First ..id Courses 4 C*7 I_ COUNCIL MEETING - MARCH 8th, 1976 P 1 A regular meeting of the Council of the Municipal District of Kneehill #48 was held in the Municipal Office, Three Hills, on Monday, March 8th; 1976 commencing at 9 00 A.M Councillors present for this meeting were PRESENT Mr G A. Berdahl Div. 1 Mr C W Poole Div 2 Mr R. W Brown Div 3 (Reeve) Mr Art W. Bauer Div. 4 Mr T A Ferguson Div. 5 Mr L Litz Div 6 Mr R G. Campbell Div 7 Mr. John Smyth of the Three Hills School Division was present for the portion of the meeting after 11.00 A M Mr G G. King, Secretary - Treasurer was present and recorded the minutes APPROVAL MINUTES Mr Ferguson moved approval of the minutes of the meeting of February 23rd,1976 as circulated Carried FINANCIAL T The financial statement for the month of February, ending February 29th, 197 was presented and Liscussed, as per copy with these minutes STATEMENT This showed a net balance at the end of the month of $216 444 74, and with all loans repaid General discussion followed, and it was noted that the net balance at the end of February, one year ago, was $23,895 34 Council was advised that there had been an actual overcharge of school foundation taxes in 1975 for approximately $75 000 00 to $90,000 00 and this amount may have to be accounted for in the 1976 budget Mr Bauer moved acceptance of the financial statement Carried GRAINGER BRID( Mr Berdahl stated that one piece of the plank deck at the Grainger Bridge REPAIRS is out and this creates a traffic hazard Mr Brown suggested the bridge south of the Megli Pit should also be checked Mr John Dorn was advised of the repair needed at the Grainger Bridge and he agreed to have it fixed today. It was also noted that employees should report hazardous conditions to the foremen MUN FINANCE Mr Litz moved that Mr G. King and Mr J. Jeffery be authorized to OFFICERS MEETING attend the Municipal Finance Officers' Association meeting in Red DELEGATES Deer on March 18th Carried Council was advised that an Alberta Social Service account incurred SOCIAL SERVICE in February and March of 1975 has just been received in regard to ACCOUNT Russell Baker. The municipal Ehare is $32 44. Mr. Poole moved R BAKER that this be accepted and payment made Carried Letter from Schumacher Padden 6 Byers.; solicitors, stated that they SWALWELL LOTS had not been able to get Mr Grassmick to pay his bid price for the portion of Block 7 in Swalwell in the amount of $1580 00 They felt that the cost of forcing a collection would outweigh any benefit, and therefore they suggested that the matter be dropped GRASSMICK 1,1cy would ao inform Mr Grassmick by double registered mail. Mr Poole moved that the recommendations of the solicitors be accepted,. and that Mr Grassmick be advised by them that his deal for the purchase of portions of Lots 11 to 26 Block 7 Swalwell is cancelled Carried .2 11 a COUNCIL MEETING MARCH *8th 1976 P 2 Minutes of the Three Hills School Division meeting of February Llth,1976 were reviewed briefly. and the financial statement and other documents sent out from the School Division were also briefly referred to Mr. Berdahl moved that these be accepted and filed. Carried Mr Litz moved that no delegate be sent to the annual meeting of the Alberta Municipal Finance Corporation in Edmonton, on April 12th Carried Council was reminded of the sanitary land fill meeting to be held at our office on March 15th next at 7 30 P M. Representatives have been invited from all towns and villages and Mr Charles Lau of the Drumheller Health Unit will be present One or two bids for collection of garbage will likely be considered at that meeting Mr Bauer moved that this information be accepted Carried A verbal report was given of the Hall Commission hearing held in Drumheller recently, regarding the proposed closure of the Acme Drumheller C P R line through Carbon, etc Mr Brown advised that he had added information in addition to the brief, in regard to the duplication of service as given by the C N R and C P R. from the general Grainger to Langdon Corner area. No definite conclusion can be reached from the hearings, but all briefs presented in that afternoon hearing