what use is being made of it, as it may be 6-- 32 -24 -4 contrary to planning regulations Mr G Berdahl and Mr G King reported regarding various matters inspected and negotiated by them on May 20th., with particular reference to the following 1 Gravel Lease with Jack Lowen - NE 9 and NW 10 in 29 -21 -4 GRAVEL After considerable discussion Mr Jack Lowen had agreed to a J LOWEN revised form of lease.; giving him authority to sell privately & K LOWEN as well as to the Municipal District Mr Kenneth Lowen was not at home, so the matter of a lease with him - NW 9-- 29 -21 -4 - had not been discussed Mr Berdahl moved that Council approve of the revised form of lease with Mr Jack Lowen and also with Mr Kenneth Lowen, if he so agrees Carried 2 The committee suggested that testing with a backhoe should be done GRAVEL for gravel in the NE 23---and NW 24- in 28 -22 -4, (Fraser and Others) FRASER as gravel there might be better and more readily available than that LAND at L. ;lens ETC Mr Paquette stated that he could have Oris Rodger move to that area to do the testing some time soon Mr Bauer moved that the testing for gravel be proceeded with as soon as convenient Carried 3 Stockton and Doyle Road - It was impossible to determine what land STOCKTON is affected without a legal survey Mr King advised that he had contacted ROAD Mr Robin Arthurs , surveyor, and he could start work in that area this afternoon Mr. Poole moved that this report be adopted and the survey authorized Carried 4 Council was also advised that Fr Jack Lowen would like some old rocks JACK LOWEN and trash pushed into a gravel pit site in SE 16-- 29 -21 -4, if the machinery WORK TO BE is near, and he would also like to hire municipal machinery to grade the DONE road into his buildings, in NE 16- 29 -21 -4 The road committee of Mr Berdahl Mr Campbell, Ted Paquette and Mr King with Edgar Riep as guide had hiked down to the river north easterly from SEARCH Trochu, to look for gravel supplies It appeared that there was an adequate FOR GRAVEL supply of gravel in the river at the east of Section 2- 34 -22 -4 and south westerly AT from there for a mile, but it would be very expensive to build a suitable road RIVER down any of the grades from the west It might be possible to get a road south along the river flat from there toward the Tolman Bridge, but this had not been inspected It would also be advisable to check for further gravel near the former Alvin location Mr Campbell moved that Alberta En-',onment be contacted for authority to test for gravel in the Red Deer river in the location as referred to above, and also for general regulations regarding removal of gravel from the river., and regarding construction of roads in that area Carried 3 Ew L43 H Ll COUNCIL MEETING MAY 2JSth,1976 P 3 Mr Litz moved that the report of the road committee GRAVEL regarding the search for gravel along the river., etc , be REPORT accepted Carried ffir Doug Kish of Twister Pipe in Calgary met with Council He stated they are starting production of spiral culverts TWISTER at their Calgary plant tomorrow., and will have all sizes PIPE available in stock most of the time Billing and invoices will be through the AAMD & C and prices will be the same CULVERT as others PRICES There is a 5% freight allowance for pick up at the yard ETC Brief discussion followed He thanked Council for the opportunity of meeting with them, and then left the meeting Letter from Tom Lynch was read regarding the old road to the Tolman Bridge, and also regarding removal of gravel and roads TOM LYNCH in that area Mr Ferguson moved that the road committee endeavour OLD ROAD \; to meet with Mr Tom Lynch to discuss the matters which he raised ALLOWANCE in his letter, and to also find out who the government official ETC was that he referred to, as giving him advice Carried Mr Brown moved that Linden Contractors be contacted to ask if they would give a price for crushing gravel which we have V LINDEN stockpiled at the south end of the Tolman Park CONTRACT Carried GRAVEL CRUSHING Letters from Alberta Transportation Bridge Branch gave the following estimated delivery dates