HomeMy WebLinkAbout1969-12-22 Council Minutes4t_w P1 COUNCIL MEETING Dec 22nd/69 (Continued from Dec 15/69) The Council Meeting that had adjourned from December 15/69 was reconvened in the Municipal Office at Three Hills on Monday Dec 22nd 69 commencing at 9 OOAM All Councillors were again in attendance except that Mr Georges Lemay,Division 7, was present for the afternoon portion of this meeting only. Mr -D Dau of the Three Hills School Division was present throughout the meeting. Mr G G King, Sec -Treas was present and recorded the minutes Page 8 PRESENT Considerable discussion took place in regard to the rate of pay to be set for Reeve and Councillors Mr Brown moved that the rate of pay for the Reeve and Councillors as from January lst 1970 be set at $25.00 per day and 12¢ per mile for mileage on Municipal work for all meetings,supervision, committee work or other Municipal duties, that under 5 hours away from home for a meeting cr committee work be considered as J day, that over 5 hours away from home for a meeting or committee work be considered as one day, that any evening meeting be considered as :1 day Carried unan, Mr Schmelke moved that an allowance of $12 00 be paid for any overnight stay required on Municipal business outside of the Municipal District by any Councillor or Municipal Employee unless some other rate is specifically stated for any special case Carried COUNCIL PAY OVERNIGHT STAY EXPENSES Mr Poole moved that the Annual Meeting of the ANNUAL Electors of the Municipal District be held on Monday MEETING March 16th /70 at the Three Hills CcmmlaIity Centre commencing at ? OOP M Carried Mr. Ferguson moved that a copy of the 1969 Financial; FINANCIAL Statement be mailed to oath rate payer in the Municipal STATEMENT District Carried Some di :,- ..,.. —, ion took place in regard to the SNOW operation of Snow Vehicles A letter of Dec 16th/69 VWHICLES from the Minister of Highways and Transport advised that Council could not require that a flag post and flag be mounted on any snow vehicle under existing regulations. Mr. Ferguson then moved first reading BY -LAW to By -law No 629, this being a Bylaw to permit the # 629 operation of snow vehicles at any hour of the day or night subject to specific regulations as per copy of the By -law with these minutes Carried unan Mr. Church moved second reading to this By -Law. Carried unan Mr Schmelke moved third reading to this By. -law Carried Unan Mr Schmelke moved that Mr. Gordon G King be reappointed as Welfare Officer of this Municipal WELFARE District for the year 1970. Carried, OFFICER /I Page 9 .. /_ " FORM 149-P SPECIAL MUNICIPAL SUPPLIES Council Meeting Dec. 22/69 Page 9 Various matters pertaining to the Titles to W EVANS the NW- 27- 31 -24 -4 were referred to Council. Council NW- 27- 31 -24 -4 was edvised that Mrs Mary Evelyn Evans had obtained title to 44 24 acres in the easterly portion of the said quarter in the year 1957. She still holds separate title to that area Her husband Mr Wilf Evans is buyi g the balance of the quarter from the Town of Three Hills, but the Town is filing a caveat which entitles it to buy back this area. within the next 50 01 so years. Council had requebt ed that the titl s to both portions be consolidated do that ther would be access to the easterly portion, but Mr vans objected to this due to the caveat. Mr. Church moved that Council approve of the CAN UTILITIES extension of Canadian Utility Services for Craig C EDWARDS W. Edwards to the SW -23 -29 -22.4 as per its map sent1to our office.. Carried Mr. Dave Macdonald of Saskatoon Fire Engine Company met with Council mainly to discuss the new water tank for the Trochu ru - °al fire truck. He stated that they could install a 750 gallon tank with 10 year warranty with an approx. cost of $1215. Work would be done in Calgary and the time required would. be approx one week Other details concerning this were discussed briefly and he was then advised that he would be contacted within a few days as a deci ion would be made at a fire committee meeting to b held this evening Tir Macdonald thanked Coun it and then left the meeting SASKATOON FIRE ENGINE TROCHU TRUCK Matters pertaining to planning and the Calgary C R P C. Regi nal Planning Commission were then discussed with part cular deference to 1. Mr C Poole and R Brown verbally reported on a me ting attended for discussion of planning with the io Mr Colburn, Minister of Municipal Affairs and )ther representatives Request had been given that legislation be changed to allow local Municipalities to db routine sub division and other similar work. 2. Yr. G King verbally reported from the meeting of tie Planning Commission of Dec 5th which he REQUISITION had ittended and at which time the requisition for the M D of Kneehill had been discussed !Jo decision had een made The matter was to be reviewed The Amore ded Staff Report of Mr. A R Smith Planning Dire for was read to Council and discussed 3, Kr. C Poole as member of the executive of the C R. .0 advised that the executive had to alternate proposals for the requisitions and by each of these the amount for the M D of Kneehill would be lowered. However, these proposals had not yet been considered by the Commission at a meeting. Mr. Poole also advised that under Section 12 of the Provincial Planning Act thiE M D could appeal its requisition to the Provincial Planning Board. 