COUNCIL MEETING NOVEMBER 24th.1975 P 1 A regular meeting of the Council of the Municipal District of Kneehill #48 was held in the Municipal Office, Three Hills, on Monday, November 24th71975, commencing at 9°00 A 14 Councillors present for this meeting were. Mr. G.A. Berdahl, Division 1 PRESENT Mr C vi. Poole, Division 2 Mr. R W Brown, Division 3 (Reeve) Mr. A W Bauer, Division 4 Mr T. A. Ferguson, Division 5 (after 10 30 A.M ) Mr L Litz, Division 6 Mr. R G Campbell, Division 7 Mr G G. King, Secretary --Treasurer, was present and recorded the minutes. Mr Walter Anderson, Chairman of the Three Hills School Division, was present for a portion of the afternoon meeting. Mr. Poole moved approval of the minutes of October 27th, APPROVAL and 30th, 1975 and of November 4th, 5th and 10th, 1975, MINUTES with one correction in date � top of page 15 • should read November 4th Carried Mr Brown referred to page 20 of the above minutes; last paragraph - and stated that the reserve had not been waived in regard to Lewis Esau The Public Reserve requirement for the subdivision in NW 20-30.25--4 was discussed in regard to the PUBLIC RESERVE Hydroponics' location. Mr Brown moved that Council NW 20_30--25-.4 agree to accept a public reserve based on 10% of HYDROPONICS 13 30 acres at $300.00 per acre, so that the net payable would be $399 00, with this subject to approval of C R. P C Carried 1 BUILDING PE t:r Bauer moved that Council approve of the addition RESIDENCE to the residence at 343 3rd Avenue North adjacent P.B I to Three Hills, on property owned by the Prairie Bible Institute, all as per application submitted. Carried The minutes of the Three Hills School Division meeting THREE HILLS of November 12th, 1975 were reviewed briefly with SCHOOL DIV Council Some discussion followed MINUTES Mr Berdahl moved that these be accepted and filed. Carried Mr. Litz moved approval of the extension of Alberta ALTA POWER Power Ltd services to the following locations- EXTENSIONS 1 To South East 24 33-26-4 Dickinson 2 To LSD 8 of 5--31--24--4 -- Andex Oil Carried Mr. G King advised Council that the bronze plaque GAETZ CEMETE Y for the Gaetz Cemetery at Section 12-33-27-.4 has just BRONZE PLAQU, been received He also reviewed briefly the other cemetery work, and advised that footstones have been ordered for some graves which were otherwise unmarked. A few of the relatives have made payments for the footstones, but others will be at municipal expense, with the assistance ...2 of government grants. j r i M 40 on � COUNCIL MEETING NOVEMBER 24th,1975 P 2 Mr Campbell moved that this report be accepted, and that the erection of the bronze plaque be discussed with Mr Ted Paquette Carried Copy of a letter from Alberta Social Services and SANITARY LAND Community Health to the Town of Three Hills advised FILL SITE that preliminary approval has been given for the APPROVAL location of a sanitary land fill in SW 25.31•-24-4 TOWN OF THREE Mr. Bauer moved that this information be accpeted HILLS Carried Council members were reminded that the sanitary land fill committee will hold a meeting at our office on Wednesday, November 26th, 1975 at 7 30 P M. Invitations have been extended to the towns and villages councils and to Mr Charles Lau, Public Health Inspector; who will be showing a film, and bringing information Councillor T A Ferguson arrived at the meeting at this time, being approximately 10 30 A.M It was noted that the Town of Three Hills was convening a general recreation meeting for the whole area, and a proposed date was the evening of December 10th, 1975 This date was not a good one for the Municipal Council because of a health unit convention and other matters, which would mean that at least 4 councillors could not attend. Mr Ferguson asked that the Town of Three Hills be requested to change the date of the proposed meeting to Tuesday; December 2nd (in the evening) or Thursday evening, December 4th, and that the time for the meeting to start be clarified Carried Council was advised that Mr Milton Rempfer had been contacted by telephone by our foreman on November 15th to check regarding a fire at the Torrington nuisance grounds Pyr Rempfer had later advised that he had damaged his truck door; as he started from his own place, and he had asked what compensation, if any, council would give. The damage to the door would cost $333 00 for repairs, and his insurance is $100.00 deductible Discussion followed Mr Berdahl moved that Council pay Mr Milton Rempfer for his time with a minimum of three hours, plus his mileage in regard to the above, but that nothing be paid towards the truck damage Carried The minutes of the Employee - held November 13th,1975, were detail The following items SANITARY LAND FILL MEETING TOWN OF THREE HILLS GENERAL RECREATION MEETING MILTON REMPFER TRUCK DAMAGE FIRE ETC. Employer committee meeting read and discussed in EMPLOYEE were noted from the discussion MEETING MINUTES 1 The advisability of a condensed work week Tuesday to Friday, was discussed at some length From