were in opposition Mr. Campbell moved the report be accepted Carried Mr R. M Kent of W. H Seager & Associates Ltd met with Council He stated that recent Provincial legislation requires all oil and gas lines must be cathodic protected against external corrosion within the next two years His firm wishes to install this protection by an installation on the road allowance at the east of the SE 5- 31 -23 -4 He gave a fairly detailed picture of the process and why they wish this to be on the road allowance rather than in the field, where there are other pipelines or other causes which might give them trouble They will bury the anode in the ground, with a minimum of 8 feet of cover, and the cables from there to the power supply would have a minimum of 3 feet of cover Mr Ferguson moved that Council grant approval of this installation subject to all provincial regulations and subject to the terms as mentioned above, and also subject to the applicant giving a written guarantee to be fully responsible and to move same at its expense if such should be required for Municipal District purposes Carried Mr Litz moved that G G King and J Jeffery be authorized to attend the Anti Inflation Seminar at Red Deer on March 16th,1976 Carried SCHOOL DIV MINUTES ALTA MUN FINANCE CORPORATION NO DELEGATE SANITARY LAND FILL MEETING HALL COMMISSION REPORT W H SEAGER & ASSOCIATES LTD ANTI INFLATION SEMINAR DELEGATES Council was advised that the acoount owing to at the end of February 1976 was approximately corresponding figure for the end of February. the M D for taxes $73,575 00 The 1975, was $979720 00 TAXES OWING END FEB /76 Mr G King advised Council that the Secretary - Treasurer's Course at Banff will be held June 6th to 9th. 1976 Mr that ±he delegates be G G King, J Jeffery, G Berdahl C W Poole Refresher Campbell moved R W Brown and Carried REFRESHER COURSE BANFF DELEGATES It was noted that reservations have been arranged at the Banffshire Inn 9 �r [A OAW COUNCIL MEETING MARCH 8th,1976 P 3 Mr Poole moved that the delegates to the Planning Forum at Banff April 13th and 14th be R W Brown, A W Bauer and G G King DELEGATES Carried PLANNING FORUM was noted that reservations are to be made for the night of ril 12th and 13th Poole moved that the delegates to the Provincial Fire Chiefs sociation meeting at Red Deer June 13th to 16th, 1976., be R G DELEGATES PROV mpbell, and T A Ferguson CHIEFS FIRE Carried CHIEFS MEETING the dates of the Fire Chiefs' Association meeting conflicts th the regular meeting date in June an alternate date was discussed CHANGE OF Berdahl moved that the regular Council meeting in June be changed COUNCIL MEETING ,om June 14th._: to June 17th DATE Carried Mr John Smyth of the Three Hills School Division came into the meeting at this time, approximately 11:00 A M , and was welcomed Councillors were reminded of the meeting of the Central Association of C A A M D & M D. & C to be held at Red Deer on March 25th, 1976, C. MEETING commencing at 10 00 A M Mr G King suggested that a resolution be presented in regard to the Municipal Taxation Act RESOLUTION MUNICIPAL In summary, Section 116 2 states that payments being mailed to the TAXATION ACT Municipal Office for taxes, etc , shall be deemed to have been received on the date of the post mark stamped on the envelope He suggested that a change be made to refer to the date stamped by a postal official because postal meters do not give a reliable date Mr Brown moved that a resolution be prepared and presented as suggested Carried Mr Ferguson moved that Mr G King be authorized to attend the Regional DELEGATE Recreation Development Meeting in Edmonton on April 2nd, 1976. REG RECREATION ii Carried DEV MEETING Letter of February 13th from the Village of Carbon asks the M D to levy an additional two mill recreation tax; exc�i.ng the Trochu Recreation Area. VILLAGE CARBON and stated the Village was willing to place a similar levy within its area TWO MILL LEVY This has been referred to at the previous meeting of Council, but the letter RECREATION had been misplaced at that time Mr Berdahl moved that this letter be tabled pending discussion at our annual meeting Carried Minutes