COUNCIL MEETING - MARCH 22nd 1976
A regular meeting of the Council of the Municipal District of
Kneehill #48, was held in the Municipal Office, Three Hills
on Monday March 22nd,1976 commencing at 9 00 A M
Councillors present for this meeting were

Mr Walter Anderson Chairman of the Three Hills School Division was present
for the forenoon portion of the meeting
Mr G G King,. Secretary - Treasurer, was present and recorded the minutes APPROVAL OF
Mr Ferguson moved adoption of the minutes of the meeting of March 8th and MINUTES
15th,1976 subject to the following corrections L
1 March 15th page 10 re two way radios - the last sentence should have the
following words added less costs of convertors to be made or installed
for the other units
2 Re- Fatal Accident - the words - the passenger is in critical condition
should read - the driver is in critical condition

Mr Poole moved approval of the minutes of the annual meeting of March
15th,1976, subject to reference to the next regular annual meeting

The Secretary., Mr King reported that he and Mr Jeffery had attended
the Anti Inflation Seminar at Red Deer on March 16th 1976 Considerable
information had been received from Mr Tom Buchanan of the Urban
Municipal Association in regard to the various forms to be filled out
for submission to the Anti Inflation Board The procedure is quite
complicated and somewhat confusing Employees must be put into
some sort of logical grouping and the average increases by groups
are under control He further advised that he and Mr Jeffery will
prepare recommendations regarding the groups and preliminary reports
for reference to following Council meeting.
Mr Anderson added comments regarding the negotiations for the
School Division and stated that the bus drivers were up about 8%
and the teachers approximately 11% but these are still acceptable
within the guidelines Mr Campbell moved that the report of Mr
G King be accepted and the recommendations regarding groups, etc
prepared

It was noted that there is no road ban now in effect on heavy
paving, such as the Acme Wimborne Road, the Trochu East road
etc , ✓
Mr Berdahl moved that Council authorize the placing of road
bans on heavy paving if and when considered necessary

Mr Campbell moved that the maximum loading on heavy paving
be restricted to 59,000 pounds gross vehicle weight and that
no overload permits be granted on any roads under ban, and
that this be effective 12 00 Noon, Wednesday; March 24th 1976

Mr Campbdl moved that Council approve and authorize the signing
by the Reeve and Secretary - Treasurer of the railway crossing V
agreement between the C N R ,, and the Municipal District in respect
to the sewer line proposed at Huxley

By -law Number 781 for Development Control had been given first
reading on November 5th,1975, but not proceeded with further
Since that time, numerous changes have been suggested
The changes as suggested and approved by the Director of C R.P.C.
were now reviewed and it was agreed that these should be
inccrporated in a revised by -law Mr Ferguson moved that Council
abandon by -law number 781 and give first reading to a new
by law number 789 to provide for Development Control

Mr Bauer moved that the new by -law for Development Control
be now advertised as required

Letter of March 11th, 1976. from C R.P.0 recommended refusal
of a proposed subdivision in SW 1 -32 24 -4 - Pryor as it
is contrary to many sections of the regulations, and also
the preliminary regional plan Alberta Transportation is
also against the subdivision Mr Brown moved that Council
concur and recommend refusal of this subdivision

Letter of March 16th 1976 from C R P C was read in regard
to the proposed meat processing, plant and grocery retail
outlet adjacent to the Village of Acme In brief it
stated that the proposed addition to the existing slaughter
house would be in conformity with the Preliminary Regional
Plan, but the food vending business would be contrary to the
plan Mr Poole moved that Council concur with the letter
from C R P C and recommend that Acme Locker and Trading
and the Village of Acme consider annexation of the area concerned
to the Village of Acme

Application of Gary Peterson for a permit to put a 12 foot by 35 foot
addition to the hog barn in the SE corner of SE 16- 30 -24 -4- was
considered Mr Ferguson moved that this be approved= subject to
all regulations of the Drumheller Health Unit

COUNCIL MEETING - MARCH 22nd, 1976
Mr J Jeffery; Assistant Secretary - Treasurer, met with Council and
read the report of the Foremen' Committee Meeting of March 17th.1976
The following were dealt with as follows.
1 Gravel Truck to be advertised for sale -- Council to decide the
reserve when the bids are opened
2 Mr Ferguson moved that Council do not approve any extra salary
for a witness who is ordinarily employed by the M D . but who is
called to a court trial, unless this is demanded by law

3 Mr Berdahl moved that Council require a medical report
as recommended for those who may be hired for permanent summer
or full time positions, as from this date

4 Mr Poole moved that Council approve the action recommended
in the report in regard to Mr Henry Tippe and Mr Ted Welsh

5 Mr Litz moved that Council approve the recommendation in
the report in regard to Mr Vernon Bitz and his demotion to
intermediate operator

Council adjourned for dinner from 12.00 Noon to 1.00 P M
The report of the Foremen' Committee meeting was then further
considered
6 Mr Campbell moved that Council place an order for 25 sign_
post holders

