COUNCIL MEETING - FEBRUARY 23rd 1976

A regular meeting of the Council of the Municipal District of Kneehill
was held in the Municipal Office, Three Hills, on Monday. February 23rd,
1976, commencing at 9.00 A M

Division He was welcomed by Reeve Brown
Mr. Ferguson moved approval of the minutes of the meeting of
February 9th. and 10th, 1976, as per copies circulated

Mr G King and Mr R G Campbell reported that they had recently met
with Mr Ken Brisbin of Underwood., McLellan and Associates and with
Mr A Cunningham, and representatives from Huxley - Bob Kennedy John
Johnson and Walter Anderson - and had discussed the proposed Huxley
Sewer system in detail A by -law to be considered by Council
and a schedule setting out the location of the proposed sewer lines
were reviewed with Mr Brisbin, and a report was now given to this
meeting Mr Poole moved first reading to By -law number 788,
this beixtg a by -law to provide for the sewer system in Huxley
Carried Unanimously
Mr Bauer moved that the committee report regarding the Huxley
Sewer System be accepted and that the by -law and schedule be
advertised as required

Mr L Litz of Division 6 arrived at the meeting at this time - 9 15 A 14
Council was advised that Reeve Brown could not be at the Council
meeting on Monday, March 8th; and thus arrangements for a municipal
photograph have been changed., and will now be taken on Monday, March
15th at approximately 10 00 A M
Mr Berdahl moved that this be approved

Letter of January 30th 1976, from the Town of Three Hills asks that
this Municipal District provide computer services for the Town water
billing This would be on a rental basis Mr G King advised that
he has investigated concerning this and believe the service could be
given as long as it did not have to be work done during the last few
days or the first week of any month
Mr Ferguson moved that this be approved in principle; and the
Secretary Treasurer be authorized to negotiate the details

Letter of February 16th.,1976, from Alberta Government Telephones asked CABLE
permission to put a telephone cable in the ditch east of Section 9 -16 and IN DITCH
21 in 31 -24 4 Council discussed this and felt that the road may need to A G T
be upgraded at least in part in future Mr Ferguson moved that Alberta
Government Telephones be contacted to ask if they can put the cable back
in the field, with the set back of 125 feet from the center line of the road

Mr Poole moved approval of the extension of Alberta Power Ltd. ALTA
services as per plans submitted with letter of February llth,1976. POWER LTD
involving lines to Section 20 and 29 in 31 -24 -4 EXTENSION

Letter from Ken R Madsen of Madsen Instrument Sales and Services K MADSEN
Ltd , asks approval for a business to buy and sell goods in the oil BUS LICENCE
well instrument service business Mr Ferguson stated that the location SW 26 -30 -23
will be in NW 26- 30 -23 -4. Mr Ferguson also asked to be excused from 4
voting on this matter, as Mr. Madsen is his nephew, and this was
agreed to by Council
Mr Campbell moved that Council recommend approval of the granting
of the business licence

Subdivision application from Don Pryor for an approximate 1 acre site SUBDIVISION
subdivision in SW 1-32 -24 -4 was considered as per details received PRYOR
from Calgary Regional Planning Commission SW 1 -32 -24
It was noted that this was immediately adjacent to the Town of Three 4
Hills and is along a secondary road Mr Poole moved that this be
referred back to C R P C for its comments due to its location, near
Three Hills

Council was advised that Alberta Municipal Affairs has granted an EXTENSION
extension of time for the Development Control By - -law to August 19th., TIME

Letter from R 0 Keglowitsch and previous correspondence from C R P C
was referred to in regard to the Downe subdivision in NW 6- 29 -23 -4 DOWNE
Mr G King reported that he had been in contact with C R P C regarding SUBDIVISION
the requirement for the service road and it appears that the ruling NW 6- -29 -23
may be changed so that only the 100 foot width of the entry road may

Mr Poole moved that this report be accepted and that Council
support the request that only the 100 foot width for service road R r
on the 100 foot wide entry be required

