( SEE OVER FOR EXPENDITURE CONTROL ) C LM 0 G COUNCIL MEETING - APRIL 12th,1976 A regular meeting of the Council of the Municipal District of Kneehill #48 was held in the Municipal Office, Three Hills on Monday, April i2thg1976 commencing at 9 00 A.M Councillors present for this meeting were as follows. G Campbell Div 7 Mr Jack Benedict of the Three Hills School Division was present for the meeting Mr G G King, Secretary - Treasurer, and Mr J C Jeffery, Assistant Secretary - Treasurer were present and recorded the minutes. Mr T A Ferguson moved the adoption of the minutes of the March 22nd, 1976 meeting, Carried PRESENT APPROVAL MINUTES Mr G King reviewed the financial statement for the month ending FINANCIAL March 31st,19765 showing receipts for the month of $69,560 39, interest of disbursements Of $51$036 460 leaving a net - STATEMENT outstanding MARCH. 1976 balance at the , Mr Poole moved the acceptance of this report arried Mr G King read the following bids on Huxley Lots BIDS HUXLEY 1. Bid from W R Beal on Lots 15 and 16, Block 9, $50.00 LOTS to be used as a museum It was noted that the C N R station was to be rebuilt as a museum 2 W. R Beal - Lots 18 and 19 in Block 9, $50 00 to be used for museum 3 W R Beal - Lot 10, Block 4. $50 00 - hoping to be used as a trade for Lot 7 and possibly Lot 8, Block 4, to be used for antique machinery display 4 W R Beal - Lot 11 - Blk 4 $50 00 to be used as a trade for other lots for antique machinery display 5 W R Beal - Lots 1 to 5 in Block 9, $125.00 to be used as a / . building site t/ 6 W. Brief discussion was held concerning Lots 28 and 29 in Block 9 and Mr T A Ferguson moved that the M D. purchase these lots for $160 00 and acquire title Ir T. A Ferguson moved first reading to by -law number 792 authorizing the M D of "...- eehill to acquire title to Lds 28 and 29 in Block 9, for the sum of $160 00 Carried Unanimiously Mr R. G Campbell moved second reading Carried Unanimously Mr J; G Litz moved third reading Carried unanimously. Mr C W Poole moved that we do not accept any bids on Lots 1 to 5 in Block 9.. Carried m-^ Campbell moved first reading to by -law number 793 authorizing the sale of Lots 10 and 11 in Block 4 to Mr W R Beal for the suim of $50 00 each Carried Unanimously. Mr Poole moved second reading to by -law number 793 Carried Unanimously Mr A W Bauer moved third reading to by -law number 793 Carried Unanimously Mr Campbell moved that we do not accept any bids on Lots 15, 16 18 and 19 in Block 9 at the present time Carried Bids were then opened regarding lease of pasture land in NE 16 32-26-4 One bid was received from Mr Ron Fyten of Swalwell and he bid $10 50 an acre per year Mr. Bauer moved that we rent the pasture to Mr Fyten on the basis of 60 acres Carried Mr G King read a letter from the residents of the hamlet of Hesketh regarding certain municipal or tax owned land in the hamlet The Council decided to approve their requests as follows Lot 1, Block 2, It appears the septic tanks, etc., for the Peterson louse and the Alberta Wheat Pool house is located on this lot, and Mr Poole moved first reading to by -law number 794 authorizing the M D to acquire clear title to Lot 1, Blook 2 Hesketh at a price of $20 00 Carried Note- Mr G A Berdahl did not vote on this matter Mr L G. Litz moved second reading to by -law number 794 Carried Mr �. A Berdahl did not vote on this matter Mr T. A Ferguson moved that third reading be given to this by -law at this time. Carried Unanimously Mr A W Bauer moved third reading of by -law number 794 Carried BY -LAW NO. 792 BY -LAW NO 793 BIDS PASTURE LEASE NE 16- 32 -26 -4 HESKETH LOTS BY -LAW NO 794 COUNCIL MEETING APRIL 12th,1976 P 3 It was noted that Mr. G A Berdahl did not vote on this matter It is to be further noted that Mr Berdahl did not vote on this matter due to what he felt was a conflict of interest, with the exception of voting that the third reading of the by -law could in fact be held at this time Lot 15 - Block 2 It appears that Everett Hare is using this lot as an access to his property Mr Poole moved first reading to by -law number 795 authorizing the BY -LAW NO sale of Lot 15, Block 2 to Mr Everett Hare of Hesketh for $50 00 795 Carried t Mr Berdahl did not vote f Mr R G Campbell moved second reading to this by -law ` Carried Mr G A Berdahl did not vote Mr. A W Bauer moved that third reading be given to this by -law at this time Carried Unanimously Mr Litz moved