Secre T 19-.7.5 COUNCIL MEETING MAY 12th, 1975 The regular meeting of the Council of the Municipal District G_ Kneehlll #48 was held in the Municipal Office, Three Hills, on Monday, May 12th, 1975, commencing at 9 00 A.M. Councillors present for the meeting were PRESENT Mr. A.Church Div 1 (Afternoon only) Mr C W. Poole Div. 2 Mr R W Brown Div 3 (Reeve) Mr. A.W.Bauer Div 4 Mr T.A. Ferguson Div 5 Mr L Litz Div 6 Mr. R.G Campbell Div 7 Mr G G King, Secretary -Treasurer, was present and recorded the minutes APPROVAL MIN. Mr Poole moved approval of the minutes of the meeting of April 21st, 1975, as circulated Carried- Mr. arried Mr. Bauer moved adoption of the report of the Sanitary Land Fill Committee Meeting of April 22nd, 1975 as circulated Carried Mr. Poole moved approval of the minutes of the Council Meeting of April 28th, and 29th, 1975, as circulated, with the following corrections (a) Page 3 - Knievel Land should be Range 23 (b) Page 6 - Ron Toews uses the gravel 1"" and smaller (not larger) Carried PRICE OF SIGNS Mr. Poole questioned the pr3.ce quoted in the minutes of the previous meeting in regard to the costs of erecting sign posts for the River Hill east of Trochu He stated that the Department of Highways' price is about $14 50 each installed COURT OF REV Mr Ferguson moved that the Council approve the report REPORT of the Court of Revision of April 28th, 1975, as per copy circulated, with the correction that the McGougan Land to be shown as Range 22 Carried POLICY RE Mr Campbell advised Council that Albert Kimmel had JURY DUTY lost one days work only when called in for jury duty & PAY There is no information yet as to the amount he will be paid in respect to that trip Policy of Council is therefore tabled again pending further information MONTHLY The monthly statement for the month ending April 30th, STATEMENT APR/75 1975, was presented and discussed as per copy with the minutes This showed a net balance at the end of the month of - $63,009.50 and with $244,000 00 owing on loans. (Rnarvilley Carried Letter from Mrs Bruce Franklin was read in regard to SALE LOTS the proposed purchase of the westerly lots in Block IN SWALWELL 7 Swalwell. Mr. Ferguson moved that the Council advertise Lots)'l to 26 , Block 7, Swalwell for sale with the Council to reserve the westerly 33 feet for road widendng. Carried Mr Ferguson moved approval of the building permits APPROVAL as listed on the Agenda, Items 12 (a) (b) and (c) BUILDING Carried PERMITS Discussion took place in regard to the application of BUCHART Alsod Buchart for a large storage shed in Wimborne BUILDING Location would be on the westerly portion of Lot 17 PERMIT APPROVAL Block 2 Mr L Litz reported that he had looked at the site and had discussed this matter with Mr. Buchart. Council considered the matter of any zoning that was needed or affect on neighbors. Mr Litz moved approval of the building permit, on the condition that the new building be 15 feet from the south border and 5 feet from each of the north and west borders of the said Lot, with it understood that the distances are minimum requirements Carried Mr M. Elford and Mr. John Jordan of Calgary C. R. P C Regional Planning Commission. met with Council and the following items were dealt with MATTERS 1 Proposed subdivision of NUT 9-29-24-4 into west 80 acres and east 80 acres - Jacobs C R P C advised thatt?-cwhrould not be adequate access to the east 80 acres because of the coulee locations. Mr Poole moved that Council recommend refusal of this subdivision Carried 2 Neuiniller Subdivision - to create north 80 acres and south 80 acres in the North West 12-32-26-4 There is good access to east from the north south road allowance on the west side of this land. Mr Bauer moved that Council recommend approval with deferral of public reserve and other usual conditions Carried 3 Subdivision in NW 20-30-25-4 - has been approved for C Toews and L Boese business. Mr. Campbell moved that this be accepted as information Carried 4. Sorensen Subdivision - 40 acres on south side of SW 32-29-25-4 This had been approved by C R I' C but with the requirement of a 1004 wide service road along the 40 acre parcel_ and without any direct access to the f .3 • COUNCIL MEETING MAY 12th,1975 P3 Secondary Road Mr Brown and C R P C advised that C. R. P. C. an amendment has been made to allow access to the CONST. Secondary Road The owner is making an appeal as there seems to be no need for a legal survey, nor for the service road It was noted that the approval form sent out from C R.P.C. states that the appeal must be made within 30 days of the date of decision The representatives present stated that the owner has 30 days from the date of mailing of the decision in which to appeal. Mr Poole moved that a letter be sent to C.R P C asking that they have a