( SEE OVER FOR EXPENDITURE CONTROL ) LM COUNCIL MEETING - FEBRUARY 9th,1976 ----------------------------- - - - - -- P 1 A regular meeting of the Council of the M D of Kneehill #48 was held in the Municipal Office, Three Hills, onMonday, February 9th, 1976, commencing at 9.00 A M. Councillors present for this meeting were Division 1 Gilbert A Berdahl Division 2 Clifford Poole Division 3 Ralph W Brown (Reeve) Division 4 Art W Bauer Division 5 Thomas A. Ferguson Division 6 Leonard Litz Division 7 Reg Campbell Mr G G King, Secretary.-Treasurer was present and recorded the minutes Mr Bauer moved approval of the minutes of the meeting of January 26th, 1976; as circulated Carried Mr G Berdahl made some comments concerning the penalty by -law., passed on January 26th 1976, and stated he felt that it should have been a better arrangement He asked to be recorded as not entirely satisfied even through he had supported the by -law He felt that payment of interest to banks is a bad procedure A monthly statement for the month ending January 31st, 1976, was presented and discussed as per copy with the minutes, This showed a net balance at the end of the month of $5,246 46, but with $177,000 00 owing on loans Mr Ferguson moved adoption of the financial statement Carried Correspondence from Bill Eltzen Electric and from Acme Lockers and Trading were read and discussed briefly Eich referred to a business each wishes to establish in the rural area Thematter of a two mile limit from the villages was also mentioned This was tabled until later for discussion with the Planning Commission representative Recent correspondence from Alberta Labour regarding building re?ulations and the requirements for a building inspector were read. Mr Berdahl moved that this be filed Carried Mr Bauer moved the approval of building permit as issued to Hudson Bay Oil and Gas Co Ltd. for a processing plant in SW 31-- 32 -24 -4 Mr Brown and Mr G King each read a report prepared in connection with a meeting held with Planning Commission representatives and other for the discusion of proposed annexation to the Town of Three Hills It is Doted that the matter requires further study and further meetings will likely be held Mr. Ferguson moved that Mr R W Brown and Mr G King prepare an article to be published in the Three Hills Capital outlining the position of Council and other related matters in connection with the proposed annexation Carried Ms Penny Remmer of C R. P C then met with Council. The letter from Acme Locker and Trading was again read and it was noted ft proposed a meat processing and meat and grocery retail outlet, which they wished to establish immediately north of the Village of Acme Ms Remmer suggested that this be referred to C.R P C for comments especially because of the fact that the application includes a grocery PRESENT APPROVAL MINUTES PENALTY BY -LAW COMMENTS BERDAHL MONTHLY STATEMENT ALTA LABOUR BUILDING REGULATIONS HUDSON BAY OIL & GAS BUILDING PERMIT ANNEXATION PROPOSAL ACME LOCKER BUSINESS outlet 2 A 10 A COUNCIL MEETING -- FEBRUARY 9th.1976 P 2 Mr Bauer moved that this recommendation be accepted and the matter referred to C R P C Carried Letter from Bill Eitzen Electric asked permission to operate his electrical water pump, stock waterer and heating system repair business from Pt NE 8- 30 -25 -4 This is on a small acreage, where he lives, and it is more than 2 miles from Linhn by road, but slightly under two miles if measured from the closest point in a direct line Ms Remmer stated that the commission idea is to allow home occupations only in the rural areas. Exceptions apply in regard to natural resource industries and in businesses which are strictly agricultural Considerable discussion followed Mr Berdahl moved that Council authorize approval of the operation of the business of Bill Eitzen Electric as applied fort subject to this being referred to the Village of Linden and no objections being received from Linden. Carried v/ BILL £ITZEN BUSINESS The proposed development control by -law number 731 and changes recommended by various Council members was then discussed in more DEV CONTROL detail It was noted that the Provincial Planning Board has been BY -LAW requested to give a time extension for the final passing of a by -law on this matter, but the reply has not been received On Page 2 (g) it was felt that reference should be made to the majority of Council members present and voting In regard to the second farm dwelling Ms. Remmer replied to a question and stated that the dwelling is considered a farm dwelling only if it is needed for additional farm help Various other matters and procedures were discussed at length Mr Ferguson moved that the proposed Development Control By -Law be re- drafted with the changes as recommended by Council, that the comments of the Director be obtained, and that this then be again presented to Council Carried Ms Remmer reviewed briefly with Council a resolution