PRESENT Councillors present for this meeting were 1 A H Church Div 1 2. C.W. Poole Div 2 3 R W Brown Div 3 (Reeve) 4 T A Ferguson Div 5 5 A.W Bauer Div. 4 6 Leonard Litz Div 6 7 R G Campbell Div 7 Mr. G G.King, Secretary -Treasurer, was present and recorded the minutes Mr. Poole moved approval of the minutes of the meeting of December 23rd, 1974, as circulated. V APPROVAL MIN. Carried FIN STATEMENT The preliminary monthly statement for the month ending DEC December 31st, was presented as per copy with these minutes This showed a net balance of $61,657 98, but with $195,000 00 owing on loans Further payments for the month of Dec -tuber will be taken into account for the final statement. Mr Bauer moved approval of the preliminary statement. Carried PENALTY DATES Some discussion took place in regard to possible changes ETC in penalty dates and rates The circular from the County of Red Deer showed that they allowed a 4% discount on taxes paid within 30 days of the mailing of the tax notice and they added a 6% penalty on taxes remaining outstanding as at October 31st This was filed as information AUDITORS Letter from Ralph A Siebring & Co.advised that they had acquired the business of J A Barrie & Co as of December 15th,1974, but Mr. Barrie would be staying withthe firm until April of 1975 Mr Ferguson moved that this information be acceptd. Carried Mr Litz moved that Ralph A. Siebring & Co be appointed as auditors as successors to J A Barrie & Co Carried THANKS -GRANTS Thanks for grants had been received from Hudson Bay Route Association, Salvation Army, C.N. Blind, Sisters HOP our Lady of Charity & Unifarm District #1104 Assessment notice from the Town of Thred Hills for our shop site showed the land assessed at $6400 00 and the buildings at $43,750 00 for a total of $50,150 00 v This property is exempt from taxation. Mr Ferguson moved that this information be accepted. ASSESSMENT C� [�E E COUNCIL MEETING JANUARY 13th, 1975 P.2 Tzie pros and cons of changes in the penalty rates were further discussed Taxes receivable at the end of 1974 were approximately $623,000.00 according to preliminary figures Mr Fergubon moved first reading to by-law number 761, this being a by-law to set a penalty rate of 10% on unpaid arrear-, of taps on March lst each year, starting March lst, 197# the present by-law to be repealed at that time�fi. Mr Gordon Towers, M P and Dr A Warrack, M L A had replied stating they would be present for the meeting This information was ordered filed CEN. Mr Brown advised that the annual meeting of the C R P C ANNUAL will be held on February 7th and he will be unable to attend. MEETING Mr Brown moved that Mr Bauer and Mr G King represent the M.D. at that meeting Carried EMPLOYEE The report of the Employer -Employee Committee Meeting of EMPLOYER January 9th was given and the following action taken MEETING 1 Council was advised that the rates of pay, etc , have been approved by the employees, but with the request that certain special items be considered (a) r"r George Berry, operator of the loader for the gravel crew requested a higher rate. Mr Campbell moved that no change be made in his rate but that it be left the same as the truck drivers Carried (b) Employees requested consideration of three weeks holidays after five years. Carried C R P C had apprpved a subdivision for the north 40 acres of the NE of 20, 31, 25, 4, but subject to a 100 foot service road along the east side of the entire quarter, and subject to certain other requirements Mr. Bauer moved that a reply be sent to C R P C advising that Council objects to the 100 foot service road as there is adequate access to the north and the other would amount to a waste of 6 acres of good land Carried 5 Notice was received of a proposed change in the Preliminary Regional Plan which would prohibit selling of food along certain highways, but would allow only the sale of prepared food Council discussed this and noted that it would be very inconvenient for those with trailers, mobile homes and local residents who desired small supplies Mr Ferguson moved that Council oppose the proposed change in the Preliminary Regional Plan Carried The Minutes of C.R.P.0 were ordered filed Mr Poole moved the granting of the permit to Peter Baerg for a private garage in the SW 16-30-24-4 Carried Mr Brown reported briefly on business conducted by C R P C this past Friday, with reference to 1. Proposed subdivision by Knievel east of Trochu Subdivision Committee recommends that it not be approved as the house is not habitable. 