Notice from C R P C was read and it advised that the annual
meeting of the road study committee will be at its office
Wednesday, February 25th commencing at 9 30 A M
In answer to questions from Mr. Berdahl,, Mr Brown explained the
general planning of secondary roads and the purpose of the meeting
in Calgaryto co- ordinate the work between the various municipalities
He also asked for Council's approval to take cost records from this
Municipal District to that meeting
Mr Poole moved that the delegates to the said annual meeting
be R W Brown and A W Bauer and that they be authorized to submit
cost records from the M D of Kneehill in regard to grading or gravelling
of roads

Corporal Al McLeod of the Three Hills R C M P detachment
met with Council, and introduced himself and stated the purpose
of his visit was to ask if there are any problems in which the
R C M P may be of greater ass3_stance. Items discussed included
the following
1 A waterways department was opened up last month, which will handle
items dealing with waterways and migratory birds
2 Municipal parks at Keiver Lake Swalwell, and Tolman will be
supervised, but they cannot always have people at these locations

He was advised that power boats and swimming are allowed at Kei.ver'
Lake,, but no power boats at Swalwell
3 They try to keep track of the route followed by motor cycle
garb, but they have problems in that no one gives testimony when
there are complaints
4 It was suggested that telephone service to Keiver Lake Park
might be of assistance
5 No unmarked police car is available for this area, and the gene
trend is away from this type of unit
6. There are five men on the detachment here; and Corporal McLeod
briefly outlined the type of shifts etc , they follow Extra
help can be brought in for special occasions
7. He explained the road check program, and the breath tests, and
expected results from those
8 Road bans were discussed He stated that the R C M.P cannot
give enforcement, but patrol divisions is the responsible party, &
they have portable scales
9 Signs and Safety - Corporal McLeod stated he felt this area. w
quite well marked with signs, but it is important to maintain same
Corporal McLeod was thanked for coming to the mk-�eti.ng and bringing the
information In turn he thanked Council for the opportunity and stated
he would like to meet with them at least twice a year He then left the
meeting
WATER
Mr Tom Slater and Bob Hardy of Water Resources met with Council and RESOURCES
the following items were discussed BRANCH
1 Sunnyslope East Drainage Project involving parts of Sections 7 and 8
and other lands in 31 -26 -4 They stated that the fast drop could Ize causing
erosion, so control drop structures are needed, and they have also prepared
plans for back flooding of the pasture land The cost for a full system
is estimated at $3223000 00 With one back flooding structure $1009000.00
and with no back flooding - about $75 000 00
The grant available would be a matching dollar for dollar grant with the
local authority and the local authority could get its money by any means
possible, including contributions from the owners,by taxes, from Ducks
Unlimited, or other sources
Mr Poole moved that the owners of the land concerned be invited
to meet with Council on April 26th, next, at 10 30 A M for a full discussion
of these matters

2 Swalwell Dam - and Release of Water for Down stream use
They recommended a second pipe through the dam at a higher level that
the previous outlet They will bring details to the meeting on April
26th It was agreed that siphoning or pumping for downstream is too slow
3 They were given a copy of the account for the work done at the
WTmborne Dam, and they will give this their attention
4 Acme Recreation Dam - they will hold a meeting in May or June with
the interested groups
5 They wild likely provide the Village of Carbon with some financial
help for a storm sewer to take care of water which flows through the village
They are also studying the horseshoe area drainage, and may recommend
char4ng or partly changing the creek channel 4

6 Orkney South Drainage Project - the landowner forms have not
been sent in, and thus nothing further is taking place
7 Drainage for Mr Haller - in or about Section 12- 33 -23- -4
It was agreed that Mr Campbell talk to them with the suggestion
that the procedure be similar to that near Sunnyslope
8 Wittstock Drainage -- SW 1- 30 -26 -4. - They stated that is being
designed now They grant free design and supervision, and advice,
but the owner is responsible for the costs
9 They stated they are making up maps of undergrounds
streams and sources
10 Development Control By -law -- Any permit related to water
also requires water resource approval.
They can give us a form letter setting out the main details
of the act, and they stated that licensing gives both control
and protection
All dams should be licensed, and from this they get an inventory
of location and quantity of water, etc
Mr Poole moved that Council submit a letter to Water Resources
stating that Council will co- operate in the matter of licensing
in regard to water matters

