The Council of the Municipal District of Kneehill #48 held a regular meeting on Monday the 11th day of November, 1946, startingat 10.00 a.m. Councillors present: John W. Olson, J. A. Ohlhauser, M. Schmaltz, H Parry, F. C. Petersen, S. C. Schmelke and C C. Campbell. Mr. Olson moved that the minutes of the previous meeting be adopted. Carried. C rried. �Mr. Olson moved that G. Tinlin be paid for gravel taken frpm his pit in 1946 at the rate of 8� per yard. Carried. 111r. Schmaltz moved that refunds of $4.00 each be made to Mrs. Winnifred Goodrich, Roy A Petersen and Chas. Bradwell, due to the fact that each of the above is exempt from poll tax by reason of paying taxes on property elsewhere in the Province. Carried. 12 COUNCIL MEETING HELD ON NOV. 11. 1946. Page 2. It was moved by Mr. Olson that the request of Mr. E. C. McDonaldifor additional pay for hauling gravel, amounting to $12.00, �e refused, and that the Secretary- Treasurer be instructed to advise him accordingly. Carried It was moved by Mr. Olson that the account of Mr. Andy Sutherland for labor and 1 post ($5.55) be approved and ordered aid. Carried. It was moved by Mr. Schmelke that the approval of the Council be given to the application of Mrs. Christina Graf, of Torrington, for an Old Age PeAsion. Carried. The Secretary- treasurer was instructed to secure a copy of the Act incorporating the Prairie Bible Institute for each member of the Council. Moved by Mr. Ohlhauser that the correspondence be filed for future reference. Carried. It was moved by Mr. Petersen that �*}5.00 membership fee in the South Centre Alberta Association of Municipal Dist- ricts be paid. Carried. The Secretary- Treasurer reported that he had received a request from Mr. James McQueen, District Engineer, for a list of the seven most important bridges (one in each division) on the Bridge Request List for 1946. The list below shows the location;of the bridge in each division considered by the Councillor to be most important* Divisional* Between Sections 28 & 29, Tp. 29, Rge. 22. --- " 12. Between Sections 8 & 17, Tp. 33, Rge. 26. 7: Between Sections 22 & 27, Tp. 33, Rge 24. Air. C. C. Campbell reported on his investigations into a pound dispute between R. L. Kane and Jack Lynch, in which animals belonging to Jack Lynch were impounded by R. L. Kane Mr. Campbell moved that an award of $10.00 damages be paid to R. L. Kane. Carried. Mr Campbell also reported on his investigations into a pound dispute between Meding Bros. Jack Lynch and Albert McGougand in which animals belonging to Jack Lynch and Albert McGougan! were impounded by Arthur and Albert Meding. Mr Olson reported that there t 18 acres of high bench land on this half section, ice being canyons and hills, and that 1i miles of road to to be built to give access to this 18 acres of . Olson recommend that the request be refused, on the that the cost is too excessive for the area and number snts would benefit from the building of such road. COUNCIL MEETING HELD ON NOV. 11. 1946 Page 3. Mr. Ohlhauser moved that Mr. Olson's report be accepted, and construction of the road refused for the reasons given above. Carried. Air. Olson reported on his negotiations with Asir. E T. Lowen regarding a road diversion across SE- 27- 28 -21 -4. The report shows that Mr. E. T. Lowen will aceept "40.00 as payment for the land taken in the said diversion, and that Mr. Lowen will fence the said diversion for $160.00, and will abandon his request for a cattle pass under the said diversion. Mr. J. A. Ohlhauser moved that the said report be accepted, and payment of 040.00 for lend, and 4160.00 for the building of fence be author- ized. Carried. Mr. Olson reported on his investigations into a pound dispute between John Schmutz and Mel Sailer, in which animals belonging to John Schmutz were impounded by Mel Sailer in the pound operated by Wilhelm J. Zeigler. Mr. Olson recommends that an award of x$`'40.00 damages be paid to Mel Sailer. Mr. Schmaltz moved that the report of Mr. Olson be accepted, and payment of 140.00 damages authorized. Carried Mr. Ohlhauser reported on his investigations into the matter of gravel taken from C P R. lands (NE- 15- 27 -24 -4; in 1945. The report showed that 455 yards of gravel was taken from this land in 19451 and that the C. P R. demands payment for same at the rate of 59� per yard. Air. Ohlhauser moved that payment of 455 yards of gravel at 55Z per yard be authorized. Carried. There was considerable discussion regarding those families which receive relief allowances from the Municipal