7 Mr Poole moved that Council accept the other reports not
separately dealt with from the Foremen' Committee Meeting

Mr Campbell moved that the Municipal District pay hourly rates
at regular time for those employed by the M D who attended the
Safety Seminar at Three Hills on March 19th, 1976
Carried
Some brief discussion followed in regard to the Safety Seminar
held at Three Hills under the auspices of the Workers' Compensation
Board and others It was felt that the men were made more aware of
the need for safety and hopefully some results would show in future
Council was advised that the M D of Kneehill had acquired title
to the present water tower location in Linden before that place
became a village It appeared logical to transfer the title to
the village This had not been done to date Mr Brown moved
that Council approve the transfer of the said property to the
Village of Linden, at the nominal fee of $1 00

Mr G King advised Council that Mr W R Beal had submitted
a sealed bid for various lots in Huxley Procedure to be
followed by Council was then discussed Mr Campbell moved
that lots available for sale in Huxley through tax recovery
or otherwise be advertised with a call for sealed bids with
10% deposit and with no bids necessarily accepted., and with the
bidders to state the intended use to be made of any lots which they
bid on

It was agreed that special note be sent to Mr W R Beal in
regard to the above procedure and that his present sealed bid
will be returned to him in regard to Huxley lots
Mr Poole moved that Council approve cancellation of 1975
business tax and penalty in the total of $48 84 against Mr
H W Hanses as the business was not in operation in 1975
However this is subject to him paying his miscellaneous
account owing to the M D

Mr. Brown moved that Council approve cancellation of an
old business tax of $9 63 levied against Mr James Marsh
for business in Swalwell; which is no longer in operation

Mr Campbell moved that Council approve of the cancellation
of $200 71 levied against James Davis for a house in Sunnyslope
which was removed from that hamlet

Mr. Berdahl moved that the minutes of the Three Hills School Division SCHOOL DIV
meeting of March 9th 1976_ be accepted and filed MINUTES

Mr Brown reported that he had attended the annual meeting of SCHOOL DIV
the Three Hills School Division at Linden on Mach 17th, 1976 ANNUAL MEETING
About 80 people had attended Some discussion had taken place
about school services for students from the County of Mountain
View on a two or three mile strip of land west of 29 -26 -4

passed at the annual meeting on March 15th, 1976 in regard to a LEVY FOR

Letter of March 12th 1976, from Alberta Environment referred to
its deAict vehicle removal program Mr Poole moved that Mr.
R Campbell be named as local co-ordinator for the M.D. of Kneehill
in connection with this project

Mr Ted Paquette and Mr Joe Dobler met with Council
C —ular from Jubilee Insurance advised that the property
damage deductible will be left at $250.00 rather than raised
to $500 00 as once proposed by various companies
Mr Berdahl moved that this he accepted and filed
carried
Council was advised that Mr T A Ferguson and Mr T
Paquette had inspected the road diversion west of 23- R1- -24 -4
with particular reference to the location of a new bridge
across the Three Hills Creek. They recommended that the
District Engineer prepare a cost estimate for straightening
the road., or changing the diversion as deemed best
Mr G King advised that the District Engineer had been
contacted, and had agreed to prepare a report concerning
this matter
The District Engineer has also been asked to prepare a report
regarding the vision at the intersection at SW 14- 31 -24 -4
Mr Poole moved that this report and recommendations be accepted.

Council then discussed traffic control, particularly at the
intersection at SW 14 31 -24 -4, where a fatal accident had occured
recently Previous accidents have also occured there including
a fatality a few years back. Mr. Poole moved that the yield
sign at that intersection for east west traffic be removed and
that the following requirements be put in effect in regard to
all traffic entering secondary road number 582 (Sunnyslope Road)
from the north or south, at the following intersections --
All traffic from the North and south be required to stop at
S4 13 31 -23 -4, SW 13- -and SW 14 and SW 15 in 31 -24 -4, being the
first four intersections countir.; from Highway #21 westerly
Further that stop signs and stop ahead signs as required be
put up for traffic control at the same intersections.

The report regarding the alternator .,s on motor grader in
Division 2 had been given with t'zc foremen' committee report.
It showed thF alternator had been repaired with minor work
on a number %occasions, but no heavy duty alternator had been
put on that machine
Council was advised that a fairly extensive Kneehill Creek
bank cave in had occured at the Hartley Hay land approximately
one quarter mile east of highway X121 Water Resources had made
an inspection and had requested that some work be done for a new
water channel A municipal cat and dozer had done the work
+ ',ts past Friday afternoon under their direction Mr Campbell
moved this report be accepted.

for gravel, etc Rate quoted was $80 00 per hour but it was not known v

whether or not this included travel time etc
Mr. Campbell moved that the said company be contacted
for more information

Mr Poole advised that Bertram Drilling has a new truck
back at Carbon, and may be able to do some test seismic
drilling to test for gravel for the M D soon
Mr Bauer moved that the circular f��om AAMD S C regarding LINE PAINTING

