MUNICPALITY OF KNEEHILL COUNTY IN
THE PROVINCE OF ALBERTA, FOR
THE PURPOSE OF CLOSING TO PUBLIC
TRAVEL AND CREATING TITLE TO PORTIONS
OF A PUBLIC HIGHWAY
BY Closing to public travel that portion of the lane which lies to the north
of the production westerly of the northern boundary of Lot 10, Block 1
Plan 4127 EH and that portion of the lane adjoining the westerly
boundary of Lot 10, Block 1, Plan 4127EH which lies to the south of
the production westerly of the northern boundary of said Lot 10

Reeve Woods declared the public hearing open, noting the hearing was being held pursuant
to Section 230 of the Municipal Government Act and the regulations therewith Mr Woods
then reviewed the rules and procedures of conduct for the hearing
Ms Brown outlined the nature and purpose of the request for redesignation
Ms Brown reported that at the May 10 2005 Council meeting, Planning Staff had requested
that Council authorize Staff to proceed with the above noted lane closure for the lane located
between the Fire Hall and Arena in Torrington During the January 24, 2006 meeting a
Public Hearing on the matter was scheduled for February 14, 2006 and first reading was
given to Bylaw 1531
Ms Brown advised that neither the Municipal Development Plan nor the Land Use Bylaw
have an outlined course of action for road closures In order to obtain Provincial approval,
as all road titles are vested in the Crown of Alberta, the Province requires that

5 Approval must be obtained from the Minister of Infrastructure
Ms Brown advised that all impacted utility companies have been re referred, and notification
has been carried out through advertising the lane closure, with no concerns received She
further advised that once the road is closed, landowners will have the opportunity to apply to
subdivide a portion of the roadway and to consolidate it into their properties All costs
associated with survey and consolidation of parcels or any other incurred expenses would be
at the responsibility of the landowner as previously stated.
Ms Brown recommended that the lane closure bylaw, once approved by the Minister of
Transportation, be given second and third reading, thus finalizing the road closure

Councillor Holsworth questioned whether Kneehill County would become responsible for
this land should the adjacent landowners not be )interested in consolidating it into their
properties, and whether the County purchasing this land could be considered a conflict of
interest? Ms Brown replied that the land would become the County's title but as long as the
due procedures were followed notifying of the opportunity to purchase the land it shouldn't
be considered a conflict of interest
Councillor Wlttstock questioned whether the easements would adequately take care of the
utilities and what were the sizes of the easements? Ms Brown advised the easements were
adequate but she would need to check on the size Mr Wittstock advised that would not be
necessary
Reeve Woods asked for any presentations in support of the amending bylaw None were
presented

As there were no further presentations or comments, either in favour or against the proposed
bylaw, Reeve Woods declared the hearing closed

Bylaw No. 1531
A BYLAW IN THE MUNICIPALITY OF KNEEHILL COUNTY FOR THE PURPOSE
OF CLOSING TO PUBLIC TRAVEL AND CREATING TITLE TO PORTIONS OF A
PUBLIC HIGHWAY
WHEREAS, Pursuant to the Municipal Government Act, RSA 2000, Section 22, as
amended
WHEREAS the lands hereafter described are no longer required for public travel, and
WHEREAS, application has been made to Council to have the highway closed, and
WHEREAS the Council of the Municipality of Kneehill County deems it expedient to
provide for a bylaw for the purpose for closing to public travel certain roads, or portions
thereof situated in said municipality, and thereafter (creating title to, disposing of,
leasing of same and
WHEREAS notice of intention of Council to pass a bylaw had been given in accordance
with section 606 of the Municipal Government Act
WHEREAS Council was not petitioned for an opportunity to be heard by any person
claiming to be prejudicially affected by the law
NOW THEREFORE BE IT RESOLVED that the Council of the Municipality of Kneehill
County, in the Province of Alberta does hereby close to public travel (and creating title
to, disposing of, leasing of) the following described highways, subject to rights of access
granted by other legislation
A That portion of the lane which lies to the north of the production westerly of the
northern boundary of Lot 10 Block 1 Plan 4127 EH
B That portion of the lane adjoining the westerly boundary of Lot 10 Block 1 Plan
4127 EH which lies to the south of the production westerly of the northern
boundary of said Lot 10
