A regular meeting of the Council of the Municipal District of
Kneehill 049, was held in the Municipal Office, Three Hills, on Mondaq
July 28th, 1975 commencing at 9;00 A.M.

minutes. APPROVAL OF
MINUTES
Mr. Poole moved that the minutes of the Council Meeting of July
14th, 1975 be adopted as circulated, with one correction, in
regard to page 7, under Weed Problems. This should read
Mr. C. V. Poole reported he had received a complaint stating
that Mr. Vern Hanson has a very bad weed problem on his land
at NE 13 -and S! of 24 in 29-25-4

A proposed Restrictive Covenant Agreement in respect to RES. CAV
two small parcels north east of the railway in the NE 8 AGREEMENT
3n-25-4 was read to Council. The agreement in effect NE 5-30.25-4
consolidates the two titles in the names of William Jacob
Fitzen and Donna Rae Fitzen Mr Brown moved that this
be approved and the required documents signed, by the
Reeve and Secretary -Treasurer

Letter of July 23rd, from Alberta Energy and Natural ResourcesRENTAL
asked for payment of $10.00 rental as full payment for the
Recreational lease for the Tolman Park area, and that this
refer to the further 10 years on the lease. Mr. Litz moved
that this be approved and payment made

Mr C King reported that he and Mr D Rutten of Underwood,
McLellan and Associates had been to Huxley recently regarding
the proposed sewer system. They had met with Mr Edwin Heer
regarding the site for the lagoon and it appears that it will
have to be at least partly in cultivated area. Further study
is being made regarding this and other matters Mr Poole
moved that the report be accepted

Mr. G King advised that arrangements are being made
for a tax sale on September 29t1, 1975, to include a small
parcel at Twining and a few lots at Swalwell Mr Ferguson
moved that this be approved.

HUXLEY
SEWER REPORT
TAX SALE
SEPT 29/75
Mr Brown reported that he had represented the Municipal SORENSON
District at the Sorenson Subdivision appeal hearing in APPEAL
Calgary recently and had supported the appeal in respect to
the subdivision in SW 32-29-25-4. Written decision is to
follow as to whether or not the service road must be provided
and whether or not legal survey must be made. Mr. Poole
moved that this report be accepted

SUBDIVISION
Mr. Ferguson moved that Council recommend to C R.P.C.
that approval be granted for a subdivision in SE 27-29-21-4 SE 27-29.21-4
to separate part lying south of the new highway plan
subject to the following conditions.
1. No additional approaches are required by the Municipal
District
2 That a restrictive covenant agreement be made to
consolidate that title with portion south of the road in
the NE of 22-29-21-4
3
That Council recommend that no reserve requirement of
any
kind be asked for as there is no change in the use of
the
land.

Brown moved that Resolutions be prepared and be
referred back to Council in regard to the following-
public reserve
1
That the Planning Act not require any public reserve

the use of the land is not being changed in any way

the subdivision.

That the benefits of the Tax Reduction Act be extended

so
that it is not necessary to delete the benefit received,

Mr Brown reported briefly regarding the land use forum REPORT ON
studies of foreign ownership and he mentioned that Ontario LAND USE FORUM
charges a 20% tax on all real estate transactions involving'
foreign owners This is being given some study for Alberta
Minutes, etc., of the Calgary Regional Planning Commission C. R. P C
meetings were referred to briefly with some reference to the MINUTES, ETC
suggestion that our Municipal representative also represent
Carbon and Acme No final decisiors have been made
Mr Campbell moved that the m?nutes, etc , be filed

Mr Poole m�t at Mr J I Barnes had contacted him
regarding a proposed subdivision in the SW 18-29-22-4,
with a portion of the land to be used for the trailer
parking site, and with the balance likely to be sold to the
adjoining owner
Mr Barnes had also spoken to Mr G King regarding the
business which he proposes to establibh, but details had
been lacking at the time It was noted that there may be
a definite problem of access to the lands, etc , but Council
is not to take any action, unless some actual application
is made

Mr Campbell moved that Mr Roy Enzie be granted a building goy Rnzie
Permit 'for a machine shed in the SW 18-33-23-4, with the BUILDING
set back of 100 feet from the center of the road This is PERMIT
because of the location of other buildings, which makes it
difficult to conform to the regular 125 foot set back

Mr. Brown moved that Alberta Recreation, Parks and Wildlife FISH FARMING
be advised that this Council believes that entire freedom , REGULATIONS
froi,t Municipal regulations should apply in regard to fish
farming within the area.