third reading to by -law number 795. Carried Mr G A Berdahl did not vote It was noted that Mr Hare must consolidate Lot 15, Block 2, into title with Lots 24 and 25 in Block 2,. Lot 26-- Block 2 - It appears that this lot isleing used as a lawn by Mr Everett Hare Mr C W Poole moved first reading to by -law 796 authorizing the sale BY -LAW NO of Lot 26 in Block 2 to Mr Everett Hare for the sum of $50 00 796 with a condition that this lot also be consolidated into title with Lots 15, 24 and 25 in Block 2 Carried Mr G A Berdahl did not vote Mr A W Bauer moved second reading Carried Mr G A Berdahl did not vote Mr R G Campbell moved that third reading be given to this by - -law at this time Carried Unanimously Mr Bauer moved third reading to this by -law Carried Mr. G.A Berdahl did not vote Lots 27 and 28 in Block 2 - Mr Paul Perman will be retiring within BY -LAW the next two years and would like to develop these lots for his residence NO 797 Mr Poole moved first reading to by -law number 797 authorizing the sale of Lots 27 and 28 in Block 2 to Mr Paul Perman for the sum of $100 00 Carried Mr Berdahl did not vote 4 I k 101 [A N COUNCIL MEETING APRIL 12th,1976 IMr. T A Ferguson moved second reading Carried IMr Berdahl did not vote P 4 Mr L G Litz moved that third reading be given to this by -law at this time Carried Unanimously Mr A W Bauer moved third reading, to this by -law number 797 Carried Mr Berdahl did not vote. HESKETH LOTS Lots 12 13 and 14, Block 2 is required for arks CONTINUED q p ��ot for the Hesketh Hall Mr T A Ferguson moved that we temporarily hold Lots 13 and 14 in Block 2 pending information from the Hesketh Hall Board Carried Lots 12, 13 and 14 in Block 3 are being used as a community ball diamond Mr Brown moved that we table a decision regarding the rest of the Hesketh lots at this time and that a committee of Mr G King and Mr Berdahl look at the situation in Hesketh and bring recommendations back to Council, for the next meeting Carried ACCOUNTS The Secretary read the accounts: totalling $293,291 47, and Mr Berdahl moved that these accounts be paid. Carried IMr G King read applications for building permits from Mr A J Greke BUILDING for a residence on Lot 1., Block 6 in Sunnyslope PERMITS l From Dale and Del Poultry Farms for a mobile home on Pt of SE 5- 31 -25 -4 and from Mr. A Chamberlain for a garage on Pt NW 6- 32 -23 -4 Mr Bauer moved that the building permits be approved Carried The Secretary read a letter from the Department of Education advising SCHOOL FOUND that the School Fonndation Program requisition is $309,375 00 based on REQUISITION an equalized assessment of $11,899,050 at 26 malls This is payable in three installments dated May 1st, August lst and November 1st Mr Ferguson moved that this requisition be approved and paid as due Carried The minutes of a special meeting of the Three Hills School Division held THREE HILLS March 24th,1976 were referred to briefly Mr Berdahl moved these be accpete ($CH00L DIV and filed SPEC MEETING Carried MINUTES The Secretary read a letter from Alberta Municipal Affairs regarding the 1975 TAX 1975 Alberta Property Tax Reduction benefits, stating that the applications REBATE TIME may be filed up-b December 31st 1976. LIMIT Mr Campbell moved this information be accepted and filed Carried 9 COUNCIL MEETING APRIL 12th 1976 IM D� The H Siemens subdivision - NW 23- 29 -22 -4 was referred to briefly Mr Siemens advised that the value of the land would be in his opinion f $500 00 pnr acre Mr T A Ferguson moved that the $500 00 per acre figure be approved for cash in lieu of public reserve calculations Carried Brief discussion was held concerning the Don Pryor subdivision application - Pt SW 1- 32 -24 -4 - C R P C had refused the application }pursuant to Sections 50 - 1(a) of the Subdivision and Transfer Regulations and Section 59 of the Subdivision and Transfer Regulations and also 16 (B) of the Act and also that the subdivision is contrary to ` Part 3 Section 3 7 (b) (2) of the Preliminary Regional Plan Other correspondence referred to included subdivision applications approved from February 5th to March 4th 1976 minutes of regular meeting f held FeL-uary 27th;1976, minutes of regular meeting held February 13th and other minutes from C R P C Mr Campbell moved this correspondence and minutes be accpeted and filed Carried Mr Brown gave a brief report on the new proposed Acme Water well ACME WATER and stated that