2. Subdivision just south of Linden - Lorne Boese and C Toews - will likely be approved soon 3 Lowen - Vickers - the conditions are being reviewed Mr Poole moved that these reports be accepted Carried Mr. G.King reported briefly to Council in regard to recent pound cases 1 No appeals had been received regarding the damage claims against cattle impounded at the Andrews pound and at the Gordon Ward pound, recently 2 A Hereford Heifer had been sold at the Loosmore pound on the 2nd of January, 1975. Details of the sale are being advertised as required 5 BUILDING PERMIT t - ,f, POUND CASES N .7 COUNCIL MEETING JANUARY 13th,1975 3 A Hereford steer calf is impounded at the Loosmore Pound and wild. be sold on January 20th, 1975 unless the owner claims same before that date 4 The Valleyvlew Hutterite Colony had impounded two cows at the Loosmore Pound and had made a claim for impounding fees of $12.40 and for 4 months feed at $40 00 They had not paid the $10 00 deposit. The owner has redeemed the cattle The owner was James Lore and he has paid $10.00 and protested the feed bill Discussion followed Mr Brown moved that Mr James Lore be refunded the $40,00 in regard to the feed claim and his $10 00 deposit and that the Hutterites be paid the $12.40 impounding fee Carried Council adjourned for dinner between 12 00 Noon and 1 00 Mr Harold Henderson, Assessor, met with Council A letter from Peer Wik was read requesting some abatement of his 1974 taxes on the old Gulf storage tanks, etc , as they had only been for private use in that year Mr Henderson advised that after obsolescence the assessment would be 710 and the 1974 tax on that assessment would be 62 $4 The amount actually levied was $261 96. Mr.Feruson moved that Council authorize the cancellation of 200 00 in regard to the taxes on Lots 14 to 17, Block 5, Huxley Carried Letter from the U F A Co -Op was read in respect to 1974 `axes against the tanks, etc , at the Hepburn farm west of Huxley. These had not been used commercially in 1974. The letter from the Co -Op stated they felt it would be fair to pay taxes to September 1st, 1974 only Mr Henderson confirmed the information as received Mr Poole moved that this report be accepted and that $83 21 of the said taxes be cancelled. Carried Mr Henderson was thanked and then left the meeting V A Provincial Service Board conference is being held in Calgary on January 16th Six proposed resolutions were read to Council as prepared by Mr Norman Soder and Mr V Bauer, Chairman of the A.S.B. Mr. Church moved that Council authorize the submission of these resolutions Carried Letter from Sulo Luoma asked Council's permission to carry on a business at his farm residence in SE 30-32-23-4 for the sale of steel buildings Mr Bauer moved that Council recommend approval Carried Mr Ted Paquette and P r Joe Dobler then met with Council. The remuneration for Councillors for 1975 was discussed at length and some comparsion made with other municipalties 1vii Brown moved that the remunation rate for Councillors be set at $40 00 per day plus $10 00 per day expenses. Motion Defeated 4-3 Mr Eampbell moved that the rate stay the same as in 1974. Motion Defeated 4-3 Mr Litz moved that the remuneration rate for Councillors be set at $40 00 per day plus $8 00 per day for expenses Carried 5--2 Mr. Ferguson moved that Councillors and all others entitled to mileage be paid at 17¢ per mile. Carried Mr Poole moved that the allowance rate for employees on business outside the Municipal District be $20 00 per night and $3 00 per meal. Mr. John Jeffery and briefly discussed No special motions I/ MEETING were made in respect to it CRUSHED Mr King gave a report to Council regarding crushed gravel GRAVEL on hand and in respect to existing agreements for stock pile REPORT sites Mr Brown moved that Council approve Linden Contractors crushing 5000 cubic yards for this M D at the McNair Pit V South West of Beiseker at a price of $1 00 per cubic yard Carried It was agreed that the Secretary -Treasurer endeavour to get written agreements for five years and with these to carry on further subject to one year's notice for all stock pile sites It was agreed that Mr Joe