correction made on their form so that the time for appeal is clearly indicated Carried Procedure for arriving at the amount of the cash payment for reserve was discussed C R P.C. members present agreed to follow suggestions which would speed up the process Mr. Brown advised that he had been at a subdivision committee meeting of C R P C. this past Friday and he reported regarding the following 1 Eitzen subdivision - approved 2 Fraser - Subdivision of Lots in Huxley - refused as requirement is that each title contain at least 10,000 square feet where there are no water or sewer services 3 Heibert Subdivision - refused because of Class 2 soil Members of C R.P. C. advised that the Knievel subdivision east of Trochu is being resubmitted and may be approved as the house has been improved C.R.P.C. members agreed to look up the file in regard to the Becker -Halstead subdivision in SE 21-29-24-4 and to advise what has happened in regard �;that application C..; �-r� /✓'� t Mr. Poole advised that Don P� has bought the Andy Mortimer farm and is considering placing a trailer park just south of the railway track, immediately south of Carbon Some discussion took place in respect to this and one opinion expressed was that the pare should be located within the Village where there is water and sewer services Perhaps the Village needs to extend its boundaries and there had been previous discussion regarding some annexations C R.P C members agreed to talk to Mr M Fenerty at their office regarding this matter Mr. Brown advised that the annexation approved for the Village of Acme failed to take into account that one north south street would be a dead end and did not give access to the annexed area Members of C R P C were thanked for attending and they then left the meeting ® SPRING CONV Mr Bauer moved that Resolutions passed at the Spring RESOLUTIONS Convention of AAMD & C be filed as information Carried �j .....4 N z:. COUNCIL MEETING MAY 12th,1975 Mr G King advised that the 25 year long service awards had been ordered from the Association for Mr Schmelke and himself. Council has not taken any action in regard to lapel pins or similar items This was ordered tabled indefinitely Carried Mr A.E.Struik of Alberta Environment, Reclamation Council and Mr Norman Soder, Agricultural Fieldman met with Council to discuss the requests by Council for assistance in reclamation of various mine sites and old gravel sites, etc Correspondence concerning same was read and it was noted that it is Government policy to actually take title to the location if it pays for the reclamation Mr Struck suggested that the work at the Trochu Mine Site would be considered as a separate deal by the Government by priority and when finances permit. Mr Struik then gave the following additional information in regard to our other requests. 1 NW 19-30-25-4 - Covers a large area and is a mess Might be considered as a possible training site It could be given top priority P4 LONG SERVICE A niARDS , ETC AAMD & C ALTA . gECLAMATION COMMITTEE MINE SITES ETC 2. He stated that all our other requests might be put in a similar catagory except as noted He then referred to (a) SE 4-33-23-4 Estimated cost $500 00 (b) SE 3-33-23-4 one gravel site at $200 00 or include the hill to the north for a total of $300.00 The discussion was interrupted by dinner from 12 00 noon to DINNER 1 00 P.M and then continued RECLAMATION (c) NW 3-33-25-4 - About two areas - lacks top soil CONTT but owner said he could provide same Estimated cost $300 00 to $350.00 (d) NE 31-32-25-4 - Aproximately 12 acres - for farming would cost about 1000.00 to reelalm Mr G Berdahl, member of the Surface Reclamation Council, then also came into the meeting and took part in the further discussion (e) SW 34-33-24-4 - 1 acre and 3 acres places - is fairly level, but has poor soil and no top soil Is readily available Cost would be about $1200.00 (f) SE 34-33-24-4 - partly cleaned up, but would be worth some further reclaiming, mainly for hay, at a cost of about $750 00 Councillor A H Church came into the meeting at this time and remainedfor the balance of the afternoon, time approximately 1 10 P M U A Ln N L01 COUNCIL MEETING MAY 12th,1975 P 5 Mr Struik named the following as a third group, but RECLAMATION said they would be very similar to number 2 SITES CON QT (a) NE 34-33-24-4 - 8 acres - Cost would be $4000 00 to $5000.00 (b) SE 18-30-23-4 - about 1" acres - would cost about $2000 00 or more to reclaim it for farming (c) NW 27-34-23-4 - 3 to 4 acres - 15 to 20 foot deep a low rating to really level this off, but it could be irrrpj u,, --a slightly They suggested this as a possible site for a sanitary land fill Cost of levelling estimated at $5000 00 Group Four (a) SE 3-33-22-4 - about 4 acres with some deep holes and has some grass on it now Could be levelled off fairly readily at a cost of $3000.00 Group Five Mr Struck said he had some doubts about the economic feasibility of doing these (a) NE 24-30-26-4 - 20 to 25 acres has been partly relevelled - to further level could cost $1500 00 but to reclaim it would be'very costly (b) North half of 3- and Parts of 10-34-22-4 - In North half of 3 is on a coulee and isolated. 