the test well had been drilled on the road allowance WELL The village of Acme would like to drill their production well on ROAD ALLOWANCE the said road allowance Mr Rogers, Mayor of the Village of Acme and Mr Roger Klessel of Hydrogeollogical Consultants Ltd entered the meeting at this time Mr Klessel stated that his company had drilled 9 holes some to the south west and some to the north west of Acme and had found water on LSD 5 of 35- 29 -26 -4 Mr Klessel recommended that the Village develop the 77 foot hole on our road allowance as a producing well They had tried for a production well 60 feet from the test hole and an cr^ci-v=tion well about 40 feet east of that point again The well in the road allowance produced 71 gallons per minute, with a 35 foot draw down and the production well 60 feet to the east only produced 25 gallons per minute with a 70 foot draw down He noted the observation well another 40 feet to the east only produced 20 gallons per minute Mr Klessel stated that he would like the Village to develop the well on the road allowance, as the road allowance is not greatly used, if at all The proposed production well would be located approximately 12 feet from the fence line into the road allowance All buildings would be placed back on private property He further stated that if a road had to be built at a later date, that a man hole could be put in They would require 1 and 3/8 mile of reasonably good all weather road at least in fair condition Mi Ferguson moved that the Village of Acme be allowed to develop the well on the road allowance providing they enter into a save harmless agreement with the Municipal District; and also on the condition that no projections be allowed on the road allownce This means that a man hole must be provided at this time so farmers may work over top with tractors, etc Carried t 6 G Fsy A ��• +1�K wpr C P 5 , Mr Brown advised that a tree trimng truck will be in this TREE TRIMING area approximately April 19th and 20th; and they will contact SWALWELL Mr Soder or Mr Poole regarding a price for the trimGg of the Swalwell trees He further advised that the actual bill for the V B.itz accident in which a power pole was knocked over, was $460 05 Various items were then referred to from C R P C as follows C R P C SUBDIVISION Mr G King reported that the Rowbottom subdivision - SW 27- 29 -21 -4 _ & CORRESPONDENCE had been tabled by C R P C . MEETING back to the next Council meeting. Carried Mr G King read a letter from Alberta Telephones and Utilities, UTILITIES which stated that a special course for Utilities Officers will be held ,OFFICERS' April 28th and 29th, 1976, beginning at 8 00 A M on the 12th Floor COURSE Agriculture Building Edmonton Mr Campbell moved that Mr Cunningham be authorized to attend this course. Carried Mr G King read a letter from Alberta Disaster Services Ltd regarding ALTA DIS Municipal Disaster Services Program Management Course on the 11th to COURSE 13th of May, 1976 Mr Poole moved that no delegates attend this meeting J as Mr Cunningham has previously attended this course Carried Mr G King read a letter from Mr Larry Edwards, and R Horvey, D.A MEETING regarding a meeting of all persons owning land immediately adjacent to RE THREE the Three Hills Creek and Bigelow Dam Mr Bauer moved to accept and f HILLS CREEK file this letter & DAM Carried Mr King read a letter from the Public Service Pension Administration PENSION advising they have scheduled a meeting of our employees on April ✓ MEETING 28th, 19769 at 1.00 P M Mr Poole moved that the meeting be held APRIL 28 in the evening or not at all Carried Mr King read a letter from Alberta Power Ltd , regarding proposed ALTA power line extensions to LSD 8 and 9 and 16 and 9, and 6 of 16 POWER all in 32 -24 - -4 Mr Bauer moved that these extensions be approved PROPSED Carried EXTENSIONS The Secretary read by -law number 790 to Council This by -law is in regard to the Sanitary Land Fill Committee Mr Bauer moved second reading of by -law number 790, with the following amendment Paragraph 4 amended to read as follows 1. The representative of the Municipal Distract of Kneehill #48 shall act in regard to hamlets in the Municipal District of Kneehill #48, and is also authorized to make arrangements where necessary for farmers on an individual charge basis "' Carried Mr Ferguson moved third reading to this by -law number 790 Carried It was noted that Mr G A Berdahl was opposed.