11 Mr Berdahl asked about certain drainage matters at Hesketh
and whether or not the natural run off had been changed in so /
far as drainage channels, etc , are concerned There was no
information available, but it is likely that Council will take
a further look at this matter
Mr Slater and Mr Hardy were thanked for bringing information to
the meeting. They noted the date of April 26th for again meeting
with Council They then left the meeting
Council adjourned for dinner from 12.00 Noon to 1 00 P M.
Mr. Poole moved that Council inquire regarding the possibility of
a pay telephone at Keiver Lake, and perhaps also at Tolman Carried
A revised statement from the Town of Trochu gave the 1975 swimming TROCHU
pool finances to the end of that year This showed the M D share SWIMMING POOL
as $4,346.09 Mr Bauer moved that this statement be accepted STATEMENT

Report from the Wimborne Community Center showed a very active year
and a large addition added Mr Campbell moved that this report be WIMBORNE
accepted and filed Carried COMM CLUB
Letters regarding a special recreation tax as received from Town of RECREATION
Three HIlls, Village of Linden, Town of Trochu and Village of Torrington LEVY
were then read
Torrington opposed the levy, both through the Council and Recreation Board L/
The other official letters from the Councils supported the levy
Mr Ferguson advised that he had a meeting in his division a short
time ago; and had discussed general municipal business All 37 persons
present had voted against a recreation levy Considerable general
discussion followed. Costs of holding a plebisite were discussed
Mr Poole moved that this matter be tabled and brought up at the annual
meeting and that this be so advertised. Carried 5

Mr Ted Paquette, Public Works Superintendent and Mr Joe Dobler,
Gravel Foreman, came into the meeting during the discussion an recreation
and remained for the Public Works portion of the meeting following
Mr Les Hempsey . District Engineer, met with Council The following were ALTA.

1 Mr Hempsey advised that C N R says the overpass work south of Three DISCUSSION VARIOUS ITEMS
Hills will not likely be done before 1977
Discussion followed Mr Ferguson moved that a letter be sent to the C N R
asking if the project can be proceeded with in 1976

2 Mr Hempsey stated that his funds for survey and road design crews
had been reduced, and he was thus short of help as some crews had to be
laid off It was generally agreed as follows
a) The design at the underpass south of Three Hills may not be needed in
1976
b) There is no hurry for the design of the road north and south of Merle
Anderson in 30 -22 -4
c) The road from Number 21 in to Swalwell is being looked at by the
construction branch for 1977
d) The road from Sunnyslope east to the pavement may be needed, but Mr
Hempsey was not certain if he could get this done
e) The Bridge Branch had stated they will supply a new bridge for West
NW 23- 31 -24 -4 this coming winter Mr. Hempsey stated they would be able
to do the necessary survey work for the report to the bridge branch
Mr Ferguson moved that this be authorized

3 Only two secondary road projects have been approved for any work -
in the Red Deer District - thus far Neither is in the M D
One is in the Verdant Valley area, and the other is Secondary Road 816
from just west of Pine Lake south to the Innisfail Road No paving has
been approved to date for any project
4 Mr G King stated that he had talked by telephone with Mr E Danchuk
the Provincial Secondary Road Engineer Mr. Danchuk had stated that it
is difficult to get approval for projects and it appears that there may
not be much grant for paving Mr. Danchuk had been advised that
this district would be interested in the grant for grading if the paving
is not approved
5 Records of our costs regarding our grading work, etc was discussed at
some length Average cost was about $27,700 00 per mile using government
rates Mr Brown explained that this was based on the government rates
and our cost records for the various mach nes showed that we had made some
profit Mr Hempsey questioned our accounting procedure at some length and
agreed that we appeared to be doing quite well in this matter.
Costs vary greatly depending on the class of road and the distance of haul
6 Mr Hempsey gave each Councillor a circular regarding the load limit
LOAD LIMITS
for the various types of vehicles and number of axles etc Provincial limits
is now 110,000 on most roads, subject to axle loading He suggested that
the M D have a load limit on various roads; but grant overload permits for
occasional loads, subject to being within the axle limits.
7 Letter from Dr. Horner Alberta minister of Transportation was read ORKNEY HILL
in regard to the Orkney Hill In brief he stated t`�.at the estimated costs PROJECT
of $-00,000 00 for improvements was not justified a` present
8 Note was made that the meeting of the Central Alberta Association
of M D & C will be held at Red Deer on March 25th, 1976, commencing at

