Councillors present for this meeting were: Gilbert Berdahl C W Poole Ralph W. Brown Art W. Bauer T A Ferguson Leonard Litz R. G. Campbell Division 1 Division 2 Division 3 (Reeve Division 4 Division 5 Division 6 Division 7 lis' G G King was present and recorded the minutes APPROVAL Mr. Bauer moved approval of the minutes of the meeting of November 24th, MINUTES 1975, as circulated Carried The financial statement for the month ending November 30th,1975 was FINANCIAL presented and discussed as per copy with the minutes. STATEMENT This showed a net balance at the end of the month of minus $116,987 50 NOVEMBER and with $273,000 00 owing on loans. Mr. Campbell moved the adoption of this report. Carried Mr Brown moved that the matter of advertising the development control TABLE by-law be tabled until December 22nd, 1975, pending receipt of the opinions DEV of the Director of C R P C CONTROL Carried MUN CREST Mr G Wilson, Superintendent of the Three Hills School Division met with CONTEST Council at 9.15 A.M to assist in the judging of the entries for a municipal i0rest. The entries were spread out on the table and judged jointly by Mr. ,Milson and the Council members It was noted that 14r Litz did not take part In the later part of the judging as one of his family had an entry There were x.04 entries in total. Mr. Ferguson moved that the following awards be paid 1 Randy Lall, Carbon, Alberta - First $25.00 v g Dan Vert, Prairie Bible Institute, Three Hills, Second $15 00 3 Katrina S Tilzey of Prairie Bible Institute, Three Hills, and Sandra Litz, Wimborne, tied for third - each to be paid $10 00 Carried Council felt it best to take the winning entries to an art teacher, and have that person design the final crest, incorporating the main ideas of the winners. Mr Wilson recommended Mr Arlie Harder of Three Hills for this Mr Campbell moved that Mr Wilson be given authority to contact Mr Arlie Harder of :'Three Hills, and have him design the final plan for the municipal crest, and also mention be put in the Three Hllls Capital regarding the entries and the awards Carried Mr Wilson was sincerely thanked for his work, and he then left the meeting at approximately 10.30 A M e-1 A 11 w r- - M r- . d I i COUNCIL MEETING - DECEMBER 8th,1975 P 2 Correspondence in regard to planning matters was read, and dealt with C R P C MATTERS 1 Decision of the Provincial Planning Board regarding the subdivision of Lewis Esau in SE 17-30-25-4 refused permission to abandon the provision of public reserve on the remainder of the quarter section In the discussion Council members could see no reason for a caveat against the balance of the quarter when the public reserve amount was being paid in full for the subdivided area Mr. Poole moved that this decision be appealed to the Minister if possible Carried 2. Subdivision in NW 23-29-22-4 - H. Siemens - decision of C R P C. of November 14th, 1975 required a survey, that there be no direct access to the secondary road, and that provision of reserve be provided by payment in cash in lieu on account of the land being subdivided, and the balance deferred by caveat Mr Poole moved that the Council of the Municipal District object to the provisions in regard to the following (a) There appears to be no need for the 100 foot service road, and it would be too close to the existing buildings. (b) The survey would be costly and the area being subdivided can be easily described so the survey should not be necessary (c) There is now access from the parcel being subdivided to the secondary road, and Council sees no reason for it not to be used (d) Filing a caveat for a reserve on the balance of the quarter does not serve any useful purpose in the opinion of Council Carried 3 Proposed subdivision of area west of railway in SW 4-30-25-4 Eitzen It was noted that this is a change from the previous application for the NW of 4 Mr Brown moved that Council recommend approval with cash in full in lieu of reserve, and with no caveat against the balance of the quarter, and that there be no provision for access road. Carried 4 Different arrangements of titles of lots in Block 2 Allingham - William Hansen It was noted that the application signed by Mr Hansen and the circulation memo from C R.P C did not agree Mr Bauer moved that this be tabled pending clarification