No 1, revised copy, which would follow the passing of the Development Control By --Law. She outlined the general requirements of the resolution She also reviewed resolution No. 2 and gave it brief review She stated Council should study these and be prepared to make any changes which they desire The situation regarding the planning matters and the Prairie Bible Institute was discussed, and Ms. Remmer was asked to get information about the proper procedure to be followed in that case where there is no subdivision as such Council meeting adjourned for dinner from 12.00 Noon to 1.00 P M DINNER Mr R W Brown reported briefly regarding the annual meeting of C R P C C R P C. held this past Friday He stated the budget is up approximately 20% and ANNUAL they expect to add four staff members A separate preliminary regional MEETING plan is being prepared for Wheatland, Starland and Kneehill Ms Remmer stated the first draft of that plan could be ready in approximately 1'-2 months. jar Brown also reported that Drumheller is trying to get a planning commission centered there., and may have success other items discussed included caveats and reserves, but these matters are now covered by legislation, so need resolutions for any changes .It was also noted through discussion at this meeting that there are no fixed by -laws or rules governing attendance and voting at annual meetings of C R P C This had been discussed at the annual meeting a year ago, but still nothing had come out of that discussion �r Brown thanked Ms Remmer for attending and she then left the meeting 3 a 1 L COUNCIL.MEETING - FEBRUARY 9th,1976 Mr Berdahl moved approval of the report of the annual meeting of 0 R P C , as given by Mr. Brown Carried Mr Campbell moved that the circular regarding Heritage Day be filed without any special action by Council Carried Mr John Jeffery, Assistant Secretary - Treasurer, presented the accounts for consideration These were reviewed with Council Mr Poole moved approval of the accounts as per list with the minutes Carried Mr Ted Paquette. Public Works Superintendent; and Mr Joe Dobler, Gravel Foreman, met with Council Council was advised that Linden Contractors have just moved their crushing outfit to the Megli Pit; and may be starting to crush there today Mr Doug Hazelton asked if he can buy 5000 cubic yards of pit run gravel from that location, and also asked what the price would be In the discussion that followed it was noted that the general supply of gravel is running low, but gravel requested by Doug would be used within this area Mr. Poole moved that the price of all gravel including pit run, be increased 10� per cubic yard, and that Doug Hazelton be advised that he can obtain 5000 cubic yards of p ,Lt run gravel at Megli's, at 50t per cubic yard, if there is enough stripping done to provide for the Municipal District requirements first, and that much as additional Carried P 3 C R P.0 ANNUAL REPORT HERITAGE DAY CIRCULAR ACCOUNTS GRAVEL CRUSHING Mr Poole moved that Lot 16o Block 3, Plan 2315 A B , at Acme PURCHASE be purchased from the Village of Acme at the price of $500 00 LOT AT ACME cash, as the said bt is needed for travel around and at our storage building. Carried Council discussed whether or not to invite bids for fuel supply FUEL BIDS for 1976, and /or further periods The foremenadvised that Gulf Oil has given good service, but they have been buying their fuel and greases..; etc from Imperial Oil Mr Poole moved that no bids be called for fuel, in 1976 Carried Mr G King and Mr R W Brown advised that the load limits on LOAD LIMITS all numbered provincial highways in this area now are 110 000 pounds winter and summer This may create severe problems with our roads. Some believe that the heavy loads do not affect roads any more adversely, because of the extra axles required on the vehicles Mr Brown mentioned that a special speaker will be at the Spring meeting of the Central Alberta Association of M D & C., to be held at Red Deer either March 23rd or March 25th Mr Bauer moved that the matter of load limits within our M D be tabled until after the said meeting Carried Council was advised that Mr Tom Baerg had asked that further GRAVEL inspection be made of possible gravel supply in SE 24- 30- 26 -4. SUPPLY Mr Paquette and Mr Jeffery had looked at this earlier, and had TOM BAERG felt that the material. was much too sandy Mr Brown moved that the area be re- inspected in the coming spring Carried Council was advised that a new owner is locating in Pt NE 12- 29 -22 -4 NEW OWNER south east of Hesketh on the former Heinrich farm He had inquired PT NE 12 -29- 4 22 -4 ILJ) C COUNCIL MEETING - f h/ FEBRUARY liBth,1976 P 4 about road and school services, etc It was agreed that his need for road improvements be considered along with other roads when the program is being drafted later. The matter of school facilities rests with the School Division Mr Poole brought up for discussion certain matters pertaining o the Swalwell Dam- and the following were noted 1. Some picnic tables and perhaps garbage barrels have been put out people with it nothing msare tot Two be referred h to toilets h Mr Norman Soder. 