Mr G King advised Council that Mr. Elmer Bauer had
a cash rental agreement with this M D for pasture use ELMER BAUER
of the South half of the NE 16- 32 -26 -4, for the years PASTURE RENTAL
1973, 1974 and 1975. That lease has now expired AGREEMENT

Mr Berdahl moved that the M D call for sealed tenders
for the lease of the said pasture land on similar terms CALL FOR BIDS
to those which we had with Mr Elmer Bauer. FOR PASTURE

Chip spreader have both been delivered to the M D SPREADER DELIVERED
Letter from Merlin Transport Ltd stated they wished to quote MERLIN TRANSPORT
on road oil requirements for 1976 Mr Ferguson moved that OIL FOR ROADS
this be filed as information QUOTE

improving the road from Sharples to Carbon This petition CARBON SHARPLES
had been delivered to Mr Berdahl and was brought by him ROAD
to the office Mr Ferguson moved that this be filed until IMPROVEMENTS
after the road tour

Mr Joe Dobler stated they expected to finish stock piling STOCK PILE
from the Beiseker location by Tuesday night or Wednesdays REPORT
and propose to move back to the Torrington Pit Stockpiling
would then be done at the junction of HIghway 21 and 27 location
and perhaps at Wimborne
Some discussion took place in regard to culverts to be thawed THAWING CULVERTS
at certain locations and dra..nage areas that need some attention ETC
soon
Mr Dobler reported that they had stockpiled approximately 68,000
cubic yards of gravel during this winter
Mr Ferguson moved that Council go on road tour on April 5th and ROAD TOUR
6th commencing at 9.00 A.M. on each of those dates. DATES

Mr Brown stated a meeting o-F the Acme Linden area representatives
will be held some time soon caith Water Resources regarding ACME LINDEN
a proposed dam He stated that he could attend to represent the PROPOSED DAM

Mr Paquette suggested a program might be worked out whereby the SERVICE MACHINES
mechanics service the machines before and after regular shifts AFTER HOURS
This would require one extra man and transportation and would mean
that one person w:;uld work in the evening one week, on an alternate basis with

The Secretary- Treasurer was asked to check further regarding
Workers` Compensation Board regulations, as to wbether or not
we need two men on duty at all times.
Mr. Paquette stated that he had been in contact with Star Paving STAR PAVING
regarding preparation of road mix material They may be able ROAD MIX MATERIAL
to come by April 15th or sooner.
Hard hat policy was mentioned but no specific action taken
It was noted that trees at the Earl Poffenroth corner limit the
vision. Mr Paquette is to check regarding a traffic warning
sign from the south
A design for a municipal crest, as drafted by Mr A Harder
was shown to Council and received hearty approval He was
asked to now design one with recommended colors
Mr Berdahl suggested that caraganas at the intersection
south west 25- 29 -22 --4 - opposite Beveridge Lake - should
be cut down, if okay with Harry Church.

A note was received that a fire committee meeting involving FIRE COMMITTEE
Airdrie area and Beiseker and the M.D. of Kneehill is to be MEETING
held at Airdrie this coming Thursday at 8 00 P M AIRDRIE, ETC
Mr Ferguson moved that Mr Brown attend on behalf of this
Municipal District.

Mr J Jeffery and Council discussed the report from the
Sanitary Land Fill meeting held at our office on the evening of SANITARY LAND
March 15th,1976 Representatives of the various towns and villages FILL MEETING REPORT
bad also been present Further information is to be obtained as
to whether sanitary land fill services can be supplied for hamlets
only, by use of one half of the municipal levy plus an extra special
levy if needed
Mr Poole moved first reading to by -law 790 , this being a by -law BY -LAW No 790
to authorize the establishment of a joint committee with the towns SANITARY LAND
and villages for sanitary land fill arrangements, and an agreement FILL COMMITTEE
with those willing to participate, and naming Mr R W Brown AGREEMENT
as representative of this M. D and with this to apply in regard ETC
to hamlets only., in the Municipal District.

It was noted that under the above policy no tax would be charged
against farmers, but they would then be required to pay a fee
to the operator for use of any nuisance grounds
Mr Poole moved that a circular from Alberta Municipal Affairs f HABITAT CIRCULAR
regarding Habitat be filed

Mr. G King advised that C R P C had telephoned to say that NO ASSISTANCE FOR
they could not get any financial assistance for the aerial photographs AERIAL
of this Municipal Distrht. We will be billed for the photographs PHOTOGRAPHS
by Lands and Forests and then can likely claim 25% as a grant from
Alberta Municipal Affairs Mr Bauer moved that this be
accepted as information

Mr Berdahl moved that any Counillor who attends an a__,o...ing DELEGATES FOR
Municipal annual meeting be considered as a delegate to same. OTHER MUNICIPAL

March 24th,1976, at 9.00 A M , at which time Council will meet jointly with