information received at the recent convention, it appeared that it is legal to have a condensed work week for certain classes of CONTRACT I DISCUSSION ETC i employees, without necessarily including all municipal employees in all branches of the work 2 Mr Poole moved that Council not agree to adding any employee to the Foremen's committee as had been suggested. Carried ..3 COUNCIL MEETING NOVEMBER 24th,1975 P 3 3 Present agreement -- page 3 Section i - it should be explained to the men that the Municipal District also helps pay part of the costs of t -king the courses and therefore feels that the lOC per hour extra pay is likely sufficient 4 Request that the minimum wage be revised to $550 00 per month can be an item to be negotiated 5 Sick pay - perhaps leave as is, with the incentive to build up sick pay days which are partly paid for at least, when a person leaves municipal employment 6 Holiday periods can be negotiated The Council meeting adjourned for dinner from 12 00 Noon to 1.00 P M and then carried on with the discussion that was taking place prior to dinner 7 Slack time for extra holidays -r this should be clarified - as the agreement states that it can be decided by the committee, but a special motion of Council on April 28th;1975, outlined it for the mechanics as the period from December 1st,: to March 31st Note Mr Walter Anderson of The Three Hills School Division cane to the meeting at 1 05 P M 8 The sick: pay was further discussed and Mr Anderson briefly outlined the policy of the Three Hills School Division in regard to the teachers and others 9 Awards for safe driving it appeared that Council did not favour the change beyond the $100 00 per year 10 Training and the requests that this be given by foremen will be considered, but may not always be practical. 11 Compassionate leave - some reference may be made to the agreement with the County of Red Deer, and minor changes authorized 12 Wages and benefits were discussed at length but no final decisions were made The idea of the compressed work week was discussed further as well as the matter of overtime after 176 hours per month and not otherwise except after 10 days a day, and various other matters Mr Ted Paquette and lir Joe Dobler came into the meeting and took part in the discussion following this matter. 13. It was agreed that the date and time of the next employee committee meeting be changed from December 1st to Tuesday, December 2nd, still at 1 00 P M V CONTRACT DISCUSSIONS CONTINUED EMPLOYEE MEETING DATE .. 4 M COUNCIL MEETING -- NOVEMBER 24th 1975 P 4 Some discussion took place with regard to the matter of taxes and possible increase in taxes, versa the amount of service to be given in the municipal work It was clear that opinions differed about what the general people in the municipal district really want and w hetheror not they are willing to pay more on condition that services be kept up or improved The minutes of the Foremen's Committee meeting of November 13th '1975, were read and discussed briefly Mr Bauer moved that this be approved, including the purchase of a portable welder Carried Mr. Ted Paquette advised that the patch crew is now working near Bob Browns. The main crew has been at the slough north east of Wimborne., since last Wednesday Mr Litz suggested that they should have been using a borrow pit at both ends of the slough to save extra travel Mr. Campbell asked about the work to be done near Doerksen's and at Poffenroths Mr Paquette advised that the rocks are frozen in rather solidly at the Doerksen job so it may not be possible to do it now It was noted that this has been long delayed. The ditch at the Poffenroth place West of 2--34 24.4 has not been cleaned out but it might be possible to still do this POSSIBLE INCREASE IN 1976 TAXES ETC FOREMEN'S COMMITTEE MEETIN PUBLIC WORKS REPORT Mr. Dobler stated that the gravel crew moved to the GRAVEL CREWREPORT Torrington Pit recently and is doing the new grade at Whatleys„ west of Wimborne They will then do the new job over the slough; which is being upgraded by the main crew Mr Dobler also advised that the crusher - Linden Contractors is now being moved and set up at the Torrington pit. It was agreed that the location for the stock pile MEGLI STOCK at the Megli pit be decided at a later time... with PILE LOCATION Council to make some decision whether to leave the stock pile on the west side or make special arrangements to have it put on the east side of the creek Mr Ferguson moved that Mr Paquette contact Mr M. V. Moran regarding the possible account owing M V MORAN to him, for some municipal work ACCOUNT Carried Letter of November 10th from the District Engineer outlined further details proposed for the road at C N R UNDERPASS the C N R underpass south of 18-31--23 4. Mr. Ferguson moved approval of the conditions as outlined; including agreement by the Municipal District to do the actual road work under similar terms to that at the Linden overpass when it was done with the costs to be shared under the formula basis. Carried 