Carried 5 October minutes as received from C R P C were referred to briefly, with some mention of a dispute over land values of a parcel west of Airdrie for public reserve purposes This is in the M.D. of Rockyview, and was for interest only Mr Poole moved that the minutes be filed. Carried Mr Brown moved that Council approve of the extension of Calgary Power services to serve Mr F Keirle in the NW 30-25-4, as per plan submitted Carried Council was advised that Mr Jim Lilley of Wimborne is carrying water in pails from the Wimborne Well, and council was asked if he should be charged. Mr Litz moved that no charge be made for anyone carrying water from the well in pails, but that the matter of an CALGARY POWER EXTENSION F KEIRLE WIMBORNE WELL - OUTSIDE TAP ETC. .. ....3 IM i COUNCIL MEETING - DECEMBER 8th, 1975 P 3 a outside tap be considered later Carried A G T Mr. Litz moved that Council approve of the underground BURIED cable of Alberta Government Telephones west of 3 and 10 CABLE in 33-24-4 and across the NE corner of NE 36-32-25-4, as per plans submitted Carried Mr G King advised Council that by-law number 627 BY-LAW provided for the licencing of mobile homes and set NO forth the rates This by-law is no longer required, 782 as the matter has been covered under the Municipal REPEAL Government Act Mr. Berdahl moved first reading to BY-LAW by-law number 782, this being a by-law to repeal 627 by-law number 627, as of this date Carried Unanimously Mr Caupbell moved second reading to this by-law Carried Unanimously Mr. Poole moved third reading to this by-law Carried Unanimously Mr G King announced that plans for the Christmas party christmas on December 20th, are progressing, and he asked for guidance PARTY on a few matters, and these were given by Council. REPORT Mr Ferguson moved acceptance of the report Carried Mr Brown, Mr Poole and Mr King reported on their RAIL LINE meeting with the Ag Development Corporation at Three Hills ABANDONMENT in regard to rail line abandonment. Considerable general discussion followed It was noted that meetings will be held later, with one to be at Carbon, but there is no definite date, thus far Further information is to be obtained before any brief is prepared. Mr Bauer moved that this report be accepted and also that ,further information be obtained regarding the use of pipelines for the movement of grain Carried Mr Berdahl moved that taxes be cancelled for the following CANCELLATION and for the reasons as shown. TAXES 1 Orest Lukey - $87 00 - Pt NW 19-29-25-4 taken into Village LUKEY & 2 of Acme Don E Williams, Wimborne - $40 72 - old warehouse removed WILLIAMS before the end of December, 1974, but taxed in error in 1975 Carried Mr Ferguson moved that the Minister of Municipal Affairs, Edmonton, MINISTERIAL be requested to issue Ministerial Orders authori ing the passing of ORDER a by-law to adopt the 1975 assessment roll for taxation purposes in ASSESSMENT 1976, and to authorize passing the by-law for more than 7 consecutive ROLL ADOPTION ETC years Carried A brief report was given in regard to the meeting with other NUISANCE town and village representatives on November 26th, 1975, in regard GROUNDS REPORT to nuisance grounds. The proposal of Mr Lau as presented at that meeting was discussed briefly. It was noted that Mr Lau is also contacting the County of Wheatland and the M D of Starland and towns and villages of those areas regarding a combined proposal Mr Poole moved that this information be filed for further discussion after we have more reports from Mr Charles Lau of the Drumheller Health Unit. Carried 4 A Em 0 COUNCIL MEETING -- DECEMBER 8th, 1975 P 4 Letter of December 4th, 1975 from the office of the Director of Lands, Province of Alberta, asked for a sketch and other information in regard to the land required in NW 33-29-25-4 for a sanitary land fill site Mr Brown moved that a reply be sent giving a diagram of the area and requesting that approximately 20 acres be held for municipal use and explaining that other discussions are under way in regard to sanitary land fill or other alternate proposals Carried Council was advised that there have been complaints regarding dogs running at large in the Prairie Bible Institute area and particularly around the grade school Mr Ferguson moved that the dog catcher, who