2 The outlet valve to let water down stream cannot be opened and Mr. Ron Hilton of Water Resources was to bring in some recommendation Nothing has been heard from him This is to be followed up immediately. Fish Correspondence recently received thatgrepliesthe be sent follows' Pond was read 1 To Alberta Culture advising that no archaeological reconnaissance has been done and no one knew that anything was required There was only a small amount of excavation in a muskeg area. 2 To Alberta Environment advising that construction is completed and they may arrange inspection when they so desire Carried Mr Berdahl asked about the possibility of a further gravel supply at the Hesketh Pit on the Nl� 10- 29_22 -4 Mr Dobler stated that there may be more gravel under the knob in the NE of 10- but testing would be necessary to determine the amount Mr. G King stated that he had written to Bertram Drilling and contacted him personally, about doing some testing but there is no action yet It was suggested that we ask the Alberta Government r-r_-Lrding rotary drill testing similar lls The matter is to be to the type of work they do for water we followed up further Mr. Berdahl stated that he had talked to Ken Loewen about gravel su ply in P1� of 9 -or NW of 10 in 29 -21 -4 Mr Loewen said the tiles are being straightened out and may have tMrsell, but has been offered 25� a cubic yard Poole moved that Council negotiate with Mr Loewen regarding a supply of gravel Carried - e It was also noted that a back NE e test or 4r gravel could be done later on the Fraser land Mr. Paquette, Mr Ferguson and Mr Campbell reported on their study regarding the Dodge rural fire truck at Three Hills This is a 1962 M unit with approximately 62,000 miles r Paquette stated they had taken the unit to our shop and found it had fair compression, but there is a noise which may be a connecting rod A new seal is needed in the rear end, the electric tachometer ood 1Theosaid committee felt Cab, tires and general condition is g at it would be difficult to mount all of the equipment on a new th cab and chassis unit, and if any new unit was being bought; it might be Letter to go the whole way They suggested that a reconditioned 360 CC motor be put in if it will easily go in place, or a reconditioned 318 c c otherwise, and that other necessary repair work be done to the prosmt unit Mr Bauer moved that the committee be authorized Carri proceed Carried 5 J� SWALWELL DAM WIMBORNE FISH POND GRAVEL SUPPLY RURAL rIRE TRUCK THREE HILLS i 19 11 Iq COUNCIL MEETING -- FEBRUARY 9th,1976 P 5 Mr Brown mentioned that he had been asked by the D A about WELDING the use of the Acme shop for a welding course Mr Campbell moved COURSE ACME S that this be approved; if they can arrange for the required SHOP power Carried Brushing on road sides was discussed briefly, and the following noted 1 Request of Fred Beirle for brushing on his side of the road east of 16- 33 -24 -4 Mr Paquette is to check to see if this can be done with the cat tractor during the winter, but there is some danger of stones 2 Mr Berdahl suggested the road down the hill to the Heysa farm inNE of 11- 29 -23 -4 should have a few of the trees cut out by hand, so that there would be a wider area for the traffic The matter of up-- grading first aid certificates was mentioned Mr Dobler stated the present certificates are only good for three years instaad of the former five year period Council had agreed to pay $20 00 per year for the first aid certificate for the five years; and some of the men thought the amount should be increased so they would get a similiar amount covering the three year period Mr Litz moved that Council pay $35 00 per year to those with valid first aid certificates who are employed by the M D , with payment to be made at the end of each year of employment when the certificates are in good standing Carried ROADSIDE B111'SHING FIRST AID CERTIFICATES Mr G King advised that Mr Charles Lau of the Drumheller Health NUISANCE Unit has telephoned regarding grants in connection with nuisance grounds GROUNDS The cabinet has recently decided that grants will be available only for land and this is a reversal of the former policy It was agreed that Councillors Brown, Bauer and Campbell meet with the Council of the Town of Three Hills this evening to discuss the use of the Three Hills nuisance grounds and related matters A proposed resolution drafted by Mr R W. Brown asked the Alberta Government to consider allowing the use of recreation capital grants for operational expenses, where new facilities are not required Mr Poole moved that the resolution be approved and presented to the Spring Meeting of the Central Association Carried Verbal reports were given regarding