HomeMy WebLinkAboutBylaw 1620 - Kirkpatrick WSA - Special BenefitingBYLAW 1620 ,,`'HIS BEING A BYLAW OF KNEEHILL COUNTY IN THE PROVINCE OF ALBERTA, WHICH AUTHORIZED THE BENEFITING SERVICE CONNECTION FEE FOR THE KIRKPATRICK WATER SERVICE AREA PROJECT AS A LOCAL IMPROVEMENT AND IMPOSED A SPECIAL LOCAL BENEFIT ASSESSMENT WITH RESPECT TO THE LOCAL IMPROVEMENT WHEREAS the Council of Kneehill County considers it advisable to supply and construct a water distribution system known as Kirkpatrick Water Service Area Project, including standard size service connections to the benefiting properties, a reservoir and other associated facilities and equipment. (the Project") AND WHEREAS the Council of Kneehill County considers it advisable to undertake the benefiting service connection fee as a local improvement and to impose a special local benefit assessment with respect to the Project. AND WHEREAS the total cost of the project is estimated to be $1 400 000 AND WHEREAS the cost of the project, less any external funding available for the project, and special taxes applied to the Kirkpatrick Water Service Area pursuant to Bylaw 1620 will be raised by a special local benefit assessment within the water service area as outlined in the Kirkpatrick Water Service Area Engineering Plan. AND WHEREAS the estimated life of the project is twenty five (25) years ND WHEREAS pursuant to the Municipal Government Act, RSA "/-000 Chapter M 26 as amended, a council may on its own initiative propose a local improvement. AND WHEREAS a local improvement tax bylaw authorizes the council to impose a local improvement tax in respect of all land in a particular area of the municipality to raise revenue to pay for the local improvement that benefits that area of the municipality NOW THEREFORE the Council of Kneehill County duly assembled, enacts as follows Kneehill County is authorized to proceed with the construction and supply of Kirkpatrick Water Service Area Project. 2 The Project shall be undertaken as a local improvement. Kneehill County may enter into contracts for the purpose of undertaking the Project. 4 A special local benefit assessment is hereby imposed in the manner set out and against the parcels of land described in Schedule A and Schedule B of this by law In event of a future subdivision affecting any of the properties noted in Schedule B and where there is a newly created roll number as a result of that subdivision, in which the water service W I �y Bylaw1620 Page 1 of 4 Initials January 25 2011