works for the town of Three Hills be contacted about providing service to the P.B.I area and asking for information regarding prices, etc Carried Mr Poole moved that the 1975 report from the Grainger Community Hall be accepted. Carried Correspondence in regard to the recreation matters were read, including the minutes of the Acme meeting of November 5th and the Three Hills meeting of November 18th Also read was a letter from the Town of Three Hills dated November 20th inviting all Councillors and Recreation Board members and others to a combined meeting in Three Hills on Wednesdays December 10th, at 7°30 in the arena It was noted that a number of our Councillors could not attend, but the Town had been unable to change the date. Mr. Ferguson moved that the correspondence be tabled and all Councillors who can, attend the meeting Carried A report of a committee meeting held November 26th, 1975, in regard to Alberta Disaster Services was given by Mr. Brown, Mr Campbell, and Mr. G King It was noted that the emphasis is on peace time preparedness, and that the program will be changing considerably as of next April 1st. It was also noted that Mr Gordon L Park had submitted his resignation as Area Co -Ordinator, due to the pressure of work at his farm Mr Berdahl moved that the report be accepted and the resignation of Gordon L. Park also be accepted. Carried Mr. Ted Paquette, Public Works Superintendent, and Mr Joe Dobler, Gravel Foreman, arrived at the meeting during this discussion Mr. Poole moved that Mr. Alex Cunningham be named Area Co -Ordinator for Alberta Disaster Services, for the period from December 1st, 1975 to March 31st, 1976 Carried Mr. Reg Campbell reported that Mr Don Graham can attend a fire committee meeting, but he prefers that the meeting be January 20th instead of Monday, January 19th, as previously discussed Mr Bauer moved that notices be sent for the fire committee meeting for Tuesday, January 20th, 1976, commencing at 7 30 P M and that a letter be sent to Mr Don Graham, of the Fire Commissioner's Office, outlining the business to be conducted at the meeting and other matters Carried Bids were then opened for items advertised as follows. ..5 SANITARY LAND FILL PROPOSALS NW 33-29-25- 4 P B I DOGS AT LARGE GRAINGER COMMUNITY HALL REPRT RECREATION MATTERS ALTA DIS SERVICES REPORT G PARK RESIGNATION A. Smith - $247.85 Mr Poole moved that the used hydraulic press be sold to K & K Farms Ltd for $1000 00 as high bidder Carried Mr Bauer and Mr Litz stated that they had looked at the spruce trees at the Rempfer Cemetery and noted that four or REMPFER five trees sometimes blow against the power lines with an CEMETERY east wind Mr G King advised that the Lutheran Church TREES ON holds title, but the two trustees named are both deceased. POWER LINE Mr Poole moved that this matter be referred to the Torrington R E A Carried Letter of December 3rd, 1975, from the District Engineer was read in regard to the division of costs for the CNR underpass DIS ENGINEER approximately 4 miles south of Three HIlls The railway is CORRESPONDENCE asked to pick up 37!1% of the cost as it is the applicant, and this would compare with the usual 1211% from the railway Further information will follow Mr Ferguson moved that this be accepted and filed as information Carried Letter of December 3rd from the District Engineer asked ROAD PROFILE for the priority for the profile and grade designs for certain PRIORITIES work in this M.D. Mr. Ferguson moved that the priorities be set as follows - 1; From SE 18-31-23-4 west 3 miles by way of the underpass 2. From Number 21 west to Swalwell and south west to the Swalwell Park 3. From Sunnyslope East to the paved secondary road 4. North of Merle Anderson being west of parts of 17, 20 and 29 in 30-22-4 Carried Mr G King gave Council information regarding portions of unused CANCELLATION road diversions in SE 14 -and SW 13 in 29-23-4 Considerable ROAD DIVERSIONS discussion followed Mr Berdahl moved first reading to By-law number 783, this being a by-law to cancel the portions of road a�lowance diversions as referred to above and to return same SE 14 & SW 13 t19 the parcels from which it came, without charge 2923-4 Carried Unanimously Mr Poole moved second reading to this by-law Carried Unanimously It was noted that this by-law will