4 Discussion followed in regard to the effect on the budget of C R P C as a result of the M.D. of Kne hill being a member It was evident that there was a conflict of opinions In this regard. By -: C omr that its Sec- Treas, reviewed very briefly the existing MUN aw of this M D which set up a Municipal Planning PLANNING fission and Develop Control under it He suggested COMM. the By -law should be repeal ed or amended or provision should be followed more closely Page 11 ... °n t ar' c COUNCIL MEETING Dec 2269 Page 11 6 Mr. Poole asked Council what requisition from the C.R.P.C. would be acceptable by Council Mr Ferguson moved that Council suggest a maximum of $1800 for requisition to this M D for the C.R P C for the year 1970 Carried. 7. Mr Schmelke moved that other business pertaining to the Calgary Regional Planning Commission be tabled indefinately. Carried Council adjourned for dinner from 12 noon to 1 00 P.M. G.R.P.0 DINNER Mr. G Lemay, Councillor for Division 7 joined v G LEMAY the meeting following the noon adjournment and was present for the balance of the meeting. Mr. C.W Poole advised Council that he had C W POOLE spent the following time as a member on the Calgary Regional Planning Commission and representative ACCOUNT from this district Namely C R P C 1966 - nine days 1967 - twenty -three days 1968 - thirty -two days for a total of sixty -four days The Planning Commission had paid him a rate of 10 dollars per day for that work but the regular rate of pay for Councillors on Committee work in this M.D had been $20 00 per day. He therefore asked that Council pay him the difference between the two rates He further advised that the Planning Commission rate given in 1969 was $20.00 per day so adjustment was needed in regard to it He also advised that the Commission pays him 13¢ per mile for his necessary travel In the discussion that followed it was noted that Council appointed him as a member to the meetings but the Planning Commission itself appointed him as a member of Sub Division Committee, Zoning Committee, Executive, etc. The time spent at meetings only in 1966,67, and 6$ would be about 33 days Mr. Poole was asked to leave the meeting briefly so that other members of Council could discuss this in private Considerable discussion took place in private. Mr. Poole was then asked to return to the meeting and did so. In reply to a question he stated that he is willing to accept the Commission rate for 1970 Mr Schmelke then moved that Mr. Poole be paid $100.00 as full settlement of his account for work with the Calgary Regional Planning Commission to the end of 1969 Carried. (Note Mr Poole did not vote on the motion) Mr Dan Peters, D A , Mr Tom Seaborn, Asst.D A and Mr. Gordon Park, Ag. Fieldman then met with Council for a discussion of matters pertaining to the Agricultural Service Board Each Councillor was given a brief summary of the requirements of the A.S.B. Act and also of the activities of the local board and the grant structure,ete General discussion followed In reply to specific questions Mr Gordon Park advised as follows 1 Regarding staff- the total staff can not get all the jobs well done during the summer. 2, Brush spraying in 1969 did not appear as effective perhaps partly due to the effect of the June frost, but he believes the results are actually Q.K. Bates be ratepayer members. Carried. 2, VIr Ferguson moved that Mr. C Poole and Mr A W Bauer be Council members with C.W Poole as Chaff an Carried 3 r, Church moved that Mr. Dan Peters be named as r presentative of the Provincial Department. Carr ed 4 r. Schmelke moved that Mr. John Jeffery be name as Secretary to the A.S B. Carried Mr. Bauer moved that the A S B be invited to meet with Council at its regular meeting on Jan 6th 1970 commencing at 9 39 A.M. Carried Mr. Peters, Mr Seaborn, and Mr. Gordon Park then left the meeting Mr Cliff Showers of R. Angus Ltd and Mr Ted Paquette, Public Works Sup then met with Council Mr Showers gave some detailed information in regard to the demonstration of the Caterpiller No. 627 hel last fall in the County of Lacombe. General dis ussion followed. He wasadvised that he would be 'nvited to bit later after dbeision was made as o what kinds of machinery would be required Mr Showers thanked Council and left the meeting R. ANGUS MACHINERY Mr Ken Hammer, of Ferguson Supply met briefly FERGUSON with Council He was also advised that his Company MACHINERY would be invited to bit for new machinery that might be considered by this M D later. Greetings of he Season were extended He thanked Council and then left the meeting Page 13 Sec- Treas, advised Council that only one ALTA. FARM app ication is now at the office for a loan under pCHSE BOARD the Alberta Farm Purchase Board Act, but others may be received before the deadline of Dec 31st The one on file involves the sale of land by Mr Geo Park to his son Angus and if this is proceeded with someone else will need to make the appraisal. After brief discussion it was agreed that this be tabled until 1970 meeting of Council. A letter from the C.R.P C asked for certain SECONDARY information in regard to the Secondary Road Study ROADS Mr. Brown Moved that Mr. Ted Paquette and G King have authority to prepare the map and to amend thE same so that the road from Wimborne North to z thE end of our M D is included as a portion of thE Secondary Road System. Two miscellaneous accounts receivable were MISC. Nr C Peters - Huxley - $28.08 for timbers THOMPSON Sec- reas advised Council that Mr. Peters reported that the timbers had been returned on a Saturday when no one was at the