of the Carbon Recreation Board meeting of February 9th,1976, CARBON RECREATION were reviewed briefly Mr. Campbell moved that these be accepted and filed BOARD MINUTES Carried Letter of March 2nd, from the Town of Three Hills listed its present members on the Recreation and Parks Advisory Board., and asked for suggestions Mr Bauer moved that Council approve of the membership as named, and also 1 Support the naming of Mr Garry Gillespie to represent the Three Hills School as suggested 2 Support the selection of Mr. Paul Vasser as recommended by the Recreation Board for the Three Hills East Area Carried Minutes of the Recreation and Parks Advisory Board of Three Hills meeting of February 16th, were read These included the 1976 fee schedule for the swimming pool, and the arena Each Councillor present was given a copy of same Mr Bauer moved that the said minutes be accepted and filed Carried 4 f ii TOWN OF THREE HILLS RECREATION ADVISORY BOARD 11 A C� COUNCIL MEETING MARCH 8th,1976 P 4 Letter from Alberta Municipal Affairs was read in regard to our request for information as to the definition of hamlets in DEFINITION OF relation to the Prairie Bible Institute, Grantville and Ruarkville HAMLETS Mr Jack Fleming of the Department stated in his opinion that the P B I would be considered one hamlet and would include the road going north south between the two areas He also felt that Grantville and Ruarkville should be considered as one hamlet as they are within the same quarter section Mr. Ferguson moved that this be accepted and filed as information Carried Circular of February 23rd, 1976, from Alberta Land Use Forum expressed thanks to all who had presented briefs, and also gave information ALTA LAND USE about where copies of their report are available, etc FORUM CIRCULAR Mr Ferguson moved that this be accepted and filed, as information Carried Letter of February 23rd 1976 from Alberta Municipal and School MUNICIPAL AND SCHOOL Boundaries Advisory Committee stated that no other action is being BOUNDARIES COMMISSION taken in regard to the Drumheller Area boundary problem as it appears that the school attendance problem has been solved through tuition V arrangements. Mr Poole moved that this be accepted and filed as information Carried Mr Ferguson moved that Council approve of the building permit BUILDING PERMITS as issued to John Sinclair for a mobile home in NW 23- 29 -25 -4 Carried Mr Bauer moved that Mr Ken Adams be granted a building permit for a machine shed in Part SE 1- 32 -24 -4 as per his application. Carried An extract from the minutes of the C R P C subdivision committee C. R P C meeting held February 13th,1976, showed that they had no objections MATTERS to the proposed closure of an unused road diversion in Parts of 13 and 14, 29 -23 -4 Mr Berdahl moved that this information be accepted and filed Carried Mr Brown reported that C R P C relaxed its requirement for subdivision at W & T DowneSand and Gravel Ltd The said company must now only provide a service road 100 feet wide on the entry road which is also approximately 100 foot in width This replaces the former requirement of a 100 foot strip on the west side of the quarter section Mr Poole moved that this report be accepted Carried Mr Poole moved that this Municipal District voice no objection to proposed changes in the Preliminary Regional Plan to provide for high density districts at Three Hills and other areas far removed from here. Carried The Council meeting adjourned for dinner from 12.00 Noon to 1 00 P M DINNER Council was advised that C R P C has approved of the subdivison C R P C for Mr G Toews in SE 36- 30 -25 -4 Mr Poole moved that C R P C be advised that no further culverts or approaches are required by this Municpal District and no extra road right of ways; and that W' Council agrees to the sum of $400 00 per acre as the basis for the cash in lieu of public reserve settlement. Carried Proposed subdivision by Mr T Rowbottom in Part SW 27- 29 -21 -4 was discussed in detail It was noted that the area north of the surveyed road is now practically waste land, and would be suitable for a building J site There are two small parcels cut off on the