the proposed closure of the C. P rail line through Carbon Meetings had been held at Carbon and the matter discussed with Alberta Trans Com Mr G King further advised that Trans Com had not been able to get any information from the C.P.R to show that losses had been sustained on that line nor that any subsidy has even been applied for Mr Brown reported further on these matters and stated that at least 9 briefs will be going to the Hall Commission in Drumheller on the 20th Considerable discussion followed Mr Berdahl moved that this Council through its committee prepare a brief urging that the rail line be kept open and suggesting that a joint use of lines may be of value as well Carried A letter from the Town of Three Hills and one from the Village of Acme, each requested the M D. Council to levy a 2 mill general recreation levy, excepting the area within the Trochu Rural Recreation area Other replies are expected from other villages Mr Poole moved that these be tabled Carried f W RESOLUTION RECREATION GRANTS C P RAIL CLOSURE RECREATION LEVY Ln 11 COUNCIL MEETING FEBRUARY 2fth ;1976 M Mr Brown and Mr G King reported on the Alberta Disaster Service Committee meeting held recently. The equipment on hand is to continue to be stored at the Municipal office in Three Hills unless otherwise arranged As of April 1st each municipality will be basically operating on its own They further advised that only Alex Cunningham will represent the Municipal District at the course in Edmonton this week as others were unable to attend on the 1st day Mr Berdahl moved that the report be accepted Carried Reeve R.W Brown read the report of the Municipal Inspection made on November 26th to 28th, 1975 It was noted that the report was very complimentary to the administration, and no adverse criticism was contained therein Mention however was made of the deficit in 1974 business Mr Ferguson moved that this report be acknowledged, and placed on file to be read at the annual meeting' Carried Mr Brown reported very briefly on the executive meeting of the Central Association of M D and C , held at Three Hills last week A further study is being made of having a book of the minutes of the association prepared and made available for sale Further details will follow at the spring meeting at Red Deer which was referred to earlier Mr Poole moved acceptance of the Community reports as received from Orkney, Hesketh, Crossroads, and also the report from the Trochu Swimming Pool Carried Minutes of recent meetings of the Carbon Recreation Board were referred to briefly Mr Berdahl moved that these be accepted and filed Carried A letter from Mrs Edna Barker of Acme area stated she wished to operate a concession at Keiver Lake Park and she gave considerable detail concerning the proposed operation She also stated they would be interested in making some kind of a deal to clean up the empty garbage barrels and generally pick up around the camp site. Mr G King advised that Mrs Barker had been to the office and had discussed this matter with him previously Mr Bauer moved that Council approve of the concession but that it not be on an exclusive basis.. and that Mrs Barker be advised that Council would be willing to pay a small amount for the work required for the clean up at the park. Bauer T A Ferguson L G Litz R G Campbell T C Paquette John Dorn Joe Dobler Robett Cranston Keith Smith J.C. Jeffery Brief discussion was held concerning the 1975 budget and the Secretary reported that we had budgeted approximately $1504000 00 and had spent approximately $140,000 00 Mr Brown reviewed our policies regarding machinery buying He reported that keeping in government guidelines from last year, we should be spending abour $165.000 00 on machinery. The Secretary then reported that we had spent $62,000 00 to date for radios accounting machine and a welder, leaving a balance of approximately $103,000.00 The truck bids were then opened, commencing at 9 30 P M The following persons were present for the truck bid opening MACHINERY BIDS ETC Bob Gingrich - Shaw G M C Bud Chaffin - representing Peterbuilt Trucks from Paccar Truck Center, Calgary Rollie Koch - Rollie's Gulf Service, Three Hills Ken Gillard - Maclin Ford, Calgary The Secretary then read all the bids - see attached summary Mr. T A Ferguson moved that we purchase two half tons and a rally wagon from Garrett Motors,, Carbon., for the price of Two half tons - at $4576 81 each Y Rally Wagon - at $5327.29 and also that we purchase one LT 8000 1975 Model from Maclin Ford. Calgary at $23,250 00 - no trades Carried The meeting adjourned for dinner and reconvened at 1.00 P.M The tenders for 2000 3 - 4 inch by 6 foot pressure treated posts was then referred to - see attached summary. 3 to Mr R W Brown moved that we purchase 2000 treated /4" posts 6 feet long pointed from Prairie Posts Products Ltd , Three Hills; at a price of 95t per post Carried Thy heavy equipment bids were then discussed.