for government culverts DELIVERY DATE GOVT 1 Correction Line SE of Three Hills - June lst, 1976 CULVERTS 2 South of Hesketh - June 15th, 1976 3 West of Swalwell - July lst, 1976 4 NE of Carbon - June 15th,1976 Mr Poole moved that this information be accepted and filed. Carried Letter from Engineering Canada Associates Ltd , on behalf of the Town of Trochu asked what arrangements are necessary for the construction TOWN OF on and across municipal roads for the Trochu sewage system The plan TROCHU as submitted appeared to show the sewage line down the middle of the road CROSSING from the Trochu Park east and Council felt perhaps a getter location ROADS could be agreed upon SEWAGE LI Mr Poole moved that the road committee arrange to meet the engineers in regard to these matters, with authority to act Carried Circular from Alberta Energy and Natural Resources was read, ALTA in regard to sand and gravel operations on crown land This set ENERGY out the requirements from the government standpoint SAND & Mr Bauer moved that this be filed as information GRAVEL Carried OPERATIONS Mr Ted Paquette reported regarding the following MIS 1 Main Crew - are now nearing completion of the Swalwell West Sob PUBLIC except that some equipment will have to return later for the culvert REPORT extension 2 Next job will be the Poffenroth and Vandenbor Road 3 Following that from Beveridge Lake south approximately 1 and 3/4 miles towards Hesketh JIw 4 U H F-1-0 Ln 144�37J COUNCIL MEETING MAY 25th;1976 P 4 4 Then Division 5 on the Correction Line as authorized 5 Patch Crew are cutting the hill at Fritags just north of Number 9 on the Hesketh road and will next be moving to improve vision at the corner on the Sharples road as authorized 6 Both of the Euclids have been broken down:, one is now working, and it is hoped that the other will be repaired soon under warranty Mr Dobler reported that the Ford Loader was recently checked by Hauser Equipment; and they adjusted the timing Fluid has been put in the front tires They have gravelled from Edwin Sept's buildings east to the corner, but were then rained out on that job and so have moved to Division 1 Copy of a letter from Alberta Chief Bridge Engineer to C P Rail was read regarding the work required at the Linden Overpass The M D is to do the excavation work and their crew will construct retaining walls and do other work at that site Mr Brown moved that this be accepted and filed Carried Letter of May 19th,1076 from the Inspection Branch, Alberta Labour clarified the regulations in regard to the employer providing for or supplying personal protective equipment The employer must have the suitable equipment at the job site, but may determine the terms of security or deposit to be furnished by the worker Mr Ferguson moved that Council Policy be amended to show that the employees do not actually have to purchase hard hats or similar equipment, but that they must make a deposit equal to the price as a guarantee for the return in reasonable condition of the item Carried Claim of Willard Koch for damages to winter wheat was referred to Council. He claimed a loss of 50 bushels at $4 00 per bushel Mr Poole moved that Mr Bauer contact Mr Koch with authority to V arrange some settlement Carried Application of Dan Ferguson for work was read Mr Brown moved that this be tabled for consideration if assistance is granted ✓ under the STEP program Carried C P R Foreman from Beiseker had contacted the office regarding surfacing of the railway crossings east of Acme when we are doing the light coat surfacing Mr Brown moved that a reply be sent advising that light coat surfacing is not suitable for that work Carried LINDEN ✓ OVERPASS WORK REGULATI )NS RE HARD HATS, ETC & POLIC` W KOCH WINTER WHEAT DAMAGE APPLICATION FOR WORK SURFACING RAILWAY CROSSINGS EAST ACME Municipal policy regarding private work with municipal equipment was reviewed Mr Campbell moved that the former policies be repealed POLICY and the new policy be put into effect as per copy with these minutes y MUN EQUIP PRIVATE WORK Carried Council meeting adjourned for dinner from 12 00 Noon to 1 00 P