south side of the road diversion, but within the same general ar +a� Mr Berdahl moved that Council 5 U N/ I IM :4 ,'_W" COUNCIL MEETING -- MARCH 8th,1976 recommend approval of the subdivision subject of the three parcels at the same times that be required° that no additional culverts or required., and that cash in lieu be recommend of $400 00 per acre Letter of Don Pryor regarding 32 -24 -4 was read Council was received from C R P C , to our regarding this subdivision., as on a secondary road Mr Poole moved that a further asking for its comments P 5 to disposition C R P C no service road MATTERS approaches be CONTINUED :�d at a value Carried ais proposed subdivision in SW 1- advised that no reply has been letter asking for its comments it is close to Three Hills and letter be written to C R P C Carried Mr Berdahl moved that the minutes as received from C R P C ' be filed Carried It was noted that the Provincial Planning Board had granted a development permit for a business in the M D of Rockyview which had been opposed by the C R P C This was ordered filed as information Letter from Barkman's General Store asked for two mercury lights BARKMAN'S STORE in front of the store in NE 22- 30 -25 -4 Mr Poole moved that this REQUEST FOR LIGHTS request be refused Carried Council was advised that Alberta environment paid the Municipal GRANTVILLE District the sum of $3468 88 as one half of the cost of the water WATER LINE line connection to Grantville in 1975 Mr Bauer moved that this PAYMENT be accepted with thanks Carried Mr Poole moved that the Court of Revision be held on Monday COURT OF REVISION April 26t 1976, commencing at 1.00 P M DATE Carried It was noted that there are only two appeals to be considered The 1976 equalized assessment figure as received from Alberta 1976 EQUALIZED Municipal Affairs were read to Council Mr G King advised that ASSESSMENT the information has been sent to the School Division and the various hospital districts The land and improvement figure is similar to last year, but there is considerable increase in regard to pipeline The new figures are as follows Land and Improvements $195301 890 00 Pipe Lines 4,080,200 00 Power Lines 199,580 00 A G T Works 6 Transmission Lines 158,970 00 Total 1976 Equalized Assessment 23,740,640 00 Varied for the Provincial School Foundation Fund 11.899,050 00 Mr Campbell moved that this information be accepted Carried Mr R W Brown and Mr A W Bauer reported on the Regional Road Study meeting held at C R P C recently Considerable discussion had taken place about main traffic roads around the City of Calgary REGIONAL ROAD Further annexation proposals add to the problems in locating the STUDY best routes Mr Litz moved that the report be accepted Carried Mr Joe Dobler -and Mr John Dorn, Grade Foreman:, then met with Council . .6 0 IM e Council Meeting March 8th 1976 Mr. Brown reported that Hannah Transport of Acme had paid HANNAH Mr Kostrosky $100 00 as settlement of a claim in regard TRANSPORT to certain dirt from the Acme East Road. Mr Berdahl moved LAND CLAIM tl.at this be recorded as being settled Carried Circular from AAMD & C advised that tapes are available TAPES in regard to talks given at the Loss Prevention Seminar Cost LOSS PREVENTION is $3 00 for a one hour tape Mr Ferguson moved that the tape SEMINAR of the address of Erne Walters and of the Workers' Compensation Board be purchased, either in casette or reel type, whichever is deemed more suitable Carried Council was advised that the financial statement of this Municipal District for 1975 has been completed and was mailed to the taxpayers, late on Friday, last A further copy was given to each Councillor present. Mr Brown moved that this be tabled for discussion by Council next Monday morning Carried Council briefly discussed reports to be given at the annual meeting, and the following was agreed upon Drumheller Health Unit - G Berdahl Nursing Home and Auxiliary Hospital - A W Bauer Ambulance - T A Ferguson Golden Hills Lodge - G G King It was also noted that Mr. Berdahl wished some information about the Drumheller Health Unit as given by Mr Ferguson at the combined meeting of government officials