8 to 10 acres - would cost about $10,000 00 This would be too costly, but it might be givgn some levelling for pasture use (c) NE 4-33-25-4 - has been partly levelled, could have top soil hauled in, but maybe better to leave as it Cost $250 00 (d) Section 10-34-22-4 - Generally OK as is Reeve R W. Brown was absent after dil.ner until this time, approximately 1 3.5 P M During his absence, Deputy Reeve Poole was in charge of the meeting Mr Joe Dobler, Gravel Foreman met with Council at this time. 1,35 PbM, Mr Poole moved that the following prposals be made to Alberta Environment for reclamation oq the sites as referred to above. 1 The mine site in East half of 14-33-23-4 should be reclaimed at Government expense 2 The gravel locations in NW 19-30-25-4 and NE 24-30-26-4 should be reclaimed at Government expense. 3. All other locations as listed should be done on a cost sharing basis between the government and the landowner and the Municipal District 4. It is strongly recommended that no change be made in regard to the titles of the lands affected Carried .6 e 0 [�E r� COUNCIL MEETING MAY 12th,1975 Mr. Struik, Mr. Berdahl and PIr Soder were thanked and they then left the meeting Mr and Mrs Maurice Frere, Junior, then met with Council in regard to the road leading to their farm in NE 30-32-24„4 An extract from the minutes of August 28th, 197"2, Page 2, was read in regard to this matter and they were shown diagrams showing that the Municipal District is responsible for the 33 foot wide road inlet on the south. side of the SW of 31- and 66 feet on the south east of 31 both in 32-24-4 The balance is the responsli'-ility of Freres and perhaps of Hudson Bay Oil and Gas due to its oil leases They complained about lack of snow plowing, about a culvert being too high or plugged, about the bus not coming into their place, and they asked that the half mile of road re ferred dand ato above be raised and more gravel Puolading up hat the north south road have more gravel, to highway 27 Councillor Bauer reported that the bus can generally travel along the municipal portion of the road, but the private part certainly must be improved if it is to travel into their boildingafter Mr and Mrs. Frere stated they planned this Council agreed to put on more gravel and perhaps make other minor improvements to the municipal road as referred to P.6 MAURICE FRERE PRIVATE ROAD Mr and Mrs Frere also asked that the ild. fir:.. _,E)ments be made to the creek crossing west of Reynolds to give some access lands andtMr,sr4Frerefthanked various further discussion Council and left the meeting Mr and Mrs Linke met with Council in regard to one and half miles °rom°t hewsouthest ofcorner 2 and11 They6plan being the road f f the SE of to build near the north east corner o 10-30-26-4 They stated they have made arrangements for power and for a telephone line from the south, and they may be able to get natural gas also They have some select cattle and they planto make their home at that location They also plan year Mr Poole road side trees for shelter belt by next y the moved that the Municipal District greetots prove and Mr g tor Mrs Linke be g road with the ranteda rder and gravel and buildiing permit for their home Carried CREEK CROSSING WEST OF REYNOLDS Mr and Mrs. Linke thanked Council and they left the meeting Letter from Olds Contracting Ltd was readaskifromfour they would purchase 5000 cubic yards of gravel Torrington Pit, which they would crush for use by bell Hudson Bay Oil and the Town of Trochu Mr amp moved that the 5000 cubic yards be sold to Olds Contracting at 30¢ per cubic yard on condition that it be used within the limits of the outer boundaries o this Municipal District Carried F LINKE ROAD SE 10-30-26-4 OLDS CONTRACTING PURCHASE GRAVEL ... 