Mr G King, Mr. R.W Brown and Mr A W Bauer reported
on the meeting held at Three Hills, on July 22nd, 1975, ANNEXATION
regarding the study of the annexatLon of certain areas ' STUDY P B.I.
to the Town of Three Hills Further details of the study ETC ,
had been discussed with the representatives of C R.P C ,
the P.R I , and the Town Where has been good co-operation
in the study, but no recommendations are made as of this
date

to the water work assistance program for the Hamlet of
T-Timborne, together with a proposed by-law and agreement
form. Mr. Bauer moved first reading to by-law Number 775
this being a by-law to autho:-ize the agreement in regard
to the Wimborne water system

Mr Ferguson moved that the Reeve and Secretary -
Treasurer be authorized to sign the agreement with
Alberta Environment in regard to the Wimborne
.Nater Works Assistance Program under the authority
of the abovety-law

Mr G King advised Council that the proposed closure
of the unused road allowance in the SE 15-29-24-4- had
been advertised and no objections had been received
tbnsent of the owners has been received in writing
Mr Poole moved third reading to by-law number
773, this being a by-law to close the said road diversion
and to return the land to the quarter section from which
it came

Mr C King advised Council that he had received
a report stating that papers and other debris are
blowing out of the Huxley Nuisance Ground and causing
problems for adjoining land owners The same situation
appears to apply at other nuisance grounds
Mr Rauer moved that the matter of a Sanitary Land
Fill he followed up, as follows
1. Write to Mr Charles Lau, Public Health Inspector,
to see if he has any f_urhher information
2. Write to the Department to retain our application
in regard. to a lease of the NTJ 31-29-25-4
3 Suggest Wednesday, August 13th, 1975 at 8 00 P M
for a further committee meeting with the Towns and
Villages and Mr Lau, for a discussion of the sanitary
land fill and with Mr R G Campbell and Mr R W Brown
to represent the M D

Mr Brown asked that Alberta Environment or Water
Resources be asked for a follow up report in regard to
the Wittstock Drainage NW of Acme
Mr Brown suggested that we consider some design for a
crest or insignia for plaques, lapel pins, etc , which
might be suitable for the Municipal District and
perhaps for the Three Hills School Division
Discussion followed. Mr Brown moved that a letter be
written to the Three Hills School Division for comments
and suggestions, regarding having a school contest for
a design for the said crest or insignia.

Mr John Jeffery gave a report of the Foremen's Committee
Meeting held on July 24th, 1975 and various items were
dealt with in regard to that report as follows.
1 Mr Ferguson moved that a special $15 00 payment be
made eachyear to any regular employee with one year
or more of service with the Municipal District who submits
evidence that he has a number 1 driver's licence and that
the Municipal District continue to pay for the medical
examination required

2 Mr. Ferguson moved that Robert Cranston not be granted
the use of any municipal vehicle to travel back and forth
from his home in Trochu

Keiver Lake Park Council agreed that this be ac now e Ye
and that Mr Warrack be advised that the land from Mr
Hansen was not donated, but was bought at a fairly
reasonably price Mr G King reported that Mr Ray
(hscon had been holidaying at the lake with his family
recently and had reported that on Sunday, July 20th, 1975
there were 2.6 boats there with 15 on the lake at one time
The situation is somewhat hazardous, but there were no actual
suggestions.
Mr. Campbell moved that a letter be written to Mr. and
Mrs Frank Hansen asking for their decision regarding the
rights of the Municipal District to charge for those using
the facilities at Keiver°s Lake

Mr John Jeffery referred certain items to Council from BOARD MEETING
the Agricultural Service Board meeting held July 21st, 1975
The following were noted
NEW TRUCK
1 A new truck has been purchased from Howe & Son at Three
Bills, and Council's opinion seemed to be that a two way
hoist should be put on it
2. Mr Ferguson moved that following decisions be made
in regard to the recommendations for the Keiver°s Lake Park 11V
(a) That buoys be put out to protect
(b) That traffic not be blocked off
as there has been no complaints
(c) That no action be taken on more
before winter

Council meeting adjourned for dinner from 12 00 Noon to
approximately 1.30 P M
It is noted that the Councillor and Foreman from the M D
of. Westlock visited the area to look at our road surfacing
program and they were entertained for dinner by the local
Council
Mr Ted Paquette, Public Works Superintendent and Mr Joe
Diibler, Gravel Foreman, met with Council.

Mr G King advised that Albert Arvidson had been billed
for one and one half hours grader work changing a water
course for a total of $33 00 He had stated that the work
was done to improve the Municipal road in that area Mr
Paquette verified Mr Arvidson°s statement and said the work
was done to improve the roast drainage Mr Ferguson moved
that the account of $33 00 be therefore cancelled

Mr Ferguson advised that Larry Edwards had requested some
work adjacent to his farm and perhaps wanted about a three

foot raise in the grade for approximately 100 to 150 feet
Location would be west NTT 29-30-23-4 Mr Edwards is
putting in some trailers for hired help in that area
Mr Paquette advised that Oris Rodgers went down to put
in an approach culvert, but Larry wanted extra work for
back sloping etc , which could not be done by that outfit,
so he had left it some time ago.
Mr. Bauer moved that Mr Poole check for details with
Mr Edwards regarding this project

Reports of the Workers' Compensation Board regarding J E
Duncan were read, advising that he will be called back fo;,
a further examination in about six months.
Mr Campbell moved that this information be accepted and
filed.