shop. Carried. Mr Brown moved that the Hon. Robert Thompson HON. R. be invited to the Combined meeting with other THOMPSON governing officials at our office the afternoon of Jan 7th 1970. Carried Council was advised that the following UNEMP INS employees had requested that Council certify their emp oyment as permanent so that they may be exempted from the provisions of the Unemployment Insurance Act Mr Geo..Park, Mr Joe Dobler, Mr John Dorn, Mr. Allen Koch and Mr A R Sommerville Mr. Ferguson mov d that Council grant their request and certify the e as permanent employees for purposes of the Une ployment Insurance Act. Mr Lemay moved that they be invited to meet our ouncil at 2 00 P M Jan 4th 1970 at our office and that this information be sent to Mr. Andy Murray, Secretary of the Rosebud Seed Cleaning Plant. Carried Mr Poole moved that thks M D pay the rent of M D $25 00 for the Municipal Social held the evening of SOCIAL Dec 13th and the total of$64 41 for food supplies " bought for that evening Carried Mr John Jeffery, Asst Sec -Treas met with ACCOUNTS Council and presented some accounts for consideration. T e Village shall house the pumper unit in a properly heated storage place The Municipal District shall on December 31, 1969 pay to the Village a one -time grant of $500 00 to help provide for this storage place. 9. �he Municipal District agrees to pay up to a maximum of $330 00 er year for fire phones commencing January 1, 1970, this maximum eing based on five phones at $5.50 per month each for 12 mon 10 1he Village covenants that the 1unicipal District or its agent ma), at all reasonable times, enter the said storage place for the purpose of viewing the state and condition of the pumper unit 11 he Village shall operate the pumper unit on behalf of the Muni ipal Distract under the direction and control of the Village Lire Chief and with the assistance of such volunteer fare fighterslas may be available 12 the Village shall supply a driver for the pumper unit at all time and shall be responsible for supplying sufficient volunteer fire fighters on all occasions 13 rhe Village agrees that it shall train or cause to be trained Crom time to time those rural volunteers who are named as auxiliary fire fighters by the Municipal District. 14 rhe Vill a g e shall indemnif y and save harmless the Municipal Distract, its agents, officers and employees from all claims for injuries, loss or damage to persons or property of the Village in connection with the use of the said pumper unit within the Village 15. The Village is to be allowed the free use of the pumper unit for any fires which may occur within the Village. The Municipal District shall be entitled and shall receive the use of any Village fire fighting equipment as an auxilia y unit which may be available for fighting serious fires for the rural area D In the event that two fires occur at the same time or w4 -thin � short time of each other, the Fire Chief shall have full authority to determine priority and to organize the fire fighting. The Agreement made may be terminated by Mutual consent of the Village and the Municipal District or, on the last day of any calendar month, provided a written notice to that effect is given by either of the hearties to the other at least one month prior to the said termination date. F Upon termination of this Agreement, under the preceding clause hereof, or otherwise, the municipal District may enter the storage snace and renove and take away therefrom ?-c said pumper unit and for that purpose do all things reasonably necessary for such removal without being liable for any damage caused thereby, and without prejudice to the rights of the Municipal. District in respect of any sums of monies accrued or accruing due from thE Village under this Agreement G In the event of any dispute between the Village and the I✓fun cipal District arising out of the interpretation, performance or obse vance hereof, such dispute shall be submitted to a single arbitrator if the parties agree upon, otherwise to two arbitrators, cho en by each of the parties in accordance with and pursuant with thE provisions of the Arbitration Act, being Chapter 15 of the Revised Statutes of Alberta, 1955 with Amendments thereto or any sta utory modifications thereof from time to time being forced. FORM '"SPECIAL U ici rru w AGREEMENT -$- This Agreement contains the entire agreement between the Village and the 1.1unicipal District and it is admitted so that they shall forever be estopped from asserting that there is any conditio precedent or warranty of any nature whatsoever or col- aterai wlarranty or covenant whatsoever to the within Agreement This Agreement shall, in no event, confer a right of action to damages on any property owner of the Municipal District or any other person for operation or failure to operate thereunder This Agreement shall, in no event, confer a right of action for damages caused by failure of the apparatus or pumper unit to work on arrival or breakdown of the apparatus or pumper unit, or operation failure of any kind, ?r This Agreement is to commence and remain in effect and be binding upon the parties hereto for a period of Five (5) years comnenci g on the 1st day of January 1970; subject only to the -prior to mination of same by mutual consent of the parties pursuant to sub- clause E of Clasue 1$ hereto THIS AGREEMENT shall enure to the benefit of and be binding upon the Village and the Municipal District and their successors and assigns.