5 M COUNCIL MEETING e NOVEMBER 24th,1975 P 5 Letter of November 4th, 1975, from the District Engineer gave us authority to stock pile gravel at the north east corner of NE 31--32,23 4 -- junction of Highways 21 and 27 Mr Poole moved that this information be accepted, and authority given to Mr Dobler to stcck pile at that location Carried Mr Walter Anderson left the meeting at this time being approximately 3 20 P M Mr Poole moved that Mr. Paquette have authority to order such grader blades as he deems advisable Carried Mr Ferguson moved that Triple K Ranching of Acme be paid for the land taken for road widening as soon as the acreage is known, this being in NW 20-29--24-4 Carried Mr Poole reported that he had met at the above location with Mr. Keglowitsch, as surveyor and with Mr Kostrosky The field work for the survey has been completed It was not necessary to bring any cat tractor back to level ground for the fencing Letter of November 19th, from I11r Danchuk Secondary Road Engineer of Alberta Transportation.; was read in regard to the proposed secondary road program for 1976 The letter recognized the priorities of Council but suggested that perhaps the Three Hllls west job should be considered ahead of the Carbon Corner east job, generally known as the Pope Lease Mr Ferguson moved that a reply be sent advising that Council's priority is still Number 1 for the Pople Lease project Carried Mr G King and Mr Paquette advised Council that Mr Ray Gebert, assistant district engineer had recently been getting some cost estimates for heavy paving on the Three Hills West project This did not necessarily mean that it would be given priority, nor done in 1976 Mr Ferguson moved that letters be writ -en to the Honourable Doctor Horner as Alberta Transportation Minister, asking for paving in 1976 of the highway on Number 27 east and also for the upgrading and paving of the access road into Swalwell, and to the Swalwell Park and that copy of each letter be sent to the Honourable Mr Warrack, as M L A Carried Mr G King gave a report regarding his investigation with the Surveys Branch at Caglary, and with the Director of Surveys in Edmonton, in regard to the road survey south of 31 29,21-4 and south of 36-29-22.4 It appeared that errors have been made in the registration of the road surveys,. that this matter is STOCK PILE SITE JUNCTION 27 & 21 ORDER GRADER BLADES TRIPLE K. RANCHING LAND PURCHASE SECONDARY ROAD PROJECT! 1976 REQUESTS TO HORNER FOR PAVING FOR 1976 ERROR IN ROAD SURVEYS e COUNCIL MEETING NOVEMBER 24th:1975 being investigated by the provincial. Director's office A furter report will follow Mr Berdahl moved that this report be accepted. Carried Mr Litz spoke regarding a road diversion in ,lest half of 25--33-26-4, around the Becker slough Mr G King is to look up further information about whether there is an actual survey or not Circular from the AAMD & C was read regarding possible increases in culvert prices Nr Brown moved that this be filed as information Carried Mr. Berdahl asked about any plans for gravel crushing for Division 1 Mr Dobler suggested that more might be done on the east side of the Hesketh pit in the north bank, but that stripping would be needed first. It is not likely that this could be arranged before spring Suggestion was also made that some testing be done for gravel on C.P R land near the Karas farm Mr Brown moved that information be obtained about who may be crushing at the Beiseker West pit, in the M.D of Rockyview It was suggested that we could use another 5000 cubic yards or so from that location, in addition to the approximate 2500 we have on hand Carried P 6 Is ROAD DIVERSI BECKER SLOUG CIRCULAR CULVERT PRICE INCREAS GRAVEL CRUSHING IN DIV 1 ETC Ownership of the Lowen land in Section 9 and 10, 29--21-4 ✓ LOWEN GRAVE is to be looked up and the gravel leases reviewed LEASES Mr Ted Paquette suggested that Council should be requesting certain design work on secondary roads if they wish the district engineer to arrange for same Discussion followed Mr Brown moved that the District Engineer be asked to design the work for the following locations 1 Merle Anderson •- north and south to connect with the previous work at the north side and to go to the south side of the hill at the Three Hills Creek 2 Swalwell ac ess road and on to the park, this being from Highway 21 west 3 From highway 21 south east 18-31 23.4 west three miles by way of the Three Hills Rural School 4 From Sunnyslope east to the pavement Carried It was noted that getting the d_sign for the above projects does not necessarily mean that the road work will be under taken in 197u'- Mr 97u Mr Paquette advised that Watrous Equipment will be holding four day classes in regard to G. M C motors with the first to be March 15th to 19th Other later dates will also be available Mr Litz moved that the Council authorize Harvey Jesske to attend the first one, and that others be considered for later dates Carried SECONDARY ROAD DESICNS'. G M. C MOTOR CLASSES 7 E COUNCIL MEETING - NOVEMBER 24th 1975 Mr Dobler asked about the possiblity of having a mobile radio in his house during the winter Mr Campbell moved that this be approved in principle, and that Joe talk to Alex Cunningham regarding an adapter or other satisfactory arrangements Carried The possibility of a gravel stock pile site in NW 20-30-22-4 was discussed The land is owned by Merle Anderson and is known as the old Heepseed yard Mr. Berdahl agreed to talk to Mr AnCerson regarding this and he also asked for information regarding the ownership of the old Webb School site; and the new or more recent Webb School site This is to be obtained later Mr Paquette and Mr Dobler then left the meeting A notice of claim from Norman E Klassen against the Municipal District of Kneehill as third party in regard to a fire loss on January 29th..1975; was read; and discussed The defendant is Tasman Richardson:, and the Gas Co -Op is also involved It was noted that this has been referred to Council members at the time of the Fall Convention in Edmonton; and Hr Jeffery had referred it to Jubilee Insurance. Mr Bauer moved that this be filed as information but that Jubilee Insurance be again contacted to make certain the defence has been made Carried P 7 DOBLER RADIO t, IN HOME STOCK PILE SITE NW 20--30- 22 4 V" , � .0, 5 CLAIM NORMAN KLASSEN Council was advised that the estimated cost for a sewer system for Ruarkville is $125 612 00 RUARKVILLE This system would tie in through the P B I SEWER and the Town of Three Hills systems_ without SYSTEM need for any pumping station There is no information available at this time about the possible government g=rants 11r Bauer roved that this information be accepted and filed pending further discussion regarding annexation Carried Mr T Ferguson advised that this Municipal District REGIONAL rjay qualify for some grant under the Regional Resource RESOURCE Project CONVENTION This matter is to be followed up through PROJECT #r Hugh Bodmer GRANT been in attendance Mr G King commented on the additional work load a stop ahead sign should be on the office staff in regard to various easement forms EASEMENTS for the Crossroads Gas Co --Op and perhaps by other co-ops GtS CO OPS It was agreed that this be discussed with Alex Cunnin`.ham Some general comments were made in regard to the fall FALL &onvention held this past week but there was no specific CONVENTION report as all councillors and the secretary -treasurer REPORT had been in attendance )ir Ferguson advised that a stop ahead sign should be 'Out up south of the Highway 27 intersection at NW 8 31-22--4 STOP 'The District Enginner will be contacted regarding this AHEAD A 11 c COUNCIL MEETING - NOVEMBER 24th,1975 P 8 Mr G King advised Council that R A Siebring & Associates have stated they wish to cancel the contract in regard to the accounting services through the bookkeeping machine as they do not have sufficient volume to warrant keeping, this up It is possible to arrange for continued use of the present machine, until other arrangements can be made Mr G King stated that he does not favour any lengthy use of the present machine by lease or otherwise as it is not entirely suitable and he therfore favours making arrangements for a new machine A rough estimate of costs is 435,000 00 Mr Poole moved that Mr King have authority to make a detailed study regarding the purchase or leasing of a new accounting machine Carried Mr. Brown moved that a reply be sent to Linden Trading Cc -Op in regard to its request to store certain supplies in 14W 20-30-25-4, and that the reply advise them that the proposal is contrary to the present preliminary regional plan, but that this is being reviewed, and that it be suggested to them thatif commercial use is necessary for the property it should perhaps be annexed to the village Carried A contest had been advertised for municipal crests It was agreed by Council that these be judged at the Council meeting on December 8th,1975, commencing at approximately 9 15 A M. It was noted that this time is suitable to the Superintendent of Schools who has been asked to assist t ACCOUNTING MATTERS LINDEN TRADING USE OF NW 20- 30--25--4 MUNICIPAL CREST Mr G King thanked Council for the plaque received G KING by him with 25 year stamp and with a 30 year seal PLAQUE on same. He also stated that an identical plaque has been rcceiv�_,d for Mr Schmelke and he will deliver it to him Mr Bauer asked that some further investigation be REMFFER made in regard to a spruce tree at the Rempfer cemetery CEMETERY which is touchinn the power line, and that the matter TREE ON of sloping the power pole or clearing the tree in some POWER LINE manner be considered It was also suggested that same information should be obtained regarding the title, and any easement of Alberta Power Mr Poole moved that this meeting do now adjourn ADJOURNME Carried Time of kdjournment 5 40 P M ---------------------- - --- ---- Reeve Secretary. -Treasurer Next regular meeting of Council - Monday December 8th 1975 commencing at 9 00 A M