REPORT
Notice from the Apprenticeship Board was read, stating DALE LESLIE
that Dale Leslie will continue with his Mechanic Course APPRENTICE
stating October 20th, 1975. SHIP COURSE
Mr Paquette ad.visai that this date is suitable
Mr Poole moved that this be approved

Council was advised that Mr Hempsey , District Engineer
had telephoned on July 24th, 1975, and recommended that
the Acme East Road be built with a 32' top so as to provide
for a 28' top after heavy paving when that time comes
Considerable discussion followed in regard to the standards
as this does not agree with the motion passed by Council
at a recent meeting
Mr Ferguson moved that the Acme East Road be given a 32'
grade top as recommended by the District Engineer and that
Council's general policy be reviewed when the need arises

Mr Brown asked that it be recorded that he did not vote
on this matter as he owns land in that area

Mr Paquette reported on the ROAD PROJECT
p grading project west of Trochu,
and stated that the west two miles have been completed and
gravelled and the third mile is near completion now
Mr Campbell reported that the deep water ditch in SW 18-33-23-4
has been sloped down and he would like some rock hauled in
as soon as possible. Mr. Paquette is to attend to this

Council was advised that C & C Salvage of Edmonton has SALE OF SCRAP
offered Stn 00 per ton for scrap metal including the
old FWD truck , with or without the snow plow, the elevating
grader and anv other materials that may be for sale.
Mr Campbell moved that the old FWD be sold as scrap without V
the snowplow

the Municipal District

LOWEN ACCESS
Copy of a letter of July 24th, from Mr Gordon E Taylor, PROBLEM
M L A., to the Department of Transportation, was read
in regard to an access for Tom Lowen to portion of NW
14-29-21-4 This involves travelling through sertain
lands owned in the East half of 22 and South West 23
2.9-21-4, by Mr Otto Rraaz of Calgary Mr Taylor
asked the Department to consider whether or not it is
possible to give access from the flat up to the land
without going through privately owned property
The road committee of Mr Campbell, Mr Poole and Mr G King
advised that they had been to that location recently to
make an inspection The hired man and his wife Mr
and Mrs Albert Radke,=had stated that Lowens can go through
the property by a route which takes them through the
yard next to the buildings The promised free access during
daylight hours, but asked that they be advised if
the Lowens wished to travel through at night, so they
will know who is going by their place Mr. and Mrs
Lowen had also been contacted and Mrs Lowen objected
to going through the vard and stated this should not
be necessary She also stated some fear of being
stopped by Mr Radke Discussion followed Mr Poole
moved that the report be accepted and that a letter be
sent to Mr and Mrs Tom Lowen stating that verbal arrangements
have been made for them to travel through the land of
Mr Otto Rraaz on the route as indicated in the discussion
above, and with a copy of this letter to be sent to
Mr Gordon Taylor.

Fnvironment regarding financial assistance for a Biting CIRCULAR

GORMAN ROAD
Mr FePuson reported that the Gorman Family have two ACCESS - GRAVEL
residences in the NF 19-31-2.1-4 For many years their
access has been by road along the south side of the
Vorth T -Test of 1P -and perhaps taking part of the area
in the South Mest of lQ as well This is used by the
bus when suitable and there is no alternate suitable road
Tie stated that Gormans are prepared to haul the gravel
to this road, but aslc that the M P. supply same without
cost Mr Poole moverthat this be approved

Tt was noted that there is no legal access according to
a auick check_ of the records, along the route, as outlined,
and Mr Rin¢ was asked to trace titles and get further
information in this regard SWALWELL DAM
Mr Poole reported that downstream landowners from the PUMPING
Swalwell Dam may request some water soon for their stock
Th refore it may be necessary to pump some water out of the
dam. ve will check concerning this
Mr Campbell moved that Mr Poole and Mr Paquette have
authority to buv a large water pump if it is considered
necessary

Mr. Rauer stated that some papers, etc , are blowing KEIVER LAKE
off along roadsides because of a Municipal truck hauling
garbane from Keiver Take Park without using a tarp It
was agreed that this be referred to Mr Norman Soder SCHMALTZ BACK

Mr Ferguson mentioned that Mr Clen Schmaltz of Swalwell HOE
has a back hoe and does good work. This was noted so
he will be included if we call for bids for work. at Huxley

Mr. oamnbell asked that the road committee inspect the / ROAD
road situation adjacent to the Merling Snring at 'ME 23-34-24-4
Mr Rauer and Mr Paquette reported that they have chosen
Mr Ruben Fbrmann as motor grader operator to replace y
Richard Parris in Division 4, after August 8th, 1975 GRAVEL HAULED