M l DINNER 5 i d Cam; COUNCIL MEETING MAY 25th,1976 P 5 Mr Paquette and Mr Dobler advise that we have about 6 double seats from the school bus which are considered surplus Some are in fair condition, others only poor Mr Poole moved that the better ones be offered for sale at $5 00 and the v others at a price depending on condition Carried The matter of various signs at Swalwell was discussed, and Mr Paquette advised that Ed Duncan can put up three 30 mile per hour signs, plus two playground signs and some directional signs for the Swalwell Dam. Mr Paquette advised that Ed Duncan has been trying out work with an electric auger, and it appears suitable for work putting in sign posts Cost is approximately $200 00 Y Mr Campbell moved that Council authorize purchase if it is considered suitable by the foremen Carried BUS SEATS FOR SALE SWALWELL SIGNS Mr Poole reported that the water on the original road allowance PAGETS west north west 6- 30 -23 -4 -- Pagets - near Highway 21 - is reportedly ROAD ALLOW fed from an artisan well on the Paget property Mr Paget told WATER him that they charge oil companies $100 00 each for use of water from that location This was given as information only The report of the Foremen's Meeting of May 20th,1976, was read, and the following action taken 1 Overtime for Foremen - Mr Berdahl moved that there be no change in the Council policy except that Council may reconsider for special reasons which are not now foreseen - and that companies delivering oil for road surfacing be advised they cannot expect municipal employees to be available during the night Carried 2 Purchase of trucks - Mr Poole moved there be no change in Council's procedure in calling for tenders, but that this be referred back to Council in September for further consideration Carried 3 Mr Alex Cunningham, Utility Officer, met with Council, and reported regarding the mobile radios Including the fire trucks and the ambulances we now have a total of 50 radios, and this should provide one or two spares; at all times It appeared that no more radios are needed, and the bracket supply is okay but Alex stated that he needs a few aerials Handy talkies have been provided for the Linden Acme fire truck and Reg Campbell has supplied two for the Trochu Fire Truck Consideration is being given to some for the Three Hill Unit Mr Bauer moved adoption of the report of the Foremen's Meeting of May 20th 1976, subject to the motions as above Carried FOREMEN'S COMMITTEE MEETING MINUTES The machine work for the proposed Huxley sewage lagoon was discussed and Council was asked if they would be willing to do this with Municipal equipment at hourly rates, but with the total not to exceed $1 25 per cubic yard Considerable discussion followed Mr Ferguson moved that Council approve of the work with municipal equipment ✓ Carried Mr Cunningham, Mr G King, and Mr R Campbell reported regarding a few matters concerning the Huxley sewage lagoon, and stated that Elmer Stickel and Jassman Plumbing have been jointly awarded the ditching contract at 754 per 6 J M i r1 2 `J LEA COUNCIL MEETING MAY 25th 1976 P 6 Mr Cunningham then left the meeting Letter of May 13th,, from the Town of Three Hills asked TOWN OF regarding cold mix asphalt for roads within the Three THREE HILLS Hills Cemetery area Mr Berdahl moved that they be ✓ referred to Border Paving at Red Deer CEMETERY Carried ROADS A circular regarding; portable cattle guards had been PORTABLE brought in by Mr Brown and was shown to Council and Foremen CATTLE and copies given to the foremen Mr Litz moved that GUARDS this be filed as information Carried Letter from Engineering Canada Associates Ltd on behalf VILLAGE OF of the Village of Acme was read in regard to the water ACME WATER supply line and the route along roads, etc Mr. Bauer moved SUPPLY LINE that this be referred to the road committee to meet with ETC the engineers with the aim of dealing with this at the same time as the deal with the one referred to earlier in the meeting regarding the Trochu area Carried 4 Mr Poole reported that old car bodies are available for OLD CAR disposal at lots of B