Dobler have authority to stock pile such quantities as he deems necessary at each of the various stock pile sites Mr Church moved that Mr Don Metzger be paid $50.00 for ✓ stock pile location in the NE 10-29-22-4 if this has not been paid previously and that Mr A C Brietzke be paid pa $25 00 for the stock pile site in SW 4-32-25--4, for Carried STOCK Mr Poole moved that the rate of rent for stock pile sites PILE which were at $25 00 or $50 00 be increased to $75 00 each SITE for 1975. Mr Russ Horvey, D A met with Council and briefly outlined TOUR WEST plans of the Department of Agriculture for a West Coast COAST grain tour The four day cost would be $155 00 each to include air fare hotel, bus trips from the Coast to Seattle, and about 2 lunches. Dates were February 18th to 21st. v Any who are interested are to contact him for further information He thanked Council and then left the meeting Mr Ferguson moved that no change be made in the rates ✓ SNOWPLOWING being charged for private snowplowing RATES Carried ACCOUNTS Mr John Jeffery, Assistant Secretary -Treasurer presented the accounts Mr Poole moved that these be approved for payment as per list with the minutes, subject to checking ✓ with Linden Contractors regarding its account for $1000 00 for pit run gravel. Carried Mr Poole moved first reading to By -Law Number 763, this BY-LAW 763 being a by-law to authorize the sale of Lot 12, Block 5, SALE LOT Plan Carbon 4387 P. to Mrs. Florence M.Ibey of Carbon, ✓ 12 Blk 5 at a price of $400 00 Carbon 4387 Mr Bauer moved second reading to this bylaw Mr Litz moved third reading to this by-law Carried Unanimously P Carried Unanimously. Carried Unanimously Quotation for grader blades as received from Mr Wayne Soobie of Union Tractor Ltd , was referred to Council Mr Paquette stated that no additional blades are needed at this time, except that he has about 100 standard type blades coming from the Association soon Others will need to be ordered later The information was ordered filed Letter of January 2nd, 1975 from the Three Hills School Division stated that they would hold one 36 passenger bus for this M D with the price to be the same as that which they get for others being sold by tender Mr Ferguson moved that the School Division be advised that this Municipal District will buy the one bus under those conditions Carried Letter from Honourable C Copithorne, Alberta Minister of Highways and Transport commended the Municipality for supporting the roads and transportation association of Canada Mr Bauer moved that this be accepted and filed Carried Letter of December 30th, 1974 from Alberta Highways stated that the access road to Swalwell would not be likely included in the 1975 construction program as it would not be practical to do this unless it was combined with a larger project. Mr Poole moved that a further letter be sent asking if this Municipal District could enter into an agreement to build the three miles and half of road at cost / $ Carried 14� l tf_ V GRADER BLADE QUOTE SCHOOL DIV SCHOOL BUS PURCHASE DEPT HIGHWAYS SWALWELL ACCESS RD I • • C COUNCIL MEETING JANUARY 13th, 1975 P g Alberta Highways Chief Construction Engineer had PAVING #27 EAST been contacted by telephone regarding paving Number 27 East this year. He had stated it was doubtful if this would be included in the program. Mr Ferguson moved that a further letter be written to the Department with copy to Dr. A. Warrack and copy to Mr Gordon Taylor requesting that further considerationbe given to pavingof Number 27 East Carried Mr Earl Danchuk, Secondary Road Engineer of Alberta SECONDARY ROADS Highways had been contacted regarding Government plans for secondary roads in this area in 1975 He had stated that the plans were not definite to date, but they might wish to conc�:ntrate on a top coat on the existing pavement in the general Acme Torrington area. Further information will follow Mr Church moved that this report be accepted. Carried Mr. Poole asked that he be sent a copy of the correspondence in regard to the Swalwell Access Road EMULSION TYPE Reports from the District Engineer in regard to the SURF REPORT emulsion type surfacing done by this District in 1974 showed that he was generally satisfied with the work. Mr. Campbell moved that this be accepted and filed Carried Southside Plymouth 'Chrysler Ltd of Red Deer have now