Mr Hempsey advised that his assistant:. Mr Ken Haslop has resigned
and is now working for the City of Red Deer A Mr Ed Mazurek
is coming as his new assistant
Mr Hempsey was thanked for meeting with Council and bringing information
He then left the meeting
Further discussion took place regarding improvements for the Orkney
Hill and the letter of Dr Horner. Mr Ferguson moved that a letter
be sent to Dr Horner Alberta Transportation, explaining the secondary
road 575 east of Carbon does not serve the Orkney area,, and that the
hill is very dangerous, and that further request be made for improvements 1%
This motion was voted on and declared lost
Letter of February 13th, 19765 from the Bridge Branch; Alberta BRIDGE
Transportation was read, giving a report regarding the various BRANCH
requests made last fall Copy of this has been given to Mr Ted Paquette. REQUESTS
Mr Ferguson and Mr Paquette advised that the new bridge west
NW 21 -31 22 -4 is now carrying traffic but still has warning signs
up The railings are still to be put on; and the floor will have
a coat of asphalt put on later
Considerable discussion took place regarding the recommendation for
a salvage bridge at west NW 26- 32 -27 -4 - near Fred Art This would be
on a cost sharing basis5 and there is no guarantee that it would solve
the problem on the down stream side The recommendation in principle
had previously been verbally approved by Mr Art
Mr Poole moved that this proposal be approved. subject to firm
agreement first being signed with the landowners on the upstream and
down stream sides of the location, and with the guarantee that no
further claims would be brought against the Municipal District

The Bridge Branch propose to supply a 60 inch culvert 94 feet long
at WNW 28- 29 -22 -4, near O'Rourke Farm Mr Berdahl moved that this
be accepted

The Bridge Branch agreed to supply an 84" culvert 160 feet long for
SSW 1- 31 - -24 -4 if that road is to be up- graded Mr Ferguson moved that
the Bridge Branch be advised that this project will not be undertaken
in 1976.

The Bridge Branch will supply two 20

Council directed that the reply of the Bridge Branch regarding our
requests be filed
Council was advised that Mr John Lehmann who works for the C P R
had telephoned to say that an 80 foot long culvert at the Linden Overpass
is plugged and is causing some concern because of water flooding over
the tracks It was agreed that this be checked
Mr Brown moved that Mr. Paquette have authority to authorize three
employees to attend the R Angus School in Calgary on February 26th

Two requests for a supply of gravel were considered, and dealt with
as follows-
1 Olds Contracting Ltd - 6000 yards from Torrington Pit.
Mr Bauer moved that Council refer them to Harvey Schmautz
and the possibility of gravel in SE 20- 32 -26 -4.

2 Art Hunter - gravel from the Megli Pit for C.W N Gas
The quantity would be 500 or more cubic yards It was agreed
that he be referred to the supply at the Beiseker Pit.
Mr J. Dobler showed Council a map he had prepared outlining
the areas that the gravel should come from for various roads
He suggested that more gravel be used from the Beiseker Pit, and
another stock pile selected along number 9 highway
Mr Ferguson moved that Mr. Dobler and Mr. Berdahl get another
stock pile site, along Highway No. 9, and also that Linden
Contractors be authorized to crush another 5000 cubic yards
for the M D at the Beiseker West Pit, for a total of 10 000
cubic yards.

