HomeMy WebLinkAbout1967-06-05 Council Minutesk• FORMf., -P SPECIAL MUNICIP SUPPLIES LTD, M D OF KNEEHILL # 48 COURT OF REVISION - JUNE 5, 1967 The members of the Court of Revision of the N D of Kneehi 1 # 48 met at the Municipal Office, Three Hills, on Monday June 5/67, to consider all assessment appeals which had been filed The hearings were held from 9.10 t' h to 11.45 M except for one brief adjournment The following Council members of the Court of Revision were present throughout Mr. H Church, Mr. R W Brown (Chairman), Mr. D�inc Peters Mr. S. C Schmelke, Mr C. C Campbell Other members of Council - Mr Cliff Poole and Mr Ralph oosmore - attended but took no part in any voting Mr G G King, Sec. -Treas , was present and recorded the mi utes Mr George Park, assessor, was present and gave i formation in each case. Appea13 were considered and dealt with as follows Each appellant or agent present was given ample opportunity to presenb the reasons for appeal, and each left prior to the motion giving he decision. SE-5-3Z-24-4 Mrs 14. Parry was present- asked reduction as a larg area is flooded Mr. Geo Park agreed that it warranted a reduction to $4,410 Mr Church moved that the assessment of the SE- 5- 32 -24 -4 be redluced from $4,630 to $4,410 Carried SE-20-31-22-4 and SW- 21- 31 -22 -4 assessed at $3,950 and $2,370 respec ivelly. Mr. Stan Milan was not present Mr Geo. Park advised that he had gone over these lands with iZr. T4,.ilan and he appeared satisfied Mr Schmelke moved that these two assessments be confirmed at $3,950 and $2,370 resp Carried. NW- 27- 30 -23 -4 G 14 Gibson was present - assessednt $3,400 SW-34-30-23-4 tq ,o 1? $2,300. His main complaint is that he has no access to the east side of wither of the above due to a deep coulee Mr Geo. Park recommended a reduction of NW-27 to $3,330. but no change in SW-34. Mr Brown moved that the Nye -27 -30 -23-4 be reduced from $3,400, to $3,330 and that the Spa- 34- 30 -23 -4 stay at $2,300 Carried. present Dwelling on SE- 25- 33-24 -4 Georges Lemay - assessed at $3,560. Mr L may asked that this dwelling be exempted as a farm horse, it is occupied by Dr. tishcroft, Veterinarian, but Mr Lemay considers him a "caretaker" and he is not paying; any rent At present t.ssessnent Act was reviewed as to definition of farm buildings No complaint was voiced as to the actual amount, of assessment. Mr Geo Park recommended no change Mr Church moved that the assessment be upheld at $3,560 Carried Dwelling on N!1- 23- 30 -26 -4 - A N Taylor- assessed at $1,270 1r Taylor was present - asked that dwelling be exempted as a farri building, part 1965 - rented at $30. mo, 1966 - empty part summer, then in October rented to Jacob Wiebe, elect ician apprentice, who helped look after the cattle on a ew occasions in winter Mr Geo ark recommended no ch nge Mr Peters moved that the assessment of $1,270 be up eld. I�;r Sanford stated he is living in this house and is not a farmer )ndition, facilities, etc of the house were reviewed iifference of any consequence were noted Mr. Geo :ommended no change 4r Campbell moved that the assessment of $1,730 Ld Carried Railwa Spur Line to mobil Oil of Canada Plant north -east of ?Jim orne - Marathon Realty Co was not represented - assess d at $30,810 Mr Geo Park agreed that the mileage should be adjusted from 2 71 miles to 2 72 miles and that assess ent based on 60% of the rate instead of 100% which he had used, he therefore recommended a redutetion to $18,56 Mr Schmelke moved that the xxd* said assessment be red ced from $30,810 to $18,560. Carried. The following three appeals were by Hudsons Hay Gas Oil Co and it was not represented. 