applied for the sales tax refund for the two Dodge Trucks with the refund to be paid to the M.D.of Kneehill. Mr. Poole moved that this be accepted and payment authorized of the $4000 00 held back from their account previously in this regard. SALES TAX DODGE TRUCKS Carried Mr. G.Kin brieflyoutlined to Council a list of OUTLINE OF M D the 35 trucks ownd by the M.D. plus the three fire TRUCKS trucks and two ambulances in which they have an interest Mr. Litz moved that this report be accepted Carried Mr. Poole moved that Coneco Equipment be given an ORDER KELLY RYAN order for two sets of Kelly Ryan wheels at $2550.00 each WHEELS with these to be for the Wabco motor graders Carried Mr Poole moved first reading to by-law 764, this being BORNO0 76tititI764 BY-LAW a by-law to authorize the borrowing of a maximum of Iv One and One -Half Million Dollars for Municipal Purposes in 1975, with the borrowing to be from the Provincial Treasury Branch in Three Hills. Carried Unanimously Mr Church moved second reading to this by-law Carried Unanimously Mr. Ferguson moved third reading to this by-law. Carried i Unanimously r L COUNCIL MEETING JANUARY 13th,1975 Mr. Poole �m4�that Tenneco Oil Company had not fixed the approach on the road allowance on SW 24-28-24-4 Mr Alex Cunningham is to be contacted for further information regarding his negotiations with the company about this Mr L Litz advised that the old Wimborne nuisance grounds needs more clean up as soon as conditions warrant. He also inquired about the number of acres and the title and this information is to be located and given to him Mr Campbell asked if one of our water trucks could be kept at Trochu during the winter. Nir Paquette stated that we now had three and these could be available if Council so wishes Mr Brown moved that Council approve stationing one water truck at Trochu, one at Three Hills and one at Linden if desired for the winter Carried P9 TEBNECO ROAD APPROACH WIMBORNE NUIS GRDS STATIONING OF WATER TRUCKS FOR WINTER GRAVEL Mr Campbell asked if Bertram Drilling might be able TEST to test for gravel North East of Trochu at the -'� NE Trochu McGougan location during the winter Mr Poole agreed to check further regarding this Mr G King briefly outlined the progress being made REPORT in regard to Sanitary land fill sites and his discussions SANITARY with the Public Health Inspector and with firms LAND FILL interested in a contract No specific approach had been made to the towns or villages and no committment of any kind made to any contractors Mr Poole moved that this meeting do now adjourn until 9 00 A lei Tuesday, January 14th, 1975 Carried l Reeve Secretary -Trey ur-rte This meeting adjourned to 9 00 A M January 14th, 1975. C Brietzke 25 00 land rent -74 D� �1 MUNICIPAL DISTRICT OF KNEEHILL NO. 48 WAGE SCALE AND WORKING CONDITIONS FOR ALL PUBLIC WORKS EMPLOYEES FOR 1975 FINALIZED BY COUNCIL JANUARY 13th, 1975 Clause 1 Those public works employees hired on an hourly basis shall set up a committee of 7 members to meet with Council, or a Committee of Council, to discuss problems that arise of concern to workmen and Council. Committee to be set up as follows 1 Chosen by Gravel Crew 2 Road Grading crews 1 Motor Grader Onerat,P - Div # 1 2 & 3 1 Motor Gradar Onerat.r --,Div. # 4 5. h, & 7 1 Shop Worker 1 Small Crew The Committee so chosen shall serve from December 1 of one year to December 1 of the next year. If a man retires, another shall be chosen by the group concerned to complete the unexpired term. Alternate may participate if regular member is unable to attend. The Committee of Council shall consist of three Council members chosen by Council. Terms of office and terms of replacement shall be subject to same terms as employee committee Employee Committee Members who attend meetings during regular working time shall be paid at their regular rates of pay, if the meeting is held any other time, they each receive pay for one-half day at the rate set for Councillors Mileage at the same rate as Council receive is in addition where applicable. The Secretary -Treasurer may attend all meetings to record discussion and recommendatzo-is which are made. When considering whether or not an employee has completed eight years of employment or more, the first year of employment shall be taken as from the first of that year or the end of that year which