Letter from the Carbon and District Chamber of Commerce stated that improvements are needed to the road from Carbon to Sharplcs as certain portions are now considered unsafe Mr Poole moved that a reply be sent stating this will be inspected by Council when on road tour Carried Quotation from Gulf Oil Canada Ltd , stated their price for diesel fuel this year is 40 28� per gallon, subject to f lucuation with general markets It was noted that the 1975 price at the end of the year was 41 7� so this is a reduction in appreciation of being granted the business Mr Bauer moved that this be accepted, with thanks Carried Mr J Jeffery, Assistant Secretary - Treasurer, met with Council and recorded the minutes for the next portion of the meeting. The report to Council regarding miscellaneous accounts receivable turned over to the solicitors, was as follows Accounts that have been collected total $663.96 Two accounts have been cancelled for a total of $60 60 �'ne outstanding small accounts total $108 98 The outstanding large accounts of L Boese $265 00, B Hanses $360 00 K. Felker $100 00 and Village of Irri.cana $237 50, total $962 50 FINANCIAL STATEMENT ANNUAL MEFTING PROCEDURE ROAD IMPROVEMEYTS' CARBON TO SHARPLES FUEL PRICES 1976 MIS ACCOUNTS The Secretary recommended that we write off the $108 98, and have the solicitors take the four large accounts totalling $962 50 to court 7 N A COUNCIL MEETING MARCH 8th:, 1976 P 7 Mr C W Poole moved that we have our solicitors take Mr L Boese, MIS ACCOUNTS Mr B Hanses, Mr K Felker and Village of Irricana to Small Debt Court over the various accounts owing Carried The minutes of the Employee meeting dated March 1st 1976 were EMPLOYEE reviewed briefly The Secretary asked Council to establish a COMMITTEE policy of some sort to deal with the following persons MEETING Mr Henry Tippe} Mr Ted Welsh, Mr. Ed Duncan, and Mr John Reznechenko Mr R G Campbell moved that we sever relationships with Mr Reznechenko completely Carried General discussion was then held regarding applications for work and Mr T A Ferguson moved that all applications for employment be dealt with at the foremen committee level Carried The Council then discussed Mr Edward Duncan The foremen advised that Mr Duncan was doing a good job on the sign crew. Mr Brown felt that Mr. Duncan should have a better auger with telescoping arms, and this would probably help him and save his back a fair amount It was decided that the mechanic shift on the main crew and also the policy decision regarding Henry Tippe, Ted Welsh , etc be left to the next foremen's committee meeting The Secretary reported that the men would like to see one foreman on each gravel crew Mr Dobler stated that he felt that we definitely did not need one on all three crews Mr Ferguson moved that there only be one sub foreman as all or most of the operators on the gravel crew are senior operators The Secretary also reported that the first aid meetinghet up for March 18th, beginning at 7 °30 at our shop.Theft will also be a safety MEETINGID meeting March 19th, 1976, with the foremen beginning at 9 00 A M The town and village foremen of the area plus school division foremen have been invited to attend this portion There will be a general luncheon at noon provided -from the left over beef from the Service Board Tour All men will be attending in the afternoon It was agreed that some time should be left for Mr Alox Cunningham at this meeting to give a talk on the radio system Mr Bauer moved that the minutes of the Employee Committee Meeting be accepted Carried Employment applications from Mr Adam Seiler and Mr Wayne Tourneur EMPLOYMENT were referred to briefly, and Mr G Berdahl moved that these APPLICATIONS applications be referred to the Foremen's Committee Carried The various Councillors then gave a brief report to Mr Dorn and COUNCILLORS' Mr Dobler as follows- REPORTS 1 Mr Berdahl reported that Flint Construction are doing a road crossing east of Ed Gleck and are doing so very dangerously Mr King offered to check this out and advise Mr Berdahl further 2 Mr Berdahl reported that he felt the yield signs were not correct in several locations., one being south of