now be advertised and followed up as per the statutes 4 COUNCIL 14EETING - DECEMBER 8th, 1975 P 6 Discussion took place regarding road approaches being used by Andex Oil and their failure to make advance arrangements for same Particular locations discussed were 1 SW 27-30--24-4 - Council had previously stated that the approach road should come in from the old highway number 21 from the west, to avoid damage to the light coat surfacing 2 Loosmore location - in 6 of 25-30-24-4 - various proposals had been given by telephone, and Andex had stated they would make their entry out to the west to come out on the quarter section line in the middle of section 25 Another alternate had been to the south and east coming down along the quarter section line A third alternate had been from the well site south west along the edge of the coulee coming out closer to the south west corner, but still on light coat surfacing Mr Brown moved that Andex Oil be advised that Council's first choice is the road to the west, but that Council will agree to the road along the side of the coulee if Andex guarantees in writing to pay for all road damages and are assured that only approximately 1/8th of a mile of the light coat surfacing will be used Carried 3 Location in 7 of 22-31-24-4 - exact details are not known so no decision could be given about the approach and the amount of vision etc Mr Brown mentioned that the Municipal District now has only 2 25 foot lots at its shop location in Acme and should have one more at the east side, to give better access, including that for school buses Mr Brown moved that the Village of Acme be contacted in this regard Carried Information received from Alberta Transportation was given ta'Council in brief in regard to the location of road signs It was noted that the sign location recommended is -within 6 to 12 feet from the travelled portion of the roadway A copy of this information was given to Mr Paquette to be relayed to the person putting up signs Some discussion followed, but no motions were made r Summary of 1975 surfacing costs was given to Council 1 mile of new surfacing cost $6400 00, the average cost of resurfacing was $6415 00 Seal coating costs approximately $990 00 per mile. The total amount of oil used was 285,000 gallons Discussion followed about the relative costs compared to regravelling, and the scarcity of gravel and other matters. Mr Bauer moved that this information be filed Carried Mr Berdahl moved first reading to by-law number 784, this being a by-law to amend by-law number 548 by adding the following in regard to maximum loads over bridges. Item 1 a - 40,000 pound maximum load will apply to the bridge over the Rosebud Creek at Beynon in SW 29-27-20-4, and a 20,000 poi --id load limit will apply at the bridge over the Kneehill Creek west NW 26-31-26-4 - south of Allingham Carried Unanimously Mr Litz moved second reading to this by-law Carried Unanimously Mr Bauer moved third reading to this by-law Carried Unanimously I 11 ROAD APPROACHES ANDEX OIL V ACME SHOP LOTS ROAD SIGN LOCATIONS 7 1975 SURFACING - COSTS BY-LAW 784 BRIDGE LOAD LIMITS i Iq COUNCIL MEETING - DECEMBER 8th,1975 P 7 Mr G King was asked to check regarding load limits required for the bridge east of Hainings°, for the one at Ralston's and also the one near George Appleyard°s, and the one going west near the old Burns' farm Mr Litz asked that the Secretary -Treasurer look up information for next meeting regarding the title to the old Wimborne nuisance grounds, and that Council then consider whether or not to offer the site for sale Further discussion was tabled pending that information Mr. Berdahl reported that Mr Merle Anderson has agreed that the M D of Kneehill may stock pile gravel at the NW corner of NW 20-30-22-4 (Hempseed Farm) on condition that the gravel be kept well back from the buildings and from the well Mr Poole moved that this be approved, and that Mr Anderson be offered $75 00 per year for the stock pile site. Carried Mr Berdahl asked that a list be prepared for a later meeting in regard to Hesketh lots that can be offered for sale This will be done for a later meeting Mr. Joe Dobler reported that they are now stock piling from Tolman and expect to move to Garson`s pit next week. Mr R G Campbell asked if a water truck is available to be kept at Trochu during the winter for use in case of fire Mr Paquette advised that one is available at any time, and there can also be one available for Linden if they so wish Mr. R.W Brown and Mr J Jeffery gave a report of the employee employer committee meeting of December 2nd, 1975. Recommendations and requests were discussed The following motions were made in regard to that report. 