ever is the closer. e g If started May 1/72 year would be taken from Jan 1/72 If started July 1/72 year would be taken from Jan 1/73 After eight full years of employment and up to and including the end of the 15th year of employment, the annual holidays shall be a) Two weeks in the busy season plus one week in the slack season OR b) One week in the busy season plus 22 weeks in the slack season OR c) Four weeks in the slack season Extended holiday periods for the slack season must be by arrangement in advance through the Foreman's Committee Hoi.rs for holidays will be paid at the rate of 45 hours per week After 15 full years of employment - one week additional holiday shall be allowed in the slack season All holidays which are not taken before the next year's holidays are due, will be forfeited Holiday periods must be arranged with the Public Works Superintendent and where required by the Foremen' Committee as specified earlier in this clause and no employee shall be permitted to take less than one week of his holidays at any time Clause 6 - Provision for Sick Pay__ A) Employees are to be given credit at January lst, 1975 for the number of days for sick pay which remain at their credit at the end of 1974 B) Credit from January lst, 1975 will be 2 day per month for sickness benefits not used There is no maximum C) A medical certificate must only be supplied upon request if an employee is off for one or two consecutive days D) If any employee is off for three days or more, then a medical certificate is compulsory E) The paysheet shall show 8 hours for each day during which the employee is entitled to sick leave benefit F) Employees time records may include minor time reporting at the office or to a doctor if less than one-half day 5 Chi L WAGE SCALE AND WORKING CONDITIONS FINALIZED BY COUNCIL JANUARY 13th,1975 P 5 G) If any employee retires and goes on pension, he shall be given full pay for all accumulated sick pay days standing to his credit. Employees who leave after a minimum of four years employment for any reason other than retirement on pension, shall be paid for one-half of the number of accumulated sick pay days standing to his credit All present credits for sick pay and years of service shall be counted in reference to G (1) and (2) and the rate shall be at the current rate of pay of the employee at the time he leaves or retires as the case may be Clause _._7_- Compulsory Statutory Holidays ' New Year's Day, Good Friday, Victoria Day, July 1st, First Monday of August, Labor Day, Thanksgiving Day, November 11th, Christmas Day and Boxing Day Payment shall be calculated on 9 hours per day at the regular rates. Clause $ F Workmen's Compensation A) Each employee shall be paid regular wages for 9 hour days for a period not to exceed two weeks if he suffers an injury while at work under which he qualifies for Workmen's Compensation benefits Any payment from the Workmen's Compensation Board in respect to the wages during that period will be claimed by the Municipal District B) After the first two weeks, the employee will be entitled to payment direct from the Workmen's Compensation Board of that portion of his wages which it will pay, but will not receive further wage payment from the Municipal District until he returns to work C) The paysheets shall show 9 hours a day for each day during the first 2 weeks that any employee is entitled to Workmen's Compensation Clause 9 - Pension Plan Total contributions to the Canada Pension Plan and an integrated additional pension will be approximately 5% by the employee and at least an equal amount by the Municipal District The Canada Pension Plan is compulsory The integrated additional pension will be compulsory for any new employee hired, effective after 9 months of employment, but it remains optional for employees hired previous to December 31st, 1965 Details are available upon request Clause 10 i Alberta Health Plan After completion of 3 months employment with the Municipal District 1. Alberta Health Care - Compulsory deduction - Cost shared on a 50-50 basis by employer and employee 2 Alberta Blue Cross - Compulsory group plan - Cost shared on same 50-50 basis [t� X ..... 