The Council of the Municipal District of Kneehill No. 48
held a regular meeting on August 12th, 1946, starting at
10.00 a.m.
Councillors present. J W. Olson, J. A. Ohlhauser,
M. Schmaltz, H. Parry, F. C. Petersen, S. C. Schmelke,
and C. C. Campbell.
Mr. Olson moved that the minutes of the previous
meeting be adopted. Carried.
Mr. Campbell moved that the minutes of the Court of
Revision held on July 4th and 5th, 1946 be adopted.
Carried.
The Secretary - Treasurer read the Financial Statement
for the month of July, 1946.

Mr. Schmelke moved that the application of Leonard
Hager to get a License for a Restaurant in Torrington
be approved. Carried.
Mr. Schmelke moved that the account of the East Trochu
Coal Co. for $20.00 for coal supplied to Patrick
Cooney be paid. Carried.
Mr. Petersen moved that Mr. Campbell be appointed as
a Committee to investigate the circumstances of the
Patrick Conney and wife, as reported by the R C M P
on August 8th, 1946. Carried.
N. Gallelli, gravel contractor, interviewed the
Council
Mr. Campbell moved that the account of the Holy Cross
Hospital for $245.75 for Mrs. Wm. Malls, of Trochu,
be accepted as a municipal district responsibility, and
that payment of $200.00 (being the maximum liability)
be paid. Carried.
Mr. Schmaltz moved. that Mr. Petersen be appointed as
a Committee to investigate the claim of T F Bishop
for damages to his truck. Carried.
Mr. Campbell moved that the account of Mrs. Kate
Muir for $15.25 at the Calgary Associate Clinic be
paid; also that Mrs. Muir be informed that this has
been paid, and that she be advised to consent to leave
hft present location and enter one of the Old Folkst
Homes. Carried,
Mr. Campbell agreed to investigate the circumstances of
Miss Meta. Scheunert, as given in statement by her
father, dated August 5th, 1946. Carried.
Mr. Ohlhauser reported on the resignation of Chas.
Trumbley, and he moved that the resignation be accepted.
Carried.
At 12.15 Mr. Ohlhauser moved that Council adjourn.
Carried.
At 1.15 p.m. the Council re- assembled, all members
present.
There was considerable discussion on the operation
of the grasshopper bait mixing station in Carbon,
and it was moved by Mr. Ohlhauser that the station be
kept open from 2.00 p.m. to 6.00 p.m. after Aug. 13th,
1946. Carried.
Mr. Schmaltz moved that the station be closed when,
in tjpe opinion of Mr. Ohlheuser and Mr. Umbrite, it is
no longer required. Carried.
Secretary - Treasurer was instructed to report to James
McQueen, District Engineer, the dangerous condition of
the steel bridge at Hesketh, Alberta.
There was considerable discussion regarding the operation
of the Motor Graders, and a map was prepared, dividing
the Municipal District into three areas for Motor Grader
work. It was moved by Mr. Olson that this map be accepted
and the Municipal District be divided into three areas
accordingly. Carried.

Moved by Mr. Ohlhauser that Emmanuel Neher, Walter
Hay and B. J. Poole be paid at the rate of 75� per
hour for labor on the July pay - sheets, and that
Emmanuel Neher be paid for 40 miles use of car at
8� per mile. Carried.
Moved by Mr. Ohlhauser that the approval of the
Council be given to the application of Raymond
Zachariassen for a License to operate a Garage and
Wholesale Oil business at SH- 19- 28 -22 -4. Carried.
Moved by Mr. Schmelke that $22.00 be refunded to
George Evans, Jr. of Elnora, the said refund being
the amount paid by Mr. Evans for two horses at a
pound sale, and the animals were redeemed by the
owner. Carried.
Mr. Petersen and Mr. Schmelke gave a report on their
investigations in a dispute bewteen Oliver Parry and
H A. Empey. Cattle belonging to H. A. Empey had
trespassed on lands of Oliver Parry, who impounded
same in the pound operated by Gottlieb Maerz, and
made a claim for 150.00 damages. Mr. Petersen and
Mr. Schmelke recommend that an award of $25.00
damages be paid to Oliver Parry, and that he be
refunded the $2.00 paid to cover costs of investiga-
tion This report and recommendation were accepted
by the Council, and payments authorized.
Mr. Campbell moved that H A. Empey be refunded
$125.00, plus the $2.00 deposit paid to pound - keeper.
Carried.
Mr. G. G. King, Assistant Secretary- Treasurer,
submitted the following statement of public works

Mr. Petersen moved that the statement of public works
expenditures be approved. Carried.
Mr. Schmaltz moved that the pay - sheets for the month
of Auly, which have been approved by the Councillors,
be passed for payment. Carried.
Mr. Campbell moved that Mrs. iBruneski's relief allowance
of $14.00 per month be transferred to Roach's Store,
Drumheller. Carried.
Mr. Petersen reported on the Cunningham Bros. pound
case, and he moved that the $2.00 deposit paid by
Cunningham Bros. be refunded. Carried.