1 Wellhead in LSD 8 of 22- 31 -24 -4 - assessed at $260 ; appeal asked &igher depreciation, Mr Geo. Park stated that he though he had allowed sufficient depreciation at 5% as it is a s ut -in well. Kir Peters moved that the assessment be con armed at $260. Carried 2 'e 1 equip. in LSD 4 of 12- 34 -26 -4 - appeal pointed out that o e valve had not been assessed and Mr. Geo Park adviLsel that this would increase the assessment from $8,790. to $8,)10. Mr Schmelke moved that the said assessment be i.ncrea ed to $8,910 Carried $ We 1 equip in LSD 16 of 13-32 -25-4 - a minor item had also b en missed in this and tir Geo Park advised that this should increase the assessment from $1,140 to $1,170 Mr. Peters moved that the said assessment be increased to $1,170. Th� Three Hills School Division was not represented at this meeting Mr. Loosmore moved that the 1967 Members of the Court COUZT OF of Revi ion of this Municipal District be Councillors REVISION Church, Brown, Peters, Schmelke and Campbell, and that Mr Ral h Brown be Chairman Carried Mr Cliff Poole was absent from the meeting of the C POOLE Court o Revision from 9.05 A M until approximately 9 50 A M wh le he attended to other Municipal business at the Three H lls Shop Thy Court of Revision met from 9 05 A.M. to 11 05 A. C OF R M and rrom 11 30 A.M. until 11 50 A M Th minutes of the Court of Revision appear separately. At 11 05 A.M., Mr. Peters moved that the Council MEETING meeting be again opened. Carried. Mr. Art Taylor met Council regarding the road from his farn where he lives to another farm which he also ART operates with particular reference to the read west of TRYLOR Prices, namely West of 1 and 12- 30 -26 -4. He asked that ROAD Council consider improving these two miles of road so that they would be suitable for farm traffic as this would save hin some extra mileage in travelling from one location to the Dther. This was discussed briefly. Mr Peters moved that the road committee investigate , regardi g the request of Mr Art Taylor as noted above and thab they report back to a later Council meeting Carried Mr. Art Taylor thanked Council and left the meeting. Mr. Church moved that the Council meeting again C OF R adjourn to allow for completion of the business of the Court of Revision. Carried. He had checked further REPORT regardi g this with Sandy Sommerville, mechanic, this morning and found that the motor had been very badly dam- aged ev'dently as the result of the truck being driven from Th ee Hills to Carbon while short of water It had overhea ed very extensively and was almost entirely ruined E FOX The bla e was placed mainly on Ernie Fox as the driver. Further study is needed to determine the merits of the sites Peters asked about 'h-� dam near Wm Burns and s said that the spill °Tay had been inadequate t not be feasible to develop it any further Adams outlined the following procedure if wishes to have a Community project proceeded equest is sent to the Director of the Provincial sources and it should ask that they have P.F.R.A. ate the feasibility of certain dams,etc .R.A. would then complete its Agriclzltural report proximately the Three Hills west road. Capital cost of a project would be shared by incial and Federal governments or it might be Federal. The Provincial government might sistance for purchase of the flooded area, but owners should be contacted for a preliminary on of this matter. Adams stated that some preliminary work had n done along other creeks for possible storage moved that a committee be named to the owners of the land directly concerned for dams as referred to by Mr. Adams along the Three eek Carried Brown moved that the Committee in respect to e be Mr. Loosmore, and Mr. Peters. Mr Adams asked that he be mailed a copy of any request which is sent to Water Resources This was agreed 1pon Mr. Adams then referred to the Carbon dam and said CARBON that the spillway is in poor condition He has been DAM endeavo ing to get some improvements made by the Federal goverment and has tentative approval if the M D will also pa ti.cipate by providing some gravel and labor. P.F.R.A would supply all other materials and the spill- way would be rebuilt to a wider standard Mr. Church moved that Council give authority to go ahead with plans and improvements to the Carbon north daze. C rried. Matters pertaining to straightening the Municipal SIEWERT road wet of 23- 32 -26 -4 