HomeMy WebLinkAbout1974-04-25 Council Minutes14 W FORM Ti 14 -P SPECIAL_ The follow Assessment on April 2 COURT OF REVISION MUNICIPAL DISTRICT OF KNEEHILL NO 48 P 1 .FRIL 25, 1974 ig Councillors met as a Court of Revision to hear Lppeals at the Municipal District Office in Three Hills 1974, commencing at 9 00 A M Mr. R W Brown, Mr R.G Campbell, Mr T.A. Ferguson, Mr S.0 Schmelke. CouncillorE C W Poole and A H. Church sat in as observers Mr Harold Henderson, Assessor, was present and gave comments and recommendations Mr Roy Ki sey, Former Assessor, was also present,and also gave comments anc recommendations Mir T A. F rguson moved that R W Brown act as Chairman of the Court of R vision Carried Mr G G. K�ng acted as Secretary of the hearing. Mr Fred Haller entered the meeting in regard to the appeal of Elvin Haller concerning SE -13-33-23-4. Mr Haller stated that o high as the land is it was fel that the ass ssment was to low and we Mr. Kinsey explained that the increase was due to the road s rfacing Mr Haller left the meeting. Mr S Schmelke recommende that there be no change in assessment. Carried. W A Richardson - not present - Mr Kinsey explained that 14 13 (Pt N W. -10 - acres hadFe-en taken out of the quarter for afelt gas planttheTvalue 31-24-4) was lower assessed land Mr. Ric per acre was now higher than previously. There were 161 acres assessed tmpbell $4400 00 - averaging $27 32 per acre The new acres are 147 aes assessed at $4030 00 averaging $27 41 per acre Mr. R G. moved that there be no change Carried. Mr A_.M.F Veres - present - SW -9-34-25-4 - Mr. Veres felt that this is a sessed too high although there has been an increase in cultivated acres Mr Kinsey explained how he had arrived at the increase in assessment and. Mr. Veres was satisfied Mr. Veres left the 4eeting Mr. T A. Ferguson moved that there be no change. Carried R S. Holmes - present - NW -21-34-23-4 - Mr Holmes noted that there is an err r on the acres and that he should be assessed for 158 acres, not 159. Mr. Kinsey explained that approximately 10 acres has been recently broken and seeded to grass Mr. Holmes left the meets g and Mr T.A Ferguson moved that the acreage be reduced b 1 acre and the net assessment be changed to $2350 00. Carried C A. Winther - present - NW -1-35-24-4 -- Air Winther stated that there are lots of rocks and hills on this quarter and 8 acres of sand. Some comparisons were made with the NW -14-34-24-4, the NI -26-34-24-4 and others. Mr Kinsey noted that there are about 12 icres which are very sandy Mr. Winther left the meeting and Mr. S C. Schmelke moved that this be reduced to $2300 00. Carried. .. 2 %W ORM T1 149-P SPECIAL COURT OF REVISION MUNICIPAL DISTRICT OF KNEEHILL NO. 4$ APRIL 25, 1974 P 2 Gilbert Harsch - not present - E2 of 5E-25-28-23-4 - Mr. Kinsey noted that this is assessed lower than the A of the quarter section Mr Reg Campbell moved that there be no change in assessment Carried V W --:-mer - not present - SE -18-33-26-4 - Mr. Roy Kinsey noted that 6-acrep are mostly sloughs and recommended that the assessment be reduced Ralph Brown moved that the assessment be reduced to $3240 00 Qarried Nick W:�isma - not present - 5E-22-34-26-4 and SW -1-34-26-4 - Mr. V,_isman had felt that these wire assessed too high, but Mr Kinsey noted that the assessment had been increased because of the up -grading of the road. Mr. Reg Campbell moved that there be no change in the assessment of 5E-22-34-26-4. Carried. Mr S Schm lke moved that there be no change in the assessment on Sti1-1-34- 6-4. Carried. Witral Hold n,s Ltd - not present - residence on SW -34-30-22-4 - Mr. Don Hansen, Solicitor, telephoned at this time to appeal this assessment and also a previous letter of his was read He maintained that the lease for the house did not take effect until Janus --y 1, 1974 and he felt that he had been misle with regard to the assessment on the residence Nir Kinsey and Mr Henderson had checked on the residence yesterday but no one was home. Mr Kinsey had also checked on December 28, 1973 and although there was no one home at that time, there were evidences that people were living there Mr Ralph Brown moved that this assessment be confirmed Carried The Court adjourned for dinner at 12 00 A.M and reconvened at 1 00 P M Alex Stewart, - present - mobile home on Pt. E2-14-29-23-4 - Mr Stewart felt that his mobile home was assessed too high. Mr. Kinsey and Mr Henderson had discussed this with him yesterday and Nlr Kin ey noted that there is a new policy regarding mobile homes. Mr Stewart left the meeting and Mr TA Ferguson moved that the mo ile home assessment be reduced to 2120 00 with the land being issessed at $100 00 for a total of 2220.00. Carried. V_C Greiff present - residence on NE -5-33-22-4 - Mr Greig noted that this r sidence should not have been assessed as the former occupant hai left before Christmas, 1973 He then left the meeting. Nr. Kinsey -ecommended that the assessment be removed for 1974 Mr S.C. Mr. Schmelke moved that the recommendations nsey, Assessor, be accepted and approved in respect da Petroleum Co. Ltd as given above Carried Hudson Bay 0 1 and Gas Company Ltd - not represented - Letter of Appeal dated February 8, 1974 was read Mr Roy Kinsey gave the following re ommendations 9 of 8-31-24--4 - no change 4 of 7-32-24--4 - recommended a reduction from $3030 00 to $2870 00 as the pump was not as valuable as it had been considered. 2 of 4-32-24-4 - three 1,000 barrel tanks are the property of Andex Oil ani should be assessed to that Company (with the assessment o $3030 00) One 500 barrel tank had been assessed twice by err)r so the correction would give a reduction of $350.00. Ten manifold3 had been assessed - this is correct The total assess- ment was $12,230 00 Recommended to now be $8,850.00 for Hudson Bay Oil and 1as and $3030 00 for Andex Oil 2 of 17-32-2 -4 - there is no controller on the gas engine and thus the ass ssment should be reduced from $2340 00 to $2250.00. Mr T A Ferguson moved that the Court of Revision approve of all of the recommendations of Mr. Kinsey as given above in regard to Hudson Bay Oil and Gas Co Ltd Carried Mr. Ralph Br wn left the Court at this time and Mr Ferguson acted as Cha rman for the balance of the hearing. Marathon Realt,v Co - Represented by Mr Paul Sykes. This Appeal was in respect to the railway line from Wimborne north-easterly to the Mobil Oil Gas Plant. It is assessed as a spur line at $18,460 00 per,mile Sykes claims it should be assessed as a main line at �B1 000 00 per mile It appeared that there is no clear definition of the term spur line' Mr Sykes referred to some previous rulings of tie Appeal Board and of the Courts and stated these supported hi3 claim. Mr. Kinsey stated this is a rather legal matter and t us it might be best to confirm the assessment with the understandin); that the Alberta Assessment Appeal Board may be called on to make a definite ruling Mr Schmelke moved that the present assessment b6 confirmed.