The letter from Alex. Benusic, in which he makes an
offer to purchase NE »13- 32 -w2 -4 for $300.00 was read.
It was moved by Mr. Campbell that this offer be
accepted, and that the Council proceed to pass a
By -Law to provide for the sale accordingly. Carried.
Mr. Schmaltz moved that By -Law No. 62 (A By -Law to
provide for the sale of NEB -13- 32«22 -4 to .ilex.
Benusic for $300.00) be now given first reading.
Carried.
Mr. Petersen moved that By -Law No. 62 be now given
second reading. Carried.
The plan of Block "P ", Hamlet of Wimborne, as prepared
by MR. L. S. Harris, Surveyor, was submitted to the
Council for consideration. It was moved by Mr. Schmelke
that this plan be accepted, and that the Reeve and
Secretary- Treasurer be authorized to sign same on
behalf of the Municipal District. Carried.
Mr. Petersen moved that the lots in Block "P" be
offered for sale at $75.00 each, providing improve-
ments of at least $p500,00 are put up within one year
from date of sale. Carried.
Mr. Schmelke moved that W E Seefried's offer to
purchase a lot be accepted, and that he be given
his choice of the seven lots in Block "P ". Carried.
The resignation of Harvey Markle was read, and it
was moved by F. C. Petersen that this resignation be
accepted. Carried.
Mr. Petersen moved that Eric Hazel be engaged as
cook for the North camp, from July 16, 1946, and
that he paid $130.00 per month; that Philip Will
be engaged as Tractor Man, from July 16, 1946,
and that he be paid 9051 per hour wages, that
Grant Robertson be engaged as Tractor Man, from
July 29th, 1946, and that he be paid 90� per hour
wages. Carried.
Mr. Parry reported on the investigation made into
the affairs of Mrs. Alma Friessin, of Swalwell, Alta.
He recommends that a relief allowance of $20.00 per
month be paid Mrs. Friessin starting in the month of
July, 1946. Mr. Schmelke moved that bis report and
recommendation be accepted, and payment of $20.00 per
month relief authorized. Carried.
Mr. Schmaltz moved that the Insurance Policy on the
new Chevrolet Truck be accepted, and payment of the
premium of $51.34 to S F Torrance authorized. Carried.
Mr. Campbell moved that a similar policy be taken
out on the Ford one ton truck in the agency of C. J.
Christie. Carried.
Third reading was given to By -Law No. 56 (A By -Law
to provide for the sale of Part of 5E- 16- 29 -23 -4 to
H R. Brown, Carbon for $1,400.00). Mr. Ohlhauser
moved that the third reading of By-Law No 56 be
approved. Carried.
Third reading was given to By -Law No. 57.(A By -Law
to provide for the sale of SW- 1- 30 -26 -4 and NW- 36- 29 -26 »4
to Robert Sutherland for $1,605.00). Mr. Schmaltz
that third reading of By-Law No. 57 be approved.

First, second and third readings were given to By -Law
No. 58 (A By -Law to provide for the purchase of a
Chevrolet Motor Truck from Louis' Garage for $1212.10).
Mr. Ohlhauser moved that first reading of By-law #58
be approved and passed. Carried.
Mr. Olson moved that second reading of By•Law #58 be
approved and passed. Carried.
Mr. Schmelke moved that third reading of By - Law No. 58
be approved and passed. Carried.
First, second and third readings were given to By -Law
No. 59 (A By _ Law to provide for the purchase of a
Caterpillar No. 12 Motor Grader from Union Tractor &
Equipment Company for $11,915.00).
Mr. Schmaltz moved that first reading of By - Law No. 58
be approved and passed. Carried.
Mr. Petersen moved that second reading to By -Law ##59
be approved and passed. Carried.
Mr. Schmelke moved that third reading of By -Law #59
be approved and passed. Carried.
First second and third readings were given to By•Law
No. 60 (A By - Law to provide for a grant of $100.00
to the Swalwell Board of Trade for the improvement
of the Swalwell Cemetery.)
Mr. Ohlhauser moved that first reading of By -Law #60
be approved and passed. Carried.
Mr. Campbell moved that second reading of By -Law ##60
be approved and passed. Carried.
Mr. Ohlhauser moved that third reading of By -Law #60
be approved and passed. Carried,
First, second end third readings were given to By -Law
No. 61 (A By -Law to provide for the purchase of a
rubber -tired wagon from J. C. Wright for $220.00).
Mr. Olson moved that first reading of By -Law No. 61
be approved and passed. Carried.
Mr. Ohlhauser molted that second reading of By -Law No. 61
be approved and passed. Carried.
Mr. Campbell moved that third reading of By -Law No. 61
be approved and passed. Carried.
Mr. E. N. Hagel, representing Union Tractor & Equipment
Company, Calgary, interviewed the Council. There was
considerable discussion on the purchase of new equipment,
and Mr. Schmaltz moved that the Council place an order
with the Union Tractor and Equipment Company for a
No. 12 Caterpillar Motor Grader, to take delivery as
soon as the Company can supply same. Carried.
(Yeas' Olsen, Ohlhauser, Schmaltz, Parry, Campbell)
Moved by Mr. Schmaltz that the Chevrolet half ton truck
(at present with the South camp) be offered for sale for
$350.00, and that Paul Elvin be given first change to
buy it; that Mr. Olson and Mr. Ohlhauser be appointed a
Committee to arrange for the sale of said truck. Carried.