Hesketh Mr Brown advised that the yield signs should be placed on the property lines Mr Berdahl felt that we should get these changed to move them back a little further so traffic would have time to obey Mr Dorn advised that Mr Duncan had no sign manual for his job, and Council advised that a manual should be obtained immediately 11 h 8 [A C --sommit- AIL- COUNCIL MEETING MARCH 8th,1976 3 Mr Berdahl advised that the Carbon Shop Door was in very ba shape, making it very cold in the shop He was advised that the door has now been temporarily fixed Mr Berdahl advised that six alternators had been burned out on patrol two grader The secretary was advised to check the work orders and report on this matter to the Foremen's Committee meeting 4 Mr Berdahl also reported that we had a new stock pile location at the Marshman Land in the County of Wheatland P 8 COUNCILLORS REPORTS The Secretary reported that the Department of Highways has been in touch with him concerning the bridge on old highway 21 two miles south of Three HIlls He stated that the survey crew had come to the office to ask if the road should be changed Mr Ferguson and Mr Dorn were named as a committee to review this matter and advise the office as soon as possible Mr Ferguson reported briefly regarding the Ambulance Society He reported that the new building is almost finished, and that the new ambulance is in the new garage now Mr Brown and Mr King asked that the Ambulance Society save the old ambulance the Ford Econoline - for either rural fire protection as a rescue unit or for EMO for a rescue unit Final decision re this to come later Mr Berdahl reported that the Health Unit had shut down the East Coulee Hotel and they are now in court regarding raw sewage in the river Mr Dorn gave a brief report regarding the Linden Overpass He stated the C ` R is not happy as we did not seed it He was advised that the M D had seeded., but the grass did not take; and that the Department of Highways will re -seed the area this spring. Mr Dorn felt we should place a cement trough with restraining walls so the water would drain away to the west He stated that when the weather warms up we will have to keep a man with a pump there at all times The existing culvert is 18 inches by 160 feet long Mr Brown moved that we write to C P R and the Bridge Branch to try and get help with the proposed trough, and to the District Engineer and to Mr Mazurek of Alberta Transportation in Edmonton Carried Mr Dorn reported briefly regarding a fire at the shop on Friday Evening Old tires had been set outtt)o close to the incinerator and the fire spilled over and caught the tires on fire He and another man with two hoses could not put it out so the Fire Department was called One power line to the Butler Building was lost Council advised him not to leave any garbage that close to the in the future Mr Dobler. reported that we have received the new truck and it is at Ed Baerg's now being fitted with the hoist and box Mr. G King recorded the balance of the minutes The Foremen advised that R Angus Ltd , had put a reconditioned cat motor in unit T -•22 recently under partial warranty Apparently there was a flaw in the block and the motor had to be taken out and sent back A n Motor has been installed 1 0 V LINDEN OVERPASS FLOODING SHOP FIRE NEW TRUCK ARRIVED T -22 NEW MOTOR 0 C3 �-44 COUNCIL MEETING MARCH 8th,1976 There was no definite information about the warranty or the cost of the new motor at this time, as Mr Paquette was on holidays The foremen also advised that the new Champion Motor v NEW GRADER Grader was delivered approximately 1 week ago It was agreed that Mr Ferguson and Mr John Dorn inspect CHANGE IN ROAD the road west NW 23- 31 -24 -4 where the new bridge is to be WNW 23- 31 -24 -4 installed later, and to recommend, �'fany change should be made in the alignment, as the bridge is now on a diversion Mr Dobler and Mr Dorn then left the meeting ` Mr Jeffery reviewed the accounts with the Council members ACCOUNTS Mr Poole moved that the accounts be approved for payment as per list with the minutes Carried Circulars just received from AAMD & C were read, respecting the AAMD & C following.