and drainage of Siewert Lake LAKE were then discussed. Mr. Adams advised that Mrs Klara DRAINAGE Ensming r had signed a consent form on behalf of the Zarboch Estate regarding the NE- 27- 32- 26--4, and consent forms have been signed by Mr. Dan Berreth and Mr. Verne Kientz. ThD proposed agreement between the Municipal District of Knee ill No-48, Mr. Dan Berreth and Mr. Verne Kientz AGREEMENT was thei read to Council and Mr Adams in detail. This BERRETH had beei drafted by Mr Crawford Ferguson, Solicitor, IllZA.L s' under date of May 23rd, 1967 It was particularly noted that the Municipal District would have the right, but not the obligation in future to maintain the channel in the E- 22- 32 -26 -4/ Mr Church moved that Council of the agreement as submitted and authorize the Reeve and Secretary - Treasurer to sign same on behalf of the Municipal Di strict, and further that Mr Dunc Peters FOLKIii.NN have authority to negotiate with Mr. and Mrs. John Folkman in respect to the dugout in the SE- 23- 32 -26 -4 Carried Mr Reg Adams advised that the said dugout should DUGOUT be a mi imum of 2500 cu.yds to 3000 cu yds. and 121 deep sh uld be sufficient. Carried Mr G. King reported that the minutes of June 13/66 page 7 aad authorized that an order be placed with Toews Buildin Blox of Linden for 500 cement slabs 1$" x 2604 at 80¢ ea. The bill had been received later in the year for these and had been paid Mr.Schmelke advised that at least 475 of these had been placed in Wimborne. None had been placed at Swalwell. Wage rate for 0 A McArthur as gravel checker was then discussed. He had been paid at $1.65 per hr. in 1966, but the new rate for general laborers after 3 years with the Municipal District is $2.20 per hr Mr. Campbe 1 moved that Mr 0 A McArthur be paid at $2.20 per hr Carried. Mr11. O.A McArthur met briefly with Council and was advised of the rate of $2 20 per hr. to him as gravel checker. He accepted this with thanks and stated that he would be able to start within a few days He then left the meeting. CIRCUL',RS T e secretary - treasurer advised Council that GROUP nearly all employees had replied in regard to the INSURANCE propos d Group Insurance through the A.A.M.D. and Sun Life and all of the replies except one stated that they favored joining in the scheme with hospital benefits, the one wished to ,loin the scheme but without the ho pital benefits. As the result of that survey, the cards are now being signed and completed and will be sent ir to participate in the scheme with full benefits This r Dort was ordered filed. In SE- 14- 31 -24 -4 - Brosseau A new bridge BROSSEAU is being deisgned for this location with the road to be straightened and details will be sent to us in the near future. Mr Loosmore moved that this be accepted and filed. Carried A letter from Western Asphalt Distributors stated OIL FOR that they will haul,supply and apply MC Asphalt oils to ASPHALT our To ington- Allingham road at a cost of 18 5¢ per gallon. Mr. Peters moved that this bid be approved. Carried. A letter from the Provincial Department of Highways PAINTING advised that its painting crew will do the painting as ROAD LINES requested by our Council on the Torrington- Wimborne road. This was ordered filed. The Sec -Treas advised Council that he had been in contact with Mr. Howard Atkin of the Provincial Bridge CULVERTS Branch by telephone and wished to advise with regard to the following 1. ulvert for S/SE- 17- 30 -23 -4, Archie Metzger - the 14ETZGER locatioa ±xxxxk has not been inspected by the Department but thi3 should be done fairly soon. Required profiles are on -ecord at Edmonton now. 2. ulvert W/SW- 8- 29 -24 -4, Steve Ma3.akz - The District MAL=�.KI Enginee 's crew from Red Doer are completing the required profile and may recommend that the road be straightened Mr Loosmore moved tliat these reports be accepted. Carried. Mr. Church moved that the Council meeting date be MEETING changed from June 12th to June 13th as some Councillors JUNE 13th are otherwise engaged on the 12th.