7 N C COUNCIL MEETING MAY 12th,1975 WA Olds Contracting also asked about doing crushing OLDS CONTRACTING work for the Municipal District It was agreed t GRAVEL CRUSHING that they be invited to submit a bid when the bids are called for from other firms. Mr Alex Cunningham, Utility Officer, met with HUDSON BAY OIL Council and stated that Hudson Bay Oil wish to ROAD CROSSING put a pipeline crossing on the road east north East 36-32-25-4 east 36-32-25-4 and they had asked permission to ditch across the road Mr Poole moved that our requirements for boring be adhered to in this case Carried Mr Cunningham then left the meeting Letter of May 9th, 1.975, from Mid West Surveys MID WEST SURVEY Company Ltd asked permission for Czar Resources Ltd LTD WELL to drill a well in LSD of 14 -31-29-24-4 with the 14-31-29-24-4 location to be only 200 feet from the south side of the adjacent road Map, etc , was submitted Mr Brown moved that this be approved Carried I.Lr Poole moved that the Municipal District BIDS FOR GAS call for bids for supply of gas from pumps to FROM PUMPS IN Municipal vehicles in Three Hills to start June THREE HILLS 7th, 1975 and with required service to be outlined. Carried Mr Bauer moved that the letter from Thurber Snow THURBER SNOW Fence be referred to AAMD & C vi FENCE CIRCULAR Carried Mr. Campbell moved that the circular from Stewart CIRCULAR STEWART Auctions regarding sales of equipment be filed Z AUCTIONS Carried Letter of May 2nd from the District Engineer advised that the Bleriot Ferry would operate between the hours of 6 00 A M to 12 00 midnight effective June lst, 1975 The Department will put up required signs Mr Ferguson moved that the hours of operation be advertised by the Municipal District in the Three Hills Capital Carried Letter from Doctor Horner, recently appointed Alberta Minister of Transportation, was read in regard to Number 27 Highway east to the river He stated they will improve the surface condition and oil same this year and are hopeful that it may be included for paving in 1976. Mr Ferguson moved that this information be accepted and filed Carried Letter of April 30th, 1975, was read from the Bridge Branch It stated they could widen the bridge west of SW 1-32-25--4, but would not replace it with a culvert, as it is in good condition Mr Campbell moved that the Bridge Branch be asked to widen this to provide for 28 foot clear traffic Carried CHANGE HOURS OF OPERATION BLERIOT FERRY L' HIGHWAY 27 EAST TO RIVER BRIDGE BRANCH SW 1-32-25-4 BRIDGE r COUNCIL MEETING MAY 12th,1975 P,$ Mr Bauer moved that Council accept and file as information the profile , etc , as prepared by Mr Robin Arthurs and sent to the Bridge Branch In regard to the location as referred to in the previous motion. Carried Letter of J Alvin Hazel, dated April 2$th,1975, was read in regard to the road west of 15 and 22 in 32-25-4 This acknowledged the advice that the road would not be built over the hill, but he -asked that Council not abandon the road completely, and continue to make at least minor improvements Mr Bauer moved that this letter be accepted and filed Carried Circular from the County of Stettler regarding loading and hauling rates for gravel was referred to briefly Mr. Litz moved that this be accepted and filed as information Carried Council was advised that a 9 foot diameter culvert 112 feet long has been authorized for the location V dust north east of Acme Mr Brown moved that this information be accepted and filed Carried Mr Ferguson moved that the employment applications of Marvin Kirk and Bill Hagel be referred to Ted Paquette Carried Mr Poole moved that the proposals for oiling and surfacing of roads in 1975 be tabled until the next / meeting Carried Mr Joe Dobler reported that he is finishing the required gravelling from the Ivan Berreth stock pile today and will move to som^ area where road conditions permit, likely to Meglivs for a short while Mr Bauer mentioned that he would like to get the Smouse Creek Road done as soon as convenient. Mr Joe Dobler then left the meeting Mr. G.King advised Council that there are tax arrears of $11$0 12 and assessment of $420 00 on Card 693 for Meadowbank Coal Company The taxes are considered uncollectable and there is no security Mr Church moved that these tax arrears be cancelled Carried V PROFILES SW 1-32- 25-4 J.A.HAZEL ROAD CIRCULAR RE GRAVEL HAULING & LOADING CULVERT NE Acme WORK APPLICATIONS 1975 OILING & SURFACING TABLED JOE DOBLER REPORT V CANCELLATION TAX ARREARS MEADOWBANK COAL CO. Mr. R.Campbell asked for a report about property REPORT ON owned or controlled by the Municipal District at ✓ M D PROPERTY the Trochu East Mine Site This is to be provided AT TROCHU EAST later MINE SITE Mr. A.W.Bauer and Mr G King advised Council that KEIVER LAKE Mr Frank Hansen has verbally objected to the proposed SALE FRANK sale by Council of the Keiver Lake Property Mr Hansen HANSEN had pointed out that at the time of acquisition of the land, the Council had made an agreement with him whereby the land could not be sold, but if it was not required for Municipal District purposes, it would revert back to the former status 9 10 N COUNCIL MEETING MAY 12th,1975 P9 The agreement dated October 4th, 1961 was read and KEIVER LAKE d-scussed This had been entirely overlooked at SALE CONT the time of the proposed sale recently At Councils invitation, Mr George Reed and Mr Don Laity then met with Council for a discussion of the Keiver Lake property.