The Secretary- Treasurer read a request from Mrs. Grace
1.1cBratney that the Council remove a Seed Grain Lien on
NE- 34- 31 -25 -4; the said Lien having been registered to
protect an advance of seed grain to David W. Klassen,
purchaser of the said land at the time of the advance.
It was moved by Mr. Schmaltz, that Mrs. McBratney be
informed, that since the lien was registered at the
time she re- possessed the land from David W. Klassen,
the Council refuses to remove the lien from the title.
Carried.
Mr. H. E. Mackay, representing Armco Drainage and
Metal Products of Canada Limited, interviewed the
Council. There was considerable discussion regarding
the steel market, and it was moved by Mr. Ohlhauser
that the following order of culverts be placed with
Armco Drainage and Metal Products of Canada Limited.

The Secretary- Treasurer was instructed to inform
Ernest Young, of Swalwell, Alberta, that he is a
resident of the Three Hills Municipal Hospital Dist-
rict, and as such, is entitled to certain reductions
in the account of his wife in the Red Deer Hospital.
Mr. Schmalke moved that 2.53 acres be expropriated
for a nuisance ground from 5E- 4- 33 -26 -4, and that
compensation be offered to the owner at the rate of
$30.00 per acre. Carried.
Mr. Schmelke moved that compensation at the rate of
$25.00 per acre be offered to the owner of SE- 27- 33 -26-4
for land taken for nuisance ground. Carried.
The Secretary- Treasurer was instructed to inform the
owner of 5E- 27- 33 -26 -4 (C S Blenkhorn, Wimbornel
that payment of compensation will be made asx soon as
the plans are prepared by the surveyor, and exact
acreage determined.
Mr. Schmelke moved that the Secretary- Treasurer be
instructed to take steps to have arrears of taxes
collected, and to engage the services of a Bailiff
to place seizures on grain, where same is considered
advisable.

Mr. CT. G. King, Asst. Secretary - Treasurer, gave a
report on the impounding of three horses in the pound
operated by E Me=el on NE- 11«33 -23 -4 Two of the
horses were owned by Konrad Buchert; one was sold to
Henry Sailer, and one to Sam Tullikopf. The owner of
the third horse is unknown, and it was bought by
Henry Sailer. Konrad Buchert redeemed his two horses
from the puchasers.
Mr. Ohlhauser moved that Henry Sailer be refunded
$61.00, being the amount paid for horse. Carried
Mr. Campbell moved that Sam Tullikopf be refunded
X23.00, being the amount he paid for horse. Carried.
Mr. Campbell moved that E. Ressig be paid the sum of
x$5.00 damages, claimed from the horse sold to Henry
Sailer. Carried.
Mr. King also reported on the impounding of 9 cattle,
the property of A. McGougan, in the pound operated
by Mr. E Mammel. Sam Tullikopf impounded the cattle,
and made a claim for x$10.00 damages, and $5.00 for
impounding a bull.
Mr. Petersen moved that the following payments be
authorized:
To Sam Tullikopf. $12.00, being $10.00 damages and
refund of 62.00 deposit.
To A. McGougan. $7.00, being refund of ��5.00 collected
and $2.00 deposit, Carried.
An application for an Old Age Pension made by Jos.
Rist, of Sunnyslope, Alberta, was read. It was moved
by Mr. Schmaltz that this application be approved.
Carried.
;A, letter from R. W. Hunter, owner of part of S - 5 -30 -21
was read. He states that he has no access to his farm,
except across the property of Richard Rowbottom.
Mr. Petersen moved that Mr. Olson be appointed to
investigate this matter. Carried.