Court in Swalwell and at the Wes Gore BODIES farm just west of Swalwell He believes there are also some south of the Number 9 Carbon Southkcorner Mr A Dick at 1 VARIOUS Swalwell might also have some available l LOCATIONS Mr G King agreed to contact Navajo Metals regarding these Mr Berdahl asked approval to gravel approximately 1 mile of GRAVEL ROAD road west of portions of Sections 5 and 8 in 28 -20 -4 The southerly WEST OF end of the two miles of road was previously gravelled, as well as Sections 5 the northerly end, and this would be a connecting link and 8 in 28- Some of the other may require regravelling, but that is routine r 2A -4 Mr Ferguson moved that Council approve as requested Carried Mr Bauer reported that Mr Ben Maerz has requested that the SLOUGH Municipal District take some necessary action to have a slough DRAINAGE drained south of the buildings in SE 26- 32 --25 -4 Mr Bauer moved B MAERZ that the road committee inspect this SE 26-32 - Carried 25 -4 Mr Ted Paquette., and Mr Joe Dobler left the meeting at this time, y approximately 2 45 P M Mr Bauer moved that Council approve the extension of Alberta Power ALTA Ltd services to LSD 6 of 31- 32 -24 -4 as per plan submitted POWER Carried EXTENSION A by -law for mutual aid with adjoining municipalities in case of MUTUAL AID any disaster was discussed It was agreed that all the towns and villages AGREEMENT of the area should be included, as well as other adjacent municipalities depending on the wishes of each Mr Campbell moved first reading to BY -LAW by -law number 798, this being a by -law to provide for disaster mutual 798 aid, and authorizing an agreement concerning same Carried Unanimously Mr Berdahl moved second reading to this by -law Carried Unanimously Mr Bauer moved third reading to this by -law Carried Unanimously 7 j� 1 t 1 5 k I i 1E �*]r L01 COUNCIL MEETING MAY 25th,1976 Mr G King reported to Council regarding the mill rates for taxation purposes for 1976 in keeping with previous decisions of Council These were discussed at some length Hr Berdahl moved that the matter of a cemetery, parks and recreation levy be referred to a plebiscite A vote was taken and the motion declared lost with three voting in favour, and 4 contrary Mr Poole moved first reading to by -law number 799 this being a by -law to adopt the 1976 budget; and to set the mill rates as per copy attached Carried Mr Bauer moved second reading to this by -law Carried P 7 Mr Brown moved that third reading be given to this by -law at this time Carried Unanimously Mr Brown then moved that the by -law be given third reading Carried Five in favour and two against Councillors Ferguson and Berdahl asked to be re7istered as opposed 1976 MILL RATE BY -LAW SETTING SAME ETC Mr Russ Horvey and Mr B Lang District Agriculturists, met with D A Council, and outlined some information regarding a green certificate GREEN program which involves farm training for students Charts have been CERT sent out to determine priorities; and he distributed some of these to the Councillors After brief discussion, Mr Horvey and Mr Lang left the meeting Mr G King advised that Lawson Graphics Western Ltd. , have been NEW MAPS engaged to prepare new municipal district maps the same size as previously Their price for their work for 1200 maps including sales tax will be approximately $3534 OQ 1500 maps would be $300 00 more Mr Poole moved that Council authorize an order for 1500 maps Carried Mr Campbell moved that the sale price for the new maps be $4 00 each Carried Walker Farms Ltd , of Trochu area proposs to establish a repair WALKER F garage with sale of automotive parts at their farm in NW 21- 33 -24 -4 GARAGE Mr Litz moved that Council authorize a letter of approval indicating BUSINESS that the business meets with fire, zoning and building by -laws Carried Mr Bauer moved that Council approve of the building permits as issued BUIDLING to Elmer Wiebe; D W Davidson., and Dale Moran as per item 27 of the PERMITS Agenda Carried Mr Bauer moved that Mr and Mrs Karl Beagrie be permitted to plant TREE SET trees a minimum of 75 feet from the center of the road at their