Mr. Brown reported that Linden Contractors have crushed and stock
piled approximately 25,000 cubic yards at Megli., so have a further
15.000 to do at that location. As the area for stock piling is
somewhat limited, Linden Contractors were authorized to move to
Beiseker to do work there. and will return to the Megli Pit later
Mr Alex Cunningham, Utility Officer, then met with Council.
Mr. Cunningham and Mr. Ted Paquette reported on the safety seminar
held in Edmonton recently, which they had attended along with
Norman Soder, John Dorn and Joe Dobler They considered it a very
good seminar, with an attendance of about 250 people They advised
they were told insurance were going up, because accidents
are going up and costs are of course much higher Deductibles
are going from $50 00 or $100.00 range to $250 00 and may go up to
$500 00 Buried telephone cable claims are also adding to the expense
The legal definition of negligence has never been made clear, but it
means that employees and others must take reasonable care.
The procedure of having motor graders travel on the left hand side of
the road at times, is also causing concern, but there is a dual
responsibility for care shared with vehicle operators.
Mr G King left the meeting at this time, and Mr. J Jeffery recorded
the balance of the minutes

Mr. Cunningham reported that when the M.D is erecting barricades IN
for road construction, they should be at the beginning of the road
as well as at the actual excavation site. it was noted that many
Municipal Districts and Counties are getting damage tufts file against
them for entering private property for snowplowing, etc., and
damage Also Municipal Districts and Counties are responsible for
railway crossings up to one foot from the end of the ties Sewer lagoons
should have a chain link fence around so no person could be hurt in the lag oon.
Mr Paquette also advised that if the M.D has a borrow pit, or a dug out
in a borrow pit, on private land, the M D. would be responsible for any
drownings, etc
There will be a motor fleet course - March 12th - in Edmonton, and the
insurance seminar advised all Municipal Districts to send their drivers
to defensive driver training course, and also should show professional
driver training films Put u
All trucks should be carrying warning signs, and be stopping to p P
all signs, and also flagging any pot holes, etc., on the roads. Mr Cunningham
stated people driving for mileage for the M D should have at least $1,000 000.00

Mr Brown moved that a letter be sent to the AAMD g C - Mr. Jack
Edworthy - thanking them for the safety course, and that the M.D. THANKS FOR
of Kneehill felt it was a very valuable course SAFETY

The Secretary reported that Mr Alan Hazel had an accident
February 20th, 1976, at 11 15 A M He was driving a 1973 International A HAZEL
half ton crew cab into Imperial Oil Ltd , when the truck slipped on ACCIDENT WITH
ice going around the corner, and hit a cement barrier The damage TRUCK
estimate from Accurate Auto Body at Three Hills was for $104.50.
The Secretary reported that the accident does not interfere with the
steering as yet, but possibly could. Mr Cranston and Mr Hazel feel
that the unit should be fixed The Secretary further reported that
there is not enough damage for an insurance claim, or to be reported to
the RCMP
Mr Campbell moved that we have the unit fixed at Accurate Auto Body

The Secretary gave a report on the gravel operations for 1975. We have
hauled 166,650 cubic yards of gravel, which at government rates would GRAVEL OPERATION
be a gross revenue of $32534 51 The expenditures for wages and employee FOR 1975
benefits, at 16 %, machine repairs, fuel, insurance and licenses, resulted
in a cost of $265,965 31, depreciation on net capital cost ofi $27,929 98
interest on investment at 10% $13.,964 99, giving a net profit on our
gravel haul operation, at government rates of $17,374 23.
Mr Berdahl moved acceptance of the report.

The minutes of the Ag Service Board of Tuesday, February 17th 1976, MINUTES
were referred briefly to Council Mr.Bauer moved that all persons getting
cyanide shells must return the empty shells before they can get more.

Brief discusaon was held concerning the mileage meals and per diem
for Mr Harold Howe during the Tour Mr. Howe had worked several days
without putting in for expenses. Mr Poole moved that we pay Mr Howe
2 days per diem, plus 100 miles

Discussion was held concerning the Three HIlls Seed Cleaning Plant and
the higher capacity machines It was decided to leave this until the
March llth,1976 meeting
Mr Glenn Smyth read his resolution to Council stating that basically
any resolutions, whether defeated or passed, at the Provincial Service
Board Conference, should be forwarded to the government for their
perusal
Mr Poole moved that we present the resolution to the Service Board
Conference