1, Mr Poole moved that the Council approve of an offer of an increase of 50C per hour, plus 5C per year up to six years for seniority, with this to be applicable for all those hired at hourly rates for public works, and service board work. Carried 2, Mr Poole moved that no change be made in the present arrangements with regard to holidays, and holiday pay, etc. Carried 3 Mr Poole moved that no change be made in regard to the present policy with regard to sick days, and pay for same. Carried 4 Mr Bauer moved that Council approve an increase in the guaranteed minimum monthly wage from $500 00 to $550 00 Carried 5 Mr Ferguson moved that no change be made in regard to the awards .for safe driving Carried 6 Mr Campbell moved that Council agree to a change in €® @ trassionate leave which would allow the three days at the discretion of the employees as to the need for sa Carried 7. Mr. Ferguson moved that no change be made in regard allowance for certificates as heavy duty mechanics or we which is now 10C per hour in total Carried CHECK LORD LIMITS OTHER BRIDGES OLD V WIMBORNE NUIS. GROUND TITLE STOCK PILE STIE NW 20-30- 22-4 HESKETH LOTS FOR SALE GRAVEL REPORT WATER TRUCK FOR TROCHU & LINDEN EMPLOYEE EMPLOYER REPORT & RECOMMENDATIONS IN A Iq COUNCIL MEETING DECEMBER 8th,1975 au 8 Mr Bauer moved that no change be made in regard to the designation of slack time for holidays for mechanics Carried Mr Poole moved that Council approve payment of the accounts as listed, subject to further review at the next meeting, if any councillor has questions concerning same Carried Council was advised that Mr George Appleyard will soon be moving into the Village of Carbon, and therefore his status as a poundkeeper is uncertain It was agreed that the Secretary -Treasurer contact Mr Appleyard in regard to this. Mr G King and Mr. J. Jeffery reported to Council further in regard to an office accounting machine, and also a cash receipting machine Permission was asked to purchase an accounting machine from Burroughs Business Machines Ltd , at,a price of $26,445 00, and with a note that there will be some extra charges for programming in materials, but the total should not exceed $30,000 00 Mr Poole moved that the Council approve the purchase of the machine Carried It was agreed that a receipting machine be purchased under the 1975 budget as this had been provided for earlier Mr G King advised that he is trying to get one from National Cash Register, as delivery from Burroughs is very uncertain Mr Berdahl moved that the Secretary -Treasurer have authority to hire Margaret Casswell for office work commencing January 1st, 1976. Carried Mre Brown reportedb briefly on a recent meeting of the Hospital Planning Committee for the Three Hills area, and he stated that the Trochu Hospital will be mainly long term day care Plans foir Three Hllls are still under study. ACCOUNTS GEORGE APPLEYARD POUND KEEPER ACCOUNTING MACHINE ETC NEW OFFICE STAFF HOSPITAL PLANNING COMMITTEE Council was advised that the impoundment of three small calves at POUND Art Taylor's pound near Acme had been a problem for a short MATTER wh*le, until it was found that the calves had been brought in A TAYLOR from just over our border in the County of Mountain View. Tho impounders had taken them back from the pound MKr Ferguson reported briefly on Auxiliary Hospital minutes and AUX HOS meetings and stated that they have been endeavouring to stay within MEETINGS the guidelines and other matters REPORT Mr. Berdahl referred to an advertisement which outlines discounts for pre TAX payment of taxes in the City of Drumheller The City allows a discount of 10% PRE - in January, 9% in February and 8% in March Brief discussion only took place PAYMENT in regard to this as it was rather late in the meeting, and full information was not available The matter of discounts for prepayment versus penalties for slow payment were discussed No decisions were made.