new subdivision in NW corner of NW 9- 32- -24 -4 BACK f BACK Carried Mr Campbell moved that approval be given to Mr. A Baumgardt to move BAUMGARDT a residence and put an addition on same in NE 31- 32 -23 -4, with the old ✓ BUILDING house to be removed and with this subject to approval of Alberta PERMIT Transportation Carried 8 i r ti i I C7 rA Iq N COUNCIL MEETING MAY 25th,1976 P 8 Mr Berdahl moved that a building permit be granted to Herman H SIEMENS Siemens for an implement shed and workshop in Pt NW 23- 29- -22 -4 L' BUILDING PERMIT as per application submitted, and subject to approval of Alta NW 23- 29 -22 -4 Transportation Carried Mr G King was asked to check with Harold Henderson and others to see if Prairie Posts Ltd , have made application for a licence ✓ PRsA :.,.....:., POSTS for their business now located in NW 26- 32 -25 -4 LICENCE FOR BUS Correspondence was read from the Prairie Bible Institute and P B I copies of correspondence between the P B I and the Town of ANNEXATION Three Hills in regard to proposed annexation plans All indicated PROPOSAL that there was no wish for annexation of any areas at the present time to the Town of Three Hills Mr Bauer moved that this correspondence be acknowledged, and that both parties be advised that the Municipal District is not taking any steps towards the annexation proposal Carried Correspondence from C R P C, advised that the plans for subdivisions C R P C within the Town of Three Hills have been approved THREE HILLS Mr Berdahl moved that this be accepted and filed as information v TOWN SUB Carried Correspondence from the Three Hills School Division was referred to THREE HILLS in regard to the minutes of their May 12th meeting and a letter of SCHOOL DIV invitation to Council members to attend their budget discussion on BUDGET June 8th Mr Ferguson moved that the correspondence be accepted and MEETING tiled and those who are free to attend the budget meeting, be authorized to do so Carried Letter of Honourable G Miniely , Alberta Minister of Hospitals and Medicare was read in reply to our inquiry regarding hospital services In brief he stated that the government feels the hospital ,�— services are extremely good in Alberta and that their restraint program is not having any adverse affect He further suggested that concerns could be taken up with local hospital boards Brief discussion followed Mr Poole moved that this information be accepted and filed Carried A number of circulars from the AAMD & C were read and dealt with as follows 1 Public Utilities Board hearings -- Mr Brown moved that a reply be sent stating that the M D of Kneehill Council does not support the resolution at the spring convention which vequested the association to present briefs opposing; all increases; and to indicate that Council believes that each utility association should take any necessary action Carried 2 Sales tax on asphalt and other materials It appears that there is no possibility of having exemption from the Federal Sales Tax Mr Berdahl moved that this be filed as information v Carried 3 Fencing of Water Storage Areas and Lagoons; HOSPITAL CUT BACKS AAMD & C CIRCULARS >S 9 r d, Ia i i N 1�a COUNCIL MEETING MAY 25th,1976 P 9 6 Licence Suspension - Mr Litz moved that this be filed as information Carried Minutes of the Three Hills Recreation Board meeting of April 27th THREE HILLS were referred to briefly Mr Ferguson moved that these be filed REC BOARD Carried MINUTES Mr R W Brown and Mr G King reported that they had met at Sunnyslope on May 19th, with Paul Weigum of Sunnyslope, and Mr John Jordan and Mr B Fairbrother of C R P C Agreement in principle was reached �regardina the form of subdivision best for the area, and it was agreed that a surveyor should be engaged to draft a tentative plan and submit same to C R P C Mr G King further advised that Mr Robin Arthurs can undertake this work as Alberta Land Surveyor Mr Poole moved that this report be accepted Carried Mr G King also advised that Mr Short purchaser of the old hardware store is tearing the building down and apparently making a good Job fhc old Sunnyslope store is a mess;