6 C7 E 141 WAGE SCALE AND WORKING CONDITIONS FINALIZED BY COUNCIL JANUARY 13th,1975 P.6 Clause 11 - Safe Driving_Award_i_ As from January 1st, 1967, any workman in the gravel crew who regularly drives a gravel truck and who is not involved in an accident involving a Municipal truck, shall be entitled to special Safe Driving Award as follows At the completion of one year employment $25 00 At the completion of the 2nd successive year of employment $50 00 At the completion of the 3rd successive year of employment $75.00 At the completion of the 4th successive year of employment and each year of employment thereafter $100.00 The periods referred to above shall be calculated from the start of employment, or from the date his previous accident occurred, whichever is the latter Any employee shall have the right of appeal to Council if he feels that he was in no way responsible for the accident Cl_a_use 12 - Leave of Absence Employees may request leave of absence without pay and Council may grant same without pay and without loss of benefits Clause 13 Terms No work shall be required on any Saturday, Sunday or legal holiday except for emergency or snowplowing Any employee shall have the right to submit a written request at any time asking a transfer to other employment This shall be given fair consideration when an opening occurs. The Public Works Superintendent may grant a temporary transfer but must, within two weeks, report this to theCouncil Committee or Council for final approval Group Life - Wage Continuance Policy - After 9 months of Employment A. Policy is in effect with Manulife & Dominion Life The cost of this shall be shared 50-50 by the employer and the employee The time during which any employee receives wages by this policy shall not reduce the number of days for which he is entitled to sick pay benefits under Clause 6 of this Agreement However, if the wages under the Policy do not provide the full regular rate of pay for 9 hour days, the difference may be paid from sick pay benefits and this additional benefit will be calculated as a fraction of a day under Clause 6 Any employee shall be expected to do any reasonable work to the best of his ability with his rate of pay to stay in his present category unless he be actually put in a new category by the Foremen' Committee teetings of the employer-employee Committee shall be held u�_ i request of either party, with dates and times to be mutually agreed upon The committee shall meet at least every three months Any employee covered by this agreement and wishing to leave the e C41 j WAGE SCALE AND WORKING CONDITIONS FINALIZED BY COUNCIL JANUARY 13th,1975 r employ of the Municipal District is asked to give not less than one week's notice The Municipal District shall give not less than one week's notice to any employee who is being dismissed from employment Exception to the notice from either party may be allowed by mutual consent The Municipal District will pay 1 week's pay to employees laid off or fired without notice Notice of Lam --Off Duplicate forms will be prepared and notices of 1ay-offs will be in writing Training - Any Employee being assigned to operate large equipment is to be given at least some kind of training before going on the machine alone Banking - Two (2) hours will be allowed off ox the Friday following pay day by arrangement with the foreman and without pay or transportation Any employee may meet with Council at any regular Council meeting regarding any circumstances. Any term of this Agreement may be changed by mutual consent at any time COMPASSIONATE LEAVE Compassionate leave for a total of not more than 3 days in any calendar year may be granted with pay based on 9 hours per day This leave may be granted by the Public Works Superintendent and/or by Council, but only where, in their opinion, the request is reasonable. This leave shall apply only in respect to an emmployee's -- spouse, parent, son, daughter, grandparent, brother, sister, 6rspouse of brother or sister). Compassionate leave is also approved in respect to a fellow employee to a limit of 2 day in each case and if it is during a regular working shift This Agreement, upon acceptance by both parties, shall be considered In effect as from January 1st, 1975 to December 31st 1975 It will further continue beyond that date unless a change is requested by either party, the request shall be considered at a meeting of both committees, and if mutually agreed upon, the final decision shall be made by the Council of the Municipal District.
