HomeMy WebLinkAboutBylaw 1625 - Control Of Pests On Road Allowances%NN. `NW BY LAW NUMBER 1625 E1,J.�20'1UNTY BEING A BYLAW OF THE COUNCIL OF KNEEHILL COUNTY, IN THE PROVINCE OF ALBERTA, TO ESTABLISH A BYLAW TO CONTROL AGRICULTURAL DECLARED PESTS ON ROAD ALLOWANCES WITHIN KNEEHILL COUNTY WHEREAS pursuant to the Municipal Government Act, R.S.A. 2000 Chapter M 26 as amended, provides that a municipality may pass bylaws under this or any other enactment, hereby deem it appropriate to create by law 1625 WHEREAS it is impractical for Kneehill County to control declared pest on highways in a timely manner because their occurrence is highly variable and widely scattered. WHEREAS the o� ner m occupar of tt:e land herefits from the c, trot of th;, declared pest on the adjacent highway AND WHEREAS the Agricultural Pests Act, RSA 2000 Chapter A 8 Section 7 and subsequent regulations and amendments there to gives authority for Council, by Bylaw to establish that a local authority may with respect to a highway that is subject to the direction, management and control of the local authority by bylaw provide that an owner or occupant of land is, for the purpose of this Act, the occupant of that portion of a highway that lies between the boundary of the land the owner owns or occupier occupies and the centre line of the highway NOW THEREFORE THE COUNCIL OF KNEEHILL COUNTY ENACTS AS FOLLOWS 1 Effective upon this bylaw receiving three readings, the owner(s) or occupant(s) of lands, shall for the purpose of this bylaw be deemed to be the occupant of that portion of any highway within the municipality which adjoins his/her/their land and lies between the boundary of his/her/their land and the centre line of the highway That the Agricultural Pest Act will apply to the said land in the same manner that it applies to privately owned land. 3 That the Council of Kneehill County may make provision for the control of declared pests through assisted programming approved by Council. 4 This Bylaw shall come into effect after signing by the Minister of Agriculture and receiving third and final reading by Kneehill County Council.
