special meeting of Council was held on Tuesday, iLpril
8th, 1975 commencing at 9 00 1-i 14
Those present were (from 14 D of Kneehill #48)
C W. Poole, A W Bauer, L G Litz, %:.G. Campbell, T Ji.
Ferguson, R 7V Brown,, G G. Icing, Harold Henderson, i,ssessor
and with Hr J.C. Jeffery, PissQt Sec-Treas. taking the
minutes.
Those attending from the Calgary Rgional Planning
Commission were
Ar. Hike Elford., SuHdivision Depot,, e'lIs Penny Remmer,
Advisory Depot ; and lir Mike Fenerty
Ar. A.W. Dauer moved that due notice having been given
of this meeting, the Council proceed with any business which
may be brought before it. Carried unan
Hr. Fenerty reviewed several considerations which we must
take into consideration when proceeding with a new by-law and
resolutions under that by-law
1. need flexible regulations - be careful of by-laws that are
too harsh and binding.
2 that the number one consideration should be the use of land.
3 the by-law and regulations must be consistant with the
Preliminary hIegional Plan
4 we need a provision in the by-law that provides for the
isolation of the farmstead.
14r. Fenerty reviewed the Preliminary 1egional Plan in
brief as follows.
1 No separate interest in land can be created by any document
i.e a lease, a will, an agreement for sale, - without
subdivision approval
2. The Preliminary [Zegional Plan has minimum parcel size
provisions. He advised to go with the 4 acre minimum -
40 acre maximum parcel provisions
3 Certain areas of the Preliminary �:egional Plan must be
referred to the Commission for their comments
(a) the development and zoning of land within 10004 of
a highway or a secondary highway (Sec.10-C-2) - any type
of development - e g planting of trees, etc - must be
approved by C R P C and the Department of Highways
(b) anything under Sec.10-C-7 must also be referred to
C Z P C Any zoning or development within two miles of
an urban centre should be referred to the Urban Centre
for their comments He added that any situation may be
referred to the C : P C if the Control Officer is in doubt.
We should be most concerned with 7=• page 21 of the Pre-
liminary Regional Plan
We could have agricultural zoning with 160 acres minimum
subdivision, but provision in the regulations of a 4 acre
minimum to 40 acre maximum parcel for agricultural use :the
Ivey tc the subdivision of all agricultural land is that the
parcel being created is an ecomomic unit

1dr. Fenerty also suggested that we send for copies of the
pamphlet "WasteManagement - Code of Practise" dated Sept /73
and is available from Department of Environment #r,gdex 538-710-

The Preliminary 11egi.onal Plan could be amended or we could
establish a new zone out of each quater section - one separate
4 to 40 acre parcel for agricultural use or for isolation of
the farmstead r:part from that allow for special provisions
as they arise
The meeting adjourned for dinner from 12.00 to 1: P P -
Ms. Rermner reviewed our by-law #524 She stated that most
of our by-law goes against the intent of the Preliminary
Regional Plan Some of her suggestions were as follows
1. 'Rust break down Councillors into the 14uni.cipal Planning
Commission and the Development Control Board.
2. An Appeal Board needs the same number of outside members
3 The local Municipal Planning; Commission has the final say on
all matters.
Mrs Remmer suggested the rescinding of our by-law and to have
only a Development Officer and the Appeal Board becomes the
Council The Development Officer must approve, disapprove or
approve conditionally all applications
Development Matters should not be referred to C R P C
The new by-law should set out the duties of the Development
Officer and the methods of appeal
Mr. Bauer moved that the C R P C provide a draft by-law and
resolutions and bring it back to the meeting of April 28th
at 9 30 A M. Carried.
Mrs. Remmer said that she would send out copies of the
proposed by-law and resolutions a week in advance if possible
so that Council and staff may review them
Mr Fenerty advised Council against a building by-law as
,he stated that, if we do have a buzldi.ng by-law, the Council
is responsible for the inspections of all buildings If we have
a building permit issued, we must have a building inspector.
He suggested that Mr. Frank.Aartin of the County of Wheatland
be contacted to ascertain how they are handling theirs
Mr Fenerty stated that we need a Development permit rather
than a building permit as the Province now has uniform building
standards
Mr G. G, King asked regarding the Development of P.B.I.
and lir Fenerty referred him to Sec 27-4 of the Planning Act
14r Elford asked regarding the Jacob4s subdivision one mile
south of Grainger. He stated that the 1.60 acres is to be
divided into two 90 acre parcels with the split north and south
No access is provided into the E. 80. Also there are no reasons
given for the split. He was advised to get further information
to bring back to our office
I>Ir R G Campbell asked re the regulation in which a 101
strip is required for public access along all water courses
Mr. Fenerty gave Mr. Campbell an explanation re the various
courses one could follow
Mr Fenerty than thanked Council and the C.R.P. C. members
then left the meeting. 3

The Council members then discussedbriefly the P.B I
addition Mr a G Campbell then moved to allow this project
and to also ascertain if P B I does in fact, have a
Ministerial Order to allow them to create the developments they
have to date Carried
Ar Drown stated that he has made an appointment for
Council to meet with .Ir. George Reed at 1:00 P N. on April
14th/75 at our office re Keiverls Lake.
'Ir Campbell advised that lir tblbert Kimmel could be
at the office on the 14th to receive his Longi; Service Award.
Pdr. Ferguson mentioned briefly the situation created when
14r Ed Duncan started back to work on March 31st instead of
on I-pri.l lst As it happened, 14arch 31st followed a Statutory.
Holiday and Tir. Duncan therefore had to he paid for both days
after a lay-off of several weeks. The Secretary was akked to
advise all foremen that they are not to let employees such as
this return to work the day before or after a Statutory
Holiday, as had happened in this case
i,Tr Ferguson moved that this meeting do now adjourn.