Dist- rict. Mr. Campbell moved that Mr Ohlhauser investigate the circumstances of Mrs. Amy Gore, Sralwell. Carried. I! Mr. Petersen moved that the relief allowance of the Magereak family be reduced to $15.00 ppr month. Carried. Mr. Olson moved that Mr. Schmelke investigate the eircumstances of Mrs. Hazel, Torrington. Carried. i IMr. Petersen moved that Mr. Olson investigate the circumstances of Mrs. Bruneski, Drumheller. Carried. Mr. Petersen reported that Tony Litvak, Ghost Pine Creek, hks applied to him for relief and assistance. Litvak lost his11946 crop by hail, and has a few head of live - stock. Mr. Petersen moved that he be granted a monthly relief allowance of 00.00 . Carried i William Howell, Floyd Johnson and Victor Gresl and A. E. Staite interviewed the Council on the matter of winter employment. The Reeve informed these employees that a definite answer on this matter will be given them at the next meeting of the Council on December 9th, 1946. (Albert Baerg interviewed the Council, and requested that the approval of the Council be given to his application for a Li sense to operate a machine shop in the Hamlet of Linden. Mr. Petersen moved that this approval be given. Carried. Mr. John Walter Ross of Trochu was present, and discussed with the Council the matter of compensation for himself and his son John Francis Ross as the result of accident pt a Bridge between Sections 22 and 27, Tp. 332 Rge. 24, ki t 4 M on September 12th, 1946. Mr. Ross informed the Coune'il that he was willing to reduce his claim for damages from $384.68 to >234.68, but was not willing to reduce the amount of the claim of John Francis Ross ($278.45) After conpiderable discussion Mr. C. C. Campbell moved that the Council offer to settle the two claims as follows' 1. Claim of John Walter Ross 234.68 2 " V John Francis Ross 115.32 350.00 Carried. Per. John Walter Ross accepted the above amounts as full settlement of the respective claims. V Air G. G. C. Petersen moved that the Public forks Statement be adopted. Carried. Mr. J. A. Ohlhauser moved that the pay - sheets for the month of Petober, 1946, which have been approved by the Councillor concerned; be now passed for payment. Carried. Mr. M. Schmaltz moved that. Whereas, the residents of the area adjacent to the Linden Home have contributed $700.00 toward the cost of gravell- ing the road between Sections 29/32 and 28/33- 30 -25 -4 on the understanding that the said contribution was to be matched by equal contributions from the Municipal District and the Province of Alberta, and Whereas, the cost of the work done on the said road was X1,696.20, of which a one -third share would be 1565.40, and Whereas, the contribution of the said residents is $134.60 in excess of their share of the work done, and Whereas, the said residents have directed that this excess am unt be refunded to the Linden Home, Swalweil. COUNCIL MEETING HELD ON NOV 11. 1946. Page 5. Now therefore be it resolved that the said refund of $134.60 be made to The Linden Home, Swalwell, and payment of same be authorized. Carried. Mr. J. W Olson moved that a request be made to the Department of Public Works that the special grant of $ 500,00 which was authorized fov the gravelling and improvement of the road from the Carbon Cemetery Fast to Dry Canyon (known locally as the Pope Lease road) be changed as a grant for the gravelling and improving of the road from Beveridge Lake School South to Hesketh. Carried. Mr. J. A Ohlhauser moved that the annual rate - payers' meeting be held on ;Monday the 17th day of February, 1947 in the Lyric Theatre, Three Hills. Carried. Mr. F. C. Petersen moved that the following arrange- ments be made for the election of Councillors in Divisions 5 and 6' 1. That R. C. Milligen, Sunnyslope, be appointed Returning Officer. 2. That nominations be received at the Lyric Theatre, Three Hills, on Monday the 17th day of February, 1947, between the hours of 3.00 p.m. and 4,00 p.m. 3 3. That election day be the 17th day of March, 1947. 4. That the following be appointed as enumerators: Divisional and 2: S. F. Torrance; Division 3, Valentine Schmaltz ,[Division 4, C. E. Davis; Division 5, C E. Ruby, Division 6, Leon. Waterman; Division 7, G. E. Postill. 5. Um brite, Field S1pervisor of the Municipal District, interviewed the Council regarding matters discussed at the Sery ce Board Meeting held on Nov. 7th. A recommendation from the Service board th,,��t all isol- ated * f stations of mustard be surrounded with a snip of grass, at leastrone rod wide. This met with the approval of the council.
